  1. Hi I have had two operations on my shoulder, one in Feb which didnt work and one in June. A full rotator cuff repair. I am employed and have been off sick since last November 2104 with my shoulder. I claimed ESA as I was advised to in May when my SSP ran out. I have had an assessment on 4th August and been told last Fri that I am not getting any more ESA payments?? And deemed fit for work??? My sick note runs out end of Sept 15 as my Consultant WILL NOT allow me back to work until my arm is back to normal use. I have complained to ESA and sent a letter to them from my Consultant telling them that I am not allowed to do ANY chores whatsoever,or employment. He told me I will go back to work when he says so as I am now having intense physiotherapy on my arm/shoulder to get it to work again!! My job is being kept open - I live alone and have struggled for the last 6 months, financially as well as being unable to dress or wash myself. My question is please I do not know what I can claim now as I have NIL income now ESA has stopped. I have appealed and just received their descision today - Mandatory reconsideration notice?? My Consultants letter has not got to them yet!!! Do I have to claim Universal Credit, JSA (But I have a job to go back to?) or Income support??? No one from ESA is helping me here. I have worked for over 40 years paying NI/Tax etc and this is the first time I have been off sick for this length of time. Any advice would be appreciated . I have no income and no savings how am I supposed to live with nothing?? Sorry for long post but needed to put all details in. Sugar x
  2. I am new to the forum so appologise if this is in the wrong section. Several years ago I was in Ltd company. We managed to secure bank funding but when the company failed we stopped and both the other director and I have been repaying the bank our debts in installments. We both signed a persobal guarantee. I have since discovered that for about a year he has stopped his repayments and because of the PG the bank is happy just to chase me. Is there something I can do to get make him continue paying and bringing his share level with mine? Is there also a way to pursuade the bank to split the debt equally? Thank you for any thoughts or advice, Jay
  3. Im currently with SSE, been with them a long time now. Im on standard meter, NOT prepayment. Ive just gone to enter my meter readings for my next bill, and ive noticed the elelectric meter has stopped. The figures have not moved since I entered them in last time, my last bill issued 18th June for period of 20th Feb - 20th May 2015 ( don't know why it was issued so long after ) So I got in touch with SSE via twitter. They responded really quickly. The guy who dealt with my query, explained to me that meters that stop, happen all the time and booked me in for a new meter 22nd September.. .He then went on to explain that what happens is, I get a new meter, they close the old account and start a fresh with the new one.. ....and because I immediately contacted them when I realised there was an issue with the meter, there wont be any charges backdated. To me, this doesn't sound right. I still have a supply coming through, and im happy to pay for what ive used. ...so it means that from 20th May - 22nd September I will be getting free electric.... id at least thought id need to pay for 20th May until reporting the fault today (11th august) but hes adamant theres not gonna be any charges. I don't understand it all. I need help
  4. Hello everybody, I wasn't sure if this belonged here or in the other motoring forum. Hopefully someone will be able to shed some light on a few questions I have. Firstly I know ignorance is not an excuse so before you berate me I am doing a pretty good job myself. My lesson from this is always check your paperwork and if there is anything that doesn't seem right question it with your insurer. Tonight I was stopped for not having insurance on my Micra. I was certain I did as I took out what I thought was a Multi-car policy with Direct Line along with a Touran in 2014 and renewed in June 2015. On my Touran paperwork it clearly says 'Multi-car discout applied' hence why I thought the Micra was also covered. Memory is a funny thing but I am sure that last year when the policy was started I added the Micra. I am in the process of hunting down old policy docs to confirm this. I taxed the Micra in March of this year. Which according to Direct Line the Micra was uninsured since June of 2014. So, three questions to start: 1 - Can you tax an uninsured vehicle? I cannot find anything that answers this question past when the law changed in 2013/2014. 2 - Anyone have experience of why Direct Line include multi-car discount on a single car policy? - Had the Multicar discount said 'Not included' I would have immediately sought insurance for the Micra!!! 3 - How on earth have I gotten away with it for so bloody long?!?! The real pain in the bum, Direct Line quoted £424 at the time of renewal, Admiral £417 that clearly stated both cars. I got a few more perks with Direct Line so decided to stick. Egg truely on my face now. Thanks everyone in advance. Any clarification needed please let me know. Btw. No previous offences or points. 9 years NCD.
