  1. Hi all I booked my car in a good few weeks ago for a new clutch (powershift), had been putting it off for a while and finally decided to bite the bullet. Got the quote which was just over 1k which I was happy with. the day came and Ford (evans halshaw) collected the car, and told me it would be a couple of days, so far so good. I get a call a few days later from the service manager who told me they'd replaced the clutch, and it turned out the new clutch was faulty...and it was the last one available in the UK atm and it could be another 3-4 weeks as it's on backorder. I have another car I can use so I kept my cool, and asked what they can offer to compensate for this, to which I was told there were no loan cars available for a month, and he would speak to Ford about reducing the cost of the work. He came back later and said they would reduce the price by £100! I am without a car until probably the end of June, with only a small discount offered. Additional point - the car is undrivable now as I assume they didn't want to spend 6 hours putting the old clutch back on Does anyone have any advice on what I should be asking for in this kind of situation? I can't help but feel I may have been kind on them when they called!
  2. My Ford Focus 2012 auto has just gone into fords after dangerously shuddering and changing gear. They have told me it has a leak and the clutch needs replacing £1200. I’ve read about lots of issues with this part due to faulty seals. My car has only done 53,000. It had a TCM update 2 years ago when it was shuddering mildly. Ford are saying it’s my problem and not covered under any recalls etc. Has anyone else managed to get ford to replace their clutch with no cost? I’m fuming with them oh and the part is not in stock and they don’t know when they can get it - tells me they are doing a lot of replacements!!
  3. I'm trying to help a friend whose clutch has failed or more likely burned out. Fiesta Zetec 1.4 petrol 2008. Can someone suggest the likely reasonable cost to replace the clutch at a local garage, not a Ford Dealership, including parts, labour and VAT. This will help decide if it's worth repairing or better to look for a new car and avoid the repair spending. Many thanks.

Purchased a clutch mail order on 11/5/2015, it had a 4yr 40,000 mile warranty. just over 2yrs and 20,000 miles the clutch was juddering violently in reverse and pulling away .they offer a no quibble guarantee for parts only so no claims for the labour charge. "parts will be replaced irrespective as to whether there is a fault or not. If you cannot be without your vehicle simply purchase a new replacement second item from us and we will refund you for the first item upon its return". sound really good customer service ! NOT. Sent it back on 26/7/2017 at a cost of £15 non re-fundable to them, no reply or refund for weeks called them, they said due to holidays and staff shortage a delay had occurred. on the 31st aug 2017 received letter saying "i refer to the above and to your returned goods for which you seek replacement, which I am unable to offer because your parts display no manufacturing defect, just fair wear and tear. Whats the point in having a four yr warrant if when you send it back they just refuse it as wear and tear. when the cluch was removed by a professional garage they said that the dmf bearing showing excessive play causing severe juddering going foreward or reverse. the offer a no quibble guarantee then take it back. I need to stop these people from robbing me can you help please.

Hi There I will need a new clutch please see the case below I purchased performance enhancing software for my car, this has now caused me to experience clutch slip when driving the dealer explained that the vehicle was experiencing to much power through the clutch, I went to this particular dealer for this software because they are the head office for the distributor network within the UK. I have spoken to other dealers within the network who agree that before they offer the software that I have on my car, they advise the customer that he will need a new clutch as part of the performance upgrade because of the power. I have never had any such advice from the guys at the head office informing me that I will need a new clutch consequently I am now suffering clutch slip which could have been easily avoided if they had given me the right advice to start with Please can somebody advise where I stand legally with regards to the above concern. the dealer has agreed to pay a full refund for the installation of the software but the software has now sadly caused damage to the clutch many many thanks
  6. hi all im after some advice. I purchased a clutch kit for my mondeo from a company called nationwide clutch at blackpool their ebay username is techniclutch. now the clutch was supplied with a 4 year 40000 mile warranty. however it managed to complete just over 18000 miles in around 20 months before it broke up (the center plate) the concentric bearing also fell apart. not wanting to have a poor quality clutch put back in my car I purchased a genuine clutch kit as I needed the car on the road. I sent back all the parts asking for a full refund as I had a garage fit the new clutch and also put a claim in for the labour cost. I got a letter back from the company saying all they will do is supply a center plate as the concentric bearing would not fall apart?????? no refund for labour costs as I did not give the company chance to sort it out??? like most people I need the car for work etc.. ...personally I think they are taking the mick bigtime.. ...do I have a case?
