  1. Looking for help with claim against Royal Mail in small claims. They admitted to losing my 'signed for' package, but then failed to reply further or compensate me. Four months afterwards, I issued Small Claims writ and they sent me standard letter and standard cheque for compensation two weeks later. They have put through their defence which from reading other threads is the same they always use, ie: 1. No contract was entered into between parties for the delivery of the parcel (they mention Harold Stephen & Co V's RM 1978 as reference). 2. The defendant has immunity to a claim in tort in respect of the transmission or delivery of post. Saying they cannot be sued in contract or tort. I know of one case on here that they lost in the County Court. However County Court proceedings are not recorded as far as I know. What I am looking for is any evidence of similar proceedings, a letter explaining the court's reasoning or similar. If anyone had anything they could redact and post I would be very grateful.

  3. I am having a right nightmare with Kensington mortgage company and need some much appreciated help . I had a suspended possession order granted in oct 2007 as I had lost my job at the nhs and my wife business had collapsed the suspended possession order was issued in oct 2007 for my monthly payment plus £50.00 i think i need to dig it out as it was nearly 6 years ago i will post later the exact amount I have been making payments over the last few years to Kensington but also built up massive arrears on my council tax and second secure loan with welcome finance at the mo long story short I have now cleared my 7000 pound arrears with council tax (rossendales ballifs ) april 2013 and got my arrears down to £1095 with welcome finance (was over £5000) however with doing this I have now got arrears of £20,018.46p as of 19th august 2013 with Kensington. I had an arrangement in feb ,march,april, to pay £636 (monthly payment) to Kensington of which I paid march £640.00 april £650.00 may £800 i only paid £160.00 in feb due to having several other debts elsewhere stupid of me i know !! on the 28th of april when i paid £800 i was charged arrears fee of £50 and i was told my arrangement had finished and i needed to fill in income expenditure form send bank statements in and wage slips to consider a new arrangement for may after filling in all sheets and sending in the above i offerd £636 + £64 off the arrears (£700.00 a month after 19 days i got a letter stating this had been declined and was advised to up my offer so i didn't make a payment in may as i wanted an arangement setup so i knew what i was paying i will explain later (don't want to go on but arragrements have been declined lots of other times over the past 5 years until i offered a lot more even if i couldn't afford it so im at the end of my tether and on the verge of giving up ! after clearing more debts in mid april and doing a new budget sheet i could offer £636 + an extra £200 .a month off the arrears i sent again budget form, wage slip, bank statements and again the payment proposal was declined after 16 days stating i couldn't afford the above (even tho the budget form stated i had an extra £204.00 at the end of the month ) offer as i had stated i would like to pay weekly and the computer calculates some months as 5 weeks the payment would be nearly £1000 in certain months i didn't pay anything in june as im holding onto my money incase thy issued possession which they kept stating every time i called them unless an aragement was agreed after sorting the above over the phone along with been told Kensington had inputed my child benefit of £134 into child benefit and also the same figure int family tax wrong (not £179.00 as stated on the budget form) and explaning the weekly thing i put a new proposal of £640 a month + £200 a month of my arrears which would take roughly 8 years to clear (still have 22 years on mortgage term) i advised i would start paying at the end of august and was advised the new payment proposal was affordable and would be given to the senior team (5th of august and boom i get a letter today dated 19th august stating unless i pay £20,018.46 in 7 days evershields (solicitors ) will apply to the court for the issue of a warrant of possession im holding onto my £840 incase i need to pay a rent deposit in the past i have an arrangement for 3 months pay it then it ends then seems to take 4-6 weeks to get a new arrangement i get charged £50 a month arrears fee and i can never get an arragemnt set up that's affordable they always decline 1 or 2 times until i offer a silly amount once i pay that for 3 months the same again the arrangement ends i have to update my budget forms and again charged £50 a month arrears except this time agfter 3 months arrangement they wont renew it.. please help i don't know what to do !! i called Kensington this evening and was told they sent a letter dated 15th august stating my 3rd proposal had been declined and due to previous arrangemnts not been kept and arrears building up they are seeking evection sorry for the long thread but don't know what to do regards mark
  4. I face a massive fine I can't pay because I ticked the box on my prescription saying I was eligible for free prescriptions. This is because I am on working tax credit I asked the chemist if this meant I got free prescriptions (I was on benefits years ago, i forgot how it works with prescriptions). He said yes, and I ticked the box and got my fee prescription. Then I got a letter saying I was being fined (including what my prescriptions should have cost) £139. I realise, having tried to appeal unsuccessfully, that the onus is one me to read the form and know if I am eligible or not. Fair enough (not really as I've read a lot of accounts of this happening and by now chemists, dental nurses etc, should have been told that they shouldn't falsely tell someone they will be free, they should either have the right information or be told 'read the form, I cannot tell you, and if you get it wrong they'll fine you £100+) but the fine is so excessive I can't pay and feel it is unfair and don't want to pay. You can tell me I am in the wrong if you like, and should pay. But my question is has anyone actually been taken to court to recover the money? I've looked around the internet and can't find anyone who has. So what if I just don't pay, what will happen? Thanks.
