  2. Hi , went in my branch today to cancel 4 continued payment authorities. They said i could not do it in branch , but i asked them to phone their head office, then i spoke to to a gent on the phone who said they can only request to stop one which was pduk as that was the only cpa on my account although wonga , cash.co.uk and mr lender are listed on my statements. what are my options to stop them taking money from my account i have 7 days.
  3. I had a business account with NW and recently sent them a SAR (and £10 cheque) which they received on 16th August now well in excess of their 40 day requirement I have also now sent them the letter before court action, time period also expired without any contact. Wherer do I go from here?
  4. I am hoping someone can please give me a bit of legal advice ? I have 2 council tax debts with Rossendales which i have tried on numerous occasions to sort out,i have sent them numerous financial statements for them to say they have not received them(how convinient).they have now received them and ingnored my offer of payment, which is only minimal as i am struggling,i do not work and receive widowed single parent and child tax.they are saying that i have surplus income and excessive spending !!!! who the hell are they to tell me that ?? i have been honest as to what i get and i have more outgoings than incomings. Is there a limit they are allowed to take off you the same as the council have ? I have also had the bailiffs sending letters but i have not spoken to them OR LET THEM IN !! i have been told a few different stories regarding bailiffs,i know that if you have not let them in at all they are not allowed in,but i have also been told that a council tax debt is a criminal offence and they can enter when they like ? I hope someone can please help me as i live in fear of loosing all my stuff and i dont want that for my daughters sake
  5. Hi, advice please? I have made a claim on my contents insurance (1st claim in over 5 years), my son lost his mobile phone at a music gig, it is nearly 2 years old so he has not got the receipt just the box with iem number and charger and earphones. They say without proof of ownership they won'y pay! It doesn't mention this on my certificate nor did they say this when I took the policy out, and after thinking about it, I don't have receipts for over 90% of my possessions and home contents! so this makes my whole policy useless, it can't be legal surely?

  7. PLEASE HELP.. I am new to forums and would love some guidance and advice with the finance company BCT. I bought a car several years back and the finance was with British Credit Trust over a 5 year period. After over 2 years of on time payments my husband lost his job and after trying to keep up he eventually had to give in and ring them to say we just couldn't afford the monthly amount of over £250. After their refusal of £50 a month until he found work, we started to get letters regarding payments falling behind. In December we received a default letter due to the arrears and other letters stating extra charges were being applied etc which we accepted as it was our fault. After several missed months and arrears of over £1000 we received 2 copies of the same letter stating that if the arrears were not paid in full within the next 7 days, the debt would be passed to a collection agency, we wanted to avoid this for bad credit reasons and a family member came up with the cash for us to clear the amount. When we called to pay this (before the deadline), we asked them for a print out of the amount being paid and notification that the account was up to date and no further action would be taken. They sent this and the info regarding the remaining monthly payments on the agreement. We paid 1 more month and then decided to VT the finance and return the vehicle as we had paid well over half and knew we were within our rights to do so as this was stated on the credit agreement. We sent a written VT recorded delivery which a week later rang them to check they had received this, they said there was a letter in the post regarding this. The letter arrived stating my husband could not VT as the credit agreement had been terminated by them. They said they had sent this letter weeks ago which we never received and we told them we hadn't which they responded to with a duplicate copy. It was dated the same time they sent us the 2 letters threatening to send the finance to the debt collector. Several calls over several weeks were had with myself, husband and BCT, they never once mentioned the termination of agreement and still when we paid the arrears and asked for the letter to make sure all was back to normal, nothing was said. Even that letter stated what payments were left in the agreement. This vehicle has now been sat on our drive for months and we refuse to pay any more of the finance and we refuse to do what they are asking which is a VS. Anybody know where we stand HELP .
  8. To cut a long story short. I purchased a car and within a day of owning the vehicle the brakes failed. The car was recovered to a local garage and they highlighted some other major issues resulting in the car being unroadworthy and quoted repair costs of £600. With a few conversation with the garage they stated they are willing to repair the vehicle. However, they must inspect the vehicle first and i must take the car back to them. This wouldn't be possible due to the issue with the car and i feel i shouldn't have to spend over £120 in having the car recovered back to them - especially when i have only owned it less than a few days. I put in writing that i wish to reject the car and claim a full refund. However the garage are refusing to do/offer this only stating they are willing to do a repair - again i must return the vehicle. Who decides/is it my right to ask for a full refund rather than a repair? SOGA?

We decide to put the house up forsale but to live in the same house until it sold because it was easier than running two homes we have dropped the price of the house to what we owe bank but cant any further we have not even had one viewer we dont live in a great area really. My wife has been paying the mortgage and i put all my benefit into running the house she has now said with all these welfare reforms coming in if i move onto Income related ESA and lose my benefit because of her income she will not fund me anymore. I am at my wits' end i havent a clue what to do if i move out into a flat she will be looking money from me to run the house i will need money to run the flat we have 2 children also. I feel like putting a rope up because i think they will all be better of without me.
  11. Hi.. Following with interest, as I am having my own issues with HAstings D. HAve you managed to get it sorted yet?
  12. :-)Hi, I'll try to keep this as short as possible. Basicly, i purchaced a car Vauxhall Astra 03 plate 1.8cdti, on 23.7.12 £1.5k, paid on my Visa debit card, from local car dealer, got no logbook with car, got told to go to post office to apply for one, just the m.o.t and a bit of service history, on my receipt it says 'Trade Sale'. We drove the car home (2 minutes away), Engine management light on and car wouldnt lock with keys. We drove car straight back and its been in the dealers posession ever since. (3weeks today) !!. In this time the car has been in 4 different garages (Including vauxhall) for diagnostic's & repair and still isnt fixed. When we checked on Friday with the 4th garage the car is in for repair at, mechanic said no parts have been ordered and thay are chocca with work so trying to fit my car in as/when they can. So,,, I decided to reject the car under the s.o.g.a on friday, as dealer promiced it would be fixed by that day, and if it wasnt he would refund me the money. When we went in on Friday for my refund, he refused as in his words 'he is still trying to fix it'. and if i want a refund i can take him to court. We have been lied to constantly about repairs over the past 3 weeks, 'its had this part fitted and that part fitted, parts are on order, bla bla, etc' . And basicly all communication has now broken down with dealer, as i relly lost the plot on friday, and gave him a right mouthful. So, ive returned the m.o.t & papers, etc, to dealer (kept my receipt tho) and given them a letter by hand, stating im rejecting car under s.o.g.a as my solicitor told me to do this, giving them 7 daysin writing to refund me the money. I paid for car on my Visa debit, i rang my bank, they are refusing a chargeback, saying they dont get involved with car disputes, yet i only had the car in my possession for about 15 minutes, as it was returned straight to the garage and theyve had it ever since. So car dealer has my car and my money and im in no man's land. Please any advice would be welcome, i was offered a hire car by dealer while my new car was in for repairs, but didnt need one as i still have my old car. I just want my money back, help ! Thanks for reading jackie x
