  1. Hello Creation ….what a nightmare I sent them my new offer at the same time as all the others, they said on 16th Oct they were putting account on hold for two weeks so that took it to 30th October to allow time for letter to arrive, review it and reply. Today not even a week on they leave me a message advising account now off hold! I rang them and could make no sense they say yes account on hold but not on hold????? Do I ignore them and wait for them to reply to letter as quite frankly I don’t trust them and at least if it’s all in writing I know where I am? Or should I call them again? I ended up hanging up on them today after they put me on hold for 17 minutes!
  2. Hi, I'm on a DMP with StepChange since 2014 and of the 8 accounts 7 have added a default within the 6 months period, apart from Creation. They have sold this to Lowells and I have written to them to ask for a backdated default to be added. they have refused and said they will update the credit reference agencies with details of any payments made. I'm worried that as all the others will drop off in early 2020 this will continue to be an ongoing nightmare. I'm not sure what to next :/
  3. I complained to Creation and just confirmed that I've had a payout of just over 3k from them in relation to PPI. Had to escalate to the ombudsman, but just received the cheque today, happy days!
  4. Please can someone shed some light on this for me. Long story short, I have a credit account that was opened in 2010, it defaulted in 2011, CCJ in 2012 and interim charge order in 2012, This account has only been reported on my credit file from 2014. no info is showing for 2012 or 2013 therefore no default shows up and the account is reported as 6mth late payment. Is this correct? if I pay the debt in full does the whole debt fall off my file as it was over 6years old in 2017 or stay for another 6 years after payment. The company say that the default was issued in 2011 and that they will continue to update my file with 6mth late payment until I pay the debt In full even if that’s for another 20 years. Surely this is unethical, are they able to do this? Thanks in advance
  5. I am really encouraged after reading many posts on various debts. I had a Store card with Creation and I did have an arrangement to pay but they told me it was not enough and through Drydens got a CCJ. They told me that if I were to pay the full outstanding balance that they requested no court case. Somehow I managed to find the money nearly 2k and paid them. Yet somehow I got a CCJ. I did not go to the court or had a defence. That was in 2011 and it will be SB'd in May this year. I read it somewhere if I paid the full amount I should not have had the CCJ. Is this correct? My question is that if it is possible to remove this judgement because I was told that if I were to pay in full no court case? Any advice would be greatly appreciated.
  6. As attached are my docs from Creation creation33.pdf
  7. Hi. I am in the middle of a dispute with Creation Financial Services. I was speaking to their helpline and they said they had accessed a telephone call I had made two years earlier and that I had not changed my address with them. Can they really access these phone calls from two years earlier in a matter of two or three minutes I was on the phone waiting for a supervisor to access the call. I didn't and don't believe they accessed it that quick and think they lied to me. Can you tell me if they can access calls from two years ago that fast? Thanks.
  8. Hi I was going through my file of statements for a Store Card taken out in 03 and realise that there is a long list of Late Payment Fees added over the years. Creation has always been the company receiving my payments on behalf of the store. And has always been the company inundating me with calls when I miss a payment !! I do use the store card every now and again. I do pay monthly, sometimes clearing the balance in total, sometimes paying the minimum. sometimes a higher amount. There is currently £500 owing. I have added up all the Late Payment Fees. (Actually Creation changed the name to "Default Sum Fee - Arrears" in end 2008.) The fees have been £10, £12 & £22. From mid 2005 to date the sum total of charges is: apx £240. Compound Interest is apx £995 Total Charges + CI is apx £1235 So their statement says I owe £500. Yet I consider, given the above figures generated from a CI spreadsheet, that they owe £1235. So should I write to them a letter saying I want these charges + compound interest reimbursed to me??? In addition since Jan 2015 Creation has added "Interest on Purchases and Default Sums (if applicable). So 6 months of interest charges on their charges??!! This doesn't sound like fair practise....
