Took my complaint to FOS for irrisponsible lending after Fancyapayday rejected my complaint - FOS upheld my complaint - removal of 5 out oof 8 laons from my credit file, refund of all loan fees, charges etc plus refund of the £700 they took from my account using a CPA. So thats around £1500 refund fancy will probably escalate to the ombudsman, lets see what their next move is

Hi all, I recently had an old paydayloan from 2012 come and bite me from behind big time. Basically I supposedly took out a paydayloan that was due for repayment in June 2012. I had forgotten all about it. I did actually dispute early emails from this email saying that I knew nothing about it and that they were to provide proof that I had taken this loan. No proof arrived so I just ignored the emails they kept sending saying I now owe such'n'such. Anyway, I recently needed to take out a payday loan and apparently gave my details to a sister company of fancyapayday. On 28th June 2013 fancyapayday used the debit card details obtained from their sister company to pillage my bank account and tried to take £1134 in total, but only managed to get £750.00. They took everything they could from my account leaving me with no money to pay for rent, food, utility bills, insurance and existing financial agreements. They are not interested in discussing this and stand to their mind set that they are in the wright and that i still owe them for the remainder. I really need some legal advice here as to what I can do other than the usual of going to FOS then small claims court. Can they use details gained from a 3rd party/sister company, are they allowed to take everything from my bank etc etc etc
