Hi I was on IB before 2001 and recently transfered to ESA (con base) Im having problems with DWP not accepting Entitlement to Incapacity Benefit prior to 6 April 2001 they are deducting an element from my occupational pension I have written to them and 3 weeks later received a letter stating "you are being paid the correct amount taking into account the amount of occupational pension you receive" can anyone give me a link to an official document that sets out the above rule please.   2. I paid them for a couple months via Monthly Standing Orders which i set up, this was after the Debt Management Company I used folded, I then stopped paying all of them recently ... I have just received a true copy of my original CCA from Halifax, back dating to 2001, so will now need to sort a repayment offer with them They are the only 1 from 5 to provide thus far, so tbh i still had a great result This is very true, i assumed info from a company like StepChange would be best i would get, not a mention or suggestion of doing CCA's came from them Sometimes their hands are tied to give certain aspects of advice and as I say CAG was a blessing in disguise when i read what people were saying about making CCA requests I have just received a true copy of my original CCA from Halifax, back dating to 2001, so will now need to sort a repayment offer with them, they are the only 1 from 5 to provide thus far, so tbh i have still had a great result !   3. Some way down the road with this already having sent letters and schedule of charges etc. Got some money knocked off twice. Sent a Letter Before Action but have not been on top of things and not followed up at 14 days. Weeks have passed. Am now going to file for court in earnest after sending a revised Letter Before Action. I'm not really happy with the way I am calculating interest in my prior documents and want to get it right and proceed with vigour. THE PROBLEM: Historic charges were applied on particular dates and did or didn't attract interest for varying amounts of time depending on how Barclaycard decided to play it i.e. A charge goes on, there is say 28 days when it does not have interest charged on it then it falls into the main balance and then charging of interest commences as if it were a purchase. When payments are made it is the first, second etc amount to be paid off and then it ceases to attract interest even if you still have a balance which was formed by purchases. THE QUESTION: Do I need to give a monkeys about the nuances of the above dates, payment thresholds etc? Is it OK to just say it attracted X numbers of months of interest which corresponded to the next time I cleared the balance? The money that paid it off would have paid off an equal amount of the "real" purchase balance if the charge had not been applied in the first place wouldn't it? ALSO: I am finding a lot of what would appear to be dead links to spreadsheets, letters etc. The ones I do find seem to be out of date for one reason or another and the forum/wiki seems to be very hard to navigate in terms of finding appropriate documents/attachments. Is there a page which has all the most up to date forms on that I am missing. I'm particularly needing a restitutional interest spreadsheet and good/recent Particulars of Claim texts.   4. Hi all, I’m really hoping that one of you may be able to help me? I’m going to try and cut a very long story short so here we go with the salient points. Back in 2001 (yes, 2001!) my father who was over 60 applied for a TXU StayWarm account which I believe was government backed and enabled users electricity and gas for a flat fee of £53.20 per month. At this time he had an NPower (or their alias back then) account and notified them he would now be moving onto StayWarm and leaving NPower – I have a signed contract between him and StayWarm dated 2001. NPower, despite being told he was switching providers never released his account to StayWarm. The first he knew about a problem was correspondence that he wasn’t paying his gas bill and a demand for a sum of approximately £5,000*18months later. This is when their endless and relentless pursuit of him began for this ‘debt’. It appears that they failed to cancel his account and were misguidedly billing him for energy use. He has never received the money back that he was paying during this time to StayWarm and now, despite paying his monthly payments (StayWarm was stopped shortly after these problems began – hence back to NPower) there is a ‘debt’ hanging over him. *Since then there have been over 55 separate demands for a sum of money between about £5,000 and £8,000 although the number is never the same (ie Jan ’09 £8,182.63 and March ’10 £5,899.95) Numerous letters from the bailiff threatening a warrant to enter his home and he should attend the magistrates court on a certain date. I attended during this summer and it was made clear that these should never have been issued because it was a ‘dispute’ over a sum of money and there was no question that he wasn’t paying his bills. Recent claims that there were two gas metres in the house; I have checked and there is only one. Customer services are useless and at times aggressive He pursued the case with a solicitor in about 2011 but once the solicitor bill got to just over £1,000 couldn’t afford any more money to pay them. Despite the fact he pays monthly over the post office counter (with receipts to prove) they claim in correspondence that he isn’t paying his current bills, and then when challenged are forced to admit that infact he is... Unfortunately this is really affecting him and his levels of stress; and the whole family. How it has been going on for so long I just don’t know, but I am now having to deal with it because I am genuinely worried it will affect his health (as you can imagine he is of a certain age). He applied for an SAR during the Summer but the NPower records only go back to 2008 so they have no proof or evidence where or what this bill is for. In among the huge file of paperwork is however multiple references to *Please do not inform the customer of any potential writeoff* He has been to the ombudsman and despite the lack of evidence from NPower (no records before ’08) have sided with them and summarized that they should write him a letter of apology and give him £150! What do I do? How can I get them off our backs? Many thanks in advance. John.
