  1. Hi, I had an agreement with MBNA where they would hold all interest, as long as I paid the debt off within 10 years. The amount owing was divided up in 120 months (10 years). However, in the mean time, they have decided to sell the debt, at the same time as our financial situation has changed. The monthly payments are now less. They write to inform me that I am in arrears. The DCA have said the following, is this right does anyone know?? The payment was set by MBNA, based upon, I assume a previous Income and Expenditure form at the point of being 'charged off' which means no further interest is applied to your account but it does mean that this is your 'normal monthly payment'. This can not be amended now as it was sold on this way. It is also less than the 5% normally applied to credit card accounts. And so, we are happy to accept your offer of payment but as it is does not meet your contractual payment the arrears will continue to accrue. We have a legal obligation to reflect accurate data to the Credit Reference Agencies, which also includes arrangements, missed payments and arrears and so your data entry at the credit reference agency will be updated with this information.
  2. Hi, I have received a letter from Lantern requesting payment for loans I took out years ago. The loans do not appear on my credit file and have not been on my credit file for at least the last two to three years. I think I defaulted on most of them six years ago that's why they are not on my credit record. Lantern have called me on my work mobile number once recently, ( within the last two weeks) and I refused to answer security questions because I was not sure who I was speaking to. But they did say they where formerly MMF. I do not wish to engage with Lantern, what steps do I take to ensure I pay them or not Thanks in advance.
  3. Hi all, On my Noddle Credit File, I have an entry from Wonga.com. with an opening balance of £704 in 2014. I have never ever used Wonga. It does say Settled, but not without some adverse credit scoring Apr - UC, Jul - 1, Aug - 2, Sep - 3, Oct - 4, Nov - 5, Dec UC. What is this, where has it come from. I haven't made any payments to them ever. Is this still affecting my credit file? Thanks
  4. I am looking for some advice regarding removal of Arrangement to Pay markers and a default from my credit report. I have an outstanding balance of £3486.90 with Link Financial who took on the account from Barclaycard in February 2015. Barclaycard applied markers to my credit report from April 11 to February 15 when they marked the account as settled, following an SAR it doesn't appear the account was ever formally defaulted. I was on a DMP until recently when I sent a section 78 request to Link and stopped paying. They did not comply with the request and subsequently issued a default notice. There is a note within the documents received following the SAR request that would indicate that the debt is unenforceable. I am looking to obtain a mortgage in the summer and these two accounts will prevent me from doing so. Should Barclays have defaulted me when I missed 3 month payments? Can Link default me as they aren't the original creditor? Should the debt be removed from my credit file as it's over 6 years old since I breached the original T & C's? How do I go about remedying this? Thanks.

Took a loan out 9 years ago with welcome finance for £2000 got into difficulty paying it back so stopped payments, now 9 years on and 6 addresses later ive just had a letter at my current address from my local county court summon to appear before a court sheriff and demanding me to take a million documents, of which some i just cant get, its impossible. Now i have been in touch with step change debt charity regarding my debts and at present my outgoings are £230 a month more than my incoming and this is on basic living, i cant cut back anywhere. Stepchange also told me that a CCJ was issued against me from Welcome finance in january 2013 and this local county court letter summons was to see if i could pay it all back, but obviously i cant. What worries me more is the list of documents the county court has asked to see, its huge, and half of it i dont have access too, and the other half ive probably thrown away throughout the years. Really nervous what to expect to happen at county court. At the time i took the loan with best intentions, It was a unsecured loan, but when i got in to difficulty i done the cut and run, and 9 years later i have a county court appearance to look forward too, great.
