  1. Hello, I have just joined. I am a joint executor Non beneficiary, in a family will where the one of the two beneficiaries also executors cannot agree to the price to buy out the other. It has become hostile between them, it is going to court to decide what happens to the house and I am now a party to the claim, as second claimant, siding with the reasonable party for the purpose of getting this protracted matter dealt with. The indemnity form I have been sent by the solicitor of one party states in the last of three paragraphs, the following and I wish to know please if this is a rea
  2. Hi, I've just switched electricity supplier and they debited my bank account for the monthly payment on the same day I switched over to them. As I was expecting to pay a month in arrears this has left me short of cash. Is it normal for them to do that? Doesn't seem right. T
  3. Ordered a new sink & taps from Homebase which should have arrived on Friday. Got a call today saying it wouldn't be in this country until mid DECEMBER. Is it legal for firms to advertise retail goods they don't have??? How widespread is this in other retailers??
  4. Further to a cca request to Lowell, see my other post (do not know how to link posts) I have received the following: Dear Mr ******* your request for further information we refer to your recent request for further information regarding this account further to our letter dated 20th October 2017, please fine enclosed your returned fee of £1 in regards to your request for information under the consumer credit act 1974. at top of letter - its shows OC which was M&S store card it quotes the original account number and Lowell reference number and a BALANCE of £
  5. See on TV news that Vauxhall are limiting production of the Astra with a loss of 400 jobs. The article went on to say that Vauxhall are now owned by the PSA group ( Pug / Cit). When were they taken over from GM ?? Instead of sacking 400 people would they not be better off training a heap of them as Auto Electricians-----might solve a multitude of problems for the whole group
  6. Tried to do IR lending compaint with Quick Quid. They said No as loans are over 6 years old. Its not much but its a lot to me right now. Also I didnt pay back one of the loans but it has been sold on, to PRA Group I think .... Should I bother sending to Ombudsman? Or write this one off? Have included the statement Thank you all. 7. We have had numerous issues with a caravan purchased from a dealership in less than a year we have had approximately 44 issues with the caravan with several issues being serious. Four of the issues resulted in the front and rear panels being repaired and then replaced. The advice I got from a lawyer was as follows; Although I appreciate you approached XXX Caravans to supply you the caravan, as you took out a hire purchase agreement with Black Horse, they are the retailer of the caravan. T herefore any rights you have under consumer law are to be exercised against B
  8. Please consider signing this petition. It is a subject very close to my heart and involves the formally free(reciprocal) provision of dialysis for families and individuals when they go abroad on holidays or trips. One of the few pluses of our connections with the EU was the entitlement to foreign health care. In the case of treatment for people with chronic or long-lasting kidney failure, it meant that the destination country could provide dialysis for those families who wanted to go abroad. Dialysis is a mean treatment, it affects the whole family, the treatment has to be tak
  9. Hi I have a personal loan with Natwest all paid up to date and fine. Had the loan for around 13 months and have asked for an early settlement figure thinking I would get a rebate on the interest. They tell me not so. The early settleemnt figure has come and states no rebate under S95 of consumer credit act 1974 or under the agreement. Does this sound right? Thanks
  10. Hello. Today I was instantly dismissed. I was handed a letter which stated my contract would terminate immediately but that i would be paid in lieu of notice. The letter (or piece of paper) said there was a variety of reasons. There is no history of disciplinary or any other action which would have given rise to this. I have been there for 3 years. I am on a permanent not a fixed term contract. I was treated a bit like a criminal and escorted off the premises. This was humiliating as there is no rhyme or reason for it. Is this lawful?
  11. Hi am trying to help some elderly friends with their debt problems they have a Amex account and they have been paying £1 a month for quite a few years They want to try and offer a full and final settlement but it would be very low - do AMEX do full & final? Have said that first they should get CCA which they have now done - have attached (hopefully) the priority application form for the blue card and original conditions - both are difficult to read - quite faint The application form refers to PPI terms and conditions shown in enclosed leaflet plus balance tra
  12. Hi, I applied for a provisional driving license in October 2016. To this day (Aug 2017) I am still waiting for it. Today DVLA told me it's still in a queue for a doctor to review but would not tell me how many months or years it would take for that review to happen. DVLA refused to tell me the average or approximate time it takes for a medical review to happen. No info whatsoever...just keep waiting... Is this normal? How long does this normally take? Is there a way I could get a provisional license and my lessons as well as the actual driving license abroad and then use that h
  13. I am an IT consultant who works through my own Ltd company. I have been offered a job that is within IR35 this means I will pay tax, NI and all other deductions which I dont have a problem with. However the employer wants to deduct from me their costs such as Employers NI in other wrds bear their employer costs, is this right? I am due to sign the contract tomorrow so urgent guidance/help would be really appreciated. Thanks
  14. Hello, I like to get as much help/guidance as I can as to where I stand legally on this issue. My default date on a delinquent account was October 2010. In November 2016 I checked my credit file to confirm it had been removed post 6 year anniversary (It had). However when I checked my credit file again in June 2017, I discovered that the same default had been re-registered. The default date had suspiciously changed to September 2011! I wrote a complaint letter to the creditor, and they basically stated that this was the correct default date, and that they could not find any evi
  15. Summer has arrived and Thunderstorms are around. If you would like to track Storms moving around Great Britain this is for you. You can close into your town see strikes in real time and even time the thunder before it reaches you. As you zoom in, you can even see the strikes in nearby streets. At this moment 03-14am I notice just off the coast of South East of Britain is getting a beating. Anyway the link you will soon get used to it.Just turn the sound on, and as you close in you will see the lightning strikes and track the thunder before it reaches you . Strange thing
  16. As the title says. This is not a final notice, but the very first. I'm not even sure what the debt's for, but I've looked at the template letter on here and I am going to send that. Just wondering if there's anything in the CCA that stipulates a minimum amount of time to pay back the debt. Cheers!
