  1. Hi Again Guys well another day, another issue that bites from my previous life.... I have today received a letter, diverted from my old personal address, from Marston Group Limited. The letter is in reference to a "high court writ" against a company i used to own. I had no knowledge of any court action against this company. The letter was threatnig to gain access to my property (my previous property) to collect goods. The letter is addressed to the company name, but at a personal residential address. The company is currently non trading and hasnt traded since june 2012, and there is an application into companies house to have the company struck off. The creditor who has issued the court action against the company was aware of this 12 months ago and has received a letter stating such. Anyway, I have called Marstons on receipt of the letter to inform them that I dont live there any more and the person who does had nothing to do with the company. I also informed them that that address was a personal residential address and that it never was associated with any business or traded from there. I also explained the status of the company. The lady, awfully rude, then asked me for my new address, which I refused to give. SHe said she would trace me, find me and attempt to remove goods from my new home. I explained that this was unacceptable and that the business had no assets and everything in the house was either mine, my childrens or my new partners. She said they would still send the baliff anyway and attempt to collect and that I had to prove, with receipts, that the goods in the house were not that of the business and would have to provide receipts. Any advice on where I stand with this? I havent seen any court paperwork or dont know who to speak to to stop this harassment.
  2. Hi My friends daughter has been off work for two extended occasions in the past year, she suffers with ME or something similar. She has been under investigations with the hospital and her GP. Whilst she has been off work she has always supplied her employer with sickness certificates. Today she has had a letter from her employer saying her manager and the HR department wish to visit her at home to put a work plan in place. Is this a usual course of action. The young lady is thinking this is some sort of attempt to intimidate her into resigning her job or perhaps they wish to pay her off. Does she have to let them visit her at home, can they not wait until she returns to work to put a plan in place. I would appreciate any views on this matter. Thank you loring
  3. Hi, Hopefully this is posted in the right area. My girlfriend has received a few letters from BCW chasing her for an outstanding debt of 8K from Aktiv Kapitol (think that's how you spell it, haven't got the letters with me!) Firstly the letters are in her married name. She has been divorced nearly 2 years and has been using her maiden name again for the last 3-4 years. She has never had a credit card/agreement with Aktiv Kapitol, so has ignored these letters. After looking through these forums, i now believe they have probably taken over the debt from someone else. She has checked her credit report, which shows an entry for Aktiv Kapitol starting in Sept 2007 and defaulted as of Oct 2009, although there are no other entries for this and no payment was ever made. There are no other credit cards/agreements shown as in arrears/defaulted. She and her ex-husband got into financial difficulty before they split. She is still on the mortgage of their house, but as it is in negative equity, the mortgage provider won't release her from it until it is in profit and he can remortgage on his own, which i can't see happening anytime soon. She lives with me but is a stay at home mum, with no income of her own other than child benefit and child maintenance from her ex. I pay all the household bills for us all, so she just spends what little money she has on running her car, phone bill and stuff for herself and the kids, obviously supplemented by me where i can. Bear with me as i'm nearly there! She has now received a letter from BCW stating that they are now going to send round a door step agent?? What if any powers do these people have, if in fact the debt is actually hers, having been passed on from an old credit card? She has no possessions of any worth and has very little money coming in. As she is now living with me, can anyone go after any of my assets? Can my income be taken into account if she has to come up with any kind of payment plan? Any advice gladly received.   5. Posting for someone else.... Martin age 54 has been on dla for about 13 years after a road accident he has a degenerative illness and cant walk. Severeal times he has had an atos 'medical' at his own house. This time he is told that he must attend one at a centre. He only rarely goes to his doctor for painkillers as he doesnt leave the house, more recently he found it easier to get them from the interenet rather than journey of £18.50 each way to doctor in a taxi with a friend to help. So how can he secure a home visit because I don't think the doctors input will be considered enough.? Previously he was granted a home visit without the doctors input though.? How come suddenly he is expected to travel using 4 changes of bus which he absolutely cannot do.? So to reiterate, how can he get a home visit, should he ring the atos number on the letter to arrange one? What if they refuse? would that be a breach of his human rights even?
  6. Had a visit from the bailiff the other day, I wasn't in but my landlord was doing some maintenance work so answered the door and was served the bailiffs letter. Its for £124 of council tax for September from a property I lived in two years ago. I have had no letter asking for the tax, no letter warning me of court proceedings and no knowledge of the debt, so it was a bit of a shock! I was receiving council tax benefit in the property, and then in September started university. I have a council tax exemption certificate from the 12 of Sept, but am worried the council are going to charge me for the first two weeks. I'm thinking of writing a letter to the council and was wondering if anyone could give me some advice as to how to word it? I think its pretty bad that they have sent the bailiff round without even telling me about the debt, so am hoping that will give me some leverage?
