  1. Hi, My landlord is wanting to send estate agents round to value the property because he wants to put it on the market. He has not yet served me with a Section 21 notice so I have no idea when he is expecting me to vacate but I would have thought a valuation would be more realistic once the house is empty and after he can do some redecorating, etc to get it ready for selling. At the moment, we have been too stressed over searching for a new home and we have been having a mad declutter and we have half packed boxes everywhere and the housework has become less of a priority, so all in all, the house no longer looks homely and I certainly wouldn't want any estate agents taking photos to use for selling purposes. Does my landlord have a right to getting a valuation, especially before he has issued a Section 21? I feel so uncomfortable about it and I really don't want anyone coming round while I still live here I have been looking through other tenants posts and came across this comment from one of CAGs members:- "Are you aware of this >> For example, a Section 21 notice cannot be served if there is no EPC or Landlord gas safety certificate in place for the property. Any non-compliance with this requirement will render the section 21 notice ineffective." Now my landlord has never done annual gas checks and the last one (for which I have a copy of the certificate) was about 2 years ago. Does the above CAG members comment mean that when I receive the Section 21 Notice it will not be legally enforceable? If so, what should I do and how do I respond to my landlord when I get the notice?
  2. Hi, hope someone can advise me on this. My letting agent is telling me that at the end of my current contract, they want me to sign a 12 month contract otherwise I will have to leave. I looked on my tenancy agreement and it states the following TWELVE MONTHS beginning 6th july 2017. If the tenant does not leave at the end of the fixed term, the tenancy will continue, still subject to the terms and conditions set out in this agreement, from month to month from the end of the fixed term until either the tenant gives notice that he wishes to end the agreement as set out in clauses 6 and 7 below or the landlord serves on the tenant a notice under section 21 of the housing act 1988, or a new form of agreement is entered into, or this agreement is ended by consent or court order" clause 6 and 7 talk about giving the landlord 1 months notice before I want to leave. Am I within my rights to ask to stay on a monthly rolling contract based on the above? Thanks
  3. Hi everyone. just a quick question. i defaulted payments in march this year. They claimed to me that they Terminated the Hire Purchase agreement in May 17. since then i have had calls and emails to contact them regarding payment. This morning a letter arrived of NOTICE OF SUMS OF ARREARS. from what i can gather from google this is sent out because the hire purchase agreement is still active. They have not sent any debt recovery letters but just always send letters under the HP agreement. Is it right they are still sending letters out when the HP agreement is terminated?? Many Thanks
  4. Hi. Sadly my sister passed away last week, she was not too well after her husband had a heart attack 5 months ago. My sister wasn't very well and was receiving £300 DLA per month and £700 Universal Credit per month. I spoke with my mum and stepdad who have said they have been to the funeral directors today and they are asking for £1800. My mum and step dad are both retired and are what you could call low income. They definitely do not have the means to pay such funds. We are in the belief that the social services should be doing more to liaise with the funeral directors to tey get some money paid. Can someone please help and advise what should be happening here? The funeral is set for next Friday 20th October.
  5. The engine in my girlfriend's van recently blew up. The mechanic who she called to come out and recover the vehicle, took a look at the damage and informed her that she would need a new engine. He also informed her that he wouldn't be able to do the work, so had given it to the 'garage A around the corner'. Quite a bit of time passed by as my girlfriend deliberated upon what course of action she was going to take. When she finally decided to get a new engine, she started to attempt to make enquiries, with garage A, to which her van had been given. Not knowing much about anything, she required a bit of information from garage A, and contacted them several times, but she was poorly received, ignored, and requests for information were not responded to. Hearing all this, I told her to get her van repaired somewhere else. Thus she made new arrangements with a more customer friendly garage. All had been arranged, or so she thought, but when the new garage B (who she had arranged to do the work after the poor customer service from the original garage A) arrived to collect her van, garage A refused to hand over the keys to the van. Although garage A hadn't done any work on the vehicle, garage A has turned around and said that they wanted £25 per day as storage fee. Whilst I know that in the absence of any written or verbal contract, whereby girlfriend consented to paying a daily storage fee, garage A doesn't have a leg to stand on, I am wondering how much of a pain in the arse dealing with this issue might be. Is this a matter for the police, whereby they simply turn up whilst my girlfriend lawfully retreives her vehicle, or is might this be a real dragged out civil matter.....civil coursts, Sheriff's Officers, etc?
