  1. I have been bullied at work by a colleague and raised a grievance. The meeting is next week which is making me very anxious and panicky. I signed off for anxiety and stress at work, informing my line manager that I will stay out of work until the meeting, because the stress is affecting my mental health. The absence will be less than five days. My manager's manager insists that I have to call in every day. I checked the Sick Leave Policy and there is only mention of keeping in touch, nothing about a sick employee calling the office every day. Is this allowed?
  2. Hello. I am currently getting income based JSA for about 1 year now. I stay with my mum, But all of a sudden my mum is saying i need to pay £27 towards to rent as the council will only pay £109. So why now do i need to pay. I have a brother who gets ESA, and my mum gets income support. What are causing the housing benefit deduction, My brother only started claiming ESA this year in march, And all of a sudden the housing benefit is cut. So could someone help me because i am getting the impression the cut is because of me but i have been getting jsa for around a year and my mum has been getting full housing benefit since untill now.
  3. Hi i would be really grateful if anyone can help or advise my situation, i feel absolutely sick and i cant stop shaking.. Please dont judge me I got a letter today from tax credits saying they believe another adult is living with me and they need documents from 6th april 2015 - 30th June 2015.. I Have been living with my partner since january, he is the dad to my 2 sons and i am so ashamed for not telling tax credits that he is living with me..he doesn't work or he is not on any benefits at all..i work but im on maternity leave at the minute..what should i do? I feel physically sick at the thought of going to jail i dont want my kids to end up being dissapointed in me please help x

Hi, I have been suspended from work after I made a complaint about my manager, basically I had to be investigated for being late to work, on the day in question I was very unwell and couldn't get the bus due to having no money, I walked to work and was a little late. My manager sent an email to the person doing the investigation stating that I am a confrontational person and the person doing the investigation should have a witness present for their own protection. This email was shown to me and I naturally complained as it is a slanderous email and it suggests I would get violent towards a colleague. I complained to the senior manager regarding this email. The senior manager visited me and suspended me on the grounds of a complaint that came in from a member of public about a month ago. There has been no investigation into the complaint and I haven't been suspended awaiting disciplinary action. In my job I have had lots of complaints from members of the public, being a civil enforcement officer it is a common occurrence, but as complaints are usually just from disgruntled people and never anything serious, which is the case this time, I have never been suspended before. These complaints are always investigated first. I believe I am going to be sacked of spurious grounds to avoid the issue of my manager and the slanderous comments made about me. Do I walk? Do I allow the sacking and appeal? Should I escalate this with HR before it reaches any of these stages? I am unsure what to do here. Employment tribunal? Thanks for any advice you can give Tony
  5. I was/is on SEETEC, but my doctor told them that I was travel sick, they've given me 3 sets of tablets to help me. I do 9-5 job search which is 5 days a week, Thursday and Friday I go to a city 45 minutes away via bus. They knew I was travel sick, but ignored the doctor's note, I wasn't well. On Monday I was ill and kept retching, I told the receptionist that I felt ill but had to wait for the manager. Well, she came back and told me I had to stay at tehe centre till 5pm, it was 12.30 and my stomach wa shurting and I felt sick. So I walked out and had a doctor's appt and he gave me the 7 day sick not which has ran out. Because I have now got the month long one I can sign off JSA and onto ESA.. I'll ring them on Monday, but I don't understand if I have to continue with the job search or ring SEETEC to tell them I won't be in. I will on Monday as they need a copy of my sick note. Can anyone help me? The doctor wrote down anxiety as cause for me being off sick. He also said this place is stressing me out and making me ill. I would gladly get myself a volunteering placement myself.
  6. My wife is off sick, and is in the process of being given her prognosis for her cancer (Specialist biopsy going to London specialist Hospital.) It's not looking good, and we're both worried about it being the worst case scenario. She has problems with incontinence and is signed off sick with doctor's notes, etc. Her work (DWP) are constantly on the phone, trying to talk her into coming back to work and saying things like "Well, we can work around you having to go to the toilet every five minutes." What is the legal position of all this? Things like how often are they allowed to contact when you have a medical certificate, etc/ Thanks in advance.