  5. Hello good people of Consumer Action Group, thanks for having me! I find myself in a work situation that I'd really appreciate some legislation-backed-up fact. I've been working for my company manual work minimum wage for nearly 4 years, never rocked the boat, always did my best to keep everyone sweet and help out where I could when people called in sick with management. However, I now find myself in a quandary where I need to take a few days off that have been expressly disallowed by da boss. Our rota goes up a few days before it starts for every two weeks going forward. The boss still finds it acceptable however to change it willy-nilly as the needs of the business dictate. Fair enough if it's a small one-man show, but this is a multi-national. So near Christmas it becomes problematic when people with children suddenly "discover" a once in a life time children's play, or family emergency, I've always tried to help out as I'm a single childless guy. But I have something I must do on Friday 14th that demands I take the day off. I asked the boss, immediately I saw the rota go up today. NO! I said, sorry but YES!! He said review your position, I'll make you work it or give you a disciplinary. I WILL be taking it off, morally and actually. What can I do to avoid the inevitable storm and bad feeling that will result despite me giving him nearly 3 weeks notice about it? It's unfortunate in that unusually this close to Christmas there is no-one else who can cover this specific shift, but I feel given my track record of always covering everyone else with their "sudden child sickness/need to go shopping" issues, etc, that I'm morally in the right to ask for this one little day off. I am prepared to die on this hill. (I'm looking for a new job already for new year), but I don't want to leave on bad terms by just handing in my one week notice now. And then get a bad reference. Especially after 4 years of actually quite enjoying the job and feeling a mutual respect with the boss. But he's dug his heels in with this; and so have I! Any legislation to help me with my stand? It's obvious that the government is making it so difficult with benefits they are hoping that everyone will just give up claiming but I didn't know whether to laugh, cry or head butt the wall with this situation and just wondering if anyone has had similar problems because apparently the people in front and behind me in the cashiers queue had the same issue!! Had a medical appointment in London yesterday for my ongoing vertigo issue and am on UC at the moment (although haven't received anything as yet due to my last pay packet back in July!). However I can't remember where but someone told me as I am on UC I could claim back my travel expenses. The UC helpline (term used loosely) advised me that I could claim through the JCP but on contacting my Work Coach (again term used loosely) she advised me I couldn't claim through them but I could claim direct with the NHS. I called the NHS and that was correct but I had to take my proof of purchase, appointment letter and UC Reward Letter to the cashier at the hospital. Obviously I know unlike JSA where you get a letter stating you are receiving JSA you don't get the same thing with UC because the Council were complaining about that when I claimed Council Tax Benefit and the girl at the Council said it was all a bit of a shambles. So I called the UC helpline again and after half an hour trying to explain to an automated message that all I wanted was advice from and advisor I finally got through. The advisor told me that the statement on the dashboard was all I needed although all 4 pages of it seemed excessive and somewhat personal considering it states that I was awarded a massive UC total of £0 due to my wage the previous month of £xyz!! Queued for 25 minutes at the cashier’s desk at the hospital with all the documents and finally when I got to the window she wouldn't approve it stating that she needed a JSA Award Letter. I politely explained that in my part of the country and more than likely most of it by now including London there is no such thing as JSA and award letters anymore, (I may be wrong) and that the UC Office had said this statement would suffice. She wasn't for turning though and kept pointing to a clearly out of date note on the wall stating a JSA Award letter was required. I tried my best to keep calm and explained again that all is done online now and this is it, all I can offer. Eventually she took my number and said her supervisor would ring on Monday