  5. Hi, I'm new to this forum and see that most posts are regarding speeding but I wonder if anyone can help with a PCN for unloading in a bus lane. The PCN is issued for being "Stopped on a restricted bus stop/stand however the location wasn't a bus stop it was a bus lane. I'm probably lutching at straws but are the two the same or can I appeal on the grounds that the offence wasn't committed on s bus stop. Unfortunately i had no choice as there was nowhere else to park up and had to make the delivery. Any help will be gratefully received.
  6. I have had a similar experience at edinburgh high riggs, but this is more complex. On the 8th dec 2014 i was asked by a security guard to take down the hood from my hooded top. I did but pointed out it was winter and a number of people were wearing hooded jackets and hats who were already in the building. The security guard insisted it was hoodies in particular. On the 16th of feb 2015 I go sign on again, this time a different security gaurd tells me I can not wear a hooded jacket; i tell him of my last experience, but this makes no difference. On entering the building i noticed an older man wearing a baseball cap so file a complaint. It is apparent that it is not the item of clothing you are wearing, but the demography of the population that the security gaurd decides yo fit into. I am a guy in his 30s, i tend to wear hoods in scotland not because I want to be affiliated with the hoody culture, but cause its cold here. I found the treatment humiliating and giving people preferential treatment like this is surely illegal
  7. Hello Everyone, My friend has her first work programme appointment on the 24th June 2013 and was unable to attend due to being very anxious, being sick and had panic attacks! I rang Ingeus and spoke to her Employment Advisor, he was busy when I rang so I left a message that is was important he call back because it was to do with my friend's appointment and that she was unable to attend that day! He did call back and I duly answered the phone call, I told him why my friend was unable to attend and if she can have another appointment date and that I will come with her, I've explained about her anxiety and panic attacks and also told him her advisor at the Job Centre knows of her circumstances as I've had to cancel an appointment she had with her job centre advisor before, I requested that my friend will need a private room as she will not cope being in a room full of people! All what we asked was granted and I also told Ingeus advisor to send me a letter to confirm my telephone conversation with him! Today a letter arrived there was no mention of speaking to me nor mentioned about requesting for a private room all the letter says! 'We have attempted to contact you by telephone but was unable to reach you. We have therefore arranged an appointment for you on such a date etc, etc. I couldn't believe what I was reading' Good job I wrote a letter confirming my telephone conversation with him on the 24th June and mentioned everything we spoke about, I've kept a copy of course and sent the letter to him! I need to write a letter to him about the letter I've received today not mentioning anything of our telephone conversations, my brain has gone pickled at the moment and I want to be careful how I write the letter! He has lied and also not stating the fact of out conversations has anyone come across this sort of problem with Ingeus it will be good to know about them a bit! Thanks helen
  8. HSBC took it upon themselves yesterday to stop my VISA DEBIT card for no good reason. I had just paid online a BT (British Telecom) bill which they thought (as stated to me when I called them) ‘suspicious’. They were in possession of two contact telephone numbers for me. They did not call either of there although when I talked to them they lied and said they had called them. This is not the first time they have done this to me. Why do any of us stay with this rubbish bank? I’m going to see my local management tomorrow and take him up one side and down the other. For all the good it will do, At least I may feel a bit better
  9. Hi, I got a liability order for unpaid council tax last year. The arrears were £70, but then they added court costs of £120 for liability order (great!) So I owed £190 which I was informed by letter they'd take each fortnight from my JSA. This deduction has been coming off since around January, but I recently changed the London Borough I sign on and for the last two JSA payments they haven't taken any deductions (and I've been paid full JSA). I've read horror stories over on the Bailiff forum that councils don't need to contact people anymore but can just send in the bailiffs incurring a further £310 fee without notice. Ending up owing £500 from an original £60 arrears is worse than Wonga interest and should be illegal, but we know DWP and councils seem to make their own rules these days. So my question please is do I need to phone up DWP and ask why they have stopped deductions, or phone up my previous council and tell them DWP has stopped taking deductions, or should I just leave it because I haven't stopped signing on, and DWP database must be linked centrally? I don't want to kick the hornet's nest and say "Oh please can you take my money", but likewise I don't want bailiffs turning up. Thanks...

I was granted DLA in 1997 for life (I still have the letter) but recently received a 40 page booklet to complete because the award was "under review" - even though it was awarded for life and has been increased twice as I became worse. Yesterday I received a phone call from DWP telling me that the DLA had been stopped. The lady couldn't tell me why, as she was not the person responsible for the file, but that they needed further information and that a letter was in the post. Nothing has arrived and I am at my wits end as to what to do. We cannot survive without my money and there doesn't seem to be any organisation that can help people like me. I do have depression and this big black hole is opening up again, so much so that I just feel like going down to the railway line when it gets dark.
