  1. The Tory have implemented Tax cut - which corbyn and McDonnell are supporting, but which have the labour party up in arms - and quite rightly. Little Corbyn mini-me mc says they wont oppose tax cuts for the needy - what bullhooks Tax cuts, of which reportedly roughly half goes to the top 10%, and roughly 90% to the richest 50% But where is this money coming from? https://www.theguardian.com/politics/2018/mar/10/poverty-benefits-families-cuts-austerity-hammond-poor-welfare "the changes from April will save around £2.5bn and dent the incomes of the “just about managing” families that Theresa May has vowed to help." "The cuts will affect around 11 million families, including 5 million of the struggling families that the prime minister stated she would focus on." So they have taken 2.5bn off the poorest to pay for those tax cuts mainly to the richest, and given a smidgen back to the poorest who pay for it. and Corbyn and McDonnell support the Tories no matter the cost to the people ... as usual ...
  2. Hi We are currently in dispute with a builder. We have taken all appropriate pre-court action steps and are now at the point of submitting an N1 form to kick off a claim. Could someone tell me if any supporting evidence is supposed to be enclosed with this claim form? Or will this be requested later? We have quite a file of letters and expert reports and we are not sure at what point these come into play. Also, (maybe a silly question but I want to do this right). If there is not enough form for the particulars of the claim in the space provided, can you use this space plus another sheet or are you only supposed to use one or the other i.e. it does give the option of 'attached.' I reaslise these particulars are supposed to be fairly concise. Thanks in advance.
  3. Hi, folks I recently had a PIP assessment and was shocked when the HP admitted that she hadn't bothered to read either the form or the supporting evidence, prior to the "assessment". I was wondering how this will play out at a tribunal? I recorded the whole assessment on my wife's phone
  4. Hello Consumers forum I have a reassessment for my ESA due in Decemeber 2015. I have been diagnosed with Agrophobia, Panic Disorder, Depression and PTS.. I have asked my doctor if he would support me which he has agreed to. I just don't know what information to ask for? I wonder if he would go through descriptors with me and agree which affect me the most and create a report from that :/ I also have a CPN is it worth asking for a report off her also?
  5. I have some questions about the correct procedures for County Court summonses. I'd be really grateful if anyone could advise me on any of these queries. I have read the guidance notes for both online and paper forms but still have some uncertainties. Background: I am about to issue a County Court summons for unpaid compensation for use of part of my property by a builder. The basis of the compensation is set out in an agreement and related emails. My questions: 1) When sending in a paper N1 form, is it correct to send supporting paperwork with it? E.g. Copies of agreements, contracts, print outs of related emails. 2) Exactly how many copies of the N1 form, defendant's notes, and supporting documents (if these should be sent with the N1) do I need to send? I assume from the guidance that it should be a total of three copies of everything: One copy (i.e. the original form) for the court, one copy for the defendant, and one copy for me (to be sent back to me). 3) I was originally planning to issue the summons online but the Particulars of Claim box on the MCOL website is absurdly small. How does anyone explain the key points of their case with so few characters and lines to work with? Any help on these queries will be really helpful. Edit: I have found the answer for question 4. Questions 1, 2 and 3 still confuse me. Answered question below: 4) I am aware that one can send additional PoC by post if using the online form but, as I understand it, these later PoC are only to be sent to the defendant. The Court and the Judge will not see them unless and until the case comes to a hearing. Is this correct, or should one send additional PoC to the court as well as to the defendant? Answer: I see that form N215 'Certificate of service' requires that documents sent to the defendant must also be sent to the Court.
