  1. After Swiss bank UBS agree to pay £940m in fines to settle charges of manipulating Libor, Damian Reece, The Telegraph's Head of Business, says the scale of undetected wrongdoing is "shocking". Swiss banking giant UBS has agreed to pay £940m to regulators in order to settle charges of manipulating Libor interest rates, fraud and paying bribes to brokers. UBS' 1.4bn Swiss franc (£940m) fine includes a £160m payment to the Financial Services Authority, the largest penalty ever levied by the British watchdog, and $1.2bn paid to US authorities. The penalty is the second-largest fine paid by a bank and is more than three times the £290m fine levied on Barclays in June for attempting to rig the Libor benchmark rate used to price financial contracts around the world. The FSA said at least 45 people were involved in or were aware of the rigging and that the breaches occurred over a five-year period between January 2005 and December 2010. The watchdog described the misconduct as "extensive and widespread", with at least 2,000 requests for inappropriate submissions documented and "unquantifiable" number of oral requests.   3. Attended my ATOS medical yesterday. The woman who saw me said she was a nurse. She checked my pulse and said it was irregular. She checked my blood pressure, it was higher then normal!! She then asked me a lot of questions, and all I could do was answer her as honestly as I could!! My MIND advocate stated to her that I was currently waiting an outpatient appointment with adult mental health because I have long term issues, and that my gp has said I am not fit for work!! I described as best I could how my heart problems were - I have sinus tachycardia which makes me breathless on the least exertion. How my mental health is - not very good which is why the mental health team have been contacted again!! She also asked about how do I pay the bills - I stated my partner does that side of things because he pays the mortgage etc etc!! Various other questions like do I cook, do I bath or shower, do I watch tv to which I replied I have to be in the mood!! She then asked me can I walk to the shop - I replied no because it was too far, then she asked can I walk to the bus stop to which I said yes but I take my time and when I get there I stop and rest as I am out of breath!! She seemed to be polite though and sympathetic - but I am aware of the lies that re told on the reports!! I have already requested a copy of the ESA85 ATOS medical report - I phoned them up when I got back!! How is best to appeal if I get turned down, and can I ask my gp for a medical report to send in with the appeal!!?? Thanks!!
  4. Hi guys Today we found a car we wanted £12,800 it was Audi A3 in White 59 plate Went to apply for a Santander Loan tonight for £10,500 as i have the rest. I have a good credit history paid a previous Santander Loan off for 4 years without missing a payment this was for £6500. I was shocked when i was declined tonight i have a £30.00 a month contract with Virgin Mobile never missed a payment taken out a Washing Maching, Ipad, and 50 Inch Tv on Finace all paid up apart from the Ipad taken them all out on a buy now pay 9 months later with comet. Paid the TV and washing machine up early ipad im still paying for per month. Never missed payments on loans, utilities or personal credit Only problem might be is i opened a joint account with my partner who hasnt got the best credit history. could this effect me ? i asked noodle to take her off my report last month they said it will be done in 14 days but she is still on there. Someone also mentioned i might have used my max credit and thats why im declined. Im only 26 by the way if age is a reason why which is discrimination to be completly fair im in a job which pays £18,500 a year

Mrs Plevin’s claim therefore failed in its entirety. Against this, Recorder Yip QC considered the conduct of Mrs Plevin’s legal representatives, Miller Gardner. Their costs, including a very significant ATE insurance premium, amounted to some £320,000 by the time of trial as against a maximum claim value of some £5,000. Despite the level of costs incurred, Recorder Yip QC also found that Miller Gardner had failed to get to the bottom of the factual case, this had caused the repeated amendments to Mrs Plevin’s claim and the eventual abandonment at trial of all but two of the heads of claim, and that there could be “no justification” for the way in which the claim had proceeded. As against this background, Paragon had made a without prejudice offer to Mrs Plevin back in 2010 on a commercial basis simply to see an end of the litigation. Miller Gardner had rejected that offer and therefore did significantly worse at trial than could have been achieved two years previously. Recorder Yip QC held that as a result, and given her “real concerns” over Miller Gardner’s conduct, it would be appropriate to order that Mrs Plevin pay Paragon’s costs on the indemnity basis in relation to the entirety of the action. This is the strongest order that a Court can make and is illustrative of the displeasure with which Miller Gardner’s conduct was regarded. It was clear from the amount in question as against the costs incurred that the litigation had been run only to benefit Mrs Plevin’s solicitors; and not to achieve the best result for her. Generally, given the findings by the Court of Appeal in Harrison and Recorder Yip QC in Plevin, claimant solicitors now have little chance of successfully continuing with claims in relation to PPI mis-selling. Further, the Courts are now very much alive to the fact that such claims cannot be regarded as being in borrowers’ best interests. The industry that has grown up around PPI should beware.
