  1. Hello, I am looking for some advice. I applied for a mortgage in December after receiving a Decision in Principle earlier this year. I was disappointed for the application to be declined based on my credit file. I got a copy and noticed that a default from 2012 with Motormile had been moved to 2016, which is likely to be why the mortgage was declined as other than that my credit file is clear. I contacted Motormile who admitted to their administration error and said they would update my file in 4 weeks. After 4 weeks it wasn't updated so I chased again and they confirmed it would be done within 2 weeks. After 6 weeks it was finally updated. 2 days later I was about to submit my mortgage application again, went on to quickly check my credit report again and noticed the default has been updated again with a 2016 date! While all of this has been going on the seller has been getting quite upset (rightly so) and at this stage it looks like the house purchase will fall through because I can't secure the mortgage. I know if this default is updated I will get the mortgage though. does anyone have any advice on getting Motormile to fix this again and update the CRA's immediately, is it even possible? I have reported it to the ICO but I don't have time to wait on them investigating. Previously I raised notices of correction with the CRA's but they all came back to say they were not updating their records, even though I have correspondence from Motormile saying the date on my credit file is incorrect.   2. Hi i need help, ive read through so many posts on here and they are full of really useful info, but im also confused with it all . Since 2006 i have been on a DMP and have just partial settled with them all. Most of the creditors defaulted me in 2007, when i started my DMP which i fully understand due to me paying reduced payments. After sending out mt partial settlements via payplan i have obtained my credit report and have discovered that after being on a DMP for nearly 7 years Lloyds TSB only defaulted me on 28/06/2012 freemans catologue defaulted me on 11/07/2011 Robinsonway defaulted me on 11/06/2008 Cabot defaulted me on 21/12/2008 this means that my credit status has been rubbish for the past 7 years ( which i understand ias i was on DMP) But its also going to be bad for another 6 years because of these late defaults. Is there anyway of having them removed or the dates altered to when i originally defaulted at the start of my DMP. All help is greatly appreciated as i am confused as to which letter templates i should use Please please please help :-):-):-)
  3. So quick background. I took out an O2 mobile contract in Dec 2008 for 18 months. I paid up every month until the end. At the end i changed to a 1 year sim only contract with O2. I had moved house and o2 rep updated my address details etc for the new contract. I paid this every month etc until Aug 2011 when i cancelled the DD and got a new contract phone. Fast forward to last week and I applied for a mortgage and it was refused. This confused me as i had always paid my debts, had a good income plus a decent deposit. I got a free equifax credit report and discovered that I had a default from the o2 1 year contract for £14. I called o2 this morning and apparently this had been handed over to a debt collection agency. Apparently all correspondence had been sent to my old address and not the new address. I did some research and found that this could possibly give me some leverage with getting the default removed, is that right? I am on the electoral role for the past 2.5years so the debt collection agency could have found me but i guess £14 isnt worth it. Should i call the debt collection agency tomorrow and pay the £14? The O2 rep said that they might only give a satisfactory payment on my credit report, i know that this is not very good. How can i get a full removal? I have written a business letter to o2 legal people but wanted to check whether i was going the right way. What methods are available to me because i might need to move home soon and a credit check is almost certainly going to be performed.... Really annoyed that my life could be hobbled by a £14 debt i didnt even know about.
  4. Hi everyone Lloyds Tsb Customer Relations have advised that they will refund all the charges and the interest. The PPI complaint has not even been looked into yet, but told this is separate. The balance now stands at £500. LTSB state the acount was closed 30th November 2011 and passed onto Moorcroft. Who due to the dispute placed this on hold. This was then passed onto Wescot in May who also placed this on hold and ceased collection activity. Have letters stating that they bellieved LTSB were looking into this. More recently though Wescot state this has been passed onto Credit Secuirities who do not have any record of the account. LTSB state this is with Wescot- so we dont know who this is with at the moment. Have asked LTSB for a copy of the default notice, notice of termination or assignment but they wont send out. Know PPI is separate to this. Is there any way we could get them to remove default with a Full and final offer? Not sure if I am getting confused with CCJ's but if after 30 days of the date of the default registering, if you paid in full, this would then be removed. As if this is true, then we did not have an opportunity with the DCA. Any advice on what to do next would be greatly appreciated, thanks.   5. Hi all, How are people getting on these days with regards to having default notices removed from credit files after credit card companies pay back charges? I owe £338 on my account and have received £607 payment. I have had default notices which are for much less than the amount. I will have a hunt around the forum to see if anyone has succeeded to get these removed from NatWest re credit card charges but thought I would start my thread off. I've successfully won against O2 previously for the same thing. Also, is it worth asking for compensation in relation to the damage these default notices have had.......
  6. I am looking for a solicitor who specialise in credit consumer act and the ICO guidelines. Must have experience in application of default notices and credit reference agency. I would prefer someone in London, Watford or surrounding areas. Thanks madtergee16

Hi All, Had a Capital One credit card with 200 pounds limit - at one point in 2007 it went upto 220 and over the course of a few months it escalated to 550! i wasn't aware of these charges as i didn't receive most of the paper work - also i was abroad for some of the time... i then partially settled it in 2008 - but was unaware that it will still be set as a default in 2007 and will not come off my credit file until end of 2013... I sent a letter in feb 2012 to the executive response team at Cap1 requesting for the default to be removed as it's ruining my life and that of my family - The amount increased from £200, simply because of the over limit “unfair” fee charges of £20 in addition to late payment charges of a further £20 plus purchase interest and cash interest – all of this eventually added up to £550 without my knowledge. Earlier today i rung them and understood that they sent a letter to my old address stating that this will be their last correspondence with me and any future communication will have to go through the financial ombudsman... and they have now cleared the balance off my credit report and instead of it saying "Partial settlement" which i settled back in 2008 - it will now state fully settled but the DEFAULT will remain till end of 2013... Is there anything i can do here to remove this DEFAULT??? Basically this default is of a small amount has ruined my Life and that of my family!!! Thank you in advance for your help..
  8. Hi there, everyone. This is my first post on a great website. I have been reading a few threads on defaults, as I have a couple on my credit report, and am hopeful if people can clear things up for me. Am I right in thinking that a default notice needs to be served when an account goes into default? If so, I did not receive this for any of the defaults. Should I therefore request copies of these? If they can't provide these, can I request that the default be removed? What's to stop them just making up notices on the spot? Also, the debts are still owed. Can I 'broker' a deal by saying I'll pay up if the defaults are removed? Thanks in advance for your help, guys.