  6. Hi all, I really need some straight advice. I've just discovered this site.. ..it has so much information that my head is spinning. I'm really not sure where or how to start dealing with my debt. I have debts of just over£25k to eight different creditors. Very, Isme, Marisota, Barclaycard, Aqua (2) Vanquis and Next. I've been with them from between 5 and 10 years. Due to a change in finances (im self employed) I haven't made a payment since January. I feel so ashamed! But I just cant afford to. I have just £131.62 left over each month which calculates to just £16.45 that I could now offer each creditor. I don't think they will be too happy with that but I can't afford to pay any more as I have already drastically cut all my expenditure which I also worry about as I dont have anything put away for kids xmas/birthdays etc... .I'm so very depressed and feel I have failed my children by getting myself in this situation. my daughter has a heart condition which may prove to be fatal within time....perhaps another 5 or 6 years. So with this in mind I wonder what advice others may have, I went to the debtchange website, filled out the expenditure form and they recommed I take out an IVA which would be paid off in 5 years with whats left over written off. As Im now a full time carer to my daughter my finances arent going to change much and the thought of having and giving very little to my daughter just makes me fall apart. What can I do. I haven't spoken to the creditors as the ones I have 'Very' and 'Isme' were really horrible. I just cant face talking to anyone. Please help x
  7. Good evening, I hope you can help me. I am writing on behalf of my father in law. After a discussion with my father in law he said he was confused by a phone call saying he was owed £7000 compensation and asked if he wanted to claim it. An agreement was posted and he signed it the (t+c) in May. He is on various medication and currently in hospital with ill health. And still receives phone calls asking when is getting out etc After he told us about this we said, No they are parasites, we will do it for you, so WE contacted Barclays and then completed ALL the paperwork from Barclays, he was awarded £2100 compensation. Later, they demanded payment saying they were successful in their claim for PPI. NO they weren't I was successful, NOT them, they did nothing. They did not do any work Looking at the T+C there are breaches everywhere 2.2 The service We will review and consider the information and submit a FREE OF CHARGE data subject access. At most they may have contacted Barclays. Which as in their contract is FREE 2.3 We will update you on our process.. No sorry nothing till I claimed it back for him then demanded payment for MY work My wife rang them and what an evil nasty set of *&^^&%& on the phone, d emanding this and that, saying IT WILL be paid etc. You WILL pay it etc. She explained her DAD was mentally and physically ill and has no bearing of what was said on the telephone at all and they just laughed with words of yea yea we have heard it all before. We asked them to provide proof of their contact with Barclays and they can no do this, all they have is her Dads signature. Reading the contract we breached by going it alone, they breached it by not doing anything, therefore contract null and void. Where do we stand??? Im telling him not to pay it. I'm very angry they were even asking how long is he in hospital for is long or short term as it needs to be paid.
  8. hi, just signed up to this amazing resource as i need help with Lowell and Red and will also be helping my mother with her unsecured debts mainly catalogues, and provident loans. ---dealings with capital one---- Last payment: oct 2009 Balance after last payment c3600 Amount demanded c4000 In 2009 i received a letter from cap1 stating times where hard and they needed to up the interest rate. I wanted to see if they could do this so sent a cca request, the agreement received is a one page application, which refers to a section 23 overleaf(i have no idea what was on the back). Letters went back and forth, they saying the agreement sent does comply and me saying i dispute any alleged debt due to a non compliant agreement. Cap1 set the in-house dca's on to me which i replied with the bemused in dispute letter, to which all sent replies sending back to cap1. Lowell made contact in Aug 2014 Shortly after cap1 and lowell send assignment letters Red made contact in Oct 2014 Red's last letter has stated they will be passing my account to Hamptons Legal their pre-litigation dept unless i pay them within 10 days. Please can anyone advise what i should do, i thought about sending a bemused in dispute letter but to who do i send it, and is this the best course of action. thank you.
  9. Hello. My wife has debts that were originally with Egg and are now being chased by Marlin. She's been paying £20 p.m. and we've had a letter saying the account is up for review and to fill in an income/expenditure form. I don't know whether or not to do this. I've read on here to just write and say I can only afford £x p.m. but is that asking for them to get awkward? Could they issue a Statutory Demand for example?

