I have a sheriff court citation by Amex for credit/charge card debt and i was trying to fill in the details for ordinary claim but i don't have anything like "BOX E2" etc, anyway i've tried to fill it out the best i can and was hoping i can get some advice. Thanks name the issuing court: Glasgow Sheriff Court Who Is The Claimant: Amex Who Are the Solicitors: BTO What type of action? (Simple/Ordinary): Ordinary What is the claim for – 2. The Pursuer provided the defender with a charge card under account *******. The charge card provision is not regulated by the Consumer Credit Act 1974. The Defender incurred charges totalling £8992.24 on the Chargecard. The balance remains outstanding and due to the pursuer. 3. The Pursuers issue the American Express Credit Card and in particular issued to the Defender a card numbered *********. The Defender s use of said card is regulated by the conditions contained in the Cardmember Agreement which was issued to him with said card. The agreement between the parties is regulated by the Consumer Credit Act 1974 as amended. A copy of said Cardmember Agreement is produced herewith. It is a condition of the contract between the parties that the Defender pays within 25 days of the periodic statement issued to the Defender by the Pursuers the minimum sum specified therein. The Defender is in breach of said condition and consequently the entire balance outstanding on said account is now repayable. On or about the 15 February 2018 the Pursuers served a default notice on the Defender in terms of Section 87(1) of the Consumer Credit Act 1974, a copy of which is also produced. The defender has failed to comply therewith. The balance outstanding in terms of said agreement as at the date of raising these proceedings was £7113.17 There is a total balance due by the Defender to the Pursuers of £16105.37 date of raised claim :- 13/02/19 Last Date Of Service:- Last Date For Response:- 06/02/19 What Documents are listed in Box E2:[or in your form requesting the same?] Amex Canada Intranet E-application, a copy of default notice dated 15/02/18 Claim is for charge card & credit card BOX D5 what has the claimant stated: IN FULL….. from your knowledge: answer the following: When did you enter into the original agreement before or after 2007?After Has the claim been issued by the original creditor or was the account assigned and it is the Debt purchaser who has issued the claim.:-Original creditor Were you aware the account had been assigned – did you receive a Notice of Assignment? Did you receive a Default Notice from the original creditor?Yes I think so Have you been receiving statutory notices headed “Notice of Default sums” – at least once a year ?   2. Hi there, I've just changed job which requires me to travel more. I work for a Global professional services firm and the policy states that if you are incurring more that £200 in expenses per month then essentially, you need to obtain a corporate AMEX. My credit history is diabolical to say the least. Do I stand any chance of getting this or should I just tell my line manager it isn't going to be possible for me to obtain one of these. I'd rather not apply and get declined... just would rather know a little about how it all works first. Can anyone help, I'm not sure what to do? thanks Lx
  3. How horrible can some women be! I had a similar with an ex. She had a credit card on my account. When we split up the card company wouldn't cancel it. They said i had to cut it up and return it to them. One day she called at my house and left the card - so i cut it up and returned it. I even phoned them and told them what i had done, again asking them to stop the card. They refused - "until it arrived". My ex made one call, said the dog had eaten the card and they immediately sent her a new card. Naturally they refused to do anything for me. Ditto the police. I was told by a [removed] that my only option would be to declare myself bankrupt. Moral of the story? Be a woman.

  5. I wrote to Amex asking them to review my account for PPI on Amex blue card. I do not have any information or account details. Amex wrote back and said they cannot find any details, and unless I can confirm the card number, they will not review this further. The card was held in around 1997-99 I think. Is there anything I can do?