  9. HI Does anyone have a copy of Creation T&Cs from circa 2003 that they can scan & post up here? I cant find mine and want to file a N1 Claim against them. And also current t&cs too, Would be most grateful. Many thanks
  10. Hi, thanks in advance for looking at my post. Basically, in 2006 I took out a buy now pay later deal through land of leather with creation. land of leather told me i would be contacted when i needed to start making payments but never did. after taking out this deal i went through a rough patch after having a prem baby and becoming a single parent in the space of a few months with no job and was extremely depressed and i forgot about the sofa payments. the next i heard i had court papers, i contacted creation to ask if i could start making the payments asap and they told me i had to pay the full amount plus the interest i would have been charged or they would register the ccj. i couldnt afford to do it and the ccj was registed and a charge was put on my house. anyway, the house is being sold, its meant to exchange next week. my solicitor has contacted creation for a balance and it is 5139.19!! the sofa originally cost 1495 and i took a 2 year warranty 240. on my credit file under creation it states 3639 and they have logged every month since 2006 sustained arrears. i contacted creation to ask why the balance is so high, they told me it was now with drydens. i called drydens, they told me the 5139.19 is the balance creation had sent to them and they had never added any fees and didnt have a breakdown. i recontacted creation and i was given the balance of 3638.55 and they told me any other fees must be drydens adding them. i am so confused and neither company is offering to help me or give me the information i need. i am about to lose my buyer. please help me
  11. Hi I'm hoping you can help, I purchased a sofa on 12 months finance in March 2008 when I was living with my ex, I only made a few payments then we split, I moved out & never made another payment. I have never had any letters from them regarding the debt due to me moving out. Last week I checked my credit report for the first time as I wanted to make sure everything was correct before applying for a mortgage & I noticed they had registered a default in August 2010 registered to the address I lived at with my ex so that will be why I never received a default notice. I'm just wondering if they are allowed to register a default 2 years after I last made a payment, I'm hoping not & I will be able to get the default date changed as it will then drop off my report. If anyone has any template letters I can email to them regarding the date being wrong I would be very grateful Thanks in advance
  12. Hi this is a bit complicated by here goes I took out a loan in 2006 with Creation finance one of those buy now pay later deals. Due to financial difficulties I was unable to continue with the repayments from August 2008, and I had assumed that the account had gone into default. In the middle of 2009 I contacted Creation finance and offered them a partial settlement and after some wrangling they agreed that they would accept what amounted to two thirds of the debt and not chase me for any more. I cant remember if they accepted my terms as full and final or partial settlement, but it was probabally the latter. I paid of other creditors in the same way, and never really looked for credit again. Then in 2013 I started getting letters from Cabot demanding payment of the outstanding balance, and of course I lost the correspondence between myself and creation re the partial settlement of the debt. I ignored all letters from Cabot and then went and checked my credit file. With regards to this loan, my payment status on my credit file was 6 from feb 2009 until August 09 (which means that I prob hadnt paid anything since at least Aug 2008) then in sept 2009 it shows a 1 status, this is where I had paid of 2/3 or the debt, then the non payments reset and ive been at a 6 status since February 2010 Creation Finance only issued a default against me in January 2013, when it should have been done around feb 09 six (ie 6 months of no payments) or because i reset the debt clock by making a partial settlement in sep 2009 a default should have been issued in march 2010? I did a SAR but of course there is absolutely no information from them regarding this Loan after 2009, no record of our correspondence re the partial settlement. I had a couple of other loans with them previous to this and the Payment protection insurance on three of them amounts to more than Is outstanding on this debt In reality what I really want is this default removed from my credit file, so what can i do, Cabot finace have resorted to phoning my neighbours to find out if I'm still living at my current address which I think is very poor form and very embarrasing for me
  13. These guys were calling me 17 times a day on mobile or landline and really aggressive. Debt owed was £1900 they added huge % and penalties so now £3100. Opened Sept 1996. I foolishly sent cheque for £1 with CCA which I am 99% sure they copied my signature to a Credit agreement, where theyactually spelt my name wrong so I know I didn't sign it. They sent my account to Drydensfairfax who wrote several letters threatening court action etc but have gone very quiet since Feb this year-waiting for next move. I replied to Drydens saying they had not returned a CCA and was therefore unenforceable, heard nothing since. No statements,no calls nothing-eery- I CCA'd them in Jan 2014-they sent several attemptsat reconstrued CCA type A3 blank credit agreements-which had nothing,no details on them....their % was 26.5% . Stupid me to have got in this mess but I had quite a nice business then a creditor liquidated owing me huge monies and I lost everything-tried to survive for a while using CCards to support myself and pay debts with each of them -made it worse.hey ho such is life. All ok have my health,my family and it's summer at last
  14. Hi, I'm in the process of sorting out my debts, i've just paid one off fully as I had a CCJ attached to it so i'm down to 2. I'm going to try sort these 2 out 1 at a time, starting off first with this one. A while back I bought a TV from Richer Sounds, after splitting up with the ex I fell behind on payments until I eventually stopped doing so. Now I'm looking to get a mortgage in a few years time it's time I started cleaning up my debts/credit report. Here's the entry in Credit Manager: Creation Consumer Finance Ltd Account number: ******** Name: ******** Account address: ******** Date of birth: ******** Account type: Credit Sale Account status: Default Date last updated: 01/11/2013 Account opened: 21/04/2007 Account opening balance: £788 Regular Payment Amount: £29 Repayment frequency: Monthly Default date: 28/02/2011 Original default balance: £788 Now it says the default date was in 2011 however I'm certain I was never paying anything to them (nor did I acknowledge any debts to anybody over a few years), how would I go about getting this default date rectified? (In order to help getting it off my credit report sooner). I'm not trying to run away from it, I'll pay what I need to but first I want everything clear on what I owe so then I can set up some sort of plan. What would be the first step towards this? CCA first then take it from there or what? I also had this posted in another thread along with the other 2 debts (http://www.consumeractiongroup.co.uk/forum/showthread.php?406740-3-different-debts. for reference), it was said that it probably will be enforceable however I may be able to claim extra charges etc back? If you need any further info don't hesitate to ask. And thanks in advance!