  17. the other week I checked my bank and realised I hadn't got enough in to cover the insurance that was coming out the next day cancelled it with a view to ringing and paying and reinstating, forgot about it, went away for a few days came back to a letter ring us by this date etc and sort it I did all be it 3 days after the date on the letter. Yesterday I get in and have another letter from More than dated 4th July(10 days to deliver??) i.e. the date they wanted me to call them by. Enclosed a Default notice served under under s87(1) of the cca. It ju
  18. friend ordered item from retailer because the price was cheap ,they took payment then realised the price was wrong .Are they legally bound to supply as they have cancelled her order and just refunded her money.
  19. Long story slightly shorter. We had a other party fault accident last year, which is been sort of resolved, although I do have a complaint in with the Legal Ombudsman regarding this. However for the past 3 weeks I am constantly being bombarded by calls from supposedly different companies all with a Manchester selection of phone numbers, all want to talk to me about last years accident. Today I had enough so I questioned the company of the day, as with the others I give no information out and I confirm or deny nothing BUT this guy knows whre the accident happened, who wa
  20. Ok I've been in the system for 8 or 9 years now and been through the M/R appeal process several times,M/R's all unsuccessful, Appeals all successfully, so don't really need help but having just been awarded 4 points for PIP and losing that money, several days later I received a letter from ESA saying because of the PIP they will be taking over a third of my ESA away, leaving me in the support group as they accept I'm not fit for work. When I rang them to ask I was told that PIP is now the gateway for the higher rate for the support group, whereas 2 years ago I was told the opposite, Both
  21. Hi, today I received a letter from Howard Cohen & co. Solicitors re a credit card debt from Barclaycard. (enc) I sent off a CCA request in October 2015. They sent back a copy of term and conditions and a covering letter. Since then they sent letters from Robinson way requesting payment then there was a Notice of Pending Legal Action letter from HC solicitors in August 2016 Nothing since then until todays letter for settlement offer. I'm guessing this is because they can't provide the CCA I requested? I can't pay what there asking anyway....should i just ign
  22. Hi there I am trying to find out if Lowells did buy the debt are they liable to pay the PPI or is it the Cap One as the Original creditor who is liable to pay this back. I have read it somewhere it is the original creditor who has the right to PPI. Any advice would be greatly appreciated. I have a Cap One card with a small balance which would be SBd in a few months. Lowells claimed that they bought the debt but I had a dispute with Cap One for a long while. I have some PPI on that card which I want to claim. Lowell had put a Default Note in my CRA and the account is in their name
  23. I bought a Google Chromecast Ultra a week ago from Argos. It turns out it is incompatible with my AV receiver due to HDCP (copy write) restrictions. Argos' receipt only mentions being able to return it (within 30 days of purchase) in its unused, original condition. I wasn't aware due to the incompatibility without using it. Can I still legally return this product?
  24. I have recently contacted this company regarding a claim. The person who dealt with my call was aggressive and hostile and frequently interrupted me/ talked over me. Aside from this poor communication, the employee continued to insist that a part could be fixed when in fact I had been advised by two separate garages that it could not and would have to be replaced. Then he proceeded to blame the garage. They insist that they will only cover the amount of the part if it had been repaired but of course it cannot be repaired. Has anyone else dealt with this company? Any tips?
  25. Well i have never seen anything like it. I have been watching the weather models like a hawk. For a week or so. Not one of them is sure what is going to happen. I watched one weather presenter very experienced guy, even say so on the BBC. However one thing seems to becoming clearer,it is not going to be like last year. All the Atlantic storms rolling in one after another. This could be a winter to remember. I enjoy the storms as being a beachcomber this is when i collect many things from the shoreline. But understand it is hell for others. Latest is that we could have a wint
