  1. New one this for me...a little help required?! My Wife has a TSB credit card, has had it 17 years no CCA at all. Have nt heard from them for over 6 months. Have sent Resolve Call, Moorcrofts and 2 others letters in the past asking for CCA AND Letters and they all give up and say they have passed it back to Tsb. Today though we receive this new one "We have been instructed by our client to recover the overdue debt. We DEMAND that the sum stated be sent direct to this office IMMEDIATELY using the payment slip below. Your failure to comply could result in a DEBT COLLECTOR calling upon you for payment or a COUNTY COURT JUDGEMENT being registered against you. Yours sincerely swiggly autograph! By the way this is from the DEBT ENFORCEMENT OFFICE in Whitchurch, Bucks. I am quaking in my boots....NOT! Any help what road I go down please with this one Is it same approach as the previous four and has any one heard of this company?8)
  2. Hello, I'm in a spot of bother with Erudio. Thought I was being clever/daring etc... by returning their letters over the last five years last week received a claim form through the post, at which point I (sensibly) lost my nerve and found CAG whilst searching the internet for help. Have followed the advice in the small claim thread, filed my AOS (today), and written CCA Request and CPR31.14 to post tomorrow. Details of claim below: Name of the Claimant:Erudio Student Loans Limited C/O Wilmington Trust Date of issue: 21 NOV 2018 Particulars of Claim: 1. The claimant's claim is for monies due from the defendant under the regulated agreement(s) between the defendant and Student Loans Company Limited under master reference xxxxxxxxxxxxxxxx, and assigned to the claimant on 22/11/2013, notice of which has been provided to the defendant. 2. The defendant has failed to make payments in accordance with the terms of the agreement(s) and default notice(s) have been served pursuant to the Consumer Credit Act 1974 3. The claimant claims the sum of £7116 4. The claimant has complied, as far as is necessary, with the Pre-Action Protocol for Debt Claims Have you received prior notice of a claim being issued pursuant to paragraph 3 of the PAPDC (Pre Action Protocol) ?Possibly. However, any post relating to Erudio would have been returned to sender What is the total value of the claim?£7626 (including court fee & costs) Is the claim for - Mortgage style student loans taken out between 1995 and 1998 When did you enter into the original agreement before or after April 2007 ? I was aware loans had been sold to Erudio, and was sent a notice of assignment, but returned it. Did you receive a Default Notice from the original creditor? I don't know. (sorry) Have you been receiving statutory notices headed “Notice of Default sums” – at least once a year ? I've been returning post about once a year. Why did you cease payments? My income has never been over the threshold for repayment. Whilst the loans were held by SLC, I deferred every year. I took an ideological stance when the loans were sold to Erudio and decided to return letters with a RTS label. I thought it was worth a try. (What a wally!) What was the date of your last payment? I last deferred 25/04/2013 Was there a dispute with the original creditor that remains unresolved? No Did you communicate any financial problems to the original creditor and make any attempt to enter into a debt management plan No I have written the CCA request and CPR31.14 and these will go in to the post, recorded delivery, tomorrow. I have also registered with MCOL and filed AOS, ticked 'defend all' and not ticked the 'juristiction' box. I'm following other threads concerning Erudio. Next step?   3. Hello newby so please be kind. I am and have always been in Scotland. I had a student loan back in the early 90s. I missed a deferment in the mid 90s and they enforced me to pay the whole lot. At this point I stuck my head in the sand and moved house a couple of times. I never heard anything and got a mortgage no problem in 1998. I sold that house in 2006 and rented for a few months. Got a mortgage at my current house in 2007. Clearly never had any issues on my credit checks back then. the SLC must have tracked me down (over 10 years on) as I started getting "statements for information only" from them on an annual occurrence. They were clearly marked as "not a demand for payment". I therefore assumed they were statute barred. Checked my credit reports recently and still nothing of any relevance. Recently appears Erudio were sold my loan so I ignored their letter. Today however I had a more threatening letter from Shoosmiths LLP. They claim my account (The slc) is subject to a decree granted by the court. (No specifics). Now I know of no CCJ/Decree. Certainly none on my current file within the last 6 years as I have just spent a tenner checking. Also getting all of my mortgages/credit etc over the last 15 years hardly suggests there ever was a court enforcement. Can/do Erudio/shoosmiths try fishing with bare faced lies ? I would prefer to ignore all correspondence but this one has got me slightly twitchy. I realise their difficulties in enforcing even if there was a very old ccj/decree. However how do I find out if such an expired document ever existed ? Are they raised in the local court as to where SLC would have been chasing ? If so can I contact someone ? Many thanks

I moved to Canada 2 years ago as a Permanent Resident and I've been paying the SLC for the last 18 months but now I've had a private loan recalled (father in law) and I can't make payments to him, MBNA UK (£10,000 on 0% credit card) and the SLC. I've decided to pay my family and MBNA but I want to know what damage the SLC can do to me. If not paying the SLC is going to ruin my credit then I'd rather lump it all in and default on the MBNA too so I can pay this private loan back quicker. If not I'm happy to pay. I get my citizenship next year and it's unlikely we will be returning to the UK. Ireland at some point possibly but not the UK. Loans were taken 2005, 2009-2012. Totally £21,000. Outstanding is £15,000 Thanks in advance.