  6. hi there i recently attended a wca i'm currently awaiting the "0 points" letter (an optimist i am not) so i'm currently thinking one step ahead to the "mandatory reconsideration" where another decision-maker looks at my case or a "mandatory rediscrimination" as the case may be i heard you can send supporting information/evidence for said reconsideration the problem is my g.p has said "as a matter of policy" they do not write supporting letters as the demand would be too high i understand that in most succesful appeals, evidence is paramount i have failed my last rotation (wca-appeal-tribunal) due to what i believe to be lack of evidence i would have attempted to attain some at the time but not once was i informed that this was needed and important a convenient lack of transparency on the part of the dwp i think anyway, does anyone have any help/ideas/tips in getting medical evidence when your local clinic is unhelpful? any help would be greatly appreciated. :violin::violin: for the record, my claim is mainly on the basis that i cant walk 30 feet without experiencing pain in my lower back, knees and ankles. i needed a walking stick just to get from a car to the atos center, nothing was asked or looked at in the wca regarding this despite me going into detail about it in the esa50 and yet im confident of a "the customer can walk 100 meters unaided" diagnosis.........its a miracle........hallelujah thanks again for listening to my ramblings
  7. I have filled in an ESA50 as I was unable to get to ATOS in Feb. They waited 6 moths to call me to assessment, by which time my support worker had left (benefit now reduced). My last ESA50 was filled in not very well by that support worker a year ago. I have answered honestly. Stated I can't walk as it causes me severe pain due to migraines, hydrandentis suppuravita & morbid obesity. But I'm not sure what evidence I need to support this. I have mentioned these things to my previous GP, but the fact I could get in to tell them last year & wouldn't let them see me crawl- I think they have interpreted as lack of severity. I refused to show private areas & so only have hydradetis suppurativa as 'possible' on my medical summary. My migraines have been recorded as 'headache'. I can send letter from clinic that diagnosed asperger's syndrome last year. Though I really forced myself to go to it & experienced much fear/panic. I was driven to assessment last year by support worker who attended. But the fact I could get to this might be used against me? I haven't been out in 6 months now though. I also have a letter from GP confirming that due to phobias I have not been out in 5 months & can't get to examination center. I think GP did this to stop me keep requesting medical certificates. As now GP has not sent back my latest SAE requesting one. My problem is that because I spend all day in bed & am housebound, I cancelled 2 neurology appointments a few years ago due to fear/anxiety of going out/people. So have not had any diagnosis or assessment for cause of blackouts & absences. So I have no evidence of these- just in my medical notes a few bits GP has noted incorrectly from few appointments. I have written to my GP a few times asking for help & treatment, the GP does not reply. I have difficulty using the phone & have no one to help- so am not getting anywhere. My statement for fitness for work has been listing depression. Though not sure how they get that as I informed past/present GP I feel suicidal on daily basis- not all depressed people are suicidal! It just feels like there's nothing I can do to actually prove my disabilities affect me severely. My support worker passed me over to an advocate who abandoned me. This is not helped by the fact I only see 2 people ever- my mother & 6 year old child. My mother is the sort who sees my asperger's syndrome as something I choose to have & what lazy people are called! And she labels me lazy & filthy (bed sheets covered in blood etc). Though oddly she's happy to take my carers allowance £60 from my ESA/child tax credit & child benefit from my bank account- despite calling me a scrounger! I have no one supportive in my life & so when it comes to providing evidence or showing true extent of my problems it becomes impossible.
  8. I am applying for work, and one application (for a janitorial cleaning type position) has asked for copies of the following documents to be sent along with the application. It seems to me that these are things which can be requested at the interview stage, but is it legal for the employer to require them at the application stage? It seems sketchy to me, and I'm reluctant to do so for various reasons, including the potential for identity theft if the documents are misplaced or misused. If it is not legal, is there a body or organization I should report them to? "Please include copies of the following documents along with your application form: Passport Drivers Licence 2 Recent Utility Bills 2 Employers References SIA Licence if applicable Visa ( right to work permit if applicable)"
  9. Hello Forum, My first post so please be gentle I'm in the process of claiming PPI applied to personal loan taken in 2005. SAR request send to bank (HSBC) on the 21/04 and in the meantime I phoned the bank to complain about mis-sold policy. Bank replied to my complain last Friday in writing stating they will look into the matter and requested to fill attached questionnaire and send it back to them. This is where I need your advice... Do I now wait for them to 'investigate' or do I send the letter to the bank together with the questionnaire requesting full refund and if yes are there any template letters I could use? Secondly I expect the bank to tell me get lost after sending the prem letter so can I find any guidance on preparing the Court papers on forum pages? Any help will be greatly appreciated.
