  1. Hi All This is my first post as I'm currently having issues with Samsonite and a suitcase I bought. I bought a small cabin bag size suitcase from a genuine Samsonite outlet store in York during the Black Friday sales at the end of November. It cost £41 which I knew was really cheap for Samsonite as I already have a couple of their cases. I used the case for the first time during a trip to London in mid January, during which time the retractable handle broke while waking along a train platform (so much fun!). I took the case back to the Samsonite store where I purchased it, and was told it would have to be sent away for repair as it was more than 6 weeks since I bought it. I've since received a voicemail from the store advising that the case could not be repaired, and to visit them to discuss. I'd really like to know what my rights are before I travel to the store (which is 90mins from where I live, so I need to be prepared), as to what I can get as a replacement. I do not want store credit or my money back, as I know I won't be able to buy a replacement suitcase without putting a lot more money towards it. As far as I can see the suitcase wasn't fit for purpose, and I'd like a replacement at no cost to me, but is this what I'm entitled to? Any help would be much appreciated so I can be prepared to fight my corner. Thanks Claire
  2. First time poster here desperate for some advice after google has proved fruitless. This is a long ongoing story so please forgive the length and thank you in advance if you manage to read everything. I bought my first car 28/06/2018 from a car dealership in Hounslow, ATM Motor Trade. I found the car on Auto Trader, the dealer had good reviews and it was a good deal for the car that I wanted. The drive from my house was around 90 minutes each way but I was confident I was going to love the car. The saleswoman seemed knowledgable and friendly and I bought the car that day. I paid by bank transfer (stupid looking back) and drove the car home. Already on the drive home there were some minor problems with the car not wanting to change into third gear which I put down to my inexperience in driving it and figured I would learn to do it properly. I was also trying to be eternally optimistic and hoping the car was fine despite my instincts now starting to say otherwise. I got into the car the next day and the check engine light was on. This concerned me enough to get the bus to work but I also called the dealer to explain that the engine light was on. They said it was just an issue with the emissions on the vehicle, there’s nothing to worry about and it’s safe to drive. I asked for this to be put in writing for me - already losing my trust and sensing the worst - but that was declined. Having lost all faith in the dealer, I decided to take the car to a trusted mechanic for an assessment. He plugged in the diagnostics computer and also did a thorough check of the vehicle. The number of faults that came up on the computer was higher than 20 and that’s without the physical issues that were found: holes in air pipes, badly worn brake discs, a puncture, even the battery wasn’t attached properly. I took photographs of all of the evidence on the diagnostics computer and areas of the car where the faults could be seen and then the mechanic and I decided it would be best to wipe the faults from the cars internal computer to see if they would recur. I emailed the dealer that day with the evidence I had and told them I would be returning the car for a full refund under the Consumer Rights Act. Initially they tried to offer a repair or a replacement instead but as you can imagine I had no faith in them at this point. Eventually they agreed I would return the car to them. I did so on 08/07/2018. I had driven the car a total of three times - two of those being home from the dealer and back again. The saleswoman was the same person who sold me the car and after much resisting sent me a text message to say that I had returned the car and could expect a refund in 14 days. After the 14 days were up I received an email claiming that there were no faults with the car, they claimed they had driven it everyday with no issue and it was “functioning” and therefore they would not be offering me a refund. They also would not return the car to me but only offered a replacement vehicle. I declined this offer and stated once again I wanted my money back. I have not heard from the company themselves since this date. I ended up escalating the issue to MCOL. The dealer did not respond to the service of the claim, a judgment was made against them and then I finally sent a county court enforcement officer to collect on my behalf. In the meantime the company (a limited company) changed their trading as name therefore rendering my paperwork and claim invalid as the company “no longer existed”. I did not know when I made the initial claim that they were a LTD company trading under a different name. Initially the name was ATM Motor Trade which they changed to Quality Motor Trade Centre (the irony!). I made a request to the court to change the company name on my paperwork and reserve the papers. I have since discovered they have now opened up a whole new business and are trading under this name instead! I am now at a loss for what to do. They currently owe me £2500 which I borrowed in a loan from my bank. I can not afford another car as I’m repaying the initial loan and I’ve been forced to revert to public transport (which is horrendous in my area). It seems they will do anything in their power to avoid paying and are obviously skilled at avoiding the courts. Any help would be much appreciated. I once again apologise for the length of this and thank you for reading.