  5. I took out a loan in 2001 from IGROUP loans. I spoke to them last week about reclaiming my PPI. I was (and still am) a Local Authority Officer at the time and would have received 6mths full pay and 6 months half pay if I became ill and could not work. I have just come across the papers for the loan. I made copious notes and there is no evidence of a discussion about what benefit my employer offered if I could not work. They have informed me that they cannot offer a refund because the PPI was sold by a broker - Headland Finance. What is the procedure if the PPI was sold by a broker? All my monthly instalments were paid to IG loans not to the broker? Is there anyone out there who can offer some advice? I do not believe that the PPI was necessary.

This is a long shot but wonder if anyone could advise I had a £7,000 loan from lloyds with PPI .. if i remember rightly it was around 2000 . i fell in money problems - basically living off credit cards , fell behind with loan repayments and ended up around £1000 overdrawn which got bigger and bigger with the constant charges , and fees for letters to tell you , your were overdrawn after burying my head in the sand for ages i finally set up a debt management plan with CCCS to pay off the lloyds loan, overdraft , MBNA, egg and barclays. Lloyds refused to accept if for about 9 months (the CCCS advisor told me this would happen, even told me which depts would write to me and what colour the letters would be !! ) so for 9 months masses of charges were added to my account , every month they would debit for the loan repayment, PPI and missed payment charges etc , then finally they accepted the DMP - by now with around an extra £1000 + added to my overdraft !! i slowly paid off everything with my DMP and slowly just had LLoyds left to pay ( i upped payments and as one creditor was paid off , assigned the rest to lloyds. ) This took about 5 years to pay off and i came into a bit of money and asked lloyds for a settlement figure which was around £3600 - as i had kept up my DMP, upped payments etc they rounded it off to a final payment of £3000 , which i paid. would it be worth doing a SAR to try and claim back the charges, and PPI - i would understand if they no longer had any record of me - but if they did have details of my current account and loan account would they refuse to pay anything as both accounts were defaulted and came under a DMP ? PS : for the record if anyone is interested Barclays accepted the DMP straight away and so did EGG - MBNA argued for about 3 months but then accepted it , LLOYDS took about 9 months+ before they finally accepted it and stopped all interest and charges
  7. Hi guys, Long story short, wife has a debt from 2001, hasn't paid anything since 2004. Cabot recently took us to court we cca'd them, they dropped the case and we heard nothing. Until now, the case was dropped in December, they sent a CCA today that looks legit, it has her old signature on it, she's now married ofc. Do I now reply with the statute barred defence? Any advice would be good.

  9. I have an old student loan from 1993. In 2001 I fell into arrears and received a ccj. I have ben paying this off at a pound a month with their agreement. I have now had a letter saying that the debt has been sold and that interest and account charges are being applied. Can they do this? How do I fight it as they want @300 a year in interest and charges so the debt is spiralling out of control. There is no way I can pay it as i am on benefits. The original debt was less than a thousand.
  10. Hello, I just received my information back from the Royal Bank of Scotland today from a SAR I sent them end of June 2014. One of the requests I made was for my RBoS MasterCard Credit Cards. I received all of my credit card statements from 2004 but they only go as far back as October 2001. I had my credit card from the mid 1990's So I contacted the SAR Team at RBoS Cards Customer Services at Southend-On-Sea (0845 835 5470) I told them I only received my credit card statements but they only went as far back as October 2001. I was also told that they changed their system during that month and year and that was the reason why they only went back that far. They also said it was their Policy that they now no longer hold customer statements from before that time. I asked to see this Policy as I was not satisfied that they had looked further back, but I was told that they would not send me a copy of this policy. I also enquired about microfiche and any other system where they would hold older records but again I was told that ALL old records were put onto the new system or as much of it as can be... Of course I was not happy with their explanantion and I have no intention of being fobbed off that they no longer have a database that does not go further back from Oct 2001. I simply do not believe them that their records of credit card accounts and their statements now all start on October 2001 What can I do now, as I simply believe that I have been fobbed off? I still believe that they have my old pre October 2001 credit card statements. As they have not sent me any information to me showing me how and why my old records have been deleted or destroyed. I would be very appreciative if anyone can give me some guidance on this as I can see on the statements that I do have I was being smashed for "card protection plan" payments ranging from £17 to £27 plus, per month up to 2004!   11. Hi all I am in the very early stages in trying to claim back PPI on the loan I took out a secured loan with Welcome Finance back in 2001. I took out a £5,000 loan and was told I had to take the PPI out or I would be refused the loan. I repaid the loan in 2007 and I think I paid in the region of £21,000 all in! I didn't think about claiming PPI until quite recently as I thought once I had paid it off it was finished therefore no point. I have emailed Welcome Finance as I do not have the original paperwork or account number. They have emailed me back and asked me to send off either £1 for copies of my loan agreement or £10.00 for a full Data Subject Access Request, where they provide all information held by Welcome Financial Services Ltd. They have also emailed me a PPI reclaim form which they cannot deal with until I pay the fee. I am fine with this and think the £1 fee is enough as I only had one loan with them, would that be right? as my loan was pre 2003 which seems to be a sticking point for most, will my claim be automatically rejected? I have no idea how much PPI I would have paid for this loan. It was a loan over a 10 year period but I paid it off early. Many thanks for anyone that can help with my queries.