Hi am trying to help some elderly friends with their debt problems they have a Amex account and they have been paying £1 a month for quite a few years They want to try and offer a full and final settlement but it would be very low - do AMEX do full & final? Have said that first they should get CCA which they have now done - have attached (hopefully) the priority application form for the blue card and original conditions - both are difficult to read - quite faint The application form refers to PPI terms and conditions shown in enclosed leaflet plus balance transfer details on reverse of leaflet but no leaflet provided only one page of conditions which does not as far as I can see mention PPI or balance transfers AMEX have also sent terms and conditions applicable at point of cancellation but as I have never had much success at doing attachments just thought I would do 2 pages and see how it goes Any help would be great Thanks am (2 files merged).pdf
  7. Hi there I've had an Amex card (Amex BA rewards card) for several years. Back in September 2015 I sent a letter to tell them I had moved house and provided our new address. However I was getting my monthly statements on line by email so did not question whether they had updated my postal address on their records. In September 2016 I set up a standing order to cover £1000 per month payment but unbeknown to me the instruction failed. Even though Amex had my phone number and email contact details they did not let me know payments were not being received. Instead they wrote to me at my previous address. What's important here to understand is that up until this point Amex always contacted me via their online messaging system and my overseas mobile (due to the fact we lived overseas and this was an easy and immediate way to reach us). My expectation was therefore always that if Amex needed me urgently this is how they would contact me. Amex claim they never received my letter requesting they change my address. In January of this year (2017) I received an email from someone claiming to be a debt recovery agent for Amex. I thought it prudent to check with Amex this person was legitimate and also ascertained from Amex direct that they had cancelled my account and referred it to their debt collection agency. I immediately paid the missing payments and have continued to pay £1000 per month whilst I decide how to move forward. So my question is this? Even though Amex have cancelled my account they are continuing to charge interest on the balance each month. Which means that the payment I am making is mostly going to servicing the interest. I want to clear the original amount I owe them but do not think it is fair that I should have to pay interest when my account is cancelled. Should I talk to the debt collection agent and propose this? Or do I need to take a different approach (Ombudsman?). All advise greatly appreciated! Thanks in advance

    Amex this week have just passed my wife's account to Allied the account is a gold card we ran into a little trouble and we haven't been able to pay in full I had hopped to be able to deal directly with Amex on this smatter as it is only a few months overdue unfortunately Amex have pulled the trigger rather quickly Allied haven't written to us yet they have just started with phone calls and an email I just wanted to get plan of action started pre harassment from Allied And to see if there is any way I can just deal with Amex Many thanks in advance cancookwill
  9. I have a UK Amex. I have disputed charges via a lawyer on the card which I did not make and Amex credited back these charges then reversed them. The amount is substantial and over £50k I have also had foreign transaction fees added to the account I knew nothing about. They now want payment and I'm refusing to pay as I do not owe them the money. I have lived in the US with a US address on my UK Amex account for the past 6 years. So am not a resident of the U.K. As I'm at a deadlock my account is now due to default soon and I will owe them over £50k. Can Amex enforce card debts in the US if signed in the UK with a UK credit agreemnt for UK. Will they take me to court in the UK or US and what will happen next? Im not running away from the debt but want to know what will happen next or what I should do.