  3. Mrs Echodale is being harranged by Cabot over HSBC credit card debt . HSBC agreed that if she made sixty payments of £xx then she could save £1800 and would not need to make any more payments after July 2018. She has honoured the agreement and made last payment as agreed. Cabot apparently bought the debt a few years ago and are chasing the £1800, they say they have contacted HSBC and have been advised that no such arrangement exists. We have the original Metropolitan/HSBC letter from 2013 and even though the onus is upon Cabot to 'prove it' we have sent them a copy. I think next step is to send a formal complaint to both organisations. Any advice welcome.
  4. just wondering if anyone can tell me what the position is RE liability when there are 2 names on the council tax bill. I only just discovered council tax has been unpaid for the whole year. The bills have been shall we say intercepted before I ever saw them. Likewise any letters from baliffs (the company is one i've had dealings with before - and I don't like them - the seem very underhand.. I digress). So, having finally been made aware of this i'm looking to pay the bill by end of next week. (I contacted the councill last friday about it and got them to send me a bill). However, there have already been visits from the aforementioned baliffs. Just wonder what position is if they come back and try to seize goods and such. And also what the position is regarding fees they might chage for doing so (or any fees they deem to be payable because they have been already). Any help appreciated. Thanks.
  5. I naively filled out some PPI claim online Pemberton Associates ages ago, gave all info I had to hand. “Electronically” signed all documents. Was sent something in the post which was lengthy, eventually completed & returned. Cut a long story short but I started getting A LOT of emails from this company. Regarding all sorts of things, claims against pay day loans, claims against all sorts of things, there was that much I lost track. I was only ever really interested in PPI and I assumed everything I filled in was to do with PPI. I got a final response saying once they’ve checked my credit history there’s only two companies I could claim against - one being a mail order company (which I owe a mere £80 and the other being my current account, which at the time was overdrawn) I replied saying I didn’t really see the point in perusing a claim against these for the reasons above. To which they agreed. I then started getting emails regarding some payday loan I took out a while back, asking me to send them a copy of some letter. I had no idea what they were talking about and told them this, on top of the fact my balance was zero I didn’t understand why they were looking into it. Fast forward a few weeks and they’re now saying I’ve breached the contract and that i’m Liable for cancellation fee’s if £360 for each company they originally persued (sure there’s about 12 all together) The guy who was emailing me was horrible, very threatening, making out like I was lying, saying they’ve now realised I’ve breached the contract for a second time as I’d not returned documents (this isn’t the case - I’ve returned everything I’ve received) I was getting no where with him, ended up leaving a lengthy yet honest review on trust pilot to which he replied saying if I didn’t remove it they’d sue me for damages. Cut a long story short he reckons he’s issuing court proceedings first thing tomorrow. He’s literally not left me alone all night, threatening all sorts, telling me I am liable for court costs on top of the damages and fee’s already mentioned. Apologies for any spelling errors, currently in the middle of something & frantically trying to explain myself on my phone! Any advice greatly appreciated!

  7. We've lived next door to them for over 18 years, they have been here since the 70's. They are an elderly couply, they are not the problem. Their 40 year old son is. He sells drugs at all hours, his Dad has to answer the door to them. The son plays loud music, games and shouts. One time, this was a few weeks ago. My mum was in the bathroom and he said to his friends 'yeah, their grandson lives sleeps in the bath'. He keeps spying on us in the bathrrom. When we reported this to the council all they said was 'He's got mental problems, he can't help it'. His mental problems are due to drugs, my nephew has learnign difficulities which he was born with. He has called my 18 year old nephew(same one mentioned above) a pervert, peado. Because he plays with his brothers and sisters. He has now got a camera which we reported today, it's pointing towards the public grass/pathway. We were told we were not allowed to record beyond our garden, not even allowed to record him if he contronts us. His dad has been to see the council, nothing. Police have been round and had a word with them, again, nothing. My brother refuses to leave the house now, he's too scared. My mum wants to move but it's hard because I have been bidding since I was 18, I'm now 31 and have gotten no where as I am on low band. My ESA (or council rent) won't cover the rent until I'm about 35. I tried to move out in 2012 but couldn't due to the council refusing me rent. I know it's a lot to take in but can anyone help us?