  6. HI I have both my Gas and Elec accounts with N Power. I have been with NPower for almost 10-11 years. Quite some time ago I fell into arrears with both accounts so went onto pre-pay and started to pay for usage and payback on the meters. I have recently checked my file, there is 2 things that dont add up. no.1 the start date on both files are wrong. The 1st 3 years the accounts were held in my company name as the house was being used for business. It seems that they have moved the accounts over onto my personal name after the company went bust. I have questioned them on this but they say that the files dont go back that far. no.2 the debt upto 6 month ago had come down from 1600 to 780ish on one account. There is then a U for 2 months and then it more than doubles to 1800ish, this coinsides iirc with when we had a new meter fitted. I have told them that it is wrong, but they have said its correct and closed the case. It is impossible for the debt to go up like that on a pre-payment meter. What can I do on both issues please? Its affecting my credit rating. Many Thanks:-x
  7. Your good advice please. I received a letter from a DCA titled a’ pre-legal assessment’ on an old credit card debt that the DCA have recently acquired. I suspected this could be nearing SB I checked my credit file and discovered that there is no information about this account on my file prior to May this year! As they are are using the usual vague language i,e, ‘may’, 'being considered’, should I bother to respond to this or should I CCA them or other? Who’s responsibility is it to insure the information on a credit file is accurate and up to date? Would the OC remove this info or what could have happened? It’s all a bit odd and I’m not sure how to respond if at all to the DCA. Regards

The purpose of this thread is to initiate a discussion with fellow eToro customers to examine the possibility of bringing a class action lawsuit against eToro, with the aim of recovering all the money lost on missold products. eToro encouraged thousands of inexperienced customers to bet their money on risky Contracts for Differences (CFDs). I argue that eToro negligently failed to ensure that customers properly understood the risks involved. The majority of these customers would not have put their money at risk if they had been properly informed by eToro. I submit that eToro is guilty of: 1. offering and promoting the use of high leverage, which made the CFD trades extremely risky and tantamount to gambling (before the ESMA rules took effect, leverage as high a x100 was available on some assets, including extremely risky ones like gold and oil); 2. failing to make a good-faith effort to ensure that customers genuinely understood the risks associated with high leverage – their boilerplate warnings were not sufficient to enable inexperienced investors to make a truly informed decision; 3. actively encouraging customers to put more money at risk by telephoning them; 4. encouraging customers to copy so-called "Popular Investors", despite the fact that none of them are professional traders and suffered losses when the favourable market conditions ended. In my opinion, such a class action lawsuit has a realistic prospect of success and is also in the public interest. Customers affected by at least one of the four points listed above can potentially receive compensation if the lawsuit is won by the claimants. This year thousands of customers suffered losses either by using the high leverage that eToro recklessly made available to unsophisticated customers, or by copying incompetent “Popular Investors” like JayNemesis and Wesl3y, who are not qualified to invest money on behalf of others. Let's get some momentum going and start selecting the right law firm to bring this claim against eToro!
  9. Me again, So out of the blue SLL Capital have put a default on my credit file for a Mr Lender Loan from 2016 that i never repaid. Can they do that? The Mr Lender loan isn't on my credit file before this I will of course do a irresponsible lending complaint to Mr Lender, is it worth sending a prove it that i owe this debt to SLL Capital?
  10. Hi I set up a Payment Plan with British Gas in September16, following an unexpected huge bill. I have been paying monthly as agreed (£160 fwiw). In Feb BG sent a letter advising my Payments haven't changed. End March BG sent a letter saying I'd missed my monthly payment - and quoted a figure of £600 more than my monthly payment! I immediately wrote stating BG must have made a mistake. I made the normal payment. Then start April BG wrote saying they were cancelling my Plan. I again wrote to complain. BG have failed to reply to both letters.. I did try calling - but got some jobsworth who told me if BG had written saying I should be paying almost £800/month then that is what I should pay..... Following on - instead of replying to my letters, BG have sent demands and threatening letters, stating they were adding charges to my account. Now I have received a threatening letter from a company appointed by BG - some kind of financial services company called arvato... saying they will make a home visit and charge me for it..etc etc. My knee-jerk reaction is to email this fs company and copy the BG and my letters and tell them to sort it out. Or is there a higher office at BG I should write to. It is SO frustrating. And there is no way I am paying almost £800/month. Help???? Also - is arvato part of BG?
  11. I am looking at a mortgage hopefully next year so thought i would give the file a look. Good job i did as its in a right mess. 1. I have a debt of my fathers somehow on there, in my name but showing his date of birth, will this be a problem getting it removed? 2. Several debts with Lowells, which are all past 6 years old but showing recentish default dates, which are NOT the original default dates( shopacheck, vanquis). 3. A couple of debts that didnt default for ages, literally showing as red box with numbers in for 3 years befire a *D* 4. Debts that show as settled, plenty of red months ( i never settled them) but past six years old, shouldnt they be gone? Any advice much appreciated.