  7. My company is undergoing a restructure and my job is being made redundant. I have had 3 consultation meetings and I have now been invited to attend my final consultation meeting at which I will be made redundant. I am currently off work with work related stress as things have got so bad that I just can't cope. I have been with the company for over 12 years. Do I have to attend this meeting or can I ask for it to be rescheduled? I know that it is only delaying the inevitable but at the moment I just can't face people. Thanks.

I know i am, it's not just because it's about people claiming benefits, but all the inaccuracies contained within these programs, the one on channel 5 about benefit cheats, is the latest, a Liverpool lad , claiming what was described as sickness benefits ,for PTSD told the undercover reporter that he was getting a total of £1,500 per month ,inc DLA , I find that very hard to believe, which makes me think of those IDS and his sanctions work leaflets that were based on lies , Also are those that are cheating the system really that dumb that they will boast to someone they hardly know about the hows and why's of what they do? Are these tv companies paying for stooges for entertainment value, and to help keep the governments hate propaganda against people on benefits alive ? if it isn't about cheating the system in some way, it's about their health conditions ie" too fat to work" ect

Hi , i worked part time 16 hrs in a care home as a maintenance man for 9 months up until june this year i worked in the dementia unit , the job was quite stressful and upsetting at times and was made worse by a recently promoted carer/manager anyway we didn't get on and we had argument and she tried to give me a written warning about my attitude , so i walked out , the other managers were very understanding and wanted me to return and sort out the problem but i just couldn't deal with it so i resigned went to see my doctor and I've been on the sick with depression/stress since . i have recently got a questionnaire fit for work thingy and my doctor tells me they will probably say i'm fit to work which is ok because i'm ready to start work , my question is will i be able to claim jsa or whatever it is when i get signed off the sick , i will tell the job centre i left the job because it was making me ill . thanks in advance.
  10. I work 4 hours a day but these 2 weeks i have been off ill. I have got a sick note from my doctors so do i need to send it in to anyone? I get paid at the end of the month so does that mean i will receive that payment? I get £10 an hour. thanks for any advice in this matter!
  11. My current sick note runs out on Tuesday 17th which was signed from the doctor. I am right in thinking the DWP always give you a weeks grace and would therefore put expiry at 23rd. I am due at my local Job Centre on Monday 16th to see my ESA adviser. Do you think its wise to order a sick note on Thursday 12th to be able to take to the Job Centre on the 16th. I don't always have to see doctor to get note it can be signed then left at reception after a request has been made. Usually takes 24 hours. Or should I wait till I receive a letter saying my sick note is about to run out please return another sick note by the 23rd(more than likely date). I am due to get paid on the 17th and 31st March then on into April 14th. I may then be in the same dilemma next month as would run out on 12th or 18th to DWP in April if give 7 days grace. My doctor gave me a note for a month last time and did say on the note he would not require to see me to issue the next one or however it explains it on the note.
  12. Hi, My good friend has been on sickness benefit for a long time at one point she was on dla too. It may have change and she may just be on a pension now, I do not know but will find out. she was taken very ill and is in hospital. However they say they will release her soon. However there are some urgent functional problems in her home that have not been repaired that need repairing plus lesser urgent but equally important work needs doing maybe costing altogether £5,000 upwards. This is aside from cosmetic re decorating that seriously needs doing too. I recall a lady on the programme 'benefits street' got a benefit loan of a £1,000 which she pays back in small amounts, to redecorate her house from orange to purple. What benefits, emergency funding etc. is available? I can pitch in and help, but sadly I can not pay for the work to be done which I would prefer to just be rich so I could just have it all done in a few days for her! Thanks in advance, Clear33
  13. Hello I am new to this forum I really need some advice. I am currently on long term sick leave from my job as a GP's receptionist. There is no likelihood of me being able to return in the near future and my latest certificate from my GP covers my absence until 10th August 2015. My GP is being very supportive and I am on medication and have been referred to specialist services where I have had my initial assessment and I am on a awaiting list for additional treatment. I know that my long term absence has an impact on my employer, I feel guilty about this, but it does not change my ability to work, I have not control over my condition at the moment. I am in receipt of SSP, my employer does not offer any occupational scheme, and I have asked them to provide me with an SSP1 form as my SSP is due to end soon. I