but keep my train tickets, which is fortunate I got a receipt because the machine eats the tickets once used!! As I left the guy behind said "Well we are buggered as well then" as he held up his UC Statement print out. When I got home I called the UC Helpline but was told they didn't deal with travel and I had to speak to my work coach and could only offer me an appointment next Wednesday!! I asked for a phone appointment because it seems a bit pointless taking up a walk in just for one question! I said that the previous UC advisor had informed me that a UC Statement would be ok but was curtly told that the UC advisor couldn't advise on that so didn't know why they had! I then rang the number for my Job Centre and went through merely to a switchboard who told me that my JCP was closed on Fridays. So we search for work for 35 hours a week and they work 4 days?!?! She however told me that the JCP can't help on that so I should contact UC Helpline!! I replied that the UC Helpline say they don't deal with that the JCP does and she said they didn't know why they advised me of that as they were wrong. After telling her I suspect she may be getting a few more calls from others with the same query I gave up at that point!!! So has anyone had any luck with claiming expenses of any kind with merely a UC Statement?! It seems impossible. The hospital say they need a letter that doesn't exist anymore, UC say it's down to the JCP to advise and the JCP say it's down to UC credit to advise. A system clearly created by a buffoon with no brain, sense or intelligence!!
  7. Having lost a few registration marks to DVLA over the years. I wondered if anyone has ever lost a registration mark which made their car worthless as the DVLA did not affix another.   8. I received a Penalty letter of £100 from NHSBSA all because my dentist registration lady misled me into believing that I was entitled to free dental treatment. I have gone through Stage 1 & 2 complaints procedure to no avail. Now, they have said I can go on to the Ombudsman if I am still not happy. My argument is - I was told I was entitled to free dental because I showed the lady my NHS Medical Exemption Card and asked if being diabetic, was I entitled to free dental as well? The lady said yes I was and asked me to sign the FP17FR form. I signed but didn't tick any box of date it because I didn't see any relevant boxes that applied to be. I thought she was the expert right? I haven't been to a dentist in 10 years. the next time I went was 9 months later, the same thing happened - I got the form to sign and I did but once again, I didn't tick or date the form. A few weeks later, I got a shock in the post - a penalty of £100 plus the dental charges of £56.30. phoned up and asked them what it was about - they told me I falsely claimed free dental. said I had a Medex card - they said that was not inclusive of free dental. said the dental lady said I was entitled - they said I signed the form and ticked the box and dated it. I went back to the dentist and asked why they gave me the wrong info - the owner told me I was responsible for signing the form When I asked to see the forms, I saw that the first form I signed had no tick and no date - but the second form someone in the dental surgery had actually ticked and dated the form - the handwriting was different. Then to illustrate my point - the owner and I both noticed that the first form was still unsigned and undated - and it was submitted to NHS which had rejected the payment because of that so that was why the NHSBSA didn't/haven't penalised me for that "false claim" yet. I asked for copies of the forms but the owner refused to give them to me - she said she will only give it to NHS if they asked for them. After my complaints to NHS, they spoke to the owner's husband (also an owner) and he said I was welcome to get copies of the forms. I went to get them - imagine my surprise when I saw that now, both forms had been ticked and dated - obviously the first one by someone in the dental surgery and probably resubmitted to NHS for their claim. How devious is that? After being told by me that I had been fined - they didn't ask me to pay for the dental fees for the first treatment - and instead preferred to tick and date the form and resubmit it to NHS! So now, I am left wondering, if I agree to pay £100 penalty for the second form, will it be a matter of time before the first from gets flagged up and I get another penalty? Has anyone gone on to the Ombudsman or even to court to fight their case?

