  1. 11 years ago I was taken seriously ill and due to the illness I lost my job and ended up in a financial mess resulting in my house being repossessed. Thankfully my health has stabalised and I'm now starting to get to grips with my financial mess. Having checked my credit reports I noticed Natwest were reporting missed payments each month on two mortgages and a loan and hadn't recorded any of the defaults or CCJ's. I lodged a complaint with Natwest which they upheld due to inaccurate reporting of my credit file when one mortgage and loan had been paid off with a full a final settlement and the other mortgage had resulted in a repossession. To compensate me for inaccurate reporting over the past 8 years they've sent a cheque for £125 which I don't believe is adequate. However, whats more worrying is that they have now listed the mortgage shortfall as an outstanding mortgage even though the property was repossessed over 7 years ago. While I don't dispute the amount is outstanding I didn't think they could report the outstanding balance once the account had been defaulted and subsequently repossessed. Am I correct or are Natwest allowed to register the mortgage shortfall in this way on my credit file ? Thanks
  2. Hi all I've just been pulled up by the police who told me, to my surprise I had no insurance on my car. Our insurance was up for renewal in January so we let it automatically renew. £200 fine and 6pts on my license I came home to see what had happened. I have been driving this car for 3 years now. The Insurance company (first Central) told us on chat (can't get hold of them by phone) the details were correct that only my husband was insured. We looked for emails regarding policy documents etc. They said that they got details from confused.com and that's how they based their/our policy. Our previous insurance company always insured the name driver and spouse. I am not sure if my husband has ticked the box which states spouse or not and there is no way to check. Could I have been driving around with my kids in the back of the car without any insurance for over 2 years??? In December last year I had to go on a speed awareness course for doing 34MPH in a 30 zone. My question is wouldn't this issue have flagged up then? I did the speed aware course in December. Our insurance for the car was automatically renewed in January. Please help.
  3. Hello, I'd be grateful for any advice please. I've received a letter out of the blue from a company called Bristow & Sutor, who say I owe Recycled Council Tax on a property I left 18 months ago. I gave the local council my forwarding address & they also had my email address. I had this account with a payment arrangement set up directly with the council. The then current bill had been passed to a collection company. I was ill & unable to work & was self employed. I asked the council if i could pay reduced amounts but they just passed everything to the bailiffs. The amounts with the bailiffs have been completely paid off. This letter says I owe the council £220.21 & Bristow & Sutor have added on £310, total bill now £530.21, now with enforcement. I've looked back through my records & on the last call to an advisor the outstanding balance was £55 left to pay. I must have forgotten all about it & I received no further correspondence. I've managed to get the account suspended for 14 days while I try to contact the council. However they take 10 days to reply. I've been emailing since the 11th January. I had a response which confirmed all outstanding bills were paid in full with the bailiff company. And that this was recycled council tax. I emailed back to say the outstanding balance was £55 & my bank statements showed payments of £260 leaving a balance of £57, I copied the bank statement in the email too. I then got a reply from another person, junior officer, who then contradicted everything the first revenues officer told me. I've emailed again, but still waiting for a reply. I've emailed Bristow & Sutor & they've only replied this morning to say I have to make an arrangement to pay & if there is any amendment to the bill, the council will instruct them. I'm expected to blindly pay for something I have no idea why I owe it. I'm being ignored by the council, their responses are just not good enough. You just can't get a straight answer but I think it's more no one has any authority. Why is it acceptable for Bristow & Sutor to put on an additional £310!! But I'm very worried this is an enforcement agency, don't want any visits. I'm also worried as I can't pay very much a week at the moment. I don't know what to do. Does any one have any suggestions please? Thank you
  4. They used to be Blemain, now are 'Together'. I am always behind with my mortgage. I am on a very low self employed income and it is erratic. So always end up having to pay three or four months arrears when they threaten me with an eviction. They have an court order due to persistent late payments. My circumstances have changed since I lived at the house...my gf who is also on the Deeds split up. She pays the mortgage, I pay the second mortgage with Together which is about £500 a month. I can never do one of those things with income and outgoings because is so erratic and I dont even live there. But I pay it every few months when I can so she doesn't lose her home, and at some point maybe we can sell it. But, because of all the charges and extra interest etc the amount I owe after paying it for about 10 years is about £10k more than I borrowed! Yet am Paying £6k a year! Total amount is about £60k and its a high interest rate because that is all I could get at the time. So virtually everything I earn bar about £100 a week pays that. And as I only get money erratically and then £2-3k every three months or so on average, I can never get in front just keep paying off the arrears and my living and some debts. So I am very depressed about it and cant see a way forward, except that one day we may be able to sell it. But there is no equity in it atm, and I am losing £6k a year really while the market is stagnant and yet actually reducing nothing its gone up over £10k. Problems started when the banks called my business o/d and loan in as then I had no way of budgeting to cope with the erratic income. I am effectively homeless, and cant even get tax credits because of my circumstances, and living between a few sets of friends and a new girlfriend. She has a tiny flat so I cant store anything there, and cant stay at all when her son is there...no room to swing a cat. All my stuff is with friends in my 'rooms' there, and I have nowhere to sit and do my books which are a few years behind and no doubt I am being chased for that too on money I haven't earned but fines for late books. I am in a total mess and cant see what to do. What can I do? Are these charges even legal? I am told they are not? I want to sort this out first as it will be one thing off my mind if I can stop them doing that. Then I have to face the HMRC and explain why I haven't done my books for several years afterwards.
