Hi Am very new to this, although i have read a few things and took advice to try and sort out our Debt problems. I have managed to sort out repayment plans with most of our creditors. The only one we are having problems with is Santander, who will only agree to a 6 month period for us to catch up on our arrears in the Loan my Husband took out in 2009, we have £3712 left on this loan. We have had problems since July 2011 when my job was made into a job share due to cuts at work therefore i became part time and my salary went down. We fell behind with our debts after a while. As i said we have sorted our other debts out, but santander are saying they will only accept £408 per month for 6 months to pay arrears and keep up to date with further installments (£240). Because we couldn't keep to this they then passed the account to Credit Style Limited. I have tried to deal with Credit Style and given them all the information they then came back with the exact same off Santander had because they are working on behalf of them and are governed by what Santander say. If i cannot agree and commit to paying £408 then Credit Style will pass the account back to Santander, and the lady i dealt with said they will do one of the following: If you are a home owner it could be a County Court Matter as Santander will look to secure the £3712.50 balance you still owe on the agreement against your property. I f you are employed it could be Court again to apply for an attachment of earnings or as you state, they may sell your balance to a 3rd party as they do adopt this procedure too. I am afraid I cannot guarantee which approach they will take as they have a department that deals with cases like yours but I can advise they will give you the chance to pay monthly / weekly and suspend all action unless you default with payment. My question is does anyone know what they are likely to do? We do not own our own home, my husband works but we don't have enough money coming in for them to receive the amount they want through an attachment of earnings order, and if it gets sold on are the other companies more likely to agree to a more suitable agreement plan? Am getting really worried as we are slightly behind with Council Tax and Gas/Electric at the moment and i need to pay these debts first. They are the only company that just wont budge on their timescale. Any advice would be really appreciated. Sorry if i've gone on for too long, its my first time doing this. Sarah
Hi. Sorry if I posted in the wrong place I am a new to the site. Please could someone help, very worried. I have a HP Agreement with Black Horse for my car purchased in December 2009. I made all payments on time until September 2011. I then had payment difficulties and made an arrangement for reduced payments which ended in May this year. A representative from Black Horse was supposed to call to see me to discuss in June but never showed up. I called and text him several times but had no response. There was no further communication from Black Horse and then a letter from Credit Style arrived and the constant telephone calls started last month asking me to contact them regarding the arrears with Black Horse. I called Black Horse to ask who they were and they said Credit Style were now dealing with my arrears and BH could not help me any further. I asked why their representative didn't show up and they said he was on the sick and his manager should have called me to discuss but didn't. I pointed out that this was unfair to transfer my account without giving me the opportunity to discuss and was promised a call back by a manager but never had one. Still being hounded by Credit Style I called them and the arranged to come to my house yesterday to discuss the arrears. Basically said pay the arrears in full and resume normal monthly payments or sign a Voluntary Surrender Authority to give the vehicle back which I dont want to do. He kept waving the form in from of me to sign but I signed nothing and after 2 hours told him enough was enough and to leave, they called me again this morning asking me to sign the VSA as there was not much time for me to think about it. If I did not sign it they would take me to court and come and collect the car. I called Black Horse again today but they keep saying deal with Credit Style. Credit Style are calling me back on Monday expecting me to sign the VSA. I feel I am being bullied into signing the form. Very worried and not sure what to do next.
Hello and apologies if this is in the wrong forum or has already been posted. I had a credit agreement with Black Horse for a car I bought which had a large residual ballot payment at the end of the term (£11400). Through no ones fault but my own I missed the final payment. I had meant to trade the vehicle against another car, settle the original loan and start another agreement. I had some conversations with Black Horse but after 21 days (I think) they passed the debt onto Credit Style - a company I had never heard of. Credit Style contacted me with all sorts of friendly advice about settling the account and referred to themselves as a company that Black Horse use to work on behalf of the borrower to work out an amicable solution. So far so good. I explained that I missed the deadline and would trade in the car and thus settle the outstanding balance. I was asked by Credit Style to direct the selling garage to go through them. Which I didn't question at the time. I approached a garage, found a vehicle agreed to trade the current car against the new vehicle and clear off the balance. The settlement figure from the new garage was confirmed at £11400. Credit Style then contacted me by text to say that the balance was now £11919 which included their fees. This was news to me. I disputed this with them as I didn't have any agreement with them, nor did I have any visibility of their fees etc. Black Horse will not discuss this with me, nor even the relationship between them and Credit Style. After raising a complaint with Black Horse, and mentioning bodies such as the OFT to Credit Style I have now been offered a deal where they will go back to Black Horse and agree to settle the loan at £10,000 which will include all their fees. Am I right in assuming that they have bought the debt from Black Horse and were looking to screw not only Black Horse but also me before, as it now seems miraculous that if I provide them with a cash sum almost £2000 less than they were originally asking for I am off the hook. BTW I am prepared to pay the original settlement value to Black Horse of £11400 but they won't deal with me now. It seems strange that as soon as the OFT etc are mentioned Credit Style have a change of heart. Any advice on how to proceed will be gratefully received. Mark ps. It's also with noting all the calls with Credit Safe & Black Horse from my office are recorded so there is a full audit trail available should it come to that.