Hi all I am new the CAG i would just like to see if anyone could help or give me the best advice on bankruptcy on a personal agreement my partner and i are directors of a LTD company The LTD company had a debt with a supplier (not sure if i can post their name ) the debt was 11938.71 in March this year they sent us a statutory demand / winding up petition which we did not want to happen as thats our monthly income so if they wound the company up me and my partner would have no income to pay the debt off we agreed with their solicitors a payment plan of £500 per month ( under the understanding the winding up petition would still be in place but on hold if we fail to make our payments ) and they would look into it in 6 months time to see if we can pay more off the debt we paid them on time each month and stuck to our word then at the beginning of July the winding up petition went active again we called to see the reason why as we stuck to our word and never missed a payment their reply was they want their money sooner rather than later we have sold the LTD company on but because me and my partner signed a Personal Agreement they are coming after us personally (also the personal agreement does not have my correct D.O.B ) i had a gentleman come out to my house trying to serve me with a bankruptcy petition he has been twice and posted a letter saying he will arrive on such a day at such a time to serve me with the petition he came but i never answered to him he has been out in total of 4 times am not sure whats the best thing to do do i take the petition off him or not ? i am willing to set up a payment plan instead of going bankrupt just do not want the same to happen where i pay them a few months then they try to make me bankrupt again can anyone help please

  11. I can't log into my account today with my PC, although it still works most of the time with my phone. I keep getting a message about AOL being called Oath now and it says that before I continue it wants me to confirm I'm in the UK and to confirm their new privacy policy. When I try to accept their conditions or manage my options, it says 'Oops something went wrong, please try again later.' Every time I try, I go through the same loop. What am I doing wrong please?   12. Hello! This seemed to be the place to put this, though equally it could have gone in transport or benefits. I had a look through and couldn't find any similar threads. I have fibromyalgia and have been trying for the last two years to get a disabled bus pass. It's been complicated by the fact that I have never been in receipt of mobility in PIP, something I decided not to appeal the first time round as I just didn't have the strength. When they re-assessed me, I decided to take it to tribunal and have been waiting, and waiting, and waiting... In the meantime, I have been trying to get a bus pass. There was a form on their application form for a doctor to fill in and stamp to confirm disability, which I made a (non emergency) appointment to do, she filled it out, I sent it off with a photo and expected it to be that simple. The first time was rejected for no reason, and again I did not have the strength to continue to fight, but a year later I decided to try again. Now they say that I must attend an 'assessment' with one of their County Council 'independent mobility assessors' to see whether or not I qualify. Apparently evidence from my GP and specialists is worthless. I have several concerns about this and was wondering if anyone had experience of this? How long does it take? How do they assess you? Do they seem genuinely interested in finding out if you have an 'invisible' illness or just in finding a reason to turn you down? I have a bit of a dilemma, because I *could* just wait for the court date (whenever that is) when I am hoping I will finally be awarded mobility, and then I can provide that as evidence and not need to undertake this 'assessment'. But then again, that could be a while. Thanks for any advice or info on your own experiences. I appreciate it.

  14. A review of past fees and charges, and you are entitled to a refund. The amount is about a few hundred. I believe my relative had a massively unfair relationship with them. Curious if anyone else has got this letter recently and what it means...annd what you've done about it.