  7. Urgent help needed please. I have a ccj for a HSBC CC for around £3500 with a Charging Order. I got home last night to a card pushed through the door regarding a pre-enforcement visit. What do i need to do? I'm really worried. I dont want this officer coming to my house. I've tried to ring the officer but his phone is off. I left a message for him to call me back but i dont want him turning up at my house while i'm trying to deal with my baby Thanks for any help

We have recieved a post card from cfs holdings saying they are doing a home visit tomorow (Weds) is this just a threat or will they it is for my step son who has mental health problems this is for a capital one debt that he cannot afford to pay much to being on benefits.any help would be great thankyou
  9. Hello, This is my first posting on this site. My Landlady and I are not on the best of terms. She was given the house by her mother, my first landlady on the basis that I can continue to live here with the rent based on what Housing Benefit would pay (despite which she has in the past tried to increase it by 150%). She is not happy with me living here (despite making nearly 100% profit) and would prefer if I moved out- which I can't afford to do and do not wish to. She keeps bringing people with her for her Property Inspection who have no legitimate business being here- I find their presense very intrusive- particularly as they wander around unattended (whilst I am with the landlady) practically measuring up for curtains! I've asked her not to bring extraneous persons with her but she thinks she has a right. Several members of her family I do not get on with at all and others of her friends are strangers to me. Can I legally prevent access to these people, and if so, on what grounds? She's due on Wednesday morning. I've a feeling she may be asking me to leave as it is the anniversary of the Shorthold Tenancy- the terms of which she has not adhered to- eg obtaining an annual Gas Certificate. Does anyone know if this is a condition for me to get Housing Benefit? Many thanks if you can help me with these issues.
  10. Hello. Just received a hand posted letter demanding the sum of £374.17 from an unpaid parking ticket from 2009. I havent received any reminders from the council in that time. Any advice on what to do? Can they legally charge this much? Thanks
  11. Hi. I have a mobile phone account that I have been unable to pay. I have no real reason to dispute the account and will probably make an offer of payment shortly. However, a had a letter from power2contact saying they will visit me at my home. I sent the template letter from cag to stop them knocking on my door and they responded with this... 'You are not correct in your assertion that, under OFT rules, we can only call at your home if you agree to make an appointment. In law, a creditor is in a different position to a postman or a member of the public asking directions. When you opened this account, you impliedly agreed that the creditor could communicate with you to discuss repayment. You do not have the contractual right to revoke that agreement until the loan has been repaid. We will not disregard any reasonable requests you make as to the timing or method by which we have those discussions. Unless we hear further from you with such a request, a doorstep visit may still be a viable option for us to discuss the repayment of your account.' I am not really worried about this. It's just that I don't want them at my door. I have sent the template letter before regarding other debts and they have just accepted it.
  12. Hi, I am new to this site and have just come across a few threads mentioning Toothfairy/Marshall Hoarers Bailiffs. I received this email 2 days ago and have no way of contacting them especially by phone on a charging number. They have no email to contact them on. I did set up a £50 repayment plan from 31.12.12 but was unable to pay due to work problems. I am in contact with Citizens Advice but don't have an appointment until Wednesday 9th Jan 2013 to get any payday loans settled. Is this email legit and will they turn up at my house this week?   13. i feel like im being a pain with all these questions lately. so ive came downstairs and found one of those "we called and you weren't in" leaflets from TVL. the time wrote on the card is 20.42 my question is,do i need to answer the door to them? i live myself with my kids,4 and 2 years old and i don't answer the door at night full stop unless i know someone is coming over.i honestly just about wet myself if my door goes at night and no one is meant to be visiting i fully admit that ive not kept up with the weekly payments because i simply couldn't/cant afford it. We've went without gas for nearly 6months apart from on a few occasions because i can't afford it so why would i pay them
  14. Hi all, I have received a letter from Debt and Revenue Services threatening a Home Visit, because I have not contacted them regarding repayment of an account.... They are demanding payment of £328.33 in relation to a debt with a company called 'Opal'. I have absolutely no idea what this is for and have never heard of Opal. What do you think would be the best way forward with this? Should I send an email asking for details of the debt or ignore them? I had a similar one for £130 a few weeks ago from another DCA and when I challenged them they said they would just pass it back to their client as I had been un-cooperative. Do these people think they can just demand money and you will just give them it without questioning it??