  7. Dear all, 31 days ago I purchased a Mini One Convertible with just 39,000 miles on the clock. Today (31 days after purchase, typically just outside the 30 day rejection window) the clutch has started slipping badly. I phoned the dealer who refused to accept any liability. I put pressure on them and they offered me £100 towards the cost of repairs (c. £400). I told them under the Sale of Goods Act 1979 the car was not of satisfactory quality and that, as this fault has developed inside 6 months, the burden of proof is on them to prove otherwise. I told them I would not hesitate to take them to a small claims court to recover my costs should I need to get this repaired privately. They then offered to repair the clutch themselves. The problem is the car is not drivable ( And I am worried they would try and bodge a repair) and their garage is 200 miles away from me. My interpretation of the Sale of Goods Act is that they are liable to come and collect the car or liable for the expenses of having it taken to their garage if they want to repair it themselves.. Is this true? If so I will insist on having the car repaired locally (unless they come and collect it), and if they do not pay the very reasonable bill I have been quoted I will take them to court. Please can someone kindly clarify if I am able to insist they collect the faulty car or fit the bill for have it taken back to their garage? Thanks so much in advance, Nicola
  8. I've just got off the phone from a solicitor's. They have re-iterated exactly what I have said above. Under section 23 subsection 2b the dealer is required to replace the clutch and bear and costs of doing so including the collection of the un-driveable vehicle. I have been advised to put this in writing to the dealer and give them one chance and once chance only to either come and collect the car and repair it, or agree to a local repair where I am. If they fail to do either of the above I will simply commence legal proceedings and I cannot see them having a leg to stand on. I suspect once I deliver an NIP on their doorstep they will cough up! "23Right to repair or replacementE+W+S+N.I. This section has no associated Explanatory Notes (1)This section applies if the consumer has the right to repair or replacement (see section 19(3) and (4)). (2)If the consumer requires the trader to repair or replace the goods, the trader must— (a)do so within a reasonable time and without significant inconvenience to the consumer, and (b)bear any necessary costs incurred in doing so (including in particular the cost of any labour, materials or postage)."

Hello, probably been asked 100s of times but what are the chances i can get the garage I bought the car from to replace a clutch kit in the following circumstances: Bought a Nissan almera £1495 from a garage 3/8/16. Car started over revving when accelerating in 3rd gear... 6/8/16. 3 days after purchase. Problem quickly worsened and had been over revving in 3rd to 5th constantly. Car has been checked today 22/8/16 , less than 3 weeks since bought, done less than 300 miles and needs a new clutch kit £305. The front brake is also stuck on and i'm waiting to hear how much to fix. To say the least it's extremely likely the clutch was already worn before purchase so the fault was pre existing but trade centre are not interested. When asked before purchase whether the car had had a recent service I was given a vague answer 'hmm I think so'. There are supposedly no MOT advisories and the car appeared fine so I went through with the purchase which I am now beginning to regret. I know the repair garage isn't making things up as I know them and dealt with them for a long time. Does anyone know how likely if I went to small claims court whether I could get the dealer to pay for the clutch...thanks
  10. I am at my wits end. The car is 2 years old and with 30000 miles on it but the car suddenly stopped 3 months ago with a faulty clutch. There are many identical incidences of this on the internet with this particular model. This situation is also an identical situation to that of 3 years ago with the same model of car with similar miles and age. In that incident Chevrolet took it upon themselves to reimburse over 1/2 when they were interested in my repeat business. On this recent occasion I paid for all of it up to £2500 as Chevrolet have pulled out of Europe and no one wants to know. Also, it is easy to blame the driver. HOWEVER, within 6 weeks it has happened again. No one wants to take responsibility. I do not know what to do. Please help
  11. Garage installed a new clutch plate BACKWARDS six months ago in my volvo which broke during a long drive away, que new repair needed plus lots of expenses. Shall I start with a notice before action, including copies of receipts etc? What is the garage liable for and what do I need to do? Thank you in advance.

