  1. I have received a Claim form from Reston Solicitors representing ARROW Global, who has bought the debt from HSBC. This debt goes back to a loan I had with HSBC which was taken out sometime in 2010 , but I stopped making payments on it in 2012 when I became unemployed. Since then, ARROW have been contacting me but I have not responded. I do not know if a default notice was issued since I have been ignoring all debts except priority debts since 2014 when I started working again. I am now in full time employment, have a spouse who unfortunately is not working, and two children. Only mentioning this as background info. My question: Is it possible to avoid a CCJ if I call Reston Solicitors and agree to a feasible payment plan? Or is the CCJ inevitable now that the claim form has been issued? P.S.: I have called STEPCHANGE.
  2. I am a light sleeper and have been using ear plugs to bed for quite some time. 2 weeks ago, my boyfriend picked up some of Superdrugs own-brand earplugs, which are like a soft silicone putty. He wore a pair to a concert and gave me the remaining two pairs to use. Despite the box saying they are suitable for sleeping in, after the third night of wearing them, I found that I couldn't remove one of them. It turns out that the squishy silicone softened so much with my body heat that it slipped down into my ear canal, and adhered to my ear drum. It is nigh on impossible to get rid of due to its texture - it is soft and sticky and firmly attached to the inside of my ear. I have been in and out of hospital seeing specialist ear doctors for the past week, have had time off work and have been in constant pain for 8 days now. I am due to have a procedure under general anesthetic with the very real possibility that it will cause permanent damage to my ear drum - that is if it is not already damaged (they're not sure, they can't see the drum at the moment as it's covered in a layer of silicone). My question is, is there any action I can take against Superdrug? This is clearly a product that is not fit for purpose. The product was used exactly how the box directed and was not forced down into the ear in any way. From no fault of my own, I have lost earnings, am suffering daily and potentially will have to deal with damaged hearing for the rest of my life. How would I go about seeking compensation for this disaster? (Please move if not in correct forum, wasn't sure where to post)
  3. Hi Everyone, Tricky situation, but I'm hoping for some guidance, found a few bits of info on here. Unfortunately my father passed away last summer. I am joint executor (with my sister who lives overseas). Here's the background but unfortunately I don't have much paperwork - He had a small bungalow worth £225k but also a £162,500 mortgage. This was sold by GE money to him, aged 70, for 14 years (In 2004) - interest only. He wasn't great with money(his whole life tbh) and soon fell into arrears. In 2006 it was sold on to Engage Credit. We are about to finally complete on the sale, and once all his other debts are cleared there's not going to be much left. We have managed to get Engage to refund £320 in fees. We're trying to establish when GE sold it on. Engage say most of the fees were GE money. There are £3554.30 in fees, plus £2703.72 in arrears. I do have comprehensive list of the fees/arrears dating back to 2006, but its hard to see who charged what, and when it was transferred. I'm so angry with companies like these who mis sell to elderly people who clearly can't afford the repayments, and my Dad was v clever hiding the full extent of the debt from us. My questions are: 1 - Can I do anything as an Executor as the whole thing is so unfair? 2 - Why the mortgage for such a large amount was sold to a 70Yr old - as the house can't have been worth anywhere near that in 2004 - I think it must have been mis sold (He only had a state pension) 3 - How can I trace who sold the mortgage? Can I report them to the FCA?[/left] 4 - Can I claim back fees retrospectively from GE Money (I've read the 2010 ruling on here) or doesn't it apply if the mortgage holder is no longer alive?   4. Hi, I had a van through Moneybarn which they repossessed in Aug 16 and sold it at a loss and now are wanting £6403 out of me. What options have I got to get them to play ball nicely? I know they had what I borrowed back plus about 2.5k in payments etc in my mind they had the initial loan back. There is a big fat default on my credit file that I would like sorted as trying to get car finance is an issue currently. thanks
  5. Hi Guys, I hope all is well. I have been trying to regsiter for a gas supplier. I have called around all the big suppliers and was told that they didn't supply my property as there was no meter point reference number. Having done some research online I discovered I could all XOSERVE to find out my MPRN so I could regsiter for a gas supplier. XOSERVE have said that due to an admin error from the previous supplier to my flat that I was not registered on their system and to contact any of the energy suppliers and sign up with them which didn't help at all. I have gone back to all the big energy suppliers explaining the circumstances and non of them seem to understand and they have all said again they can't supply my propery because I dont have a MPRN!!! I would be very grateful if anybody who has dealt with this situation before could give me some advice on how I get a MPRN in order to sign up with an energy supplier?   7. I'm about to buy a (relatively) low cost item from a small-time online manufacturer who usually sell in large quantities to tradesmen. They have applied a 'low order fee' to make my order up to £50. Are they allowed to do that? (I suspect yes). I noticed in the Shopping Basket breakdown that VAT then also got applied to this fee - are they allowed to do that? Thanks.