  10. Hi, Looking for a little advice on how to proceed,I I have received a CC claim form from Amex\Brachers regarding an outstanding balance on my former Amex Corp Card. I got made redundant in January 2014, before leaving the company I submitted my remaining expenses to the company for payment (The company paid Amex dues directly). I calculated my personal expenditure approx £2500 and paid this directly to Amex in February 2014 and I received my redundancy payment at the end of February.2014. In March I received a letter for late payment charges on an outstanding balance of £4415.41, I responded to them that I had submitted expenses to cover this amount with my former employer and did not hear anything else until April where I was contacted by Amex claiming to be the debt recovery department and asking when I would be settling my outstanding balance. I explained as before that i submitted expenses to cover this amount, and that they should take the matter up with my former employer, after a lot more call repeating the same information, I attempted to contact my former manager, the personnel department and the expenses department via the contact method for ex-employees. After a lot more emails (the only method on communication they accept) It was confirmed that my expenses although submitted were not paid as my former manager who is from Belgium had declined to approve them . My manager has refused to comment on this despite email phone calls & Txt's. The personnel department will not get involved as I am now not an employee. I repeated this information back to Amex who said they would contact my former employer for clarification, I was then sent a list of statements by Amex detailing the outstanding balance and a demand for payment and a hefty interest/latepayment charges. This conversation has continued and continued, Brachers then got involved and even suggested that I should sue my former employee for the money ! I am not in a position to pay the outstanding amount, my former employer is refusing to get involved, I have also learnt that former manager has now left. I am getting nowhere. I am still out of work with many other debts starting to pile up and this driving me insane. Any ideas on how would i file this as a defence for the CC, would this be accepted as a defence or am i wasting my time get the ccj and offer a £1 a month until restart work (hopefully soon).   11. I have a query in relation to my AMEX corporate card. This is a charge card and is fully cleared once a month by a direct debit from my personal bank account. American express are withdrawing these funds on the correct day. However, my statements and online account always report that the payment has been made a whole month beforehand. This means that my online balance is almost always wrong and the statements are not a factual record of the account. Is this even legal?? Here is their "explanation" for why this is happening: This hasn't cause any problems up until recently, but then I was surprised by a very large payment which was marked received on my September statemen t and I had removed from my budget planner. Fortunately, it went through without any charges but it could have really messed my finances up. Overall, this seems pretty dodgy and their explanation is flaky! Would greatly appreciate any advice about my options. Thanks, J

  13. Hi all, I have a corporate card through a very large organisation and I am leaving the company next week to start a new role. I have never missed a payment but the past month I have ran up a £2000 bill roughly. Stupid I know and I haven't missed a payment or anything. My question is..... My american express doesn't show on my credit file at all. I can not pay the full £2000 off in one go like you have to every month. If I didn't pay the bill my understanding and this maybe naive is that the company I used to work for has to pay it? If I did not pay it how could it effect my credit report? I am thinking it won't because it doesn't even show. If I don't pay the amount I will get a few nasty letters I presume. My point is if I don't pay the £2000 nothing will really happen? Am i being stupid, probably am. If I didnt pay what is worse case? As long as it doesn't affect my credit report I am not really that bothered. Thanks for help
  14. Hi, I hope someone might be able to provide some general advice. I am trying to reclaim £450 in Platinum Card membership fees, I have already unsuccessfully been through their complaints process and they've sent me the FoS leaflet. 1 - I've had both a British Airways Amex card and a Platinum Amex Charge card (with flexselect credit) for almost ten years. The latter has a membership fee of £450, paid in December 2 - I hadn't actually used the Platinum Card for two years until April 2015 when I tried to use it to pay for a hotel abroad - declined, despite my statement telling me I had over £1000 of my £3500 Flexselect credit available 3 - I rang Amex, and they essentially told me that because I was a risky customer, they were declining to put through my charges. Yes, late last year I ran into financial difficulties and had problems making loan and credit card payments and this will have affected my credit file 4 - However, at no time did Amex tell me I can't use the card. There is no notification on my online account, and I have received no letters or phone calls, so this is the first I had heard of it 5 - In fact the card does work sometimes. It usually works for smaller (less than £20) amounts in supermarkets etc. Not always. Yesterday an £8 charge went through, today a £17 one didn't 6 - I wrote to Amex making a complaint asking that my card be downgraded to one of the free ones, and that as I had been sold a card I can't actually make full use of, that my year's membership should be refunded 7 - Amex has rejected the complaint saying I could only have a pro rata refund (which I guess would be £300 odd) and making me aware that they can basically stop me using it when they want as it says so in the Tcs and Cs I would now like to complain to the FoC. The basis of my complaint will be that Amex knowingly sold me a card membership I can't make full use of, and never told me that I can't fully use the card. Had I known this, I would not have paid them the £450 at the end of last year. I have two questions: 1 - There is £550 due to be paid next week, some of this is from the small purchases I have been able to make - public transport, small supermarket shops etc. The rest is from my flex select balance. I am in a position to pay this, but would there be any grounds for me not to, if I am disputing the account? Or would this make things worse and I should just pay up as normal. 2 - Because the Amex card seems to work for most smaller charges, does this in any way negate my complaint? The £450 membership is sold with various travel benefits, but as I discovered I can't actually use the card when travelling Any other advice of how I should approach this with the FoS is appreciated. Thank you for hearing me out, all being well I'll look to submit my FoS complaint in the next few days
  15. Hi Guys After reading lots of useful info on here I have decided to get on top of my debts. Been paying Payplan since 2007. but have decided to take control. I have decided to CCA all my creditors. I have just received this from AMEX. I don't think it complies. However Amex say "these documents for the executed agreement between you and American Express". I'm not so sure? My ultimate aim is to offer one F&F offer to all creditor, If I can prove they haven't got a hope of getting judgement, the offer will be lower. One final point I now live in France and they know this.