have now received a letter informing me that a meeting has been booked for this Thursday 2nd July and that I need to attend to discuss my sickness in detail. The meeting will be with the partners (husband and wife team) and the practice manager, and I can bring a colleague or union representative. The reason for my absence is anxiety and depression and there is no way that I can attend this meeting at my place of employment. It would not be fair to ask one of my colleagues and I am not a member of a union. I am concerned that although the letter I have received states they want to assess my ability to return to work, I think that the senior partner in particular wants to assess my illness. I am very vulnerable at the moment and I am seriously considering resigning as there is no way I am well enough to work in any job let alone the stressful one I have. The senior partner is extremely dismissive of his staff, he is basically a bully and has made things difficult for staff members who have handed in their notice to leave to go to other jobs, and he has made things difficult for other colleagues who have been off ill. I don't know what do. I am going to ask that they given me more time to get advice and I want to try and see if my local mental health team can offer me some support. I cannot attend this meeting alone, my husband has said he will attend with me, but I know my employer will not allow this. The senior partner has made it clear to one of my colleagues & immediate line manager (who is the only person from work who has been in touch with me before this letter), that he doesn't believe my illness is genuine and he has even threatened not to pay my SSP, which he hasn't done. What should I do? I am so stressed which has made my anxiety and depression so much worse over the last few days, I am not due to see my GP for another few weeks, not sure whether I should go to him to discuss my fears. My employer has not asked to see a medical report, although he has on several occasions told my colleague to inform me he will be doing this if I do not return to work. I have no problem with agreeing to access to my medical records as both my GP and the local mental health services information on medical record would back up my version of how I am feeling at the moment. I feel that I am being forced into to making a decision I do not have the mental capacity to do so at the moment, I feel bullied, and paranoid. Any advice or opinions would be appreciated. Sorry if this post is long and rambling, it has taken me ages to write. R

A colleague at work had an accident at work and was signed off until 22nd June.However,the company are refusing to pay him until he brings his sick form in personally.Can the company do that ,because if you have been signed off unfit to work, how can the company expect you to come into work and bring your sick certificate and fill in sickness payment forms? I was under the impression that if you had an accident on company premises and were signed off work, then the company has to pay you full pay?
  15. Got a work experience interview tomorrow to work in a charity shop working through the back got it when I went in to do my daily sign on does it last 6-8weeks ? If am not happy with it can I get out it after 2or weeks or some? Just like some feedback on it. Anyone worked in a charity shop for work experience before via job centre And what hours and days? And was it through the front of store or back of store? Hope to hear back
  16. hi, one of my friends is not well, she was on sick leave about month ago (problems with back), she works in the warehouse where lifting is involved. she is not well again so she did ask doctor to give her a letter stating that she can work but is unable to lift parcels over 10 kg, doctor stated on the note that she can lift only between 2-4 kg. when she gave it to her employer he send her home until letter expires which is 2 months. She can work but is unable to lift, they used to move other girls to do different thinks before. do they have to pay her for this time even when she will be at home for next 2 months? thanks for any help
  17. Hello everyone, I'll try and explain my issue as best as I can. After many years as a stay at home mum I finally found a job for a small company local to me. I started on January 26th 2015 and my trial period ended on April 26th 2015. On May 6th I was taken ill and ended up having an ECG scan and had emergency blood tests. I kept my employers in the loop and they seemed understanding. A few days later I was still quite unwell and told them I'd need a few more days. They understood and asked me to let them know. However on Friday 15th I received an email from the owner of the company saying that they were grateful for all I had done but after a performance review (done in my absence and without my knowledge) they were letting me go with immediate effect and they would pay me a week's notice. My question is: can they do that while I am off sick? Can they have a performance review without me present and then decide I hadn't met their "targets" which were never discussed with me previously in any shape or form?As I had worked past my trial period even though it was only a few days over, do I have any rights at all? It feels wrong that the first time I am in a difficult position they just fire me without giving me any other chance. Am I being naive? I appreciate any feedback.