Hi there , i desperately need some help , i have received a letter from marston bailiffs stating that they will use force to gain entry and remove goods in order to pay fine of 600 pounds court fine ( fail to give information about driver identity ) sentencing date 19/06/2009 , i was not in the country at that time and received no letters no phone calls from the court since this happened , i also need to mention that i have moved few times from the address that i lived in 2007-2008 , in 2008 June i left Britain and returned on December 2009 the letter states Fine value 600.00 compliance fee 85.00 and attendance fee 215.00, please any advice will be extremely appreciated.
  16. bailiff is coming back tomorrow 11am demanding 774 pounds, as i lost my job two weeks before xmas i missed 1 payment, he said if i dont pay they will come in and take my goods {bristow & sutor} can they do this? very worried

Hello all, I am new to this forum and need some urgent advice please, quite a few yrs ago I got into trouble for various motoring offences, I was unemployed at the time and the court fines I received were somewhere over £1000, because I was unemployed the payments were taken out of my social security payments then later my JSA and all was well, I started working a couple of yrs ago and had to make payments out of my wages (£5 pw as I'm on a low wage) my payments always got paid though not always on time sometimes I would pay every wk other times I wouldn't pay for a couple of wks then pay the arrears to catch up again and the courts seemed fine with this so I guess I became a little lax with my payments, over Christmas last yr, I knew I had gotten behind with my payments so I paid £30 (phone call, automated service) and thought I was probably up to date again, then yesterday a man from Marstons came round and issued me with a final notice unless my fines are paid in full he will remove my goods for sale sometime this wk, I didn't let him into my house although he asked and he left. I immediately called the courts but the man I spoke to was very unhelpful and told me to deal with Marstons, I asked him if Marstons could use a locksmith to get into my home and he told me 'of course, you haven't paid your fines' he also told me that the final notice letter had been returned to the courts (I'd changed address) which was my fault because I hadn't told them my new address. I called the bailiff who had visited me and asked if I could make payments, he said no and he'd be back this wk to take my belongings. Last night I found your forum and read for hrs but still not sure what to do next, called the court again today and spoke to a nice lady who told me even though I hadn't received a final steps letter it was out of their hands and I would have to deal with Marstons, I asked her how much I owe on the original fines and exactly what they were for, she told me the amount owing is £510 for driving without insurance x 2, keeping a motor vehicle on the road without tax and not wearing a seatbelt. Marstons are asking for £810.50 Should I carry on making payments to the court? beg Marstons for more time to pay or what? can they get a locksmith to let them into my house as my debt is from court fines (there seem to be many conflicting answers to this) do I have to pay the extra £300.50 added by Marstons? Don't know where to turn and I'm worried sick, any advice would be greatly appreciated, Many thanks
  18. hi.. any advice please ..got home yesterday and found a card in door from an agent from moorcroft re HALIFAX..asking for total of 235.00 and please ring.. .i havent a clue what this is for. ..i used to have a halifax account about 2 years ago ..it was a basic account with no overdraft or anything. ..havent used this account for a few years. ..i know i didnt ask for a visit. ..and dont know what to do. ..i know also i will not be ringing him. ..as i dont want to converse with these....

RE: Outstanding credit card debt with vanquis bank Hi I recieved a letter from resolve call saying that if I did not contact their client Vanquis bank within 3 days they will send someone round to my house to discuss repayment offers. I phoned them up today and said that I have sent a letter to Vanquis bank today as I do not want to negotiate over the phone with them. I also said to them that I do not invite anyone from their company to my home to discuss this and if anyone does come around I will phone the police for trespassing. The women got very annoyed and said that as I have revoked the agreement under the CCA a third party has the right to resume collections as they see fit including door stop visits without invitation and that because I haven't spoken to vanquis over the phone she or they are sending someone round to the house to discuss this with me. she also said I should read the cca. Now I really don't want a doorstep visit I have an elderly father who lives with me and although I can shoo them off this will probably scare him especially if its some meathead they send round. So should I just phone vanquis and give in? Is she right in what she says?
  20. How long do they normally take to investigate an error? I had savings over the £6k (about £2k over) for about 6 months. I did explain that it was because I borrowed the money so I could lock it up for 5 years to earn 6% interest PA. My account showed that money being paid in viA my dad, then paid out 6 months later.