  8. I can't buy the shirts I want from the popular internet stores ( or local shops). After searching the net more fully I came across the C&A website. This website is in English and displays a selection of shirts I want to buy and in my very large size. I tried to order a couple. When I got to destination address (what country) I discovered C&A don't deliver to the UK. Deliver to nearly all Europe. What happened to their UK stores?? Matalan sell Morley shirts that are designed to suit me but only go up to 2XL. Is there a C&A Outlet shop in UK.??
  9. Just found out there is no Citroen dealer in the county of Fife or indeed Dundee. Makes me wonder what is going on with them, as Citroen used to be good sellers in this area. Not convenient for spares & replacement cars.

  11. My niece and her mother were subjected to an arson attack on their home over 4 weeks ago. Police are investigating and the fire brigade have already been and reported that the occupants should not be living in the property due to fire damage and smoke inhalation. They live in a multi-occupancy home, with their home on one side and a neighbours on the other. Their neighbours home also sustained some damage on their doors and smoke inside their home. Hyde has sent numerous contractors to try and clean the soot from the walls but it is still there, electricians to put in temporary battery powered lights and a surveyor as there is structural damage. They have also written a report for Anti social behaviour (which is what they are classing the attack as) but refuse to move them to temporary accommodation and will not provide them will a letter to take to Lewisham Housing. My nieces mother has liver problems and attends A&E frequently due to inhaling the fumes from the soot which is causing her difficulty breathing. Is there anything they can do:?:

  14. I was a Lloyds TSB customer for 30 years. Lloyds left some years ago and took all the sensible staff with them. The place is a complete shambles now. I was embroiled in all the TSB nonsense in April. They refused to let me close my accounts online or by phone. I hadn't been able to access them for 6 days. I had to go to the Boothferry Road, Goole branch where pensionable staff took 40 minutes to decide how to shut them down. I was then handed £2000 in notes, without having them counted out in front of me. We are currently embroiled in a county court claim because I made a subject access request to check all my details. They sent them to this branch and refused to post them to my home. I went into the branch, where at least half of the staff know me, but they refused to give me the data envelope, as they needed to see ID, even though the staff agreed they knew it was me. I wasted my time and fuel money driving there. I truly believe TSB are the worst bank in the UK.
  15. I hired a van from Sixt Car Hire in Leeds in early June in order to move my belongings to a new house. I hired the van just for the day and used Sixt as the prices were competitive and they were located nearby. When I picked up the van I was shown around it and giving a considerably long list of pre-existing damages. It was clear the van had been in quite a few incidents before as there was considerable dents, scuffs, scratches etc. When I rent a car I usually take my own pictures of the car but stupidly didn’t in this case mostly due to the tight time schedule I had for being able to access the loading area near my flat (my fault). I used the van for the day without incident. When I returned the van, the office was closed and there was no one there to receive me or check the van. There was only a locked drop box for hire keys. The van could only be left in the car park which has no gate or fence, just open to the public. The next day I received an email from Sixt saying thank you for using them and my deposit was returned. A few weeks later I received an email saying there was damage to the van and that I was liable to pay £586 pounds in damages. They attached a form which had a box for me to state whether or not I believed I was responsible for the damages. I said that I wasn’t and that there were no incidents whilst the van was hired to me. About a month passed and I received an email from Sixt stating that they reviewed my response and decided I was responsible for the damages and that I had two weeks to pay them the money. In response I requested that they please send me time stamped photos of the damages before and after I hired the van and proof that the van wasn’t damaged after I left it in the drop off area. Sixt didn’t acknowledge my email and just responded that I had 14 days to pay the damages. I again replied requesting the data and attached the previous email I had sent to them and stated that I formally was disputing the claims. Sixt then responded with photos of the van which when I looked at the files had no time stamp on them. There is also no photo which shows the claimed damages as well as the van in the same photo. Only far away photos of the van I hired and then very close up photos of the damages where you can’t see any distinguishable details of the van. They also have not responded about how no one was there to receive and check the van when I dropped it off. Two days later I received an email from Sixt stating the following: Further to our previous letters regarding the above damage, we have still not received your payment for the claim. This account will now be passed to our external solicitors to commence recovery action against you unless you make a payment within 14 days. I have no idea what I can do to refute this, I didn’t damage the van and feel that I have no way of defending myself. I feel like if I don’t pay the damages the fees will just get larger. If anyone could please advise I would be very grateful. Steph

I've just sent them a Sar in the hope of reclaiming charges as I know I was in arrears about 7 or more years ago with capstone what's my chance of success here? I've just noticed they have cashed the cheque and £10 has been credited to my Morgage account. Is this normal practise?