  8. Hi, I received a Parking Charge Notice for parking in a place I thought would be fine to park in. I have a PCN for £60 rising to £100 that I just can't afford to pay. Things are so tight i'm afraid that this might take me over the edge. Is there ANYONE that can help me?   9. Hi Guys, I am currently on long term sick and I am in receipt of ESA. I had to fight a DWP tribunal last year and thankfully won it. I am therefore in the support group and received council tax reduction. However, as I had to move recently and although I notified DWP there has been a gap with registering for council tax reduction. Now the council want the full amount for the last 3 months and I do not have the £600 they are demanding. I have been warned by the council to expect a summons. I am very worried. What can they do? I have told them my financial reason but they won't stop the process. Is there anything at all I can do? I do not really want to have to go to the Magistrates Court and plead my case, but of course if I have to do that then I will. If I have to go to court can someone please tell me what to expect and how best to respond in court? Any help would be greatly appreciated. Jake

Took a loan out 9 years ago with welcome finance for £2000 got into difficulty paying it back so stopped payments, now 9 years on and 6 addresses later ive just had a letter at my current address from my local county court summon to appear before a court sheriff and demanding me to take a million documents, of which some i just cant get, its impossible. Now i have been in touch with step change debt charity regarding my debts and at present my outgoings are £230 a month more than my incoming and this is on basic living, i cant cut back anywhere. Stepchange also told me that a CCJ was issued against me from Welcome finance in january 2013 and this local county court letter summons was to see if i could pay it all back, but obviously i cant. What worries me more is the list of documents the county court has asked to see, its huge, and half of it i dont have access too, and the other half ive probably thrown away throughout the years. Really nervous what to expect to happen at county court. At the time i took the loan with best intentions, It was a unsecured loan, but when i got in to difficulty i done the cut and run, and 9 years later i have a county court appearance to look forward too, great.
  11. Please could you help? It would appear that my partner's historic debts have been sold off as this is the second issue in as many months... On 28th December we received a Final Demand from Moriarty Law for an alleged debt to Sky for approximately £200. This was the first letter we had received. On 2nd January we sent the SAR and £1 as recommended by CAG. Today we have received a letter stating the following: Please be advised , we are unable to supply copy bills or statements of account. To obtain these you will need to log into the Sky portal using your Sky ID for online services. With regard to your request for a copy of the credit agreement relating to this claim, we can confirm that this debt is for services provided by Sky and not for credit and the Consumer Credit Act 1974 does therefore not apply. Consequently, please find enclosed a refund cheque for £1.... Can they request money with no proof and have we sent the wrong letter in the first place?? Any help would be gratefully appreciated as I'm not sure how to respond. Many thanks for your time JT
  12. Just by way of a change on this forum I thought it would be fair to point out when a company gets it right. Put in a claim for delayed flights at around 11pm six days post journey and by mid afternoon the next day the airline came back saying they had investigated, the flight was delayed by 3 hours 12 minutes due to operational reasons, this was within their control and considered non-extraordinary circumstances under EU law and they would be paying £440.26 (£220.13 per person) into the bank account of the details you gave within the next 14 days. They've also agreed to an extra £6+ for extra expenses because the vouchers they gave out weren't adequate. This isn't a prestigious airline with expensive ticketing. It's Easyjet and it was a short hop costing approx £60 per ticket. I think they deserve a public pat on the back. Yes, they should all get it right all the time but they don't. This lot did this time.
  13. Ok heres the deal. I signed up for a 3 month virgin active membership back around july, after one months use I wanted to cancel, they wouldnt agree and the idiot manager would not even agree to simply talk with me. I didn't use the gym in the last two months but they don't care and the contract doesn't of course. Arc debt collection has been dealing with me, I owed around £170 or something in total ive already paid £90 worth, maybe that was the wrong decision but I do not want to pay them the remainder. I've set loads of dates to pay and many I have not paid and we just rearrange one guy called saying the solicitors will get involved and court action if I do not pay, I do not want to pay them and i did not pay a payment recently. No doubt they will call me saying solicitor or court action will be taken. What should I do??? I know I should have came to this forum earlier. I do not want to pay these morons or go to court and be forced to pay this little amount and travel there since its out of london etc. ????
  14. How much rent can you afford? An interesting article with links to government and local authority calculators. It points out that you need to consider far more than just any fees and the rent itself, but all other utility bills, council tax, water bills and in some cases, service charges.

  17. OFCOM have upheld a case against Channel 5 regarding the TV series Can't pay, we'll take it away. This case starts at page 41 of the OFCOM bulletin http://tinyurl.com/ycwlnaev In this case it would appear that although consent was given, OFCOM found that there was no 'Informed Consent' meaning that the complainant had not been given sufficient information to make a concious decision.