  6. Hello I am looking for some advice about mortgage style loans from SLC 1997-2000. I deferred successfully up until the year that Erudio took over my account, circa September 2014. As their deferrment form seemed more invasive/complicated, I chose to ignore here I am now, after ignoring default notices, letters transferring my account to Capquest/AIC and PAP letter, Now a CCJ county court claim form. I have followed some guidance on this website - completed AOS, sent CCA request to Erudio and then SAR request to the solicitor. Drysden have written back to say have placed my file on hold whilst we seek our clients instructions they have requested copy documents referred to in my SAR letter. I need to file my defence by the 5th December - do I still need to do this with the solicitor stating they put my file on hold If I still need to file my defence do I just need to say that I took out the loans a long time ago and have requested copy documentation that is not yet forthcoming so that I can review/check what I need to pay?   7. I forgot to notify them of change of address and stopped deferring so they're now chasing for the full amount of my 1998 loans. I've been a stay at home mum since 2013 so no income at all. They've passed it on to Link Financial which I'm assuming is their debt collection agency. They've said my last deferment ended 2014. Which might be right as I moved that year. They've also said I've breech the terms ie cannot defer anymore and loan won't end at 50 I can't declare bankruptcy or do an IVA. Unless I win the lottery there's no way I can pay this and don't want a ccj. What are my options if any? Thanks
  8. Hi, I am new to the forum. Thanks in advance for any advice given. Student Loan Has Matured/ Full Payment Due within 14 days letter received from Erudio I am 45 years old and had taken out two student loans(95,96) and one (98) so under the old and new style loans. About 10 years ago I had arranged a payment plan (spread across all 3 loans) with student loan company (I think I was over the threshold to defer but was experiencing hardship). I had set up a standing order which remains in place to this day. When Erudio took over I received letter, calls , statements etc from them but have never contacted or corresponded with them in any way (just figured I am paying something towards the loan and was worried that if interacted with them in any way it would somehow trigger a new agreement or obligation, so just left it at that). I have recently received 3 letters within the last two weeks from them stating that my loan has now matured and full payment is due (aprrox £3600). Only after looking around on forums have I become aware of statute of limitations, but am I correct in thinking that my payment plan still running to student loans company constitutes acknowledgment of the loan? I believe that these payments continue to just beforwarded to Erudio (as I never signed or arranged for the payment to go directly to Erudio, only to the Student Loans Company details I had at the time). I’m wondering why there sending me letter so closely spaced, are they trying scare tactics to get me to contact them? I have other priority debts so do not want to pay this off if there’s a chance I could continue to do it over a longer period. Does it make any difference that I have not acknowledged anything to do with Erudio, accepted calls, responded to letters etc. Any advice is most appreciated. Thanks

Hi All I have been trying to get my deferment debt which was applied to my student loan from 1993 ,even though I have contacted them many times as I was homeless in 1998 -2003 but still contacted them ,its now 2019 and they still insist I owe them even though I was assured by them in 2002 it was taken off . It now seems in the hands of Link financial and thesis loans with Honours trustee being the owner or something , As I am in University now for a PGCE there is a block with this deferment ,which I thought was resolved in 2006 when I had a personal apology from CEO of SLC , I dont have that letter to show as I never kept the correspondence If anybody has had the same expereince I would be grateful to hear them