Hi, can anyone tell me if alleged"defaults" from creditors can remain on my equifax file or for that matter any credit reference agency? in my own case.. i have won 2 cases against me alleged to default in 2012 whilst i understand they are going to fall off the file this year... its later in summer.. my query is .. having won my cases, does that not say the dispute was won on an alleged debt.. therefore should not be there?
  13. Hi all, I'm hoping someone can advise, back in October I applied for a loan through Admiral but the application was unsuccessful. My credit score (i use Clearscore) went down this month with a note saying: What changed in July 2018 : Hard Search performed by Admiral Loans for Credit Application The October application is showing the exact same information - why would they simply perform another hard search without my consent? and is there anything i can do about it?   14. 11 years ago I was taken seriously ill and due to the illness I lost my job and ended up in a financial mess resulting in my house being repossessed. Thankfully my health has stabalised and I'm now starting to get to grips with my financial mess. Having checked my credit reports I noticed Natwest were reporting missed payments each month on two mortgages and a loan and hadn't recorded any of the defaults or CCJ's. I lodged a complaint with Natwest which they upheld due to inaccurate reporting of my credit file when one mortgage and loan had been paid off with a full a final settlement and the other mortgage had resulted in a repossession. To compensate me for inaccurate reporting over the past 8 years they've sent a cheque for £125 which I don't believe is adequate. However, whats more worrying is that they have now listed the mortgage shortfall as an outstanding mortgage even though the property was repossessed over 7 years ago. While I don't dispute the amount is outstanding I didn't think they could report the outstanding balance once the account had been defaulted and subsequently repossessed. Am I correct or are Natwest allowed to register the mortgage shortfall in this way on my credit file ? Thanks
  15. This is an interesting one.... I have an outstanding default from MMF (now lantern – ROFL) for a payday loan last paid in feb 2012 (the loan was paid 10 fold over this was the point i said no more). The default was registered in May so its just due to be dropped off my credit file and statute barred, so I thought it prudent to down load a copy to keep on file. To be honest I haven’t really paid much attention to this one as i had bigger dragons to slay but on printing out the report I have noticed a discrepancy in the reporting with a payment of £1 showing , then disappearing, then showing in Jan , feb and march 2016 J F M A M J J A S O N D 2016 138 139 138 :-x138 138 138 138 138 138 138 138 138 2015 139 139 139 139 139 139 139 139 139 139 139 I have learnt a lot of lessons along the way so I am a meticulous record keeper at NO POINT Have I contacted them about this debt, put in a cca request or made any payments. This is blatant false reporting and also means at first glance that i have paid towards the debt, thereby acknowledging it which means it is not statute barred. I know I should let sleeping dogs lie as they have yet to action this but part of me wants to take action as it is just WRONG - is there anything I can do such as reporting them to the ICO. They are bottom feeders and use tricks like this to make so many peoples lives so miserable - i want to fight back.
  16. Hello, Going through my credit file and I have on closed accounts with a UC marker, details of an old logbook loan that was paid off 4 years ago, no defaults, no late payments ever. I wonder why it is there. stupidly it was not the only one I ever took out but they were all paid off. Is it normal for these loans to appear on a credit file? Thanks

Hello, Bought a TV from Very.co.uk 06/01/18, statement shows £559 for TV and £6.99 for Delivery Account starts with 1p in credit (from last order) Statement produced 03/02/18 says £5 due 23/02/18 With estimated interest of £0.41 based on payment balance of £6.98 Payment made 21/02/18 of £56.60 by card on the website towards the TV Statement produced 03/03/18 says £7.43 overdue Payment due by 23/03/18 actual interest £0.45 Estimated interest for next time £0.00 Standing order of £56.60 paid 05/03/18 Statement produced 31/03/18 says £0.00 due Shows payment made 05/03/18 of £56.60 Shows £49.17 has been allocated to your BNPL items on 05/03/18. Leaving £7.43 to be allocated to the postage. Sometime in March I called Very to query why there is a payment due as I had selected BNPL for 12 Months at the time of order and I had made a payment of £56.60 on 21/02/18 before it was due. I was told the payment is for the postage, there was a discussion about recent payments where they said, because I had made the payment online 21/02/18 and allocated it to the TV they couldn't allocate it to the postage, so I asked for the most recent standing order 05/03/18 to be used to pay the late postage, thus clearing the late payment. Move on to today 15th May, my credit file shows a late payment for the delivery costs. It appears they have one credit order from me which includes delivery, but they have then taken a payment towards the TV but have split the delivery costs out. My understanding the whole way through the order was the TV was on credit, not the delivery, so how can this be marked as late if the payments were up to date? What do you think?