Hi All First post, couldn't see an intro thread, so hello from Wiltshire Bought a car (SAAB 93) circa Feb 2014, dealer gave 12 month warranty with it, he is a decent guy, had a couple of issues, and he sorted them all no problem. One was the clutch started slipping @ 84k miles, i bought it @ 82k miles. Now it's slipping again @ 92k miles, and 13 months later Looking through the paperwork, it also had a new clutch @ 36k miles, so it now needs its 4th clutch in under 100k miles. He is basically refusing to acknowledge there is a fault with car, and i need it desperately for work, so have agreed to pay for the repairs, albeit @ £40 an hour labour instead of £55, and to pay cost for all parts. Do i have a leg to stand on, in so much there seems to have been a fault with car (forever) and certainly 8k miles on a clutch is ridiculous, he says it must be driver error, but i drive it normally, i'm 47 and have 3 kids not 19 So my questions are, do i suck it up, and forget, or take him small claims after the work is done? I need car now for work, so need the repair done urgently, Thanks in Advance Flux
  13. Friend of mine bought a second hand car from a dealer about 2 weeks ago. Today the clutch has failed and the RAC have said a new clutch is required. Dealer has been contacted and said it is nothing to do with him. Car is 10 yrs old with 95,000 on the clock. The price paid was about right for the car with that mileage. Are there any rights under SOGA or CPA. thanks
  14. I purchased a 19 month old Vauxhall Insignia in May 2014 from EMG in Ely. On the whole the car gave me excellent service, apart from a few niggles, which were rectified under the Vauxhall 3 year warranty. However, in September this year, I noticed that it was getting more & more difficult getting the car into gear. The car was just under 3 years old, and had covered 43,000 miles. I took the car into York, Ward & Rowlatt, in Wellingborough to have it looked at. After a test drive, they said that the clutch had failed & it would not be covered under the warranty, and would cost £982 to put right. I then phoned Vauxhall Customer Service, and was told that it COULD be covered under warranty, but only if the failure was deemed to be manufacture defect, and not wear & tear, and, I would have to agree to an inspection involving removal of the gearbox. This had to be done at a dealership, and if the findings concluded wear & tear, I would have to pay for the inspection, but it would be included in the repair if I paid up. Needless to say, they came back to me with "wear & tear". After several phone calls to Vauxhall, they said that they weren't interested. They would not even offer a good-will gesture. As far as I could see, the clutch was not worn due to bad driving, otherwise it would have been slipping, and I would have noticed a drop in fuel economy. Once in gear, the clutch was fine. Eventually I agreed to have the work done "under protest". I asked Vauxhall for a fault report on the original clutch, and also information on the expected life of the clutch. Originally they said that they would not have that information, but I pushed them, as I couldn't believe that a manufacturer would buy in parts for which they had no idea how long they would last. I was promised this information "no later than 16th October". It is now 18th October, and needless to say I am still waiting. Whilst I am not happy with Vauxhall, the people I have been speaking to have been courteous and as helpful as they could be within the company guidelines. I am a great believer that any problems I have with a company, it's not the fault of the person on the other end of the phone. There are numerous motoring forums on the www, and most seem to have disgruntled motorists posting complaints about Insignia clutches, some of which are after only a few thousand miles. This is quite clearly not an isolated problem, and it's about time Vauxhall got their act together and helped their (hopefully valued) customers.