  11. need some legal advice on current situation. me and my partner spilt 3 years ago, we have a 3 year child together. we moved into a rented council house while i was pregnant and as he used to be in the army the british legion paid something towards the white goods, washer, oven and fridge and towards the carpets. after we separated he left the home and was very happy for me to keep the goods as they were necessary for his daughter. now after 3 years.. (he is now engaged and living with his new partner in fully furnished home with his 2 other children) he has had his solicitor contact me stating that he wants the goods back and to arrange when he can come to collect. this then would leave me and his daughter with no carpets, fridge or cooking appliances. Can he legally do this?? i am on benefits so i would not be able to replace these things. i have to reply to this letter myself as i do not qualify for legal aid anymore so any advice would be grateful.
  12. Hi. Firstly thanks to the Cag team & people involved, you guys/gals do a great job. I am a single father with MS (multiple sclelrosis) on DLA and living at home. My ex, her mum is also on benefit (ESA) & receives child benefit for both my daughter & her stepsister. I have no idea how much the child benefit give her (any idea's on that?) We have both been separated a good long time, time in which I've always tried to provide nice things for my daughter (I'll just say Bec from here out, its easier) whom I see on a fairly regular basis. With her starting high school this year (she's 11) I got a visit from my mum (becs nan) saying that Becs mum had been stressed at the cost of school clothing & that I should step in and do the right thing. Now here, I made a point of stating what seems to me to be wholly logical by explaining to my mum that child benefit is for these things & what, for examples sake, if in same situation I had four kids by her mum, would myself as a single Dad on benefits be expected to cover this cost four times over? Anyway, we had quite an argument about this though I since went and told Becs mum that rather than haranguing my mum for these things that I would simply offer up 100 pounds a month towards my daughters upkeep (anything for a quiet life plus my daughters happiness) I had been actually putting money aside into savings for my daughter for when she reaches certain age, which I will still try to do though I am not certain if I can keep that up so well in the face of this new 'situation'. So what I would like to know please is am I doing the right thing? I ask this because I do not think her mum would use this money wisely and solely for my daughter, in fact I would rather take Bec out (difficult with my health probs) & sort the things personally. Also, am I right in saying that her child benefit money should cover the school clothes costs? Whether child benefit covers it or not, as her father I will do the right thing one way or the other, I am just seeking some much needed intel on the situation. Look forward to some clarification on these things, thank you. Oh, and for the record, Becs mum never put me or anyone on the birth certificate as Becs father though I do not want to start getting into a big legal thing about that, she's my daughter, I'm her Dad, we already know this. I just want to do the right thing with the money.
  13. Hi all. I had a phone call this morning from Credit Assistance, the bod told me it was regarding a Santander loan and could he have my address to confirm it was me who he was talking to. He got mighty miffed when I informed him I will only deal in writing and that I wanted my tel no removed from their list as it would only waste their time trying to talk to me. He then said about a letter they had sent (not received letter yet). The story is that I volountary surrendered a car about 4-5 weeks ago as I am on ESA and not able to keep payments up. It was about 38 mths into a 60 mth agreement. It was a fixed sum loan agreement. I have not had anything from Santander saying they were refering this to a DCA or anything, but I have changed address about 18 mths ago (which I told them about) so they may possibly have sent a letter to my old address. Any ideas what I should do about this? or shall I just wait and see what turns up in the post.
  14. Hi all new to the site, hope someone can help us. My mother received a letter from a debt company on 23rd April 2014 stating money was outstanding from a mobile phone account and the debt company was assigned to collect it. It states there is outstanding call charges/line rental as well as early termination fees. We went to the mobile phone shop concerned as my mother has never taken out a mobile contract let alone ever had a contract phone. The man in the phone shop put in the details and nothing came up so gave us a number to call. Went home and called the mobile company and they said the contract was a business tariff contract that was authorised verbally over the phone in 2009 by a Mr........ in my mothers account. We then tried to explain over the phone that my mother has no contract with the company nor has ever had a mobile contract with the company let alone a business tariff contract, or even signed a contract to open an account with the company. In the end the woman said she would get it investigated. A few days later another letter came in the post from the debt company wanting payment for this outstanding fees and early termination fees. Rang the mobile company again spoke to a man he said you need to speak to the investigation team then gave me the direct no to call. Rang the number and it said something like caller put down phone so I thought its a Saturday no one in the office. We rang the mobile company again as I wanted to know what was going on with the investigation and then I had more info to relay to the debt company. It appears there was no investigation team looking into it. the number I was given was not even valid. I was informed by the woman the account belongs to my mother and it is my mothers responsibility to pay this account. Even though the mobile company admitted that someone else had authorised the business contract and phone, my mother is responsible for this bill. when I questioned the bill the woman said it was over 10 years ago. I argued the point why was there NO correspondence then from the phone company with regards to a bill until 23rd April 2014 and then it was a debt agency and not the mobile company. I wanted to speak to a manager but they said no one available will call me back. Still waiting! I then rang the debt agency and explained the situation they said the bill is from 16/9/2000 to 2nd May 2010. (Long contract!) They said they was going to get back in touch with me once they have spoken to the mobile company. Still waiting! Today I went on line live chat to the mobile company and they said go back to the mobile shop, where I had already explained to them I had already been there and they cannot help as they have no details on their system of my mother or this account ref on the letter. So sorry for the long thread, can anybody give me any assistance please on what we should do next with the mobile company and the debt company.

