  1. Hi everyone my sister got a letter on the 6th of feb saying she owes £173 for a parking ticket that happened in October last year. It says a warrant has been put though from the courts but my sister hasn’t received any other letters about this. This is the first she’s heard of the parking ticket. With her being on benefits and not having the money to pay I was thinking of sending a n245 form but don’t no what court to send it too. Ill upload a copy of the letter. Any help really appreciate. Thanks Andrew E007F505-5A47-4D11-99C1-143F8339C132-converted.pdf
  2. Hello, My sister has had a incident with my travel card. When she was exiting the station a travel officer caught her using my card. She admitted to the travel officer that she had used her husbands travel card as she did not know it was mine. She had also informed him that he did not know her taking it. She admitted to using it, and gave all her personal information. He informed her that she would recieve a letter and now we have recieved that letter. The letter states that she was reported 26th of October 2017 failing to produce a valid ticket, pass or photocard for the journey. The facts of the incident are being considered and they are advising that legal proceedings may be taken against her . In order for them to deal with our case correctly they want us to fill out the form on the reverse side. We do not wish for her to be prosecuted and she has never been convicted before regarding anything. I have not sent her appeal yet but I would like some advice before i send it This is what I wrote in her appeal: Dear Sir / Madam I would like to inform you that all these years I have been living in the UK, I have never been part of such an incident as well as I have never been a part of any criminal activity and most certainly never fare dodged. I feel so ashamed and depressed because of my ignorant decision. It was not something I neither planned nor did intentionally; rather it was more in the heat of the moment. It has been a very stressful period for me and my husband since he is working full time and I am on maternity leave alone with toddler and baby during the days. I literally have one free day a week when my husband has a rest day from his job, which lately I have been spending on gathering necessities for my children and relatives regarding our travel in November. Therefore when I was to enter the station I notice that I am not carrying my own pocket book and I had already reached the entrance. There was a long queue behind me stressing me so I panicked and used the card that was in the pocket book which I thought initially was my husbands. After this whole incident I feel even more stressed, distraught sad but mostly ashamed. I have had so much trouble sleeping and I barely have enough energy to take care of my kids. I am so afraid of what will happen to me. I will co-operate with you to the fullest and you have my guarantee that this will never be repeated. I would like to make you aware that there is no excuse for what I did and I am ready to pay the maximum fine for my mistake. I wish one day in the near future to return to work and continue my job search after starting a family, and a conviction would destroy my chances of finding a decent job to support and help provide for my family. I beg and wish for you to have some understanding of my current situation and we can find our way towards a settlement. If anyone can please read this through and advise me what I need to add and if there is someway we can settle this without her getting convicted? If there is someone out there with similar experience and can inform us what our next step should be and what we should be prepared for I would appericate it so much I would appericate it My sister is so stressed out right now. Thank you very much I have updated my appeal and added a few things: Dear Sir / Madam I would like to inform you that all these years I have been living in the UK, I have never been part of such an incident as well as I have never been a part of any criminal activity and most certainly never fare dodged. I literally have one free day a week when my husband has a rest day from his job, which lately I have been spending on gathering necessities for my children and relatives regarding our travel in November. I left my apartment in such a rush and quickly picked up my keys, my purse and what i thought was my pocket book from the kitchen table, since I was already late for my vaccine appointment, when I was to enter the station I notice that I am not carrying my own pocket book and I had already reached the entrance. Since I did not have my own card and I know that i could pay for my ticket due to that I did not have my bank card or any cash with me since they were in my pocket book. I was not thinking clearly and I was already so stressed since i left home so late and knew I had to be home so early. All I could think of was coming home to my children that I had left with my husband so he would babysit them while I am away for my appointment. I knew I had to be home early since he had a night shift the same day. There was a long queue behind me stressing me so I panicked and used the card that was in the pocket book which I thought initially was my husbands. 3. Hi there, First of, any help or advice would be very much appreciated. my sister ended up getting into around £1300 worth of debt with orange due to her teenage daughter running up a very large phone bill in one month. My sister, I assume - has just ignore it all. I only found out yesterday due to her asking to lend money to resolve this. She received a county court claimform on the 27th September and a letter from Lowell's to state court proceedings would be the next option on the 2nd of October (after the claimform had already been submitted). Had I have known earlier I would have sent a CCA or SAR I think it is for her but now obviously things are a little more tricky. I told her to hold off doing anything until I had done some research (prior to this she offered them half but they refused). she totally ignored me because she's a royal pain and sent off the court letter saying she intends to only contest part of the claim. I imagine a few will be slapping their foreheads over this haha. what would you advise to do? She is also a new foster carer and has been informed if a CCJ does register against her she could lose her place as a fosterer. So obviously want to avoid the CCJ at all costs Thanks for reading!