  11. yesterday, I spent most of the evening driving around to catch more info about the guy and filing a police report I got hit by a lorry... he drove off.. i followed and parked in front of him alerting him he had hit me. . he pulled over, started to get aggressive, wouldnt exchange details, swore a lot and so i backed off for my own safety. I took a photo of his truck and my damage and went to the police. I filed the report - but they will only help if the insurance company need the info - the damage isnt worth my excess I have the drivers partial reg, the company details name and address of the company. Can i send them an invoice stating it would be quicker than going to court? At the end of the day he hit and drove off... in a company lorry, which is silly because I can always track them down. They're scaffolding people working on the building a lane before where i got hit
  12. Hi Son is 16, on approved training course. Returned completed form to Child Benefit before the cut off date in August, child benefit stopped. Wrote to Child Tax credits to inform them of approved training course. Tax credits also stopped. Would you advise what to do next? Thanks
  13. I went to sign on this morning and after waiting for a long time, one of the advisers came over and asked me who I was there to see. I told them and she went off, and then came back and asked me to sit with her at her desk and asked for my NI no. which I gave her. She then looked up my details and informed me that my claim had been stopped. I was then asked if I'd missed any appointments, to which I replied 'No', and then she told me to wait as she needed to speak to someone. I was then called over by a manager, who after doing some digging around, told me that it seems to have been an 'error' and that I could be signed on as normal, and my claim would be 're-started', although he wasn't sure when I would receive my money and I'd need to drop in next week to find out. BUT... ....on my last signing a fortnight ago, I saw a new adviser who told me that my jobseeking log 'may not be adequate'. I asked why and he got quite impatient, and refused to tell me how I could amend it to meet the requirements and he said if I wanted to discuss that he would make an appointment for me to speak to someone, to which I agreed. At this appointment, I spoke to the same manager I saw today and actually found him to very helpful. He said my written activity log was basically OK, but I should write the job location and ensure that wherever there was a reference number, to include that for all entries, not just the ones found on Universal Jobmatch. He also confirmed that although it was mandatory to have an Universal Jobmatch account - which I have - that it's not mandatory to give them access -which I haven't - and that my written diary of jobseeking activities which I take to each signing, was acceptable. I asked if he could make a note of our conversation on their records, which he agreed to, and I left that appointment feeling better informed and as if I'd been treated fairly. But then today, I go in to find that my claim has been closed down. So, I'm just wondering if anyone can see if there's any possible reason for this to have occurred, or if it's, as the manager told me today, simply an 'error'. I'm pretty stressed about this so any thoughts/advice would be useful. Thanks.
  14. Hi all i found this forum through google so hopefully i am posting in the right area. I am claiming ESA and had an Atos assessment on June 6th. 25 minutes before my appointment, they rang me to cancel saying the doctor had a flat tire and couldn't make it. Fast forward to around July 12th (Not got the letter on hand), i received a letter asking me to explain my absence from my assessment on July 10th. I wrote back saying I have had no notification of an assessment on July 10th. A few weeks later, i receive another letter telling me my ESA has been stopped due to failure to attend my assessment. I rang up straight away to dispute this decision and a friendly gentleman arranged a callback for me at 3.30pm. The callback didn't come until Monday 10am which i missed (Today) I rang the number they left on a message and spoke to a woman. She was condescending to me throughout the call and was very deliberate in confirming and asking me "So you got that letter but not your appointment letter, can you think of a reason why? - I dont know if this is part of their training but i found it disgusting along with her tone and impatience throughout. She told me that it is being referred to mandatory consideration and could take up to 28 days. Is this the correct next step? I am absolutely stunned with the whole saga and am now extremely worried about the mandatory appeal. With the process taking up to 28 days, will i receive the ESA backdated if they overturn the decision? Thanks

Hi all, just had a bad morning with a new advisor at the job centre, handed in my work sheet, and she said is this it a piece of paper why not on UJM, i told her that i always write it down there is no problem with this with the other advisors, she than said she wanted proof of what i had applied for which is no problem i got them all on email on my phone, each date she asked for i had the email, she then got ****ty with me and told me i must show which ones are full time or part time because to claim JSA it must be full time only, do any of you know if this is true. thanks in advance.