  19. Hello all. First of all thank you very much for supporting this website. It has given me some hope in what to me appears to be a very dishonest situation. Summary PCN received after stopping for 12 mins at the entrance to a P&D car park in which ALL 4 Spaces were blocked by a wooden pallet each with a notice saying the road was too narrow for parking and emergency access. Details Broadwater Street West in Worthing, West Sussex is a short, narrow L-shaped side street running along the side of Starbucks and to the left behind it and other buildings, giving access to lock-up garages and waste bins. It has 4 parking spaces nose to tail running from the entrance of the road. My passenger had a painful case of cystitis and needed to use the loo. Thankfully we saw a Starbucks and from the main road it looked like there were parking spaces free in the side street next to it. After turning into the street and letting my passenger out, I saw that each of the parking bays had a wooden pallet in them preventing their use. In addition there was a sheet of paper on the wall to the side of each space saying that access was required at all times in case of emergency, bin collection and deliveries and that the road is too narrow for parking cars and through traffic. This is certainly the case. Having entered this narrow street the only way out was too drive to the end of the L where there is just enough space to turn around and then drive back to the entrance. Unable to park I waited just short of the main road for my passenger to return. Although I had fully intended to pay, with it not being physically possible to park let alone legal, the whole place gave the appearance that parking was at least suspended if not cancelled. Hence it never crossed my mind that I would be penalised for stopping there. There is of course no one supervising to tell you. My passenger could have just run in to Starbucks, used the toilet and run out but being polite she chose to buy some tea. We had just left the vet after having spent an hour talking to one of their very kind nurses about the loss of our dog which has been heartbreaking. It was a very emotional time and with the cystitis as well I couldn't drive off and leave them; stopped by the entrance I could at least clear the road if for example an emergency vehicle required access. They returned after approx 10 mins and we left. What Happened PCN received for "Failing to Park Within a Marked Bay". Given the situation described above where I was physically unable to park in a marked bay, let alone do so without blocking emergency access I thought it was a [problem] and a quite ludicrous one at that. And for this reason I have not contacted One Parking Solutions. I have since received a letter from ZZPS Limited saying my unpaid PCN has been passed to them to resolve. The balance owed has now increased to £170. They have quoted Parking Eye v Beavis as a recent Supreme Court Ruling. I have spoken to them and they said I was parked for 12 mins. If I do nothing the matter will be passed to their solicitors.

Having some issues with O2 as of March this year as they have decided to link 2 accounts for another person with the same name and DOB as myself, however this other person has a middle name and i do not. I do not have any accounts with O2. 18/3/18 Received letter stating i was in breach of contract for not paying my O2 bill. 22/3/18 Received letter telling me they had stopped me making calls and texts. 23/3/18 Checked call credit report and O2 had already linked my address with the debtors in Janurary 18 and had both accounts listed. 23/3/18 Emailed call credit stating the incorrect information. 2/4/18 Received letter from O2 telling me they had disconnected my phone. 7/4/18 Requested credit report from Experian. 20/4/18 received letter from call credit stating that O2 had not bothered to respond to them, and are unable to amend the entries to my credit file without the permission of O2. 20/4/18 same letter as above also stating that the disputed entries will be supressed from my credit file, however, O2 can remove the suppression at any time. 21/4/18 complaint letter sent to Experian stating the incorrect accounts and linked addresses. 17/5/18 Received email from Experian telling me O2 had supplied the following details "The link is correct as the account was registered to the disputed address." 1/5/18 Received letter from Experian stating O2 had removed the accounts but not the linked addresses. 1/5/18 Complaint send to ICO about Experian knowingly registering wrong information on there systems even though it had been proved it was not me O2 were looking for. 5/6/18 sent SAR to Experian 5/6/18 SAR sent to O2 8/6/18 Received letter requesting what specific information i wanted from Experian. 11/6/18 Sent Experian an email stating i wanted the information between themselves and O2 to see what had been said about the matter. 