  15. Hi there For nearly 2 years I have had a complaint about my mortgage company with the FOS. My mortgage company were preffered, then accenden and now engage- (although I settled the mortgage on April 2011.) My complaint was mainly: In 2009 after being made redundant I fell into arrears, 3 months worth. I made an arrangement with them and was told as long as I stuck to the arrangement no further action would taken. some months later I checked my credit profile on Experian and they had marked my mortgage account as being in default. I was never sent a notice of default so had no knowledge of this. Also I had asked to capitilise the arrears but I was told that as I was in a fixed period it would not be possible to do this until fixed period ended. Also they were heavy handed with the charges on my account. Today I have received a letter saying they ombusman have made their final decision and that the agree the default should stay in place. They say I was offered the chance to capitilise the arrears but I declined, (why would I do this??) They say engage have "notes" to prove this but this is a blatant lie. They agree the charges were high and have award some refunds, about £500 and 8% interest. I ended up selling the house because the situation was making me depressed and I now rent but it seems I have to now spend another 3 years waiting for this default to drop off the account. I feel let down by the FOS for just accepting what this suspious company say. I have 2 options, I accept the decision, take the money-(assuming I get it!) or I reject the decision and fight through the civil court. I'm looking for advice on what I should do? My heart tells me to just take the money and move on but I'm so angry it just doesnt feel right. Furthermore even though this was settled in full in april 2011 they still havent updated my credit file to reflect this, I have asked several times. Any advice greatly appreciated. Thanks.
  16. Hi there all New to the site - but would welcome some urgent advice. I had a payday loan with Uncle Buck back in 2010, which I had to rollover on several occasions because of debt problems. I thought everything had been paid off, I moved home a couple of times, got married, changed banks, got on a better financial footing etc. All ok in the world. My postman has handed in 2 letters today - both are for addresses which do not exist (it's using the area as a street name which is wrong), and which I have therefore never lived at. The postcode & house number is right, but the address is plain wrong. He has tried my address as the other people on other streets have no idea where it's meant to be. by sheer luck - I have received a letter from Moriarty Law, on behalf of MMF (an old Uncle Buck debt) saying that despite earlier letters advising of x, y, z they are issuing proceedings in the County Court against me. And, he has also handed me a claim form from the County Court from MMF for the debt of £350 plus over £100 of costs! The court claim form is also for a wrong address (not just that I have never lived there but it does not exist). Here's the rub -IF , I do owe the debt I have no problem paying it off. I have no problem facing up to my responsibilities, and happy to pay. I am also in a fortunate position of being able to pay it off (although it will hurt to do so in one fell swoop), which I know not all are. However, I do not want a CCJ, AND, I cannot see how it is fair that I pay over £100 of costs and interest when I have never heard of a single thing for years from anyone until now. What's worse, is that I am going abroad with work next week for 2 weeks so won't be able to do anything and time is ticking (forms issued on 24th August). Moriarty Law are telling me to call them to amicably resolve the matter - but I have been reading online today that this seems an ill-advised course of action. I just want things sorted this week - even if I just take it on the chin. 1) How do I get the court action stopped? 2) The claim form/admission form - I ideally don't want to fill that stuff in, as I don't like the idea of someone holding my personal information somewhere. 3) If I just offer to pay Moriarty Law say £250 now, will they likely accept and cancel everything with the court? I don't want to pay even more interest when I paid the buggers a load of interest 5 years ago!! 4) How best do I communicate with Moriarty Law - and what's the best way to contact the court? I have worked hard to get myself onto a firm financial footing and an old CCJ is about to be removed from my file in the next year, I cannot have another one tagged on after all I have done.   17. Hi all, I ordered things yesterday online, I selected next day delivery, but when I have just checked now, they aren't estimated to arrive until Friday? Something I ordered today is also due to arrive Friday and not tomorrow. All were prime eligible products. So I jumped onto their webchat, and spoke to someone. Turns out they have suyspended next day delivery until they can catch up from Xmas and get their drivers back. In fact here is a snip from the web chat. "Ojas: I can truly understand your concern however as you must have been aware that we had loads of deliveries on Christmas season so the inventory at our fulfillment centers is revising so they are not getting shipped on the same day as they are placed. This is the reason the next day delivery is extended however please be assured that it will be in its original form once again in 2 to 3 days as all of our carriers are also returning back to work. Me: hmm so it's down to the fact you are behind on deliveries, that's fine as long as you say that Ojas: So please be assured that the prime one day delivery service will be in effect within a couple of days." Isn't this a breach of contract? A warning for anyone else expecting their deliveries they day after they are placed as usual.
