  1. Hi all, Looking for some advice - I've been reading through and there's lot of great advice here on the forum and I've kind of used some already but messed up in places to give the gym more than I should - so here's the story. My wife and I are a member of the Sweat Union gym in Chelmsford, we are both on rolling monthly contracts. On 22nd August 2018 we both sent them an email saying we would like to cancel our memberships and she subsequently cancelled the DD (2 x 21.99 as she paid for both of ours). We were then informed the next day that you had to cancel prior to the 15th of the month so we would have the pay the September gym fees. We were willing to pay and she called them to say the DD has been cancelled and they said this means we would need to pay the £21.99 for Sept and both incur a £15 admin fee because of the DD. She called the bank to try and reinstate it but they said Sweat would have to do it and they didn't seem willing. The payment wasn't due until the 31/08 so we emailed and said we'll pay the outstanding £21.99 each but don't agree with the fee, the email was ignored. I ended up looking at my account on the site and could see the balance due (£21.99) and the option to pay online so we went ahead and both paid the September balance on the 29th August (before the due date). I then emailed Sweat to say the balance was paid prior to the deadline and I assume this clears the matter, that the admin fee will be removed and that we can still use the gym through Sept as we are paid up. They emailed back to say no, we have to pay the £15 fee each, we cannot use the gym unless this is paid and on top of this, we cannot cancel our memberships with outstanding arrears on our accounts. Now this is really galling - I know £15 is not a lot but I don't want to pay it out of principal. The gym have acknowledged we would like to cancel but refuse to let us do so without paying the £15 fee. They say that if we don't pay the £15 our accounts will be passed onto a third party finance agency. Reading other threads, it seems like they don't have any legal right for the £15 fee Should I do anything else at this point or just ignore going forward? Any advice is greatly appreciated.

  4. I was left with no option by my bank RBS but to submit a complaint to the Financial Ombudsman in my dispute with them. The dispute relates to Personal Guarantees for my former business which ceased trading last year and is now formally dissolved. The Adjudicator is claiming they can't consider the case as I am neither a 'consumer' as the finance is considered to have been 'acting for purposes within my trade, business, craft or profession.' nor a 'micro enterprise' as the business 'isn't capable of being represented and it can't raise a complaint'. They've used a court case BlueFin v Ombudsman to support their position with regards to my not being a consumer. So, despite having been a victim of extremely poor practice by RBS I am caught out by this Catch 22. Anyone had a similar experience or can provide any pointers on how I could challenge their response?
  5. Hello, This morning I drove to Totnes station to get the 10:19am train to London for a few days. I had checked on Saturday that there is long-stay parking in the APCOA parking at the station and the machines do long-stay tickets and offer the option to buy tickets in advance. So you would think if you can buy a ticket in advance there would be enough space. However there were no spaces except one in the parking allocated for maximum 1 hour stay. As far as I am aware there is no other long-stay parking in Totnes and with panicking about what to do with only a few minutes before the train I parked in the 1-hour area, ran over the bridge to buy a ticket for 4 days and ran back over to display the ticket and catch my train. Otherwise I would lose an expensive train fare. Maybe I was foolish to e-mail APCOA explaining the situation and wanting assurance they would not capitalise and they replied: Good morning, Thank you for your email. Is it possible to advise us of your vehicle registration number and for your arrival and departure dates and we can log this on our system? Unfortunately we cannot prevent a parking charge notice from being issued, however we can give you a reference number for you to appeal against should you be issued one. Kind regards, APCOA Parking (UK) I didn't send them my registration number (which I don't remember anyway since I just passed my driving test) but said I would be seeking legal advice. I believe they will try to get £100 profit from me for having to use the last available space. I do not know if they use wheel clamps. It is patently ridiculous to a. offer advance parking payment in a car park that was full the first time I used it and without reserving spaces b. to claim they cannot prevent a parking charge from being issued since it is they who are issuing it. Any advice on what to do in this case would be welcome. Please advise on what I should do! Thanks!

  7. Hello. Heres the quick version: Can I claim housing benefit for rent that I have already paid for? And some more detail. . . . I am claiming sickness benefit and DLA, this makes it almost impossible to rent accommodation through letting agencies, in fact as I dont have a guarantor that earns three time the rent of the properties I am after (a1bed flat) my only option given to me is to rent as a student as I will be studying in september, doing this means I can pay by the term, so I will have to pay three months upfront at a time. Sadly my sickness benefits and DLA claims are taking many months to process, the good news is that I should get a large back payment, its this payment that I hope to use to pay my terms rent, the question is can I claim housing benefit for these three months and keep this thing rolling? The tenancy agreement which I hand to housing benefit will clearly state that the rent has been paid for three months in advance. My worry is that without the three months housing benefit which I need to claim successfully, I wont be able to pay for my next term and will be kicked out before I can do anything about it. The catch 22 here is that landlords nearly always insist on the rent being paid up front, housing benefit on the other hand will only pay for a backdated period, ie after one month has passed they will pay for that previous month, not in advance as the landlords and I would like, so I am always going to have to be claiming for a rental period that I have already paid for, is this right? or even illegal, housing benefit is there for people who can not pay their rent which in all honesty I cant, what will they say when they see that I have? Yours Coda.

  9. A major study by consumer group Which? found that Tuesdays are the cheapest day of the week to fly out of Britain, and travelling midweek can save people a significant sum of money. For outbound flights Tuesday was, on average, the cheapest day to fly with the three biggest airlines in the UK. Flights with EasyJet from London Gatwick to Alicante on a Friday were, on average, 35 per cent or £28 more expensive than a Tuesday. Which? found flying on a Sunday was, on average, the most expensive day to return home. Return flights with EasyJet from London Gatwick to Alicante on Sundays were, on average, 45 per cent or £56 more expensive than Thursdays. The study also revealed that as well as cheaper days, there were cheaper times of the day to fly, though this varied across different airlines. BA's cheapest outbound flights were before 7.30am in the morning. However, outbound flights with EasyJet between 5.45am and 11am in the mornings were their most expensive. http://www.telegraph.co.uk/news/aviation/9501573/Flying-Its-cheapest-to-catch-a-plane-on-a-Tuesday.html#
