  1. In Oct,we received ccj papers for an old debt from egg. The claimant was Marlin and the solicitors was Mortimor clarke. I sent the court paper to the solicitors in Oct with a request contest jurisdiction as we had received no warning from anyone re the debt. Not even a 14day warning letter. We heard nothing until a letter dated 23 January from solicitors saying the ccj had been awarded by default. What do I do now? Should I have sent it to the court? Have I done it wrong, anyone advise? Regards
  2. Dear Caggers, I live in Indonesia, and have done so since 2006. I had an Egg card taken out in 2000, which fell into arrears in 2008, and despite CCA 78 request the documentation received did not appear to satisfy the four corners rule. I have made no payments since late 2008,but would have to try and check when this was exactly. I have written to Egg many times to explain the account is in dispute, but as per many fellow unfortunates, it seems the account has simply been passed to Barclaycard and Marlin Capital, and finally Mortimer Clarke. On a brief holiday to the UK, I found mail piling up at my flat( rented out) including letters from Mortimer Clarke. I emailed them on 19th June to explain I do not live in the UK, and the account was in dispute. I have now received a County Court claim form dated 20th June, asking for 12k credit card arrears and nearly 5k interest. I intend to acknowledge the service initially, but my questions are: Should I mount a defence based on the fact that I do not live here, and will be unable to attend court to speak in my defence. Was Mortimer Clarke able to lodge this claim knowing this..?Unless timing was purely coincidental.. Should I apply for another CCA 78 or SAR, and to whom..EGG or MC..? What is the current feeling regarding pre 2007 CC agreements-are they unenforceable, as was thought a couple of years ago, when I was last in the UK.. Any advice kindly received, and I will buy a scanner in order to load any copy documents required..
  3. Hi Guys, Firstly I would like to thank all the contributors as the forum is really useful, I was panicking until I came to CAG last night. I am helping this for my Mum who is being a victim of these DCA as she being chased for same account by several DCA. She has no income just a mortgaged property with 2 charging orders from 2010(default judgement) which after reading this forum I would apply to set aside late but first thing first. The CCJ was issued on 20-02-14 for 23,070 including cost interest and fees. The interim charging order was issued on 25-April-2014 with interest being charged at 8% p.a I got delayed because I was in the process of getting a LPA from my mother to deal with these DCA myself. I have already sent the N244 application and requested the court to transfer thsi to my local court hearing is on the 02-06-14 and have been told that they will put this to the judge so he could decide. I need urgent help with the defence and dont know what will be best as my mother does not recognise the debt the agreement date is 05.03.2007. This coudl be Statuary Barred and/or unenforcable my mother is sure she never signed any agreement physically.

Hi Please could someone help me, after much persuasion from friends about PPI claim I called my previous mortgage supplier (Santander) and found out that we had PPI on all 3 settled mortgages, I was totally gobsmacked as I had NO idea there was PPI on them at all. The claim is now being investigated, we also found out that there was PPI on a credit card that I also had with them, I had no knowledge what so ever! This has now encouraged me to check all previous lenders etc, however I had a personal loan with Northern Rock which I settled around about 2008 and also a EGG credit card, this was also settled around the same time. Does anyone have any contact numbers for Egg Cards prior to Barclaycard taking over? Would I need to contact NRAM with regards to the personal loan taken out with Northern Rock? Does anyone have the contact number? I will update you with regards to the claims that I have already made! Absolutely gobsmacked that there was PPI! Thank u
  5. i have an outstandng dispute with egg card and heve been chased over the years by various DCA'sI have now heard that Barclays have brought egg.I have a barclays account can they take money from this account to settle the egg card