Hi all I am new As title says I went for my assessment on March 11th after waiting 8 months for it and got a Call from DWP today saying Atos have declared me "Fit to Work" and as such I am not entitled to any ESA payments I asked for a Mandatory reassessment and was told this can take up to if not more than 6 weeks for a decision and until then I cannot start the appeal process. I understand when that starts I can get put on the assessment rate of ESA while the appeal goes through the slow process of getting to the tribunal. My problem is I cannot afford to have No money coming in for those 6 weeks and was told that my only access to benefits is to sign on and claim JSA while the Decision Maker takes another look at my case. I suffer with chronic back pain and suspected Spinal nerve Damage (Waiting on MRI scan at the Hospital needs to be done under anesthetic as I am claustrophobic and have a number of Medical phobias) and cannot walk for more than 50 yards cannot stand or sit for longer than 10-15 minutes without significant Pain. I am worried about being able to convince Job Center that i am well enough to claim Job Seekers Allowance and also worried that by claiming I will hurt my appeal process I was told as soon as Tribunal has received my appeal that ESA would automatically be reinstated and I would not have to sign off job seekers allowance as the switch back to assessment rate would all be done automatically is it a Good idea first to sign on Job Seekers Allowance and second to trust what DWP have said? Won't signing on Job Seekers Allowance be like admitting they were right to say I'm fit and are there ANY other choices open to me? I have no Family or support network to help me through 6 weeks of no money for Food Electric Sorry for the wall of Text but i just dont know what to do
  17. Just a quick question, I haven't had a ticket yet. I was looking for somewhere to park while my girlfriend popped into a local shop. I drove right up and down the street, but roadworks were covering up all the places to park. So I stopped on a corner, which has double yellows, while she got back in. not a second later, I see a camera car crawling up the road, they definitely wouldn't have found anywhere to stop, so she jumped back into the car and I drove off. My question is, would they have caught me while they were moving, or do they have to be stationary to take a picture?
  18. my step-son returned from Oz about a year ago and went to live with his sister claimed JSA which he received after a family fall out he moved to his other sisters now dwp have stopped his jsa because they say he has no proof of residence and further he must wait for 3 months before he can claim. He 29 a uk citizen what help is available re funding ie. no income as dwp insistent that he must have 3 months residence at sisters. Are dwp correct and now social fund is defunct who does he apply to regarding finance. Advice would be welcome. .
  19. Hello, quite new to this forum so not quite sure where to put this, this seemed the most likely forum so apologies if wrong. I have been on income support for 6 months, due to being estranged from my family at 18 years of age. However, recently out of the blue I received a letter from income support stating the following; I am writing to tell you that we cannot pay you from 18/4/14 We have decided to stop paying Income Support because you have failed to return the A2 review form issued 7/3//14 Please reply to this letter within one calendar month of the date of the this letter. If you fail to do so, we may cancel your entitlement to benefit. Please tell us straight away if you cannot give us the information we require. I am baffled as to why they have stopped my benefits without informing me about a review letter I was supposed to receive and complete. As of today I haven't received any such A2 review form. Is there anything I can do from this stage? Does this mean I will have to re apply for Income support or is this merely a suspension until I give them what they require? I also have no possibility of appealing this decision. Thanks. Wayne
  20. Hi I stupidly sent my ESA renewal form back in late (about 10 days) and my ESA has been stopped. I am having Mandatory Reconsideration and am still waiting for a decision (3 weeks). I sent my form back late as I truly had thought I had already sent it in as I was under considerable pressure after Christmas. I receive a form to claim DLA and my ESA renewal form on the same day, filled one in, posted back on time and just forgot about them. Then, I received a letter saying my ESA was now stopped. After many phone calls, when my form was at ATOS, with the wrong office or just couldn't be found, I was told my reasons for returning the form were unacceptable and that I should apply for Mandatory Reconsideration, which I did. At the time, my son with Schitzophrenia was poorly (over Christmas and January), I was still visiting my mother with Dementia daily and also had an recurrent infection in my new, transplanted kidney (which was painful and so I was getting no real sleep). This decision, however, had been made before they received my form, which I filled in in a panic when I realised I had forgotten it. My question is, can they really stop my money when I have been told that my medical situation is not the problem, but that the reasons for sending my renewal form in late had been rejected? I have been told that the Reconsideration Office is unlikely to overturn the initial decision and that it is very likely that I will have to appeal and that may take 9-10 months. I am in a terrible panic and think this government want everyone except their ilk to just disappear and stop sponging (if only I had an expense account.....) Can they really stop my money if I still fulfill the criteria to receive ESA? Hoping someone out their can help. I thought I was at the end of my tether at the end of January - little did I know what the DWP are capable of. Many thanks for reading all this.