  19. A relative's carer helped themselves to her bank account. This was discovered by the executor who stopped looking back through the bank account when the amount topped £11k in the five months prior to her death and handed the matter to the police. It is going to court and there's little doubt there will be a conviction. It will however be for considerably less than the amount taken because the criminal case is sensibly concentrating on those withdrawals and purchases which can be proved without any doubt. The direct victim was the now deceased relative and if she was still alive she could sue the thief. Can executor or beneficiaries?
  20. Hi, I have just received a letter from a debt company that I haven't used for over 15 years. The letter says data protection laws have changed. This means thy need to provide me with an updated explanation of how they use my personal data. I do not want then to use my personal data. Do I ignore the letter? Thanks in advance.
  21. Hello I wonder if you can advise me. My son has had a loan from Money barn. He picked the car up and its been one problem after another with the car. He has phoned moneybarn to tell them, and they say they have opened a case but he should take it up with the garage. It is 14 days on Wednesday so does he still have time to cancel the loan and if he does should he send an email as well as phone them, he wouldnt have time to send a letter would he? Thank you for any help you can give.
  22. This is the second case from the OFCOM bulletin and starts at page 78 http://tinyurl.com/ycwlnaev This case is (in my opinion) more serious than case 1 in that NO consent was obtained. Also it has disclosed that the Body Worn Cameras transmitted live audio/video to the film crew. The BWC were supplied by the production company so all copyright material belonged to Channel 5 rather than DCBL.
  23. For the last 2yrs I have been kept going in circles by the NHS, I've seen 4 consultants, been passed through 3 different districts and all of them have said the same thing... I need surgery. I have a problem that needs correcting, but there is another problem getting in the way of them being able to do that surgery. They CANNOT carry out the needed procedure until the secondary issue is resolved... I have been repeatedly fobbed off and passed around without anyone taking responsibility for it. Then after almost 2yrs it got bumped back to my doctors to apply for funding for the secondary procedure. That has now been refused. To put it as bluntly as possible... I am barely hanging on by a thread here...I have zero chance of a normal life ever again... and it's not an overly complicated or expensive procedure. My doctors have letters from all of these consultants spelling out what needs doing, and the effect it is having on my mental health... I have asked for copies of all letters sent/received regarding this funding and have nothing. This was my last hope... and they're saying my life isn't worth anything, that I don't deserve any possibility of a normal life... let alone a fulfilling one. I don't know where to turn.... I have no one, and no idea what to do... I'm scared of what may happen to me.

Hi everyone,This is my first time on this topic .I am currently paying off two loans on reduced payments, one with Welcome which is almost finished and one with Norwich Union which is halfway through. The Welcome document shows an optional payment protection insurance for £344 and healthcare for £170.The Norwich Union shows an item for Norwich Union Creditcare Gold for £369.Would I have case to reclaim these charges.Both date back to 2001.
  25. Hello, I have written before on this forum concerning my mental illness and the debt, successfully writing off debt from MBNA. I had a mental breakdown in 2005 and a relapse in 2015 when I fell again into a deep depression. For people who do not suffer with mental health issues, it is hard to explain how things effect you. It’s not I am another person but, I can appear changed and not myself. When I am suffering these episodes my moral compass, well it isn’t there I basically am an ar*e I care not a jot and do things I know can be destructive. I have had great help from social services to help me cope and as I said in a previous post, https://www.consumeractiongroup.co.uk/forum/showthread.php?489343-tesco-credit-card-amp-freds&p=5142374#post5142374 I do have outstanding debts with Tesco Credit card £7700 owing, still haven’t heard anything from Frederickson or Tesco for an age. PayPal credit card £2200 sent me an email, I have attached that email. This is the first I have heard from them. I noticed I still had a direct debit set up for Tesco I have no idea what it was for so the bank recommended to cancel it, so I did. It was over a month when I got a phone call from Tesco, saying I was default on my loan, what loan, I had no idea. The person asked me several security questions that I couldn’t answer all of them, then they finished the call stating they wanted there payment. I have searched high and low to find out what the loan was but I have no paperwork at all. I vaguely remember clicking on a link on an online statement from Tesco about something. Now I still get monthly statement emails from Tesco but cannot access the account on line. Looking at my credit report I can see a loan over 5 years that I had paid for 3 years and a part account number. I have written to Tesco with the part account number as well as my old credit card number explaining my situation. Since the letter I have had 3 calls a day all blocked, I told them in my letter do not call as I can be very offensive so I don’t answer to any one I don’t know, the phone is there for me to get in touch with my doctors. I have no paperwork for Tesco, I have asked for my information by post and still nothing, when can I say this is getting to be harassment? Your help as always is appreciated edit paypal 1.pdf