Hiya. just a quick question, i paid the biggest majority of money for a car and i mean a big majority altho i do not drive, obviously someone else drives it, i have a receipt of the money i paid for the car, the relationship as broken down, i just want to know what my rights are regarding the car, could i actually take the car of this person, any advice would be grateful. thank you

Hi Guys - Fairly new to this posting malarky so i'm expecting a good response from those who know: I took out a loan from Welcome Finance some 6 years ago now and fell behind with repayments on the loan shortly before this PPI scandal kicked off. Pretty sure most of the debt is now paid off however I've had a letter from Empingham chasing me for just under 3k to which clearly I dont have. I was sold PPI at the time of the loan to which i told was a condition of acceptance. I've SAR'd these con merchants and they've sent me a copy of the agreement with my signature on it. My question is how do i proceed from here in terms of going about to repair my credit file as this is proving to be a massive dent and red mark all over my credit report. Any advice on this would be most appreciated. Who to email? Write to? Sample's all would be most helpful. Thanks in advance
  17. My first post so hello there people! I need some help as i am about to suffer from depression! I need information regarding people living with you and wanting to go bankrupt. Long story so bare with me. Me and my partner moved in with the inlaw so we can save up, get married and move out with the intention of buying our first home. The first year has gone so fast we dont even know where our money has gone. The second year (January 6th 2012) my brother in-law landed on the door step with his marriage ending. He loves to drink! He goes out every Sunday now and get plastered and my little 8 year old girl has to see this. Now last Monday he decided to not get up for work (still drunk) and told his boss, he's not going to work for them anymore. so he's walked out! Now he has been out everyday to the pub drinking the last of his money behind the bar. he doesnt pay anything to his mum for food, bills etc. He has a 4 year old girl but not a full time parent. He has maybe £14,000 worth of debt and said he is going to file for Bankruptcy. Please help me with some information i cant find. If he files for Bankruptcy, will the debt collectors or bailiffs look at my stuff and my partners stuff? Will they take anything belonging to us? I own alot of stuff but its all in either the celler or my bedroom. Im going on holiday with my partner soon and dont know if i should take everything i own to my mum or dads house while im away. please help me as any information will be greatful! kind regards. joe

  19. Hey there! I would like to start tidying up my credit file as ideally in the next 3 years I'd like to buy a house and settle down. I was recently affected by negative credit in a job application, and its made me realise that I need to take charge of things in my life by the time I reapply for the role in 8-10 months time. I've came through a lot of things in my life to get this far career and personal life wise, so I would like to nip my credit issues in the bud once and for all. Compared to many people I see, my debt isn't particularly big (its maybe around £8k at most), with the bulk of that a £4500 RBS default from 2007/8. I've just been a bit silly in my younger years after two abusive relationships, and now I want control of my life, to enter my 30s (just over 18 months away!! ) with a better start than I entered my twenties. I last checked my credit profile about 5 months ago, when I started in my current position, and even though there were a couple of defaults on there it didn't stop me getting my job. It has hampered me in a promotion, which is saddening but as that is the only reason, one can only learn from it and go onward and upward, right? I get paid on the 31st, so I'm going to get my credit reports again on that date (I don't have the free trials anymore ) - I just wanted to check that a) this is the appropriate place to post and b) I'm not being too cheeky just swanning in here saying "help me sort out my life!"?