  18. Hi, Does anyone know what Nationwide is likely to do in our situation please? Wife is 16 years older than me so we had a 10 year self cert mortgage taking her to age 65 originally through Derbyshire/Salt and now taken over with Nationwide. About 12 months ago we rang Nationwide after receiving a standard letter re repaying the loan at the end of the mortgage term. The friendly but extremely unhelpful call center guide was only interested in referring us to an independent mortgage advisor when asking about options and whether we could extend the term as they couldn't give advice and there were NO options on Nationwide doing some sort of deal or changing the mortgage. There wasn't much point in talking to a broker as my business went south in 2009 and we have wobbly credit, can't prove income to service the loan now although have no arrears or ever been in arrears. Instead we have been trying to sell the property - £255000 mortgage and 2 local estate agents started us at £395,000 now down to £340,000 and only 3 viewings in a year! I have been trying to understand 'Forebearance' but can't find any examples of any lenders being helpful to customers when they can't afford repayment. All we want to do is to continue actively trying to sell it while paying interest only rather than have it repossessed and forced sold. Does anyone know what is 'likely' to happen - particulalrly where Nationwide are involved? Any thoughts or advice would be really appreciated. Wife was just going to leave today she is getting so upset. We have until Feb for the mortgage term to end although haven't received any notices about the mortgage since last year. Thanks

Also I didnt pay back one of the loans but it has been sold on, to PRA Group I think .... Should I bother sending to Ombudsman? Or write this one off? Have included the statement Thank you all. Decided on a Redmi from banggood and all was well. My friends mum told me that I should ask for the parcel to be sent via swiss post which I did. So I come home from school today and my mum has a right face on her like dragging on the floor kind of thing and whats happened is shes had a notice through the door asking for and extra 11.42 for charges £8 for rm and 3.42 for tax? dad said i cant do nowt about the tax but maybe with rm charge and sent me here to ask. Shes threatening to refuse to pay and send it back which is bonkers. The declared value was $21.94. can anybody advise please.

  23. Hi In April this year I left my job due to bullying in the workplace and relocated to be nearer my family. As I didn't have a job to go to I wrote to all my credit card companies and explained that I would be unemployed for a period of time and wouldn't be able to make my minimum repayments. Different companies have dealt with me in different ways from continued harassment to being fairly understanding! I have always been employed and in have never missed a payment of any sort. I have now found work but unfortunately I no longer work in a city and the wages are no where near what I was earning before. As things stand I am no longer able to afford the repayments - I have kept in touch with the companies regularly, I have written to them once a month to keep them posted of my circumstances. Now I know I cant afford to pay, I don't know what to do next? A couple of the companies (the ones who seem to have ignored my letters) have issued default notices, I don't really know what the implications of this are? Could someone please give me some advice as I really don't know what to do next.
  24. There is an electrically operated gate across the entrance to the development which can be opened via a key pad on the outside or a button on the inside. There's also an emergency release lever for if (when) the gate fails. The management company have put a padlock on the emergency release lever so it can't be used. Their argument is that it's use may cause damage to the gate, which supposedly will only fail in an open position unless there's a power cut. As a result, when the gate failed whilst closed on Saturday night one resident was trapped outside and had to book into an hotel and everyone else was trapped inside until someone cut the padlock off the next morning and opened the gate, without damaging it. My engineer hubby thinks it's unlikely that operating an emergency release lever would ever cause damage, so are the management company talking c**p and just using this as an excuse to get us to pay extra for their emergency service, who would have the combination for the padlock? There's no manufacturer name or any other details on the gate or any of the controls, but there is a warning notice directing pedestrians to the (imaginary) pedestrian access!
  25. can anyone help? Sorry if im going about this wrong but ive never used a forum before im in need of help over a parking fine my grandparents received during an emergency trip to the hospital. any reply with advice on where to begin to correctly post for help would be greatly appreciated