  5. Think I might be fighting a losing battle with this one but I'm coming to the end of my contract and checked my phone bill just to see what I pay out. Dont normally check the details I just pay it as I trusted that it was correct Really shocked to see throughout my contract i've been paying insurance which I never agreed to. Contacted Vodafone who said tough as I should have checked the phone bill. They also said I took the insurance out in store. I know I didnt take out this insurance and my query is can anything be done to get a refund? Surely they must have a signed copy of the agreement. Then secondly didnt like the attitude of saying if you dont check your bill then tough. What they're saying they can charge what they want and if you dont notice it then tough Any advice would be appreciated Thanks
  6. Hello CAG Members, I hope you can help.. I just returned home while being away for few weeks and I received 3 letters from mml and moriaritylaw. It looks like to me mml and moriaritylaw work together and this is in relation to the same debt. So 1st letter is from mmf - dated 27/06/2017 demanding payment for their client 405.00 Then 2nd letter - dated also 27/06/2017 demanding payment for their client PDL Finance Ltd t/a MR Lender £787.50 Then 3rd letter - dated 13/07/2017 - Final demand before proceedings, demanding payment for their client PDL Finance Ltd t/a MR Lender £787.50 Long time ago i toke a Pay Day Loan with Mr Lender and I paid it off however i was late and I think by one month. I pulled out my recent credit file and Mr Lender is there and status of account is 'Closed'. I'm nit sure what to do next. There is no default on credit record, account status closed - settled. Please help I looked carefully through letters and it looks like those are for 2 debts.. So 1st letter (debt) is from mmf - dated 27/06/2017 demanding payment for their client 405.00 owned to CFO Lending. Then 2nd letter - dated also 27/06/2017 demanding payment for their client PDL Finance Ltd t/a MR Lender £787.50 Then 3rd letter - dated 13/07/2017 - Final demand before proceedings, demanding payment for their client PDL Finance Ltd t/a MR Lender £787.50 Looking into my credit report I have only entry from Mr L and as closed / settled. I rang Paratus AMC Limited to ask what my mortgage repayment would be after the Bank of England Rate raise, I was not surprised to be told it had increased but was shocked when I was told Paratus AMC Limited had added Buildings Insurance Premium of nearly £50 a month to my mortgage repayments!! - which means I would be paying over £500 a year just for insurance, when the fact is I have my own buildings insurance and much lower. I asked why they had added Buildings Insurance Premium, I was told it was a legal requirement, but I've had my own Buildings Insurance in the past and never had this problem before! Now out of the blue, Paratus AMC Limited have added Buildings Insurance Premiumof close to £50 following the Bank of England Rate raise. I told them I have my own Buildings Insurance and I want the Buildings Insurance they have added to my mortgage to be cancelled, but they refused to do so, asking me to send in the insurance schedule, so they will check it and then decide if they want to cancel it or not. They also sent me a letter, detailing adding buildings insurance to my mortgage, again they should never have done this without asking for my permission and I don't need it because I have my own insurance. Paratus AMC Limited have added the Buildings Insurance illegally without my permission, they can't do this and I want it cancelled with ASAP. Please help me draft a strongly worded letter I can send to them, before my mortgage payment is due later this week. Do I really need to send them a copy of my insurance schedule or will a strongly worded letter be enough?