  15. Hi - firstly brilliant website with most amazing advice, has helped me out over the years but this is a new one which hopefully you can help me with. If I am being harassed by phonecalls (over 4/day even when I speak to someone and say I have already spoken to someone an hour previously) do I have to go through their "security" before they can stop the phone calls. I got a fridge on finance and about 6 months ago there was problem with my bank account and all my direct debit went funny so have been paying my monthly payment which is £27.04 and I have been paying £30, but because they cannot draw on the direct debit they contacted me. As I only have 3 months left on my agreement I don't see why I should set up a direct debit seeing as I am paying by standing order. They are after me for some charges on my account for +/-£46 which I think are very high especially as I have been making payment. When I spoke to them I told them I could not pay the charges via debit card (which is what they were phoning me for) they kept on saying could I just make a small payment or token payment on the £46 even a £1 would be ok??? Firstly I don't see why I have been charged but will ask for details and secondly I am scared to give them my card details in case they use for more payments. That was last week but this week the calls have started I keep saying I have spoken to someone and could they stop calling but they say they cannot do this until I have gone through security with them. I have been ill in bed for the last 2 days so feel rubbish and do not want to sit and go through security I just want them to stop calling. PLEASE HELP - I want get over my flu in peace!!!
  16. Through their error they took money out of my credit card account and sent it to someone else's credit card. They have admitted it was their error after three months. They refuse to give me the money back! They haven't received it from the credit card company they erroneously sent it to so they won't pay me back. Do I have rights?
  17. Hello guys someone please help I took out a finance agreement in November 2014 I took my Ford Fiesta into a new ford company and I was 3 months into my contract with ford credit for my fiesta and wanted to come out of it and get into a focus they managed to get a settlement sorted and I got my focus however I have had a load of problems with the car since including two window regulators needing replacing and also something wrong with the suspension the works were carried out in the end after they tried to fob me off with temp repairs however the suspension problem came back less then a month after they said they had replaced the lower arms i took it through creation who asked auto Union finance to investigate I was then contacted by the main dealer I got the car from who told me they wouldn't cancel the contract like I had requested under the sales of goods act 1994 and they would only offer the repair the car I dug further and found out that I was on a personal loan and not a hire purchase agreement the word personal loan was never used by the dealership otherwise I would have gone elsewhere for a cheaper interest rate and I now notice on my agreement it said fixed sum loan agreement but not the words personal loan. I have since had the finance company arrange for a inspection of the car I'm waiting for a copy of this but the person said to me that it doesn't look like the arms have been replaced when it says on the paperwork from the works they carried out that they replaced them. Where do I stand in relation to the personal loan side of things and also my right to cancel the contract as am not happy with the goods supplied (under sale of goods act 1994) Regards Adam mcgoldrick
  18. Evening everybody - Happy new year I do not understand default dates very much but am under the belief an account will be defaulted around 3-6 months after last payment? I have just received a response from equifax about a dispute I raised because I believed the default date was wrong. The default on my equifax record from Creation finance is dated 11/2010 - the last payment to them (as confirmed) by their response is Jan 09. They have said that the information recorded is correct and that the 'charge off date' was 11/10. Is the charge off date the same as the default date? Are they allowed to wait 675 days from last payment to default an account? they have added AP markers up until May 2010 and then started the 6 month count until default. They have said that if I still dispute I need to send documents so they can investigate? What documents? I don't ever remember receiving a default notice - but by their own admissions they have said that they didn't default until a year and 10 months later. Can they default so long after last payment? What should I do next please Many thanks