  10. This was quite a while ago. I've been going though my 2005 statements due to a problem with bank and have realised that I paid at least £600 of c/tax within a 5-month period. I was a full-time student at the time. Were students exempt from c/tax at this time? If so, what are the chances of recovering the sums paid? Thanks
  11. I graduated back in 2002. I know after that, the Student Loans Company sent me deferment forms which were filled in and accepted. Erudio took these over years ago and I have never received any deferment forms from them, or any way of doing so. I've made no payments or, as far as I'm aware, acknowledged anything with them. The other day, 3 brown envelopes arrived from Northampton. Opened one and it was a County Court business centre claim form for £2400ish against me from Erudio / Drydens. (Letters from Drymens telling me that I would receive court papers arrived a few days later). I have no idea what to do here. I'm not fully clued up on the logistics of the loans and can't remember exactly when they were taken out but if I graduated in 2002, the 1998-2002 seems about right. I've never earned the required £2200 or so a month and this was fine with the SLC and I'm not exactly making enough to make the sort of payments they would probably be looking for. The last thing I want are CCJs against me for this. The forms seem to be giving me the options of: Admitting the amount and want time to pay Admitting part of the amount Disputing the claim 28 days needed to prepare a defence. The forms didn't go to the address I've generally living at (but to my parents I used to live at) so I've got maybe 6-7 days now to do something. Any ideas what I should do? Whilst I don't mind paying them back if I have the funds to do so over time, why have they waited 16 years after my graduation in order to do anything?
  12. Hello everyone. I'm getting anxious about my currently deferred student loan and seeking some advice/guidance/reassurance, please. I have four mortgage style student loans from the early 90s and as I’ve beenbelow the threshold I have been deferring them; every year since I graduated. It’s all been pretty straight forward and deferment granted promptly. Last year’s deferment letter from Honours Student Loans(and maybe several before that) said, if memory serves, I was in breach of theloan T&Cs as I no longer have a direct debit in place. It must have ‘timedout’, as I’m sure there used to be one. As I’m now within a few years of my loan being written off I’m keen not to do anything that could be used against me by placing me in breach of the T&Cs and put me in arrears during my final few years. I’m winding myself up by reading the entire internet on whether the T&Cs actually state I must have an active direct debit inplace, even if I’m currently in deferment. So my questions is, when I receive my next deferment letter should I give them my bank account details, or even call them to provide them now, or shouldn’t I? On the subject of the deferment paperwork – have HSL changed it this year (2018)? Will my paperwork be different in 2019? If so, should I approach it differently? The next issue is difficult for me, as I think I may have been filling the deferment form out incorrectly. I haven’t been including Child Tax Credits as income as the advice I received at the time was that it didn’t count as taxable income and therefore didn’t need to be included on the form. But now I’m reading that I should have been declaring it? If so, then would your advice be to start putting it on the form from next year? The tax credits would place me close to, but I think still under, the threshold. As I haven’t been declaring child tax credits and probably should have been, would this be grounds for me to be regarded as in breach of the T&Cs and effect future deferment/write-off? If I should declare it, do I need to declare 100% or canI declare 50% as it’s in joint names with my wife and her income doesn’t count? Many thanks for your help.