  8. Good afternoon. I owe a trade supplier £200 for goods I have received. I have returned stock to the value of £139 which they have agreed to credit me with. Therefore I owe the supplier £60. However they have got a DCA to chase me and the DCA are claiming £566 presumably made up of some jumped up charges. I have asked the DCA to confirm what I owe for Goods supplied but was wondering what else I should do? Thanks in advance
  9. Hi I have just received a change to my credit file alert and when I checked it is a CCJ added by County Court business centre. I do not know who has issued it it just says the amount. It was served at an address I moved from 18 months ago. Can I get this set aside and find out who has issued this? thanks

Hi Every time I read about Single Premium PPI, I am always told that most financial institution will add the cost of the policy to the principle loan and pass both amounts to the borrower as said loan as per the credit agreement. If most do that, what do the others do? I ask as my partner a had Single Premium Policy which was deemed mis-sold however she never actually received the cost of the premium ie the premium was not added to the principle loan and deposited in her current account, although the cost of the Single Premium was added to the loan account to be repaid, which she did. I think she was swindled but she says it is not the case. Can anybody advise regarding my question above? Thanks!

  12. I went into Argos to use my card which had an available balance of £50 (I logged into my account online to check) and the card was declined in store. I called them up and they said my account has been closed and they are seeking to recover outstanding balance of £250. I hadn't. Even. Profiled that it had been closed and been making payments each both. They said I'd missed a couple of payments (which were late not missed). If only received statement letters from them asking for minimum payment and they are still charging me interest! I'm not in a position to pay more then the minimum payment but will never clear it at this rate and there's no point trying to and putting myself in debt with other creditors. My husband is the only earner and we struggle month to month. I've tried to keep things afloat but it's been hard. How do I get a final balance from them and get them to stop charging interest? Thank you
  13. Hi, my balance was £6,700 on my MBNA credit card and paid £4,409 which made my new balance £2,224 owed. My direct debit then paid the minimum of £67 which should of then made my newer balance £2,157 but this did not happen, instead, my balance owed went from £2,224 to £2,291, adding £67 to the debt rather than deducting it. I'm currently in a interest free offer and I have not used my card. This has never happened before, it's strange.

Hi there, friend of mine has been dealing with cabot for a CC, she has ignored them for some time recently been receiving letters regarding going to court from their solicitors stating the amount court costs would be, she is not worried about that as she knows it will be statues barred very soon but she has just checked her file on Clear score and the amount has been increased by the amount of court costs described in their last letter. Can they do this, add the costs on to her cra file before it's even been to court? Many thanks.
  15. Please help!!!! This is a long story so please bear with me. My sister hired a car last year to move home. She was on the hire agreement with my Dad as a free driver also. My Dad was caught by a speed camera while moving her stuff to her new house in the hire car. My sister put her current address on the hire agreement The address she was moving from NOT to as she stayed there until two days afterwards. She did not pay for mail forwarding but asked landlord to forward any mail. A NIP was sent a few days afterwards to old address as this was provided by Enterprise hire company. She changed address with DVLA three weeks after moving and recevied confirmation four weeks afterwards that they held her new address Six months afterwards she hears from the DVLA that they have given her 6points and £900 fine for not attending court and providing driver details. She obviously did not know as everything went to old address. She went to court again as she explained she didn't know about it. She was told she did not need legal representation and just to take my Dad and explain he was driving. They both went and my sister pleaded not guilt to speeding (As it was our Dad) and not guilty to providing driver details as she felt she had changed her address in the correct time frame. It is now going to trial and she has been told lots of different things regarding whether she was right/not right to plead not guilty. Apparently the hire company should have told her to provide a forwarding address?? is this correct? The agreement doesn't give her the opportunity to do so. Advice would be VERY most welcome as my sister and my Dad are both very upset