  15. Hi everyone, my dad recently had a problem with his Toyota Urban Cruiser 4WD Diesel. The vehicle is four years old has been serviced all its life (He bought it from new) at a Toyota garage. The vehicle has only done just over 20K He has recently had problems getting the vehicle into gear so he took it to our local Wolverhampton Toyota Dealer Charles Clark Toyota. They diagnosed the problem to be the clutch. They quoted £1000 to replace the clutch (Original) or approx £800 for a none Toyota one I find this rather odd a Toyota dealer offering none Toyota parts. The clutch on the vehicle was previously replaced at about 10K due to a major problem with the vehicle apparently Toyota only cover the clutches for 2 year so my Dad had only done 10k miles on this one. This one was just over the 2 year mark. My dad mentioned that he was getting a bit tired of the vehicle to which the dealer suddenly stated that a Hybrid would be a good idea as no clutch. My Dad and myself find this attitude rather bad basically it was your car is buggered tell you what we can sell you a new Priusfor £22K. They introduced him to the sales manager gave some story about how parents have them and love them etc. To cut a long story short my Dad left it and contacted A1 Clutches in Wolverhampton. When he took it to A1 Clutches the said that it might be the clutch but it could be the flywheel this part would have been covered under the Toyota warranty. Unfortunately my dad went ahead with the repair and it did turn out to be the flywheel. He contacted Charles Clark who were basically not interested they said that they needed to do the work and replace it with a proper Toyota part apparently A1 did replace it with a clutch from the same manufacturer. They stated that the teeth were worn on the fly wheel. He went to A1 as they quoted £650 for the clutch. The repair has now cost him over £1k. My Dad has trouble walking a heart condition and is undergoing treatment for cancer at the moment his vehicle is absolutely vital to get him to the hospital hence his haste at getting the vehicle sorted out. I find Charles Clark Wolverhampton attitude to be disgusting, the vehicle obviously had serious design/manufacturing faults a clutch does not fail after 10k and a fly wheel after 20k. The vehicle has a dual Mass flywheel which causes real issues I believe. How can a Toyota dealer offer none Toyota parts on a vehicle that is still under a Toyota Warranty also??? There attitude by trying to wash their hands of the problem and sell my dad another vehicle is also very bad. Should we contact Toyota and state our displeasure with the dealer or just go for the dealer with the sale of good act? Thanks
  16. I took the car to the garage because it sounded rough. They kept it and looked at it and said it was the gearbox. Instead of taking 4 days as they said it would I didn't get it back for 4 weeks (I felt they were having problems with it). After driving it for a few of days I can feel the clutch peddle shuddering and making a slight noise and its hopped out of reverse gear twice. I looked at the invoice and it says at the bottom: Advisory: will need a new clutch and flywheel! Note: 1) the clutch was not shuddering or slipping out of gear before they changed the gearbox. There was nothing wrong with it. 2) they changed the clutch and flywheel 18 months ago so I wasn't surprised when they didn't say that needed changing too. 3) I know if the clutch and flywheel need changing as well as gearbox the garage should tell you this. 3) if Id have known it needed a clutch and flywheel as well as a gearbox I may very well have decided to scrap the car and use the £1000+ to get a new one. Before I go and see them and they start fobbing me off what are my rights on this?
  17. The clutch pedal went without warning on my 2004 Mondeo. I called the AA, they sent a very helpful mechanic who, after trying the clutch, confirmed it had gone and needed to go to a garage. He towed me to Mr Clutch, gave them my details and collected a courtesy car. When the garage phoned me they said the Duel Mass Flywheel had gone, this had damaged the slave cylinder and soaked the clutch plate with oil. Mr Clutch then told me they had been in contact with the AA and had been told this was wear and tear so would not be covering this under my breakdown cover. I was, to say the least, baffled by the decision of the AA, as to how they can make this assumption without seeing the faulty parts. I asked the garage to strip down the flywheel to see if the springs were intact but on inspection the spring was found to have broken, which is failure not wear and tear. I asked the AA to send out an engineer to inspect the broken item which they did, but still came to the same conclusion. I then went through the complaints procedure, and have just heard back to say they think it is down to wear and tear. To my mind if a clutch goes all of a sudden and is due to the springs in the Duel Mass Flywheel breaking causing the slave cylinder to break up and soaking the clutch plate with oil, this is breakage, not wear and tear. I do not know where to go from here, I still have the clutch parts. Any suggestions?