  13. Hi all I'm in desperate need of advice. I have some mental health issues please bear with me. I had a debt relief order approved, however I was somewhere that if you have student debt it has to be declared even though it is excluded from the DRO. I log into my student loans account to see how much I owe. Looking through the old correspondence online i spot a problem with student loans and benefits. I moved back to my home town last year as was kicked out by ex partner and was homeless staying in various sofas. Months beforehand i was considering doing a masters degree but wasn't sure. In the end I went and enrolled and received £1500 student loan. A few days later I realised I was homeless, mental health deteriorating and in debt. I was in no position to continue so I withdrew before classes even begun. I thought they would be in touch about repayment but no. in the meantime the money is eaten up by my debts\buying food to eat then throw up and I had totally forgotten about it as my health had gone downhill, I d isn't know if I would have anywhere to live. Once I moved problems in my new place sorting out the debt, . I went to the CAB who said explain everything to the jobcentre so I made an appointment for a few days time. I know I have to pay back the money but what else is likely to happen? The period the loan would cover (although I was only enrolled a few days) would mean paying back 5 months U C (No housing element at that time). It's no excuse but the past year it's been one th ing after the other and I haven't been coping mentally (I'm in the work prep group). I want to try and focus on dealing with my bulimia depression and anxiety but can't until this is sorted. Also, this prompted me to look back through my whole journal online. When I first claimed U c they asked about previous earning s and ex partners earnings. I misread it and ticked we got less than £430 a month. They asked about ex partner as I live d with him for 3 months (only claimed benefits once he kicked me out( surely that doesn't matter as I wasn't living o r with him when I put in the claim? do I mention this also? For 9 of the previous 12 months before I put in the claim i was a student and living alone, then for 3 months i lived with ex partner, and worked for 3 weeks before I had to leave due to bad mental health and being kicked out. Which brings me to my final query. I ticked that I wasnt expecting any more wages from previous employer. 4 days after I submit my claim online I got a final wage of £400, but was paid during the first 7 days of my claim, and online those waiting days were not included in the assessment period. Do I need to declare that too? I've never been in trouble in my life and oversights like this is unlike me But this last year has been the worst of my life. I'm desperate but have to put on brave face. I am having CBT for the eating disorder but how can I begin to recover with all this going on? I know I'll be a year late in declaring these changes but hopefully because i n not just leaving it hoping they won't find out will work in my favour? That I want to sort out the repayment? When I got my flat me misunderstand invest I'd had to resulted in my payment being delayed, so hopefully they will see in not making this up. I 'm barely functioning. If anyone has any advice please i would be so grateful:help:
  14. Hi there, I have an old student loan from 1996-1999. I informed the SLC/Student Finance that the debt was statues barred three years ago and they left me alone. I started working for the NHS four months ago and today's payslip has a deduction for Student Loan repayment on it. I have never given permission for anyone to do this as I do not acknowledge the debt. Where do I stand? Many thanks, M
  15. I've had a student load in NZ since 1996 and never paid anything off. I have lived in the Uk for 15 years and recently I was contacted by a collection companany called CCI representing IRD and saying I owe NZD 36,000 and need to pay now. After advice from a lawyer, I have decided to apply for bankruptcy in NZ. Now, my question is, do I make contact with IRD and/or collection agency informing them that I have applied for bankruptcy as have no way of paying loan back? I am worried they will continue putting pressure on me now they have found out where I live. I have no assets, earn a low income, an a single mum etc so really have no way of paying anything back.
  16. Hello you good people! Please advise, as I've read all the relevant threads but none end with a definitive answer or resolution. I deferred my Student Loans from 93,93,95 each May until 2013 when due to a move, I forgot. I phoned SLC around late 2014 to be told the loans were now with Erudio and to phone them. Having read all the hoo-haa surrounding Erudio, I didn't phone. Nothing further happened. Fast forward to March 2017 and I noticed a hard search on my credit file from Erudio. Nothing further happened. Since last month I have started getting multiple phone calls from Erudio. No message is ever left, and I have blocked each number identified as coming from their stable. As I am on the voters' roll, I can safely assume they have my current address should they decide to write. Could anyone please advise on what my options are? I don't want them getting a backdoor CCJ, but the account must be in 'arrears' since around June 2013. I am not in a position to pay, nor do I earn over the threshold requiring me to do so. As far as I can see, having read the other threads, my move should be to wait until they send a begging letter, then I send them a request for my original CCA? If/When they do what should I do then? By my calculations the first 93 loan should reach the '25 years' write-off point this year, however as I'm currently in arrears I don't think it applies? As my last deferment ran out May 2013 do you think I can just wait another 12 months, 'head-in-the-sand' stylee, until the debt becomes statute barred? I'd just like to know my options, and the dirty tactics I can expect from Erudio now the beast has woken and acquired me!! Any advice gratefully received. Thanks for your time.
  17. I am on the new style loan and after moving repeatedly I haven't had any contact since 2015. I now live in France and was wondering if anyone has ever successfully lost student loans? Would I be unable to return to the U.K if they have lost me?