  18. Hi all, wondering if some-one can advise on this. Last year after a catalogue of errors and muddles with my pay and holidays etc, something happened and I had a melt down on the phone to some-one in HR (sheers frustration at being fobbed off and not listened to). It took me by surprise..didn't realize stress had been building up, so I finished conversation saying something like..I'm going to see my doctor and if I am ill you (my employer- public sector) have made me ill. T hat was on the 29th July 2014. I did go and see my doctor on the 1st August, (mainly to let them know the score) and continued to work as normal (part-time, evenings and weekends). I'd made it clear my job was not stressful it was all the management nonsense with my contracts, pay holidays etc that got me down and stressed , as I had to sort it all out in my free time in office hours.. Within a few days a letter arrived from the Occupational health service telling me to attend a meeting on Wednesday the 10th. The referral had been made on the 1st August. just two days after my meltdown on the phone with HR. So, Several questions. (the referral was for stress). a)are employers allowed to ambush some-one with OH like that out of the blue without even discussing the problem properly or formally even letting me know me I would be referred. b) I wasn't even on the sick and had never been on the sick. Did they have to right to refer me, especially without asking?( I idid get sent a consent form, with the appointment letter, but that had warnings about how if I didn't go it might affect decisions my dept made about me. I was stressed, not thinking properly, signed it and agreed to go to the appointment but made it clear it was under duress. c) The appointment was for a Wednesday 1.30, at a place about 8 miles away..in my free time plus I was expected to get there at my own expanse. As it happens I was afraid of driving in case I had a melt down again in the car (basically a high anxiety attack..sobbing not being able to breath etc.) . I asked for Time in lieu as I'd have to go on the bus,.., which would take ages. HR said no way but eventually relented and offered to pay for a taxi. Should they give me TIL as well as the taxi? The OH report basically said I was fine, just having a normal reaction to intolerable management issues. I continued to work for two months, while a review of the muddle with my holidays etc. was carried out. There is more but I'd like to see what people think about this lot first. Many thanks
  19. Hello everyone, I'll try and keep it quick as it is a bit of a headache. July 2014 started working for a small local business. No contract signed. Dec 2014 found out I was pregnant. Jan 2015 told employer I was pregnant. We discussed my Maternity Leave starting on July 3rd. I tried to make all of my maternity appointments on days I was not working, even changing midwives. Due to my health this was not always possible. I had a few sick days in Jan / Feb due to pregnancy illnesses and depression. Feb 2015 prescribed 25mg Amitriptyline which was doubled to 50mg after 7 days. Also prescribed Codeine and referred to a physio for PGP. My boss knew all of my health issues. 16th March signed off for depression from 16th-23rd March. On 23rd March my boss text me to ask why I wasn't in work, I tried explaining that the sick note was inclusive of 23rd and I would be back following shift which was on the following weds. He said I was wrong and phoned his gp who said I should have been back at work that day than phoned my GP who said my next day at work was Wednesday. The text messaging went bck and forth for a little while and actually made me very ill that day. I went back to GP that day who was not happy my boss had phoned his surgery and signed me off again and said it was inclusive of dates and if I didn't feel any better by following Friday than to go in and see him again. 23rd March signed off for depression from 23rd - 30th March. Friday 27th March went back to see my GP as my depression was getting worse and Amitriptyline was doubled again to 100mg. Text my boss to say I had been signed off for another 2 weeks (27th March to 10th April) I text my boss to say I had been signed off and he text back saying he needed sick notes that day and I also needed to phone him. I phoned him that afternoon and he said he was in a bit of a predicament and he either needed to reduce my shifts to one day a week or lay me off. The discussion ended up going in the direction of me being 'laid off'. I specifically asked him if I was being fired or made redundant and he said 'no, you are being laid off. it's different'. The conversation was quite amicable, he knew I wasn't well and I think he was genuinely concerned for my health. I said on the phone I understand his situation and I would be leaving soon to go on maternity leave. There was no discussion about any notice or when my final day was, I assumed it was that day. On 2nd May I received my p45 in post with a couple of old payslips and a payslip dated 4th April with SSP payment and an overpaid holiday deduction. I have not received this final pay. Can I ask him to send me this in a cheque? We used to get paid cash weekly on a Friday for hours worked that week and I was once paid by cheque as he didn't have enough cash on him to pay. The p45 also has my leaving day down as 4th April and is dated 2nd April. I have had no contact with my previous employer since that conversation on 27th March. My boyfriend took my sicknotes down to him on 27th March as I just couldn't face it. I really want to have as little contact with my previous employer as possible, the whole situation made me worse when I was already quite ill and I am starting to get better and don't want to do anything to knock me back down or affect my health or the babies health. Can I text him to ask him to send me a cheque for the final pay amount? I really don't want to talk to him as I have been worrying since I got my p45 on Saturday. I didn't even realise I was owed and SSP and tbh I could really do with it now as I have no income until I get my Statuary Maternity Allowance in a few weeks. Thank you all for reading my post x
  20. I have just had a return to work interview where I was off sick for 9 days in total. I have been told by my manager that due to company procedure that due to me being off sick on more than 3 occasions in a 12 month period they will not be paying me the days I was off sick. Their company procedure states that: "The Company reserves the right to limit the number of absences in any 12 month rolling period to a total of 3 periods of absence. At this time the Company will review the application of the sickness scheme and reserves the right to withdraw the entitlement to OSP at any time" I had followed procedure and had contacted them keeping them updated of my illness and I went to the doctor on the 3rd day of me being off sick and I have a doctors note for the period I was off apart from the 1st 2 days. My question is, where do I stand, are they allowed to not pay me anything? What do I do now?