  4. Hi I am hoping someone can give me some advice on this as I am really confused. I contacted TV licensing on 10th October to inform them my sister had recently passed away. As she had paid for her license up tol April 2017 they said they would issue a refund. I was advised a scanned copy of the death cert with an email would be sufficient which I sent on 10th Oct. My sister did not leave a will but I have been dealing with her financial affairs. On the 12th October I received an email saying that they could not accept an electronic copy so I sent a letter on 14th October together with a copy of the death certificate. I emailed them again to chase this on 10th Nov as I had heard nothing back and got the following reply: Having checked our records I can see that we received your letter on 1 November 2016. I can advise you that we've issued an executors letter for you to complete and return which you should receive within 10 working days. I emailed them again on 18th November to chase executors letter and asked why I was not sent this in the first instance abd received the following: I can confirm that the executor letter was sent to you on 11 November 2016, I must advise you that it can take up to 10 working days to receive it. I'm sorry for any inconvenience I still have not received the executors letter from them so I emailed them again on 29th November to express my dissatisfaction and requested information about making a formal complaint and have not heard anything since. I read somewhere that they do not give refunds and I was just wondering if this is true.
  5. My sister passed away in January and before she died she absolutely assured me she had no debt or credit cards. She said I'd find it easy to deal with her affairs as she owed no money anywhere. There was some money in the estate, but when everything (or so we thought) was paid and settled I wrongly assumed it would be alright to use the money in the estate to pay bills and expenses we'd incurred moving into a flat near her to help care for her. In other words, I was the beneficiary of the estate, being her only relative. She died intestate and there was no need of letters of administration as her bank were happy to pay money in her account directly to me as her next of kin. It was a huge shock when a letter arrived for her 4 months later at her previous address (her partner opened it) from Cabot (Marlin). It seems to be a statement and says she owes £11372.27. We both in a blind panic tried to phone them but they refused to discuss until we send a death certificate. I have sent the death certificate and I assume what comes next is that they will make a claim from the estate. There are no records that I could find at her home of any such transactions, but they say original lender was HFC Bank PLC - Credit Card. It says Agreement date Jan 2000 and says Date Assigned 11th August 2010. I have no way of knowing whether 6 years have passed or whether she has made any payments, no original documents or agreements and no copy of any assignment documentation. I don't know whether the estate can request these? I feel absolutely sick about this as I was only just coming to terms with losing her! I'm assuming the worst and they will have a legitimate claim against the estate and that I will somehow have to find a way to pay the money. Can anyone advise?
  6. Hello all, Got some really good advice before so would appreciate some more, Family member of mine works part time as a entertainment agent for a company ( providing bands etc ), they pay her a set amount for shows and then she pays the acts/ does some of the promo/ takes a percentage herself from it- they book/ pay for multiple shows in advance She has recently gone through a really rough time - she suffered a very severe sexual attack - and she has been in and out of hospital/ counselling the last few weeks, due to an injury suffered she will be having an operation tomorrow. She is overdue in a few invoices to acts but the venue has very kindly said they will pay them this week if she returns the money to them- she has a very good working relationship with them and they really appreciate the work she has put in She has 4 future dated shows that she is also going to return the money for as she wants to get herself back to feeling good/healthy again before starting again My question is what is an acceptable timeframe for this? She needs to get out to the bank to organise it - as not in a account she accesses online and needs to move some bits around- the money is sa If she writes to them ( or I will for her ) saying all future show payments and the overdue invoice payment will be returned within 28 days is this acceptable business wise? Obviously my concern right now is trying to alleviate pressure on her and getting her to recover from this Is there a template letter for a business to pay within 28 days that I can adapt? Any help massively appreciated Many thanks
  7. :!:Hi all, Just wondering what options my sister has. She need to pay rent on the 01/01/2015 but she spent too much on Christmas and has no more saving. She is thinking of paying late or a payday loan. She needs to pay £375 What would be best for her to do? Thanks Andrew
  8. Help Please, Was caught on 3rd of October with my sister in law discounted oyster card , at the time i didn't know it was discounted card. she wasn't using it anymore cause they issued her freedom bus pass. The day i borrowed the card, i couldn't find my card which is discounted as well from the job center so i had to borrow. when i explained to the inspector he didn't believe me and took my details anyway. 4 weeks later i received a letter to explain what happen and replied with sincere apology followed the explanation and told them that am unemployed. Today i received a letter to appear in court 2 months from today. I have 3 options 1.Guilty - Don't attend the court 2. Guilty - Attend the court 3. Not Guilty - Intend to call witness What should i do? Do i need legal representation? Will i get criminal record for this? Do i call tfl or write to them to settle the case? Any advice and information is appreciated.