In a moment of madness (I have a recurring mental illness), I rang the benefits agency and told them (incorrectly) that I had received a lump sum which I had given away a number of years ago - what actually happened was that the money went to someone else but it had been offered to me and I hadn't accepted it. Since the 1st of January they stopped all benefits whilst they decided they would investigate what had happened. They stopped the benefits retrospectively - I did not find out until a couple of weeks later when I received a letter from them. So, now we are in February and my rent is not being paid and I understand that I can not apply for a crisis loan whilst they investigate me. It looks as if this situation could go on for some time. I have been to a drop-in in my local town where they have started to correspond with the benefits agency and local council - and it seems that there is nothing anyone can do about getting me a loan to manage. The only help that seems to be available is a bag of food each week - but it is not enough to last more than a few days. Does anyone know of anywhere where I can get financial assistance to pay for food? I don't think that I can last more than another week.
  22. I stopped my car in front of school on the yellow zig zag line to allow two members of public to cross the road. In the mean time, a car coming from behind tried to overtake from my right hand side (possibly not knowing why my car was stopped). It was my natural response to look over my right shoulder before I could move away safely. But in these split seconds (and while looking right) my wife who had dropped my child to school had opened the passenger door on the left and was boarding the vehicle. I allowed her in and moved away safely. However, the overall stay still did not exceed 5 to 7 seconds in which all the above occurred. Please note I never stop even to pick up my wife from the front of the school and she knows it. But on that day, she thought I had stopped to pick her up without realising I had stopped to allow members of public to cross the road. When I got the ticket I was not sure why I received the ticket because in last 4 years of dropping my kids to school I never parked in front of school on yellow lines. The still picture only showed my wife opening the car door? I wanted to see the video evidence and emailed council. Instead I received surcharge notice which required me to pay £165 instead of original £55. I wrote to them again and requested for the video evidence. They then revised the amount to £55 but still did not send the evidence. I called back for the evidence and now finally I have received the video evidence which confirms all of the above. But it confirms one more thing. The video shows I went pass my wife by few yards and stopped only when members of public were crossing the road. It then further shows my wife rushing towards the car from behind on the left hand side (while I was looking right) in an attempt to open the door while I was about to leave. If my intention was to allow her to board I would stop exactly where she was in front of the school door. But this was not the case. Do I stand a chance in the appeal? What shall be the grounds? Is this a long stay? Is there a provision for stopping to allow passenger to board, although this was not my intention?
  23. Hi Guys, A very good friend of mine has just had his JSA stopped and I need some advice on how to help him. For the past 9 years he has worked at the same estate agents. However recently he was having problems with some clients because of personal problems with the owner of the estate agency. They threatened my friend with violence if he did not leave the job as they knew the owner would struggle without him. My friend was initially threatened with violence, then had his car windows smashed and just last October was physically attacked which led him to be hospitalised and he required stiches. That was the final straw and his family asked him to leave the workplace for his and his family’s safety. He claimed JSA for the first time in his life at the age of 35 and just a few months into his claim he received a letter yesterday informing him that his claim had been stopped because he left the job voluntarily. I want to help him to appeal and was just wondering what our best way forward is? Surely we can point out that he did not leave voluntarily and was forced out due to the physical violence? He has a police report and has been having counselling since the attack. I would appreciate any help/advice and any template letters available that could be helpful. He has a young family and has been trying to find work since the New Year as he has no plans to be on JSA long term. However in the short run he needs the financial help. Thanks
  24. Hi, I have just found out that my ESA (WRAG) was stopped because I put in an appeal about being put into the wrong work group. I was then told that I could not appeal as time limit had ran out. NOwhere in any of my paperwork did it say I could appeal if decision was wrong. So I sent in a letter with a letter from consultant at the hospital as I feel that I am in the wrong group and being hounded by the job centre to keep going there to see my adviser. She then keeps telling me I can do training courses for Plumbing, electrics etc., Now this is considering I have COPD Arthritis in both hips and carpel tunnel syndrome and suffer from depression and raynauds.All confirmed by the hospital. They have now said that it will start and be in my account on the 28th Jan. Can they stop it even if I cant appeal. The last appt at the job centre I could not attend and cancelled as I was ill and said I could provide proof of this. I was also told that I could send in a letter and say that I did not appeal in the time limit as I was not informed. Will they stop my money again while this is going on? How many interviews do you have to attend at the job centre with an advisor I have had 10 now and missed the 11th. Also been told that my review is due around october is it worth holding out till then and then put every bit of evidence with it or send in letter. Thanks for your help
