  1. I was due to have an operation at my local hospital and was to present myself at the specified ward at 7:30 am on a Monday morning. The Saturday before my operation I came down with a bad case of the dreaded Flu so I telephoned the hospital reception to speak to someone on the ward dealing with my operation but was informed that said ward was not open over the weekends so I couldn't be put through. However the receptionist was able to put me through to a different ward so that I could at very least ask that ward nurse if my cold would jeopardise my operation Monday morning. She said if I still have the flu Monday morning then I should contact the ward nurse dealing with my case and she would advise me what to do. I asked her could she make a note of my call and she said she would let them know I have phoned. So Monday morning came and I still had the flu, I phone the ward nurse at 7:am and informed her of my condition and was promptly told not to come anywhere near the ward because I would not be admitted for obvious reasons. She also told me that she would inform the surgeon and his secretary would be in touch with me. 5 days later I was diagnosed with swine flu and confined to my home for what seemed like an eternity. 2 days after this I received a short yet abrupt letter from the surgeon’s secretary stating that the surgeon was not a happy chap and because I missed the appointment for my operation he would not be sending me another. I got the impression that he was not aware of my flu or of the fact that I was told to stay away from the ward. Two and half years later and thankfully I have now been referred back to the hospital for the same operation. I have suffered immensely because of this oversight and have gone through Two and half years of immense mental stress because of this. My question is this, do I have grounds for compensation of any sort or at very least an apology. All replies greatly appreciated. Love and Peace Unclebungee
  2. Hi I am so angry with knowhow and would like advice as to what legal action i can now take against these people. I have sent 5 emails - no reply, numerous telephone calls some lasting for more than an hour and still no answers. I have had a laptop since 2006 and at the same time took out the PC performance insurance policy, paying a regular payment of £9.99 a month without fail for over 6 years now, a total of over £7.000. i had sent my laptop off for repair several times during september and october 2012, each time it came back with the same fault or sometimes a different fault, and had to be sent back to knowhow. I recently sent my laptop for repair on the 10th November 2012, knowhow attempted to return my laptop not repaired, when they first attempted this, the driver insisted i must take it as he had no paperwork to take it back and, in his words "it would just be dumped in some warehouse" i still refused to accept it, and the driver took it back. after waiting several weeks, emails sent, telephone calls made, i heard nothing, i was then told on the phone that my laptop neede a part, they ordered the part, but was told that as the laptop was so old the part was no longer available, i was told to ring back in 2 days, i was then told, after being on the phone for over 1 hour, that the fault was not covered by my insurance as there was a hole in the case there was no hole in the case when i sent it off, the problem i told them about was it had no power, it seems Knowhow had changed their mind and this was the first time i even heard of the hole in the case. i have had enough now, after paying so much for over 6 years and getting no reply from letters, emails or phone calls, i now widh to take legal action and revover all my expenses and costs, i have contacted BBC watchdog over this, is there any action that can be taken through the OFT or Trading standards? many thanks Sharon
  3. Hi, I am not sure if anyone can help with this. My husband was forced by Barclays Bank back in 1992 to take out a Business Loan or be shut down. He had to take out a loan for £7,000 over 7 years. On seeing all this about the PPI etc I had a look at the old paperwork, found the statements from this loan and low and behold this insurance is on the loan. It was a one off payment added on at the start of the loan. We have tried to claim the PPI back and have been turned down 3 times, because they cannot find the Policy. Well we can prove we had the loan, we have the statement with the £7,000 on it, we also have the statements and the first statement showing the insurance payment. The fos will take it up but they have said it can take 12 months. Not sure now what to do, anyone got any idea's?
  4. Hi there, I am hoping to find out where I stand on this. We pay for my sons swimming lessons in blocks of 10, and pay 2 weeks in advance. They have a no refund policy if children are ill during the 10 week block and have to miss lessons. During this block of lessons my son had an ear infection and his ear drum burst. He has been advised by his Dr that he can not swim for up to 8 weeks. He has already missed the last lesson before Christmas and yesterday. Yesterday was pay week at swimming and we rang them up for some advice, we were told that if we didn't pay yesterday for the lessons that begin in a fortnights time we would lose his place. We were told to pay yesterday and then go to Drs on Monday and ask for a letter 'to tell them why he is really off'! and they would credit the lessons he has missed to his 10 next 10 week block (the 1 after the 1 we have just paid for). We went and paid yesterday. I then found out that the Drs would charge me £25 to write the letter. We called the swim school back to ask for a refund of the money we had paid yesterday as we had paid 2 weeks in advance of the first lesson starting and lose his place. I was point blank refused. I feel like we have been led up the garden path slightly on this - just to be clear, I am not asking for a refund of the lessons my son has missed I am asking for a refund of the money I paid yesterday for the lessons due to begin in 2 weeks. Thank you for reading, I know I have waffled on a bit!