  9. I'm new to this and got directed here for help. I am tiring to sort out my sister's debt problem, so a brief history My sister was working in France for a couple until 8 months ago when all three of them where involved in a fatal car accident, Husband of the couple ( French national )was killed, wife and my sister ( rear seat passenger ) where severely injured. My sister had to spend nearly 8 weeks in a french hospital before she could be returned to the UK. Now to the point, in the course of this time period she has racked up some debts and is being chased for them, she is in no fit sate to deal with them as she is still recovering at my home. I am tiring to get her debt problem sorted before she returns home. What are my options as I'd like to try and get them sorted, I have access to her computer and bank details. Regards Mike
  10. Hey everyone. My sister needs help. First off she has learning difficulties and doesn't fully understand the situation she's in. She works for a care company where she goes to peoples houses to help the elderly with there daily things. She's on £7ph, the problem I see with this is they will schedule her to work 30 mins at a house and they will only pay her half of her £7 which I can slightly understand but what annoys me is she has to pay for her own travel nothing discounted or anything. She spent 5 days a week leaving the house at 8am getting home around 9pm and in 3 weeks only got paid £171. I do not think this is fair and was wondering if this is allowed.
  11. My sister was caught shoplifting in Boots today a face cream worth £15. She has been told by security guard that she will receive a fine in the post. Do you have any idea how much this fine will be as she is currently claiming Jobseekers allowance and is very worried that she won't be able to pay the fine. Any help will be much appreciated.
  12. Hello! My sister accidentally took my 16+ photo-card today. She was caught by the bus inspectors. She said she accidentally took it because we both had the same oyster cover and few minutes later they called me to ask and I said she probably took it by accident. My question is, will my chances of getting another 16+ be affected? some say i'll have to do voluntary work to 'earn' it back or i'll be suspended for 3 months! It's not my fault because I was sleeping so I didn't know she took it but I can't say that obviously because she didn't mean to take it in the first place and that'll get her in more trouble. Please let me know. Thank you.
  13. i was wondering if someone could help me. Im writting on behalf of my sister. She is 35 and a single mother to one. She worked for 10 years cleaning, but lost her job two years ago, due to her depression and taking to many days off. she has always had depression and is on very strong tablets, sleeping tablets ect. She was ESA last year, and tried to claim for DLA, as she can not leave the house, and has extreme panic attacks. if she goes out i have to go with her. She only goes out to my dads in a taxi twice a week. My neice helps alot. Anyway she put in a claim and was only awarded 6points, and wasnt allowed anything. She had a tribunal, but they was going on what happened the year before even though her depression is 10x worse now. She is now on JSA. But even just looking for a job she has panic attacks. She has attacks in crowds and if there alot of people. She is struggling to live. Im really worried about her. She has hardly enough money to make ends meet, let alone by her daughter new clothes when needed ect. So i help her out with that. She applied for jobs but because of her depression she doesnt get them, although both myself and the doctor doesnt believe shes in the right mind for a job atm and it would do her more harm then good. What could she do? could she apply for DLA again? We both know that if she can feed and wash herself she isnt really entitled to it. Help please xx
  14. I wonder if anyone can advise me on this matter? My sister suffers from bi-polar disorder, having been officially diagnosed at the start of the year after a long history of severe depression. She is currently in receipt of DLA and as far as I know, aside from Housing Benefit, this is her only income. Since our mother died in March she has become severely agoraphobic and hardly ever leaves her flat or opens the curtains. A few weeks ago she was persuaded to move in with our father, and so I have been collecting her mail and passing it on to her. This week when I went to pick up her mail after a 2 week absence, it included 8 separate giros, totaling over £3k, for the same 2 week period. As far as I can tell this was a genuine clerical/official error by the DWP, as she has not made any changes in her claim or informed them of changed circumstances. She is convinced that the payments represent a backdated amount that she is entitled to, but there is no accompanying letter to say as much, only the bog standard 'here's your money' letter they always sent fortnightly with 1 giro. Of course this error has been seen by her as providence and something she should be able to take advantage of, a theory fuelled by all the articles you can find online about the DWP being unable to take people to court for overpayment if it's due to a official error. I told her they will dock her benefit for the next 2 years when they realise the mistake, but she doesn't seem to understand that this will have long terms effects. It's money sent by the Gods as far as she's concerned. So my question is this. If I were to inform DWP of this, would she immediately be in hot water or would the fact that she is mentally ill be mitigation of some kind? And is she right, is overpayment by a technical error something that can't be reclaimed through the courts?