  6. This is a general question for most people paying a DCA. How come most of the experts on here ask why we are paying a DCA? My OC says "refer to the DCA" so I can't pay them (account closed). My DCA implies they will sue my sorry arse off if I don't pay them what they want (no matter if I can afford it). The advice from here is that DCAs have no legal rights. And that we should not be paying them. So what is the crack? How can we avoid paying Metropolitan for an HSBC debt (for example) without having our sorry arses sued off? Thanks.
  7. After a day out my wife and I returned to our car to find a £70 parking ticket issued by the council. When we arrived at the car park it was quite busy so we pulled up outside on the road opposite the car park along with dozens of other cars. My wife spotted a parking warden in the council car park and went to ask her if we were ok parking on the roadside, we were told that due to the double white line in the middle of the road no cars should park on the roadside and the police would ticket any car it found there. I spotted a space in the council car park so I pulled over the road and parked there instead in full view of the watching parking warden. The parking fine was issued because we didn't park in a marked bay, by the same parking warden my wife had spoken to and had watched me pull into the council car park, she had waited 10 mins until after we purchased our ticket and left the car park for our day out. The car park itself is a gravel car park, with absolutely no markings on the ground to indicate bays, no markings on wall or fences to indicate bays, or lack of bays. We had parked nose to the fence, not blocking vehicle access, pedestrian access or any other kind of access. Can they enforce not parking in marked bay when there are no markings or signs to indicate bays or non parking areas? What defines a marked bay? The fact the parking warden watched us park there having already asked her if we could park on the roadside and taken her advice that we risked a ticket just makes me even more angry! Thanks
  8. The Salvation Army realised that it had never received a donation from the city's most successful lawyer. So a Salvation Army volunteer made an appointment to see the lawyer in his lavish office. The volunteer opened the meeting by saying, "Our research shows that even though your annual income is over two million dollars, you don't give a cent to charity. Wouldn't you like to give something back to your community through the Salvation Army?" The lawyer thought for a moment and said, "First, did your research also show you that my mother is dying after a long, painful illness and has huge medical bills that are far beyond her ability to pay?" Embarrassed, the Salvation Army volunteer mumbled, "Uh... No, I didn't know that." "Secondly," says the lawyer, "did it show that my brother, a disabled Veteran, is blind, confined to a wheelchair and is unable to support his wife and six children?" The stricken volunteer began to stammer an apology, but was cut off again. "Thirdly, "the lawyer said, "did your research also show you that my sister's husband died in a dreadful car accident, leaving her penniless with a mortgage and the burden of supporting three children, one of whom is disabled and another who has learning disabilities requiring an array of private tutors?" Completely beaten, the humiliated Salvation Army volunteer said, "I'm so sorry. I had no idea." And then the lawyer said, "So, if I don't give any money to them, what makes you think I'd give any to you.
  9. my partner is being tuped from one firm to another but the new firm want him to fill out a job application form and want to do a credit check on him but he refuses the credit check as he dose not work with money, and has told them no im worried that they may sack him for this, i know that under tupe law his contract and hours stay the same but once he signed to the new firm can they dismiss him for this? he works as a security officer and the site he on now has been took over by a new security firm and has been told that he will tupe over to new firm and everything remains the same why the job application form and the credit check though?
  10. Budget airlines, phone companies and gyms could be forced to make the small print of contracts clearer under proposals to reform the law. Loopholes used by companies to bury extra charges and payments could be closed under plans unveiled today by the Law Commission, the independent legal review body.   12. Put the TV on and all the Sky layout has changed, different colours, different font different everything. I suppose this has cost Sky an extortionate amount of money to be rebranded and for what? Why cant companies just leave things alone, it like Tesco we now have a big sign up saying hello!! whats that all about, I am going there to shop not pass the time of day. If I want Sky I will have it regardless of the colour of the writing, if I want to shop at Tesco I will, a sign saying hello isnt going to either encourage or discourage me. And dont get me started on why they changed the name of Opal fruits or marathons.