  19. In short.... On or about October 2012 I purchased furniture on 0% finance to be paid for in 24 equal installments of £28 over a 2 year period. The first payment went out in Nov 2012 and there was no missed payments or indeed any issues until Feb/Mar 2014. In January 2014 I purchased through Currys, a Fridge Freezer and a Tumble Dryer (again on credit) to be paid back in 10 equal installments of £50.10. Due to some error my initial payment for the Fridge etc did not go out and I received a letter stating that I had missed a payment. I duly phoned the company paid the outstanding amount and set up a DD. It seems at this point, an error was made and changes were effected which led to the previously arranged £28 payment to start redirecting to the wrong account. The £28 payments continued to go out of my account every month, so understandably I was blissfully unaware that there was an issue. It seems that instead of clearing the furniture account, this money was now going into the Fridge account. As a result the Fridge finance was cleared in 7 months (instead of 10) and the other account was accumulating arrears. The company did not at any stage contact me via email, letter, phone, text or indeed any way at all, to advise me that there was a problem on my account. If they had, it would have been plain to see that a) I had been making the payments and b) that these payments had been posted to the wrong account. If the company did this or applied due diligence to their own accounts management, this problem would have been easily identified and rectified. I did not in fact find out that there was a problem until I was refused two credid card applications that I had made on line. At first I thought it was because I was 'too good' if this makes sense..... because I am the kind of person to actually pay off my Cr. cards in full to avoid interest... when I was refused the second time however, I became concerned so I obtained a credit report (at my own expense) and was horrified to see that not only did the report show me as being delinquent for 6 months, but I was now judge 'very poor'.,.. this has and will make it impossible for me to obtain any credit..... my credit reputation is now ruined, and it has been due, in its entirety to a completely avoidable error of the consumer finance company. As soon as I found out about this I contacted the company, explained what had happened and asked them to correct the accounts... reverse any referral charges and correct my credit file... Their response was completely unhelpful and unsympathetic... despite my attempts to explain what had happened they insisted that I now contact the collection agency because the account has now been passed to them. I am furious... no phonecalls, letters, emails... their error and now I have to contact these undesireable people to fight my corner and perhaps have them hunt me down for money that I have already paid? Can you please advise if I have a case, and how I might proceed with the matter. I have also lodged a complaint with the FS Ombudsman, but I am so upset at how their personnel have treated this situation that I am now inclined to want to go further.
  20. Well, I believe there maybe a few people in similar situations but I don't wish to intrude on other peoples threads. Where to start, well I hate them! I had a 3 years interest free loan agreement through Creation via Ultralase. I started travelling 6 months into the agreement but always made sure that I had sufficient funds in my account to meet the monthly payments. No problems for the first 2 years then it all came tumbling down..... 1 month (march 2013) I did not have sufficient funds to pay, I was unaware of this but kind of knew I was low in my account any way, so later in March I transferred over enough money to pay for the next months and shortly after that I transferred enough to pay for the next 4 to 5 months. It was not until I checked my online account a couple of months after to see if i need to put more money in my account that I noticed nothing had been withdrawn via DD. I tried to get hold of creation via phone which was hard in Australia, and also sent 3 emails to them before I finally got a response. The said they cancelled DD because of non payment for March. I explained why I never new about it and basically that does not matter and they told me that my payment to bring account out of arrears was £850 give or take. So basically it was £110 I pay and according to them it was 3 months missed payments, the march one and the following May and June so they are charging me £520 in penalty fees. The only reason I never paid may and June was because they cancelled the DD which I was unaware of, as I did have money in my account to pay for them. Now I have collection agencies knocking at my door and it has destroyed, what was, a perfect credit rating. I have tried to reason with creation but they say its in the hands of collection agencies and when i speak to the collection they say they cant sort that out, speak to creation. I dont mind paying a late payment fee for March but not what works out to be £170-180 for it and I certainly do not want to pay fines for non payment after they cancelled DD. Any help or advice for this very stressful situation would be amazing. thanks for reading, sorry its long and maybe confusing
  21. We decided to pay off the finance agreement with creation for goods bought at Currys. They gave us the settlement figure and then told us that they would be charging us £3 for using a Debit card. The settlement amount was almost £300! Should they be charging us the £3 considering that a Debit card was using and they charge 26% interest?