  21. Flat mate had a letter from powerless 2 contact stating they would be making a visit about an account. He wrote the std letter withdrawing his consent for them to visit but they have ignored it and visited on wednesday just gone. However I went to the door and stated that I wasnt the person he was asking for. The p2c rep stated I must have been him as I came to the door. He didn't ask amy security questions or supply any identification and proceeded to discuss the account, arrears and tried to get me to speak to the oc on the p2c reps phone and take a payment. I told him I wouldnt be doing anything or even discussing the account and so he left in a huff. My flat mate is livid and has wrote a complaint to p2c and the ICO. However he is not happy with just doing that as p2c will just ignore the complaint and the ico are toothless. So he has issued a LBA for breach of data protection and intends to commence proceedings in 14 days from last wednesday. He want to complain to the OFT but I cant find the email address so does anybody have the postal or email address to complain to the OFT?.
  22. Well these are jokers, the CCCS sent a settlement payment to them on the 20th of November. No word from Joseph xxxxxxx as to if this has been received despite 5 emails to him to make sure this is the case. I returned from work yesterday to find a letter through the door from "Ground Collect" stating i MUST contact them right away etc, I called MHB who say they have not received payment, CCCS confirm it was sent. Set of clowns down at MHB that's for sure. Would of loved to of been in when they came round, It would of been fun that's for sure. Id of been knocking on 2 of my neighbors doors who are police officers to have them removed from my property.

Several weeks ago I received a visit from a man form Rossendales explaining that we had an oustanding Council Tax bill that had been passed on to them and they had a Magistrates Order to recoup the money. I agreed to send an income and expenditure breakdown and come to an agreement over paying it in installments. I filled this in and sent it back. Today a man appeared on my doorstep with a piece of paper explaining that I hadnt kept to the deal, and he was here with the van. He told me I have to pay over 1200 pounds or he will be back with the van and the police. I explained that its not possible, and said that I could get 300 tomorrow, and he said, that he'll take that and give me to the end of the month to come up with the rest or it will be van/boys in blue/bye bye furniture/car. The piece of paper is form Rossendales and not the court. I explained that I'd sent the paperwork back, and phoned the office and was told its not their fault, and that i should have either sent it recorded delivery, or phoned to make sure it got there. I asked if I have any recourse to appeal, and was told that the only thing I can do to avoid them coming back and forcing entry is to pay the full amount by the end of this month. He said he was "being nice" by doing this for me. I was quite stressed out at the time, and didnt want to get into a confrontation that might make him change his mind and take the stuff there and then, so I kind of capitulated and said I'd have the 300 tomorrow and see what I could do about the rest. Is there ANYTHING I can do to get them to take the installment plan? Their paperwork says: "No further arrangements are acceptable and payment is now required in full by CLEAR FUNDS ONLY." I was helped out over a mortgage issue by some of the guys here a few years ago, and hope someone can point me the right way...
  24. Hi all, I filled the esa form in a few weeks back, got a letter back saying I'm having a home visit by a doctor. So I'd like to ask a few questions on what'll happen, firstly I never asked for a home visit, is it dependant on what your disability is? The letter doesn't mention "medical", it says appointment and assessment, it also says a doctor will be arriving, it names the dr and gives a time, what will this dr do? Should I ask for identification/qualification. Anything alse I should know, seems strange after seeing my gp, doctors, surgeons, professors at the hospital, that they need to send a doctor, what does this doctor know that the others don't. Thanks.
  25. Hi Guy's Just in the process of finishing with Equita and 1 week later I have Rossendales knock at the door. This is for 2012-13 council tax. Work has been very poor, for the last 2-3 years. Self employed. My crime is making sure I have a roof over my head (renting) and feeding my family, Well I had 1 weeks break, Rossers called today. The wife spoke to he Bailiff, But this time did not let him in, She is a foreign National, The Bailiff left a sheet of paper as follows. Notice of attendance Magistrates Liability Orber Dated 10/07/12 Address xxxxxxxxxxxxxxxxxxxxxxx Amount£xxxx Plus Costs I have atended today with the intention of seising your goods and chattels as are nessecary to discharge the above debt If you can not pay this Bill in full you should be aware that even at this late stage, with an inital payment of £ 150.00 you can pay in installments Yours sincerely Mr XXXX Bailiff in charge I miss read the letter when I posted on my other thread, I thought he ment I had £150.00 in charges. Well I do not believe the person who attended today was a bailiff. Was not pushy when he spoke to the wife, when she told him to speak to me. just handed the letter to her and walked away. I'm sure the council informed them I had paid up the first LO and the set the Rossers on me . Just starting to get back on my feet and attacked again 2-3 weeks would have been nice so I could build up the funds. No cash flow no work!! I feel like giving up and tell them to empty the house and let the state take care of the family one step forward two or three back. I've had enough!!!!!!!!!! Leakie