  18. hi my car which is a hyundia i30, 09 plate went in for a service to a local garage where it had a service and a new clutch,everything was fine for about 6months then we started to get a whirring noise every time we pressed the clutch down plus loss of power.so we took it back and it was the clutch again being worn out and this was replaced. then a few days ago while the wife was driving the car it just came to a halt at the traffic lights she couldent get it in gear or start it,so the AA towed us to a garage so they could take a look but before i let them i checked to see if we were still under warrenty and the car was so i decided to take it to an hyundia garage as it minght have been a problem which was covered under warrenty. Anyway after stripping it down they told me it was the clutch again it had wore out,i couldent belive it!! they say theres no way we should be going through clutches like this its impossible.the wife travels to work and back from mansfield to nottingham which is proberbly 20miles each way and she is a steady driver. So ive got the clutch and im going to take it back to the garage which fitted it,but ive a feeling they are just going to wriggle out of it and i just want to know where i stand with this problem,i want my money back am i entitalled. thanks
  19. Hi there, I am after a bit of advice with regards to a Ford Focus I bought from a trade seller 10 days ago. Yesterday the clutch started slipping, I have hardly used the car since purchasing it and I was wondering if I have any rights with regards to getting the dealer to repair the problem? I have been on Citizen's Advice and seen the law under the Sale of Goods Act 1979 but I am not sure if this applies to me? I have 12 months warranty but as it's probably wear and tear I can't imagine the warranty paying out? I spent £4k on this car only 10 days ago so I really can't afford paying out £400+ to get it repaired. I have been told that clutch problems are hard to spot before they arise but I would like to know if I have a leg to stand on with getting the garage to help? Many thanks, Alex

  22. Hi, need some advice. My vehicle had it's clutch replaced for the first time one year ago after probably about 85k miles at the same time it was MOT'd. In the last week vibration had started and a noise when the clutch was depressed. Took it back to the garage and they said it sounded like the flywheel. They've now taken it apart and the flywheel is down to it's mounting bolts apparently and so needs replacing, but with the 'bits' whirling around damage has been caused to the new clutch causing 'adnormal' wear. The MOT expires on 5th March so the clutch was replaced within the last year (just). I'm being asked to pay for yet another clutch, which isn't cheap. Is this just hard luck or should the flywheel have been replaced/had more attention paid to it at the time? It's a 2006+ Ford Ranger 4x4, one of the first of the new ones so it had a new engine but I think an older clutch or gearbox.
  23. Hi Guys, I am part way through a small claims for a car I bought last year from a private seller. The car was advertised as 'in excellent' condition in an ebay advert and I bought it but after the ebay listing had finished so was not entitled to any buyers protection. Anyway I paid in cash for it without test driving it and discovered that the clutch was blown as on the way home I couldn't get about 2krpm without extreme slippage and burning. i complained within a few hours to the seller asking for 50% contribution towards a new clutch or returning it and offering her to keep £100 fo the cost. It was a Toyota Celica 1997 and I paid £450. Anyway after getting it repaired, without using it for 3 months due to not affording the repair. I made a small claims and the defendant didn't reply to the papers within 2 weeks so asked for a default judgement which I was awarded. they challenged this and the judgement was 'set aside' two weeks ago. Now I'm back to square one. My question is shall I on my allocation questionnaire express an interest in 'mediation' or just proceed to the court hearing?? Has anyone any knowledge/experience of the mediation process?? I didn't pursue this originally because they didn't want any contact with me or they'd report me to the cops!! Thanks for any help
  24. I have just taken my car into Richmond Hyundai Portsmouth to have it checked as the clutch had FAILED. The car has covered 18,000 miles, is in daily gentle use and has NEVER shown the slightest sign of clutch wear whatsoever, no slipping clutch, no change in clutch pedal travel, no baulking gear changes, nothing. The car has FHSH and had just been into Richmond Hyundai Portsmouth, for a full service not 6 weeks and less than 1000 miles before and there was no mention of clutch issues, because there weren't any. The service manager at Richmond, then told me that the reason the clutch wouldn't engage was that the clutch had "welded" itself to the pressure plate with rust, and asked whether the car had been left for several weeks parked in a flood! Of course I explained that it had never been parked in a flood and the car is in daily use, which I can happily prove with our CCTV. He then asked me whether the car had been driven through any water? Well, as I live in the UK which has just had the wettest April for 100 years, I would have to admit that yes, it has been driven through puddles. This apparently, may be the cause!!!! I may not be an automotive engineer but, in my humble opinion if the Hyundai i30 is supposed to be driven only in dry conditions, then I would suggest that it should only be sold in particularly arid countries and certainly not in the UK which is quite prone to rain. Richmond Hyundai told me that this is not going to be covered by warranty as the clutch is showing wear and therefore cannot be a warranty claim. The clutch is showing wear? I'm sure all clutches that have been installed in a car will show wear if the car has been used at all, it is a part that is designed to wear. This is nothing to do with clutch wear, it is to do with the clutch FAILING due to a design fault or manufacturing defect, or is it normal for the clutch to “weld” itself to the pressure plate with rust? So, Richmond Hyundai want me to pay £630.00 to repair this failure, which I absolutely refuse to do. They asked me to authorise them to put the car back together, so that this cost can then be fully incurred. I will not. If this is how they treat customers, when their clutch fails due to being rusted to the pressure plate, even though it is only 3 years old, done 18,000 miles, is in daily use and has never been in a flood, then I will be obliged to take whatever action necessary to get this resolved satisfactorily and to inform other Hyundai customers and potential customers of A. this "dry use only" clutch problem and B. The way Richmond Hyundai and Hyundai UK deal with issues like this. I will also take this to the Trading Standards and if necessary to court as I absolutely refuse, on principal, to pay for what is obviously either a design fault, manufacturing defect or downright shoddy manufacturing or materials. I have spoken to Hyundai UK’s customer care department and after speaking to Richmond Hyundai Portsmouth, they have also refused a warranty claim.