  21. In 2010 I had a hysterectomy due to cancerous cells in my ovaries. Following the operation I was very ill and didn't cope well with the immediate Menopause. It was also discovered at the time that a heart murmur I had, had for years was more serious than I was aware of. So serious I needed to have the Aortic Valve replacing. I was also diagnosed with early stages of COPD in the right lung. I worked full time and had held my position for 6 years. Just before I was diagnosed with Early stages of Ovarian Cancer my employers wife had come back from her maternity leave. On her return she made it very clear she wanted me out of the office. I was demoted but my pay stayed the same. When my boss was around she was the perfect office buddy. When he wasn't she would make back handed comments and accused me of being an emotional wreck. I felt bullied and humiliated at a time when things were just not good for me. I developed complications during 2011-2013 and my heart operation was delayed. Then in January 2013 I had a series of small heart attacks and I was rushed into hospital for heart surgery. My employer was on my back all the time asking me when I was returning. Which I understand as a small employer he needed to know. But I was just to ill for working. I was also a little scared to go back because of the way my bosses wife had treated me. Last week a lady who I used to work with contacted me as she needed to talk to me about how my boss and his wife had treated her. She has breast cancer and has just gone through chemo and breast reconstruction. She told me that they didn't beleive she was so ill she couldn't work. In distress she had sought advice from ACAS. They had informed her that whilst she was of from work that she should have been paid holiday pay as well as her SSP. We wondered if anyone can clarify this for us? We are both still employed by the company despite the time we have been of. They do keep asking me when I shall be returning I was recently told by the consultant I wasn't fir enough medically to return to work. I have been of work since October 2011 and my colleague has been of since October 2013.Have we got a claim ? TIA
  22. I am felling ill at the moment and i don't think i will be well enough to go to my Work Programme provider this week.I have job search there on Monday,Tuesday and Thursday as well as a one on one appointment with my advisor on Wednesday. What is the process for calling in sick?
  23. Hi. Been on ESA since August 2014 and my current note runs out on 16th April, ironically when I have a payment being made. I have been trying to make an appointment to see a GP for ages but they are so full it is almost impossible. The receptionist asked when my note ran out and I told her and she said the doctors no longer back date so I could not see anyone until after the note had run out. Whilst I understand that gives me a 2 week period to get the note to the DWP is this pushing it a bit fine or is this now general practice? I always send recorded first class anyway and keep copies for myself. In the past I would see my GP a few weeks before note had run out and he would backdate it so cross with my last note.   24. hi I have had a lengthy phone call with Occupational Health who said i have high stress and high anxiety levels, at the moment so i have been signed off stress - 'not fit to work' for 2 weeks minimum as the doctor will re-assess me in 2 weeks time. My employer has now asked me to attend a stage 2 absence meeting ( as i have previous absence for stress at work and at home), during this period that i am off on sick leave. So my question is simply.. is this a reasonable request from my employer and do i therefore have to attend the meeting? please help me, your knowledge and experience will be greatly appreciated on this matter. thanks you..
  25. She suffers from panic attacks and has never worked due to being on the sick. She has 3 children one under 2. She has a partner but Ingeus or JC has told her it is up to her to go to work not him. My Dad has just got off the phone from my sister because she has an appointment today. She can't go in because her boyfriend has gone out knowing she had an appointment and left her with her son. Ingeus has moaned at her because she can't come in, but they also moan at her because she has to bring in her son. She can't work, has no expirence. Her boyfriend would rather go drinking with friends a few times a week then look after their children. What can she do? She was denied PIP.