  16. Would really appreciate some advice on a CCA request & reply from AMEX. The account was taken out in 1997 and in response they sent me: A copy of a 60 second application form (these are not signed on behalf of AMEX). It is signed by myself but does not contain any prescribed terms. It does say "I agree to be bound by the terms and conditions which form of part of the agreement". The "apparent" terms and conditions - these are barely legible and a separate sheet, unsigned by myself. There is no definite credit limit documented - just that "we will decide in our discretion, your credit limit from time to time and inform you what it is". (I am reading this with a magnifying glass!). They included a current statement of account and returned my £1 postal order as they are "happy to waive the fee". They have come back saying "You will note this has been signed and dated by AMEX and consequently the agreement has been properly executed". (They are referring to the "approved UK accounts box"). Can anyone with experience of AMEX agreements let me have their thoughts on this. I've been reading the forums for a while and have got some really good information from here. I think the time is probably right to SAR Amex. I'm pretty sure they don't have the original document - this looks like a microfiched copy. Thank you in advance.
  17. Hi!! I am trying to sort out my finances (many unsecured debts) and had to call up some dcas to get current balances. The one that looked after amex cc advised that it had been returned to amex and i should call them. I called and they advised that if i was wanting to set up a payment plan they assign to another dca and I would hear from them by end of week. Today, I received a letter from Amex stating they were willing to accept 40% and write off the 60% remaining as debt forgiveness? There is a time line to call them back I had not heard of this before and wondered if anyone on the forum could advise and if this is too good to be true? Thanks!
  18. I have been persistently contacted and pressured by AMEX for almost 1 year after paying the debt off to their debt collector in full. I have contacted AMEX on multiple occasions telling then this but they say it's still outstanding. Insultingly the have now offered to reduce the debt. The payment has gone to their nominated debt collector and I've double checked that. The reason I want to think about legal action against them is for the psychological harm their debt collection practice caused to me. I don't want to go into details here but my doc is satisfied it was down to that. Any ideas?? Thanks
  19. Hi friends, I am on a mission to claim all the PPI I have ever paid to all my lenders in the past. Amex is the only lender whose statements I have failed to retain. I have their Application acceptance letter for the Blue Card that clearly says .... I have a couple of questions. I am not sure if I need to SAR this lender. I know through this letter the start date but do not recall when I cancelled the card. What should I say in the FOS about the end date? Will "please check your records do?" Note : Apart from the above letter I have just one more letter in terms of record from Amex.This one is about a £5/- overdue amount but to my advantage has a date of Nov. 2004 which means I held the card at least for 4 years between these two letters. Dear Caggers The last time I had anything to do with AMEX was in 2009,when in response to a CCA request (for a debt dating back to the early 90s) they sent me an application form with the Prescribed Terms in a separate T&Cs document. I replied setting them straight in their error (sig and prescribed terms in four corners of document etc) and left it that they should no longer pursue me as they cannot prove the debit. They appeared to have taken this advice until last week when I received a letter from AMEX telling me that the account had now been closed, payment in full is due immediately, and that they are referring the debt to a DCA! I assume that they had hoped that if they left it 4 years, that I might forget their CCA failure, or that I might not have the original letter, envelopes and recorded delivery receipts. Wrong! So, do I just ignore them, or do I remind them that the account has been in dispute since 2009. Should I complain to the OFT that they’re harassing me? Cheers MSR
  22. To be brief.. Amex passed my debt (£2280) to AIC who harassed me to pay even contacting my elderly parents (not lived there for 20 yrs) and their health is not too good. At the time my world had started to fall apart for various personal reasons. I paid AIC but they kept chasing me and now AMEX have said they will write off some of the debt so it's now abt £800 less than I paid AIC. I've suffered ill health from this. My bank say it was defo paid. Can I get the discount back from AMEX? Please help. .my health really can't take much more of this...