  25. On the 28th of October I bought my daughter a second hand Suzuki Swift which was immaculate and came with a 3-month warranty. I have since found out that the garage offers the warranty - not with a recognised Insurance company.The car had done 69000 miles with full service history. After 1000 miles the clutch has started to slip badly. I contacted the garage and they told me they would not repair it as it is normal wear and tear. I therefore contacted them again and asked that the clutch be repaired under the 'sale of goods act. This is the letter I sent to them: 29/11/2012 Dear Sir. On the18.10/2012 we travelled down to Blackburn to purchase a Suzuki Swift from youas a present for our daughter. We have a receipt stating that there is a3-month warranty on the vehicle. To date,with the mileage at 71000 the clutch has failed. We have only driven the carfor just over 1000 miles I havecontacted you today with regard to a claim on the warranty, and have been toldthat the clutch is not covered, therefore, I do not wish to make a claim under your warranty for the clutchfailure, I wish to make a claim for the repair of the clutch under ‘The Sale ofGoods Act’ The Sale ofGoods Act states that if a failure occurs within 6-months of purchase, then thefault was there when the item was purchased from you. Therefore, Iask that a decision is made within 7-days that you either, repair, replace, orrefund the monies paid to you. I enclose aquotation from a small local garage (rather than a main dealer which would betoo expensive) for the cost of the repairs. If youdecide to repair the item yourself then you would have to make arrangements torecover the vehicle. As a gestureof goodwill I would be willing to pay £50.00p towards the repairs. I hope thatwe can come to an amicable agreement, but I expect an answer within 7-days. YoursSincerely. This is the reply we had from them: I am saddened to read your letter given that I am trying to help you, the sale of goods act states that faults that occur within the first 6 months of sale must be proved by the supplier not to be evident at the point of sale, given that you collected the vehicle from Blackburn and drove it back to Anglesey and have since been driving around in the vehicle since the 18th of October it seems reasonable and just to suggest that the clutch was in good working order at the point of sale and legally speaking this would be sufficient, however not withstanding this point I am trying to be reasonable and fair with you and your daughter and having met you and you myself thought that I could have arranged the repair to our mutual satisfaction, I have just called the first parts supplier in the local directory up and asked them for a price on the part only, they quoted £49.10 plus Vat compared to the price you have quoted me of £145.15 plus Vat, a large difference I am sure you will agree, my local garage have Quoted me £50 plus Vat to fit a total cost to me of £99.10 plus Vat compared to your quote of £285.15 plus Vat, a huge difference I am sure you can appreciate. Given the above information and the fact that I try to be more than amicable and pretty flexible with my valued customers I will offer to replace the clutch at my local repairer and ask that you call to make those arrangements with myself even though the part is diminished through fair wear and tear for a vehicle of this age and mileage and not an actual mechanical failure. If you still feel that this is not acceptable I can only advise that you speak with the OFT trading standards. The problem is is that I cannot get the car to them to have the repairs carried out, without it costing me a great deal of money (a recovery company quoted £300 !!) I have been told that under the sale of goods act in trying to get the repairs done I should not be out of pocket - Can someone advise me please? Many Thanks