11/6/18 Received email back from Experian stating that they had supplied the information the comparison data sets in the additional information i could request. No information regards conversations about themselves and O2. What O2 have done here is add accounts and linked addresses to a serial debtor on my credit report , opening the floodgates for all of these other companies to jump on the bandwagon adding CCJs , Defaults, Late payment accounts to my credit files. They are refusing to remove the wrong data from my Experian report and as stated above have not even replied to call credit about the issue. No reply as yet from the ICO as they are running 8 weeks behind about the Experian complaint. Next steps to take against O2 if anyone has any suggestions, AGAIN O2 are the ones that have opened the floodgates for all of the other comapnies to throw wrongful information onto my credit files without even bothering to do the correct checks. ***Please also note that my Experian credit report in April stated O2 were the source of the linked address, however my credit file in June states Experian are the source of the linked address*** Something funny going on i think.   21. Hi All, At the start of June I ordered some tools from an online seller (Uni-Thread LTD) which were shipped via Royal Mail with an un-recorded next day service. After about 3 weeks* I called the seller to find out what had happened and after some investigation RM tracking said the parcel had been delivered - no signature or any further details. *The reason for the 3 week delay is I didn't get a confirmation email or invoice from the seller, so assumed there had been some error and it had failed to go through. It's only when looking back through my accounts that I saw the money had actually left my account. I've searched all my neighbours who would normally take in parcels and found nothing. The seller is offering a 25% discount if I order again, which I do *sort of* appreciate but am still unhappy about having to pay for these parts twice. What are my rights in this instance? I should mention this was a purchase for tools that my business made, not a personal purchase.
  22. I have a mobile account with o2, my bill is late by 1 1/2 months at this point as ive had a few financial issues this month. I am expecting a bit of a cash boost into my account this week due to selling a few items and the money being transferred via paypal. I expect to have it in my account by monday. However in the space of this month 1/2 I havnt paid my bill ive had a disconnection notice last week on the Thursday saying the account had been disconnected but if action is taken that can be reversed if the monies owed are paid, thats happened slightly fast (because its not as if ive gone `months` without paying and I have in fact been in contact with o2 to explain my situation already via livechat and was assured a note would be placed on my account to expect payment soon) but I can sort it on monday when ive got the money and all will go back to normal. However yesterday saturday I recieved a default notice saying they now expect payment of all monies owed for the contract in a single payment! within only 3 days of getting the letter saying I could remedy the situation if I paid the balance owed! 3 days! what are my options here, I want to pay off what I owe and have the number reconnected on monday when I have the funds, does this default notice mean I cant do this now??? is it even legal to go about things this fast? I think the default letter to arrive saturday must have been sent the same day or next day even after the letter I received saying I could still remedy the situation! and as I said ive not even missed 2 payment dates on the account, as well as the fact that ive been in touch with them and been assured notes were put on my account to explain my late payment and the fact payment would be upcoming (this obviously didnt happen) I am fuming to be honest, yes my payment is late but its not stupidly late, I havent gone months and months without paying and Im literally a day away from being able to pay off everything I owe and proceed with the account as normal anyway! Not to mention the fact they tell me I still have time to make a payment to reverse the disconnection and then the very same or next day they send me a letter saying thats now to late! so what are my options here?
  23. I defaulted on a bridging loan and Receivers have been appointed. They have secured the property (changed the locks) and have asked me to book a time to remove my belongings (Torts Notice served). The property was and is my home and my only home but I have not lived there since taking out the bridging loan is because the loan was unregulated and I did not want to be in breach of the terms. However, it was never rented out; in fact, I never removed my belongings from the property. I have never desired to be landlord and the only reason for taking out the loan was to keep my home. This was declared to the lender from the very beginning; nonetheless, the product offered to me was an unregulated loan. As I was not eligible for a mortgage at the time and it was very unlikely that I would be by the end of the loan term, sale was my only option of exit strategy. This was a better option than having the property repossessed. The Receivers have said I must either remove my belongings or pay for storage. I have not abandoned my belongings or “left them behind”. I am in the process of remortgaging and they are aware of this, as I have kept them informed. The mortgage has been agreed subject to valuation which is due tomorrow. Can they force me to empty the property?