  23. AMEX have written to me offering full & final settlement out of the blue and unsolicited. The offer taken from the letter : "If you pay just 40% of your outstanding balance still owing, we'll waive the remaining £0.00 of your balance in full and final settlement. In order to accept this offer, please call Amercian Express on 0800-etc. This opportunity allows you to repay a reduced amount from which you otherwise owe us. From Michelle Upton Manager American Express Address Amex House Brighton." They call this a 60% Balance Forgiveness. In brief this concerns an Amex credit card taken out in 1995 inclu. PPI and is in dispute since 2009. They closed my account July 2009 after i tried to make a claim on the PPI. They then had many different DCA's chase me as the debt was passed around without notification . Each DCA have been dealt with via CCA letter etc following the correct time-lines none have provided the information requested hence all are in dispute. Further oddities they lost my details on a laptop believed stolen, have had Amex letters advising i contact there insurance people only to be confronted with AIC and a rude aggressive French lady who told me PPI will not pay out until i am bankrupt etc etc Then all went went silent for many months until the settlement letter arrived this week. I need advice on dealing with this development please help
  24. Hi Folks, I had sent Amex £1 and requested CCA. They responded by saying chargecards are not regulated CCA. I then asked the DCA in question the same question and they have now sent me the below attached application form purporting to be the agreement but there are no T&C. The application is a very poor quality yet they are threating me to court if I don't pay the DCA. Is this application form enforceable ? please advise as I don't remember ever signing an agreement back in Feb 2006 with T&C. I have also asked the DCA for default notice, termination notice but they are not able to comply to my request apparently. Any advise on Law in regards to charge cards with prescribed Terms ?   25. Hi, Can anyone give me an address at Amex that I can get hold of the corporate T&Cs? Basically, here’s the story: Whilst I was in my previous role for a large company, I had a Corporate Amex card. Due to various personal issues (mainly gambling and alcohol related) I ran up a debt of £19500. I have seen been fired and the company I worked for passed the debt on to me. I received various phone calls from Amex and Brachers regarding the account but as usual buried my head in the sand. I’ve now received a Statutory Demand and am in the process of s*****ng myself. I have rang up Brachers and made an offer to pay which is being reviewed by Amex but what I’m now concerned about is that if it’s rejected they’ll continue with the bankruptcy route. I have my own house which is around £15000 in negative equity (mortgage plus secured loan) and is the house I co-own with my wife, and we also have a 9 year old son. Will I lose it? Also, is it legal for a Company to place a corporate card debt on to an individual? Not reading/remembering the agreement I signed at the company, I don’t know if it said or not they could do it. It is the type of card where I put in expenses then paid off myself. I’m absolutely petrified about what’s going to happen and don’t want to lose my house, wife and son (which I will if it goes that far!!). I’ve offered to pay £300pm until April then £400pm until the balance is paid, hoping and praying that they accept the offer. This keeps it to repay in total to 59 months, plus I’ve offered to pay my annual bonus of £1200 - £2300 gross directly off too. Can anyone please give me some advice on where I stand? Do you think I should speak to Amex directly about my offer? Many thanks, Steve