  12. Hi everyone, looking for a bit of advice as im getting more and more frustrated with this. I had a Lloyds TSB account, opened in 1998 that I had until december 2001 when I switched my account over to Abbey (through work, was a requirement to have an Abbey account weirdly). I had a phone call in november of 2001 advising that 2 companies could not be switched over due to the DPA, so i rang the 2 companies and gave them the new account details (one was o2 for a mobile contract, cant remember the second one). I then went into the local Lloyds TSB, and handed my card, cheque book and a hand written letter asking for the account to be closed. I heard nothing more from Lloyds TSB until the middle of 2002 when I received a letter stating I owed £320 for unpaid DD charges. I rang the collections department and said that i had closed my account in december so did not owe anything, to which the advisor said that they could see the account was closed so would write that off and i would hear nothing more of it (not those exact words but you get what i mean). I did not hear anything for around 3 years when this amount surfaced when a DCA wrote to me saying they owned the debt (alleged) and i had to pay them. I rang them back and explained that i did now owe anything, which no surprise fell on deaf ears. I have ignored these letters (and phone calls), and after a while they disappear only to resurface a couple of years later with a new DCA. I do not call these companies now, and do not correspond with them. ABout a year ago one company offered me a settlement figure of 45 quid to clear the lot, however as i do not owe anything why should i pay any figure. I am now being hounded by Mckenzie Hall, who are writing letter after letter and leaving voicemails on my home phone number at least once a day. I have had the misfortune of speaking to them on the phone and when i refused to cinfirm any details the guy said they would write to me but would continue to call me. I am now at the end of my tether and really need advice on what to do as after 13 years this is still causing me stress and worry. Any advice will be gratefully received. Ray
  13. Hi, I'm new here so all help is appreciated. I had 5 loans with barclays between 2001 and 2003, I took out 1 loan and then refinanced 4 times. The cash prices not including PPI or interest were for; Loan 1. £1500.00 Loan 2. £2200.00 Loan 3. £6000.00 Loan 4. £6400.00 Loan 5. Unsure I made a complaint 3 weeks ago and have forwarded a SAR to barclays so I have all info incase I need to forward my complaint to the FOS. Does anyone have any images of a barclayloan agreement around 2001 and 2003? I did not ask for PPI and had no idea i had it until i contacted the bank so i'd like to take a look at an agreement to see how i could have missed signing up for it (if i did?)

Hello Some advice please would be appreciated with regards to Credit Agreements and PPI I have a copy of my Old Egg Card Agreement dated 28/01/2001 - Amazed I kept it but its the only CC I currently have which is now with Barclaycard The first page of the Credit Agreement has a section on PPI ---------------------------------------------------- Limit x Interest and Credit Charges x Repayments x Your Repayment Protection premium is payable to the insurer at 69 pence per £100 of your monthly statement balance for the accident, sickness, unemploymen, life and serious illness cover you have choosen in accordance with the Egg Card Repayment Protection Policy document supplied to you The argument I am currently having with Barclaycard is they state that PPI was optional on the Credit Agreement, and I am stating the following No sign of the word optional against the PPI details on the first page of the Credit Agreement or maximum amount on the credit agreement I was made to feel that PPI was not optional once again after the on-line application with its pre-ticked box No where did it say interest would be added to the PPI I could only cancel the PPI policy if I took out a new credit agreement - this is now considered to be unfair by the FSA Are my arguments valid, I appreciate any comments and differing opinions, thanks in advance
  15. Hi, I have found some old paperwork regarding another matter (under a different thread), that also includes all the paperwork for a LLoydsTSB bank loan that I took out sometime around 2001. Now on this paperwork at the bottom it states: Optional Loan protection YES ticked Premium advanced as part of loan YES ticked Now I was not working at the time loan was taken out & was in fact registered disabled. So there was no way I could have claimed anyways. Can I claim anything back at all & if so, how do I go about this. The Documents I hold are "Credit agreement regulated by consumer credit act 1974" which gives details of the loan amount etc. Also 2 pages of "Terms & Conditions" this is all. Many thanks
  16. I thought I already had a thread for this but can't seem to find it, so doing this one, so as to give encouragement to those who are having problems or are unsure about claiming. In February 2012, I sent off my PPI claim to Barclays for a loan I had taken out in 2001. In April 2012, I received a generic standard rejection letter and phoned them to find out the specific reasons and was told that it was because they had no copy of the agreement. Luckily I still had the agreement and other supporting paperwork so sent them a copy of that, with a letter that I required them to re-examine my claim. After many months of sending them "What are you doing and hurry up" letters and a Formal Complaint about lack of responses and the time taken, they have now replied. They have upheld my claim and enclosed a cheque for £2300. I am very pleased with this as it is just slightly in excess of my calculations. It does go to show that you must challenge them and not just accept any old tosh that they send out. It does also show that you can do all this yourself and don't need these so called expert claims companys. Of all my PPI claims, I now only have one that has not paid up and that one is with the FOS, so may be some time yet. Just remember "Never Give Up: Never Surrender". Jedicris