  18. Hello i have a loan with the Co-OP and its not showing on all the 3 credit agencies, its been sold to a DCA however there name is not on either, this happened for anyone else? what would it show under on your credit report? i checked noddle, clear score and experian, cant find it!

Probably a daft question, but can a debt be registered duplicate d as seperate debts/defaults on my credit file... .I have two in question. ..an old lloyds tsb loan which is registered as a lloyds tsb default and elsewhere on my file as a lowells default.... .The second one is barclaycard default which has seperate entries as a barclaycard default and a hoist portfolio default... ..The reason I ask is that it's making my credit file look worse than it actually is (it's still bad though!)
  20. I had a loan via satsuma loans (provident financial ltd) I started to find unaffordable. I did the right thing and rather than paying late I contacted them being honest and setup a payment agreement, which I have stuck to 100% and not missed a single payment since it was setup in may 2017. Despite this and the fact ive made major strides to improve my debt handling and credit record over the last 12 months its still had something dragging it down and ive just found out that its provident financial ltd. The record for them on my credit file is still showing as per the original loan agreement which I haven't been paying for almost 12 months now however this is no longer valid as the new payment agreement I had with them superseded this original agreement which explains why I haven't been making payments towards it. I have requested via experian and noodle that satsuma update this record to reflect the new agreement but they have refused to do so. My question is, is this legal? I dont see how when ive setup a payment agreement with a company's approval that the original payment agreement is still valid as surely you cannot have 2 payment agreements with 1 company for 1 loan.. ...the payment agreement I setup surely supersedes the original one? and I dont see how its fair that im being penalised for late payments on a loan agreement I no longer have any agreement to pay. this whole thing has utterly tanked my credit file despite the fact ive worked really hard over the last year to sort myself out and until I find someway to correct it it will keep on tanking my credit file. So just wondering what my options are here? Is there anyway I can force satsuma to update my file to show the new agreement rather then the out of date invalid one? Can I get some advice please?
  21. Hi, I've read a few threads today and found the advice very useful. Just wanted to share my specific case to see what advice can be given. I noticed a CCJ on my credit file through clear score registered at Northampton County Court. Today I rang the court and was advised that it was in relation to a PCN from SIP and Gladstones have taken me to court. The case is regarding 2xPCNs at the start of January 2017 outside of my address in privately rented apartments. On at least 1 of the days in question the ticket machine was out of use (I have a photo showing this - although it probably isn't the greatest as it doesn't clearly show where the machine is just the "NOT IN USE" message). A couple of weeks after these dates I moved from my apartment and didn't receive anything from the claimant regarding the claim or subsequently anything from the court. The first time I realised there was an issue was looking at my credit file and finding the CCJ. The CCJ amount is in excess of £400 (inc court fees etc) which is quite frankly extortionate for 2 days parking. I don't have allocated parking in my tenancy agreement. I would like to remove the CCJ from my credit file and have received the N244 application notice from the county court. Any help and advice would be greatly appreciated before I pay the £255.