  22. Creation Financial Services - now with Akinika (before that was IQOR) Etam store card Not showing on Equifax file Balance £1468.04 I pay £3.94 I have original letter dated 19.12.07 when IQOR added an admin fee of £100 Letter dated 10.01.08 from IQOR states client have asked IQOR to “collect on their behalf” Akinika letter dated 23.12.13 is with reference to debt, "owed to Cabot Creation Financial Services" CCA requested 06.01.14. from Akinika, no reply r’cd to date. should I withhold payment until evidence r'cd
  23. Hi We owe £3000 to Creation Finance and had agreed to pay £50pm some 2 years ago, we have paid on time each month and were happy to continue for now... But We have received a letter form Lowell bluntly stating that that they have purchased the debt and we have to pay them. I cancelled the Direct Debit to Creation so that they didnt receive the money and awaited for Lowell to contact us with a 'welcome pack'(!!!) We have now received a letter form Clarity stating Failed payment notice! Can we continue to pay the £50 pm to Lowell as we did to creation or are we at the mercy of Lowell now?? Many thanks
  24. My first post here, so please bear with me... I have been out of work now for just over a year, when I had taken out my debts, I was in a well-paid job and could comfortably afford the repayments. My circumstances changed when I had to give up work and I was no longer able to afford my minimum payments - debts totalled 17k over 4 CCs and 1 loan. Contacted StepChange who helped me put together my I&E forms to send out and all but one accepted my token offer of £1 payment - Sygma (or Creation Finance). They have been a nightmare from day one - I've been harassed on the phone by them and had to send a letter asking them to remove my number under the DPA. Then they were wanting to know the details of what car my husband owned - when I explained to them that it was my sole debt and that I had taken out the CC before we even met, let alone got married, they weren't interested and accused me of being deliberately evasive. I used to call them up, but they were like attack dogs on the phone and one guy in particular called me a liar and said that my husband could probably cover my debts, but I was being deliberately unhelpful to them (his words were, 'some people genuinely need our help and some people just want to get out of paying their way ). He got really nasty, I had a good cry after I'd come off the phone and I'm not an overly emotional person. Fast forward to now, they are asking to see 3 months of wage slips (I don't work), 3 months of bank statements and any claims of benefits I receive. I told them that I have no wage slips, and any benefits we receive go into my husband's account as a joint claim (we only get child benefit and a small amount of CTC). As for the bank statements, I asked StepChange and they effectively told me to inform them to go whistle. Sygma replied today, saying that they need 3 months' worth of my bank statements, as well as 3 months' worth of my husband's bank statements, because that is where our benefit payments go. If I don't then they will continue to apply interest, default charges etc. to my account which will result in the balance increasing to unmanageable amounts and will be passed on to a DCA or followed up with court proceedings. If you've got this far, well done. Question is, what do I do next? There's about £25 in my bank account, but my husband has said that they'll see his bank statements over his dead body. I wouldn't mind if he was on a footballer's wage, but we're downsizing to a new house next month as we're just about breaking even each month where we are at the moment, so it's not like we have loads of spare cash between us. Any advice?
  25. I'm new to this site so please bare with me, hopefully I have posted in the right place. On Saturday 26 October I went to PC World/Curry's to purchase an Ipad and 3D TV on their buy now pay later scheme. I was told that as I was purchasing an apple product I could have the 12 months option. As I have used the scheme before with PC World and Creations I thought all would go through without a hitch. I was stunned when I was told that the application had been declined and was given a letter by the salesperson. I promptly telephoned Creation to be told by the person on the phone that it looked like all the information had been entered correctly and I must have been rejected because of something on my credit report and should contact Equifax. I knew that there was no problems with my credit report as my bank gives my access to ID Aware acts the same way as Equifax. I have a high credit score, which they say is in the top 20% of the country and everything on there says either settled or cleared. I registed with Equifax so I could see the information they were holding. Again I had a high credit score and everything they held said excellent or good. I spoke to Equifax who told me the problem must be with the lender. I have emailed Creation again who have told me that the rejection was because of their internal credit scoring, but they won't give me any information as to how they have reached the decision. I am at the stage now of wondering, does an application get rejected from an applicant who has no debt, has never been in arrears with anything, and has always cleared the amounts borrowed from Creation in the past well in advance of the 6 months period. Is it a false promise of buy now pay later, but make sure you don't pay by the due date so we can make some money out of you from charing interest fees? Has anyone else been in this situation and if so how did you resolve it? Can someone five me some advice as to how to get the the bottom of a matter that Creation just won't discuss. I thank you in advance.
