  1. Hi all, I was hoping one of you good people could help. My Dad has received a letter from Chester County Court with part of it hand written stating that a warrant has been issued for collection of a debt. He advised me that this is from around 10 yrs ago and not paid a thing since. Am I correct in thinking this is statute barred? The letter looks a little dodgy to me, almost as if Arrow are trying to scare him into paying. It mentions a warrant has been issued, but no copy of the warrant was enclosed, also there is no date to pay by before the bailiffs visit. I believe a CCJ was issued many years ago. The envelope used also looks like it could have been reused. I have attached the letter and envelope below. This is all that was enclosed with the letter which arrived Friday. Envelope: Letter: If someone could look at this for us that would be hugely appreciated, I have asked my Dad to pop to Citizens advice too. Kind Regards, M

Hi Caggers Just a quickie, I have a debt of £156 that I honestly forgot about when I lived in Devon, Last saturday I was out working and a bailiff came to my door and spoke with my misses, she didnt let him in, but he handed her a letter just staing that there is a liability/warrant order and would like to come back when I am present to discuss a payment plan. I do owe the debt and I almost know my rights. But my question is when i arrange for him to come back do I have to let him in to arrange a payment plan? or can I do it on my doorstep? I dont want to let him in for many reasons I'm sure you all are aweare of the obvious ones. But mainly my misses suffers from anxioty and I have 3 children. Quick response will be appreciated

Hi all, I've been reading posts on this forum for a few months now and the advice and help given to people who are having problems with finances which are made a lot worse by bailiff fee's being lumped on top of debts they already struggle to pay is brilliant. Keep up the good work. I am currently having a few debt problems of my own, being self employed I think it goes with the job!. Lately I seem to be just working to pay bills. My first request for advice is not an urgent one as I paid the amount demanded before I found this forum It was a few months ago I was off work ill for almost 2 months so had fallen behind with a few bills, one of which was my council tax, I owed £121 in council tax, before I got chance to earn the money to pay it I received a hand delivered letter from a company called Jacobs at 7am one morning, he didn't knock on the door as my two dogs would have let us know, In massive red numbers £375.00 in 48hrs or we'll return to remove goods to the value!. Not knowing any different I phoned the number and paid it!, by debit card, a few days later I noticed on my internet banking that they had put £24.50 back into my account. My car and work van were both parked outside when he posted the letter, the van having my name on the side, My question is can they really charge more than £250 to drop off one letter?.   4. Hello Can anyone advise . I am trying to help a friend. Its regarding an old fine at a midlands magistrates court that has just shown up out of the blue A bailiff turned up this morning with a distress warrant for an old fine of approx £600 plus £ 300 charges that are not detailed. The bailiff says he will not discuss the matter and will turn up in the morning with the police and a locksmith to enforce the warrant. I have phoned him on my friends behalf to try to make an offer of payment but he was not interested at all. My friend lives with a partner in a rented house [ partner only is the tenant ] and has very few worldly goods and no vehicle of his own. The bailliff stated to me that he is an ' enforcement bailiff' subcontracted to Marstons. That I would not be able to phone Marstons and that they would just refer me back to himself. I explained my friends circumstances and said could an arrangement to pay be made. He said no only full payment because ' its gone past the stage where arrangements can be made' I have checked on the Bailliffs register and cant find the name on his card. Please can anyone help. I think he wants to attend and try to enforce even though the circumstances have been explained just so he can add more charges. What can my friend do ?
  5. Hello, I am new to the forum and I'm hoping to get some advice from you good people out there! I have had a hand delivered letter from a bailiff stating that the have called to execute a warrant issued by Northampton COunty Court They claim to be authorized by a court under the enforcement of road traffic debts (certified bailiffs) Regulations 1993 (Amendments 2003) To remove our vehicle/household effects to satisfy an unpaid penalty charge notice due to the council. They say that I need to contact them within 24 hours or they will attend at any time of day or night to impound vehicle/remove goods. 1. I don't know what the fine is for, as I cannot recognize the reference no from any correspondence 2. Since being made redundant I have very low income and I don't have enough for me and family or able to pay even 1p for this if it is valid. The chances are there is a debt somewhere but I cannot find any correspondence in relation to it. 3.I have recently started a business which is highly dependent on the car, cannot afford for them to take it away! Desperately need good advice can someone help please! Thanks in advance

I let a bailiff in but never let her stay long enough to list goods or never signed a walking possession order and now im trying to make a payment plan and can only afford £5 a week can the bailiff refuse this? as it is all i can only afford . i am doing a debt relief order . and my girl friend told them this so i am worried they want as much as they can before it is processed.. so can they refuse a amount that i can afford and ask for more that i cant ???
  7. Hi, Hope someone on here can help with some advice. A few months back I received notice of BCW taking me to Court over an outstanding account to Orange, I don't dispute the date so was awaiting information from teh court on paying this debt etc, I never received a judgement in the post and to be honest had forgotten all about it. 4 weeks ago I got a letter from St Helens court advising I had fell behind on payment relating to the judgement and a Bailiff would attend my property. As I was not aware of the judgement details I have tried calling and also faxed over letter to the Bailiffs office to no response, I was not in a position to make a full payment for the arrears but a part payment and to then catch up on what was owed. I have today received a letter saying I have made no attempts to contact the office and they will attend within 7 days with a van to remove goods, I obviously want to get this sorted, I am worried with living at home that someone is going to turn up and take goods from my Mums house. I have once again tried calling the office, appears they are only manned for 2 hours a day. Any advice would be greatly appreciated
  8. Hi A bailiff is claiming they have made a Levy of my 'goods' from "outside the property" in October 2010. I did own a car at this date (on finance, so didn't actually really own it) They are using this Levy as basis for enforcing a liability order made against me just before I went bankrupt in Nov 2011. Im aware that if there was no levy made before the bankruptcy then the liability order would make no difference and the council tax debt would still be provable in the bankruptcy (and written off) I believe this is why they are still pursuing me for the debt despite my bankruptcy. My conundrum is....... even if they accurately identified my car as an asset (I live on a main road in a terrace and often my car would be parked some way down the street) and it is listed on the Levy, what happens now?, as the car was returned to the finance company shortly before the bankruptcy and I am obviously no longer i possession of it. Would this make the Levy void? any advice would be greatly appreciated
