  1. Hello everyone, I am new to this forum, I need some debt advice please. I've been receiving letters from Lowell financial chasing me for two old debts for almost 4 months now. They were threatening court action, so I finally responded . One debt is for an old Tmobile account, (which I remember), the other is from Shop direct (which I don't remember). I sent them a statute barred letter the shop direct debt because I couldn't remember anything about the debt, I assumed it must be a very old debt seen as It doesn't appear on my credit file. They have since responded to my letter saying I opened the account in 2004, last payment was in 2008. Apparently I made a payment between 2009 and April 2013, so based on the last payment of £10 in 2013 (which I don't remember) they state that the debt is not statute barred. The letter also states that a CCJ was issued against me in MAY 2014, with the terms to pay £50 per month (again I had no clue there was a CCJ) which is now in arrears. I need some advice for the best way to proceed please. I am now stuck, do I have any more leg to stand on, or do I just go ahead and make payment arrangement with them?. The total debt they claim for shop direct is £1180.23, I can't afford this now, I'm already struggling financially and paying other debts. Please help, what do I do next?, I don't want another CCJ or bailiffs at my door. Thanks in advance for your time. Jo x
  2. Hi there, I have received a Claim Form for a debt i believe to be Statute Barred. The Claimant is Arrow Global Guernsey Limited and they are being represented by a Solicitors firm. In the Particulars the Contract date is 12.07.2008 whilst the assignment date to claimant is 20.12.2011. I am pretty certain that there has been no payment from 2008 onwards and any previous payments were initially made from a company account where the company has now been dissolved. The company used my credit to obtain a credit card. The debt has never appeared on my Credit File (requested from Credit Expert) and still does not appear recently. I have older reports saved that show this has never appeared. I have submitted a statue barred defence and requested information on the account. They have now sent me the transactions list - the total debt is circa £14k including the court fees and solicitor fees. The last payment was made on 1 April 2010 so it is within the 6 years, however, I am adamant that I have not paid this or the previous payments - I had no idea of the amount on the bill, I have no recollection of the actual debt. They have never directly pursued me for this debt in last 6 years. Having looked through the list of transactions and payments just under £6k is a "Finance Charge" or "Bank Charge". Any ideas or recommendation would be grateful thanks
  3. Please I need advice on how to handle this Restons and his allied Arrow global chasing me for SB Natwest credit card. The claim was for credit card, according to the claimant it was assigned to arrow global, last payment to the account was in July 2007, since then I have no contact with the original creditor except 4 months bill sent after the last payment in 2007 and letters from DCA in 2008. I was not aware that the account was assigned and I can’t recollect receiving any Notice of Default. I have checked my credit file with Noddle and nothing showing NATWEST/ARROW GLOBALL.
  4. Morning all, This is my first posting on these forums so apologies if it's in the wrong place! This morning I received a claim form from Northampton County Court Bulk Centre with the claimant Arrow Global stating the following particulars of claim:- "The claimant claim is for £1401 being monies due from the Defendant to the Claimant in respect of a regulated credit card agreement between the Defendant and the Royal Bank of Scotland (card number XXXXXX) and assigned to the claimant on 15/12/2010, notice of which has been provided to the Defendant. The Defendant has failed to make payment in accordance with the agreement and a default notice has been served pursuant to the Consumer Credit Act 1974. The Claimant claims the sum of £1401.00." I believe that this relates to an old Mint credit card which I had in my teens but no longer hold any paperwork to, but I am also under the belief that I have not made any form of payment in relation to this debt in a long time (possibly more than the 6 years required for a debt to be SB). I've checked my bank statements as far back as 2007 and can't see any record of payments to Mint during this time so I'm thinking about using the complete defence of the debt being statute barred, however before I do this, is there a way I can find out for definite when the last acknowledgement/payment of the debt would have been? I have checked my credit report this morning with Noddle and nothing shows from Arrow/Mint. What should be my next steps? Should I call Arrow and ask for the last payment date in writing? What should I do with the claim form? I know that time isn't on my side here so would appreciate any input from experts in this field. Thanks in advance.
  5. I'm new here and hoping someone can help me. In august 2005 i got into debt problems and stopped paying my credit card and bank loan both of which were with the same bank. Last payments were made in July 2005, recently on checking my credit file I noticed that 1st Credit have logged a default on my account and all the info is wrong!!!!! They state the account as started (i'm assumng this relates to the bank) in October 2005. And they have logged the default date as November 2010. I have not kept any paperwork relating to these dates but can catagorically confirm I have never spoken to either a bank or a DCA in the last 6 years and I have sent no letters to anyone relating to this.. . I have over the years received letters relating to this but I sent them back. The Debt is now 7 years since any acknowledgement and payment was made. Also today I have received a letter from Ruthbridge asking me to contact them re a personal matter, I am assuming it is over the same thing as this is the only debts I have never paid. I am and will ignore this letter. What I need help with is I want this removed from my credit report as it is all incorrect. Does anyone know how I go about doing this? Thank you