  18. Hi I dropped out of Uni after 3 weeks after realising the course was not for me back in September 2017. Just before Christmas I periodically started to receive letters from the Uni (Located in Scotland) requesting payment of £1100. Since my departure from Uni I have had no income whatsoever. Despite doing my best to find employment I have had no luck .My wife works and I'm very conscious not to be a financial burden to her. I don't smoke or drink and I limit myself to one meal a day. She is very supportive of me in my search for work, and I don't wish to give the impression that she is some sort of tyrant because I am sanctioning myself in terms of money and using household resources .I didn't show my wife the letters because I didn't want to worry her, and in many ways I just hoped the situation would just go away. I have also had 3 phone calls from STA International which I also ignored. Last week I got a Final Notice from STA International outlining ways to pay in instalments and I don't know what to do. I am just wondering what the procedure will be from here on in if I continue to ignore them. What is the worst case scenario? Can I expect a knock at the door? Ps. I was a mature student studying in Scotland (where i also reside) and prior to going to Uni I was in a job which I had served almost 20 years

  20. We have recently received the Deferment Form (D10) for my husband, who has old-style student loans from 1994, 1995 and 1996. His loans (according to the letter) are still administered by Honours Student Loans. We are puzzled, as this is the first time we have received the 'new' version of the form. He is self employed and does not receive support from any other sources, so we can happily answer NO to question 3.1. Do you receive support from other sources. I'm puzzled by question 3.2 Is a student finance loan your only source of income? Firstly, I'm not even sure we need to answer it if we answered NO to Q3.1, but nowhere does it say this! More importantly, what on earth do they mean by this question? How could loans taken out over 20 years ago be your only means of support? Should we be answering this or just assuming it is aimed at people who have answered YES to Q3.1 (even though it doesn't make sense!). Sorry if I am being completely dense here!
  21. HI all its been 12 years since I moved to Canada I did inform the SLC of my address. I did not have to pay since my income was so low. This year I have been receiving letters from debt agency saying that they have brought the debt and want me to pay it back. I believe that the old loans are now statues bard and it should only be one or two of the new type which are still with me This year they have been sending letters to my old address saying the they have been sold off again to a new debt agency. I have been on disability for many years and dont have much income what should I do many thanks
  22. I have two statute barred student loans from 97 and 98. I am finishing my degree and was told by student loans company that I have no outstanding debt and that I could proceed with the finance application. I have now been told that: "We have had confirmation that the balance is statue barred, however, this does not wipe off the debt from your account. As you are in breach of the original loan agreement, you will remain ineligible until such a time as the arrears have been cleared in full from your account". I will be derolled if I can't get the loan to pay for the tuition. Is this correct information I have been given? Thanks
  23. Hi there, I got a "new" student loan in the year 2000 for my undergrad in UK. I paid some of it off when i worked in London 2006-2008. I moved to Paris in 2008. I think I contacted SLC in writing in 2012 but didn't pay anything back. I just received a nasty letter from SLC saying that a Third Party Debt collection agency is going to be contacting me to get £6,000. My friend says that if after 6 six years if haven't (1) contacted the lenders in writing acknowledging the debt or (2) made any payments to the lenders then the debt is wiped as it's past the limitations. Is this correct? It will be 6 years in one year. Thanks, BOB
  24. Hi, everyone! I'm new here so apologies if I have or if this has been answered before somewhere! I had three student loans in 1995, 1997 and 1998. I deferred paying them for years on end up to around 2010 when I moved abroad and my salary meant I could no longer do so. However, I didn't pay the full amount they required because of my circumstances and eventually stopped paying altogether. After being sent umpteen letters for Thesis and now Link Financial / Capquest, I agreed to pay around 20 quid a month to each. I then stumbled upon this website and read something about my loans being statute barred and the fact that I might not owe anything now as there was more than a six year period where nothing was paid. Can someone just clarify this for me? If I deferred for over six years are my loans considered statue barred or not? Thanks!

I have a default of £2,976 with Natwest. £1,176 of which is made from fee's from when I went over my overdraft limit and then couldn't afford to pay enough money back to the bank to be able to get myself back under the limit. I accrued the overdraft while at Uni. This was a student account to start of with. The first time I went over the limit was in May 2011. My owed balance went up from £1767 to over £3000 in the space of 8 months. Even though I complained to the bank that this was spiralling out of control and I didn't know what to do. They just said you need to pay it back now to get under your overdraft limit. I couldn't afford this, I was only just breaking even at the end of every month anyway. I am now finally in a place financially where I can actually start paying something back. However, I am unsure as to how to go about this. I have already had debt collectors (Robinson Way) trying to contact me. This was about 2 years ago. Can anyone advise me on what to do? What about the fee's of approx. 140 a month will I need to pay all this back? This has been troubling me for a long time and I want it sorted as I really want to try getting my credit record in order to enable me to get a mortgage. Any help would be greatly appreciated.