  13. I have sent all the paperwork off to Salford for a small claims action. When I filled in the paperwork I specified my local court as a preference. Today I have recieved the notice of issue back and it states that it is in the Northampton Court (some 200 miles from where I live). What would be the reason for this ? I have also had communication from the defendant that they will be defending the claim and seeking for it to be heard in their local court - again some fair distance from me. Do I have a say in this matter at all - would there be a reason that it cant be held in my local court ?? I will post the claim details seperately as I have a few questions and dont want to complicate this thread. Thanks in advance.
  14. It doesn't really matter if you don't pay, the odd few that come to sites like this and see they don't have to pay are few and far between so they still make a pretty packet. Government statistics show nearly 1.17 million electronic requests were made in 2010/11 by private parking companies for vehicle details from the Driver and Vehicle Licensing Agency (DVLA). Figures show drivers are paying more than £93 million in charges, based on a private parking fine of £80, compared to £21 million five years before. The latest DVLA figures were obtained by Nick Smith, the Labour MP for Blaenau Gwent after he received complaints from constituents about a car park in Ebbw Vale, south Wales "I do not believe that British drivers are becoming less law-abiding,” he said. "Some motorists believe that some car park operators are only interested in penalising the motorist at every single opportunity for the most trivial infraction."
  15. If other agencies I pay bills to acted like SCC they would be seen as bullies and reported to the FSA. I have today recieved a summons from SCC for the privilege of paying them £150 in April and £150 in May, but as I didn't pay on the day they want it as I pay when I have the money, they issued me a summons and added £48 costs. Year after year I pay in full before the next years bill is due, but that seems to make no difference in how I am treated. I wanted to turn up at court as you would in this situation with any other agency and asked where my papers were to send in a defence. There was no Claim Form or particulars of claim. They really didn't want me to turn up at court, despite saying this was what I wanted to do. They make Dick Turpin look like a pussycat. If I haven't been served with the Claim Form and the Particulars of Claim then they have not effected service on me I am told. I have to write and appeal to have the 'Authority costs' of £45 and 'court costs' of £3 removed. Surely these charges cannot ligitimately be demanded? I am incensed by this action and the fact that they can get away with this and there is no agency that they have to answer to.

I have filled in an acknowledgement of service to a claim by MBNA represented by Restons, where POA states: “The claimant claims payment of overdue balance due from the defendant under a contract dated on or about xx/xx/xxxx in the sum of £xxxx.xx (£5K+) inclusive of interest to the date of this summons at 8% per annum from xx/xx/xxxx to xx/xx/xxxx. Particulars a/c no: xxxxxxxxxxxxxxxx DATE ITEM VALUE Xx/xx/xxxx Default Balance £xxxx.xx (over 5K) Post Refrl Cr NIL Later date xx/xx/xxxx Interest xx.xx Total: XXXX:XX Together with:- Interest pursuant to s69 County Courts Act 19 At the rate of xxx.xx per day to the date of Judgement or sooner payment” Prior to filing an embarrassed defence, I now wish to make a CPR 31.14 request to Restons for: 1 the agreement 2 the default notice (All I had was Notice of Sums in Arrears, a letter saying that failure to pay will result in registration of default with CCA. Then they wrote and said a default is due to register for 6 years on my credit file and when this happens balance of the a/c WILL BE SOLD to a Third Party. This does not seem to have happened as MBNA are the Claimant, all I had was a much older try-on from RMA) 3 the assignment?? and perhaps for 4 DPA?? As not all were mentioned on POA, would you agree? Anything else?
  18. Hi Wife has a debt with HSBC credit card in single name- paid since 1985 & never missed a beat. Due to change in circumstances cannot pay more than £5 monthly. Current debt is 10.5K @ £300 per month. Received Default notice. Have paid £5.00 per month for last 2 months, sent I&E asked for stop in interest/ charges - ignored - next step ?? Also ebay fees of about £100 - started at £10 - they screwed up email account so Paypal didn't work & she lost payments toalling £80.00. Now with DCO ? ignoring!! Cheers benjibutton