Hi All, the is my forst post on CAG. I have a question, which im hoping the community will be able to advice me on if it is legal, and if not the steps to take to resolve this. 7 and a half years ago, i split with my X wife, which was quite a bitter split. In her wisdom, when we split and put the marital home up for sale, a few weeks later my x wife took the house off the market, stating i had never asked for her permission to sell the house, and she refused to sell the house even though she had moved out when we split. Consuquetly, the house was repossed and a CCJ was rejistered against me. I did try and come to an amicable agreement with the Natwest where by i was responsible for half the debt (£16,800), and my x wife was responsible for the other half, and once my half was paid off it would show as settled on my record, which they rejected. So, i thought i would wait out the 6 years, for the CCJ to expire. During this time we have moved twice, and i have not received any letter from anyone for about 2 years relating to the CCJ, so im actually unsure who actually own's the debt (Natwest or DCA) The debt did expire on May 31st 2013, and did 'dissapear' off my credit file. I pay a monthly subscription to experian so regually check my file. Last week the payments started showing again on my credt file as 6 months in arrears and deliquent. After alot of research i was under the impression that once the CCJ had expired after 6 years, that was that, unless of course they tried to re-rejister to the courts for a CCJ. Im thinking of getting legal advice, however before going through the cost i thought i'd see what my options are on here. So my questions are: 1. Is it true the Natwest or any DCA can rejister these late payments that have just appeared on my Credit Report after the six years 2. If not, what are my options to have these removed from my credit file? We where hoping to buy a new house in the next 6 months, however that is going to be impossible with this on my file All help is VERY greatfully apreciated in advance
  23. Hi, I'm new around here! Looking for some advice regarding a debt I have with Lowell. In 2013 I left a property I was renting, BT contacted me about a month before I left saying that the new tenants would like to take over the service and wanted to know if I was happy to do this. As I was moving to a shared house, I couldn't take the service with me and agreed. A few months later, I got a bill for £599 from BT for the rest of the service that I had cancelled early. After a few phone calls where they continued to ask me to pay the bill I sent them a letter stating the above information and that I didn't want to pay. After this, I didn't hear anything about it and presumed that they had wiped it. Then around a year ago, I started receiving letters from Lowell saying that they have taken over the debt from BT and need to collect. I ignored the letters for a few months, until they started putting defaults on my credit file. As soon as this started, I contacted them and set up a payment plan as I was unable to pay the full amount. I have been paying a nominal amount for the past 6 months but Lowell continue to put a default on my credit file. I called them to ask why, as I am making payments. I can't remember the exact wording, but it was something along the lines of because it is not an active debt like a credit card they are able to default me every month until the debt is paid in full. Are they allowed to do this? I'm only paying a small amount on the debt, it could take a long time to clear, meanwhile my credit rating is dropping all the time.
  24. Hi Again.... I have a problem that I ought to have dealt with, but have not because I had more pressing issues: 4 sets of serious or urgent litigation that had deadlines, or financial priority: I had and still have a collapsed lung, I sadly have a deceased mother in law, a baby, who ended up in special care, while my wife almost bled to death during an emergency c section, I've bought a new house that the surveyor messed up big time on, I have had 2 new jobs, 2 surgeries and a tumor in my colon. I know they are not excuses for delay, but it has truly been a crap few years and this issue is the last unresolved pain in my side. All the issues above happened around the time of the N power debacle, or since. Some time around 2013/14 I moved into a house and the N Power Direct debit stopped. I had used NPower at a previous address. My dad had been paying as he is a kind man and he offered to when my wife and I were broke 10 years ago and he never stopped paying (despite me asking him not to). Npower screwed the bills up and I didn't pay the incorrect bills. At all times, I felt there was an ongoing complaint/ issue. Eventually the correct bill came and I paid it. The end? No. I applied for a loan or mortgage (cannot remember which off top of head) and was rejected. I had a default registered with Experian by Npower for the period where we were in dispute. The defaults are numerous and are all over the place. I wrote to Npower, Experian and complained to the FOS and got nowhere. What can I do, the defaults are only with Experian and they are utterly inaccurate. I am stuck. I need help with this.
  25. Please help, First time I received my salary and my outgoings monthly payments are bigger than amount received. I have unsecured loans and pay day loans and this Month I won’t be able to pay 3 of them, I read all the 10 steps but I am still panicking, I have more payments than my salary and I need at least 3 Month to back to "normal" when my paY day loans will be paid in full but this Month and next one I have to stop some payments. Please help and let me know how to go the creditors and what I can ask TO HELP ME, WHAT should I tell them? Can I ask to freeze 2 Month instalments or just offer pay a little? Many thanks