  16. Hi, thanks in advance for looking at my post. Basically, in 2006 I took out a buy now pay later deal through land of leather with creation. land of leather told me i would be contacted when i needed to start making payments but never did. after taking out this deal i went through a rough patch after having a prem baby and becoming a single parent in the space of a few months with no job and was extremely depressed and i forgot about the sofa payments. the next i heard i had court papers, i contacted creation to ask if i could start making the payments asap and they told me i had to pay the full amount plus the interest i would have been charged or they would register the ccj. i couldnt afford to do it and the ccj was registed and a charge was put on my house. anyway, the house is being sold, its meant to exchange next week. my solicitor has contacted creation for a balance and it is 5139.19!! the sofa originally cost 1495 and i took a 2 year warranty 240. on my credit file under creation it states 3639 and they have logged every month since 2006 sustained arrears. i contacted creation to ask why the balance is so high, they told me it was now with drydens. i called drydens, they told me the 5139.19 is the balance creation had sent to them and they had never added any fees and didnt have a breakdown. i recontacted creation and i was given the balance of 3638.55 and they told me any other fees must be drydens adding them. i am so confused and neither company is offering to help me or give me the information i need. i am about to lose my buyer. please help me
  17. hi - I am really stuck with this, I had legal costs added to my mortgage (past repo attempt) but they were above what the court allowed, eventually I got them back by going to court but they remain on my balance attracting interest. The mortgage company say I should have given them the money (about £1,500) but it was not actual money, it was charges they added. I asked the legal firm the mortgage company had used to take me into court originally, to show that the mortgage company had actually paid out the amount they had not - the legal firm had charged the right amount but the mortgage company elevated the costs, as they do. I am still stuck wondering what I can do about the additional £12-15k they will have made out of me for interest on that 'notional money'. Any ideas as the FOS don't seem to understand. There is no agreement that covers this and they are now saying it forms a new loan but I cannot understand how when they caused all the problems by trying to adding fees unlawfully. thanks in advance.
  18. I was in Court today and heard a case that involved a debtor with a Court fine, this was in the enforcement stage from a few years ago. Whilst watching this case I was intrigued that the defendant (D) was able to successfully swear the SD. The reason this was more interesting than normal was this was a fine for a traffic offence more than 18 months ago and was at the enforcement stage. The defendant was shocked that the first they knew of the debt was when the EA came calling. Good friends advised the debtor to make an SD. This was heard today. The bench in its wisdom made the following comments, Reheard the means form (MC100) not heard at the first hearing Bench asked if D would have pleaded guilty and paid the fine if they had attended that day, D said yes The bench reduced the fines and costs to monies already paid to the EA. Said to D your fine is now paid in full and you owe us nothing. Due to the bench rehearing the case it in fact noted that D had paid over what was due with their new levels of fines. But said they could not return the extra money at the moment. The bench at no time asked D if they had received the further steps notice. D had made an arrangement to pay the EA but never had a CGA in place. Now this is where it gets interesting, since the original fine has now been changed and that all payments to the EA been accepted by the Court as payment in full. But, as this case had gone out to enforcement can the EA still claim the fees added to date? Then bench said to D that they were to inform the EA that the case has now been reheard and that any monies due to the Court are now paid in full. Since the case has now been reheard and all monies due to the Court are paid , but, minus the EA's fees can the EA' still go after the fees that have been due to this point? I believe not, due to a new hearing and a new outcome which in all respect has put the case back to the equivalent to the day of the original case. Therefore now enforcement cannot be continued and in this case the EA has to abide by the new hearing results. Can the EA now go after the fees that have already be added? I think not. As the reason for the enforcement has now ceased due to the new hearing.
  19. For a very long time (at least four years that I know of) plans have been made at the Ministry of Justice to charge a fee to debtors when court fines are imposed. I have posted brief details of these plans on the forum over the past year and the official announcement was made yesterday of the actual amounts and the reason why they are being charged.   20. Hi Guys, I have had ongoing correspondence with opos regarding a loan I took out with MiniCredit almost 2 years ago. After repeated requests for them to provide me with a completed breakdown of the claimed debt including charges/fees/interests I have finally received the below. They are attempting to claim £1,187.50 on an original loan of £150! Would appreciate any advice on how to respond. I am sure the Debt recovery fee and attempt fees are unenforceable. Here is the requested statement : Loan reference: Date issued: 01/09/2012 Due date: 25/09/2012 Loan principal £150.00 Interest £217.50 Overdue charges £80.00 Debt Recovery fee £100.00 Attempt fees (£5 per attempt) £640.00 Total balance £1,187.50 Payments received 31.10.2012 £100.00 05.11.2012 £100.00 Sincerely, Derek Thanks in advance guys.
  21. HI I have been dealing with MYJar over a text loan from a fair while back. it was paid monthly via stepchange for a while and then when i left them i offered to pay monthly. I only borrowed £300. They said i owed them £276 and i was to pay £1 a month for 10 months and then the remainder off. Anyway, i was paying £10.00 a month and in February i sent a payment on the 1st and one on the 28th. They then got in touch 2 weeks ago and said as id missed march payment then the plan was cancelled, the loan followed its original credit cycle and additional charges were added as per the original agreement and the loan was forwarded to Secure Recoveries. I have checked my credit record and there are now 2 entries from MyJAr 1 for the original loan being showed as paying back and the other is for £1543. I called them up and they said it is Secure recoveries. What can i do I sent them my income and expenditure months ago and a covering letter as i couldn't afford to much payments. Shall i keep ignoring Thanks
  22. Hi Last year we were in mortgage arrears and were told we would be taken to court, they were after a possession order. Stupidly I didn't get legal advice due to cost and my local CAB being unavailable pretty much all the time. The Mortgage company said if I arranged an amount per month with them in additional to my payments they would just get a suspended possession order and I needn't attend court (bad advice it seems but I was naive). so they got their suspended order and we started paying it, but then had some work difficulties and went through a period of not being able to pay the full amounts. Now they are saying they are going for an eviction though no date is through yet. There want a large lump sum, I don't have one. Help! I have filled in an income and expenditure which proves I can now afford the regular monthly payment, the spo amount and a small additional amount towards the arrears but it sounds as if they won't agree and just want possession now. Will they get it? There are a few hundred £'s of insurance payments on there which they say they will remove due to me already having buildings insurance elsewhere. They have bought this mortgage off another company which were charging me arrears charges of around £55 a month too. Can anything be done about that? Because if all of those things came off we would be a bit nearer to making a dent in the arrears? Basically help! I have three kids and am worried sick!
  23. An agreement was made at Court with the mortgage company to sell the property within 3 months. A money judgement was made for around £183,000. We could not sell the property within this time so we asked the lender for more time. They agreed to 3 more months and also informed the court in an effort to save costs. The house was sold within this time - it was actually 3 days over the original time given on the Court order. By the time the mortgage was redeemed, they added over £9,000 in costs to the mortgage account. I have heard from one source of legal advice, that if the house was sold within the time allocated, that the mortgage should only be redeemed for the money judgement amount. Is this true?? We have taken this to the FOS - at one point they said the mortgage company should repay the £9,000 and take it back to the money judgement. However they have come back with a pitiful offer amount, siding with the lender. If anyone can shed any light on this, or need some more info, please post. Thank you
  24. Hi All I have been paying Rossendales regularly with an outstanding council tax bill. I missed a payment by 2 days and tried to pay online. I put in the wrong card details and they blocked me from paying online. I did call them and they wouldn't take the payment over the phone as said I needed to speak with someone that wasn't in the office regarding my broken agreement. Today I have received a visit from an Enforcement Agent who left a letter for me adding £235 on top of the £140 outstanding bill. I am unemployed and now getting in more of a panic..... Please help

Hi each and all, I have just checked my Credit File on Experian, it is squeeky clean APART FROM a default from Northumbrian Water, now granted I have never paid water, nor have I ever communicated with them regarding my bill(s) they even started sending letters addressed to the present occupier, I have signed nothing, agreed to nothing, never spoke with them, nothing, yet they have placed monthly defaults dating from the 8th month 2014, i have cicles with "8" inside which states: " The account is in 'default'. You failed to keep to your credit agreement and have not responded satisfactorily to requests to bring your payments up to date, so the credit agreement has ended." How the hell can a company I have never had any dealings with, and not signed any credit agreement forms do this? is there any way round this as it has completely obliterated my Credit File, they claim I owe them £1709, this is like not paying your garage bill or paper bill and them placing a default on your credit file? is there any way round this joke or am I done for?