  5. hi i would like some help with the situation i am having with the know how investigations team il explain i have a laptop and support agreement with pc world/currys and recently i had an accident where i fell down the stairs i contacted pc world where they said to bring it into store and they will see what can be done so i left it in there capable hands on the 5th oct 12 i got a letter back saying this. "we have carried out an inspection and in the opinion of our engineer the damage seen is inconsistant with the reported explanation and/or the damage exceeds what we would expect given the circumstances. as a result of our findings repairs are not covered by your agreement and we are returning your product to you unrepaired. i wrote back with a full detailed explanation of the accident on the 19th october i decided to ring the customer services and ask if there was any news on the reply to my letter and the guy on the phone said yes that they are sending you out a letter and it has been refused again, i said can you tell me why and he gave me a brief insight of what the letter said which was that there was over £2000 of repairs already on the laptop and that there were marks on the bottom of the laptop near the fan which looks like a tool or implement has been scratched across it so therefore no repair will be done also they said i need to check the T&C,s i was really gobsmacked by this as the laptop only cost £400 and was a refurbishment and as far as the scratches go i can see them but i dont know how there got there ? presumably by the fall i just wanted a bit of help on how to reply to this i am going to be asking for an engineers report and a list of the £2000 repairs??? ive had the laptop 3 yrs but ive been with pc world for 6 yrs thanks much appreciated marie x
  6. Placed order at tesco.com yesterday for 54 bottles of Coke (2lt bottles) they have it on deal 3 for £3 plus delivery it worked out 58.50 minus £10 voucher for first groceries shopping I had to pay £48.50. Booked slot between 12 pm - 1 pm for today. Waiting between those hours and no sing of the driver, so after 2 pm loggoed into account on tesco website and next to my order it says it was delivered. Contacted tesco by on-line form and just had the phone call from them saying that they canceled the order because of stock shortage and because items are too heavy to deliver. Why do they sell them if they too heavy? for example if you order from ASDA you can only put in the basket 16 or 12 2lt bottles, if you order from Sainsbury they will deliver it to you ( done so once with 40-50 bottles). They did`t even bothered to contact me and let me know that order has been canceled. Is there anything I can do now? I know I can complain to tesco but I don`t expect them to do anything about it. Is there anywhere else I can complain? They just make me laugh regards

  8. Hi there I would be grateful for advice dealing with these parasites minicredit. I took out a £100 loan which I knew I would be able to repay on my payday which i told them was 28th September. Technically we should get paid on the last working day of the month but often it hits our accounts the day before. I have 2 current accounts one for credits/spending and one for household bills. I am trying to pay off my overdraft on the one account so that I can close it as Lloyds tsb have started charging for the overdraft which used to be free, in addition to the the £25 a month account fee. I arranged to have my salary credited to the second account in preparation for this and had begun the process of changing over direct debits etc but as i still have some payments (including the mini credit loan) coming out of the account I plan to close, I transferred some funds into the account for this purpose. Mini credit charge £2 for changing your debit card details and you have to have funds in your account to change the details and i didn't so i couldnt give them the card details for the preferred account prior to the repayment date. I thought as I had told minicredit that my payday was 28th that the funds would be debited on 28th. I transferred funds on 27th for this purpose. On 2nd November i noticed an email from minicredit stating I had defaulted, I was really confused. I logged into my account with them and my loan was showing as overdue. I looked at my bank accounts and it became clear that minicredit had tried to debit the funds on Sunday 30th September - who gets paid on a Sunday ?? its not a working or banking day. As on Sunday my regular direct debits were in the system and earmarked to be debited the next day this did not leave enough funds for mini credit. Whilst I had the funds available in my other account for my direct debits(lloyds give you up until 3.30pm that day to pay in any necessary funds to cover recent debits) as mini credit had tied to take a card payment this was declined by my bank. I immediately attempted to make a card payment online for the full loan amount (which included a £25 charge. The payment would not go through but there was no reason why that I knew of. A while later I got an automated call from Lloyds TSB fraudline to my switchboard at work. I couldn't complete the request as we have an analogue system so I couldn't press the appropriate buttons.I tried calling back when I got home(as I had had a missed call to my landline) but you just get a message saying they Lloyds Fraud department have called and will call again. I emailed mini credit through their stupid web form query system and they told me that another £55 charge had been added. I asked them why they had not taken the funds on 28th when they were available and they said that I had told them my payday was 30th. They also said that more charges had been added for 'failed debit card attempts They said that I should take this up with my bank as to why the online payment wasnt allowed and that they dont refuse any payments. I should also add that they charge £4.50 for making a payment or a partial payment ! on top of everything else. I was not happy about paying these charges and whilst i had the actual amount payable I didnt have another £55 for the added charges so even if I had paid they would still have kept adding charges on top of charges. I have been sending them messages through their web based form and their replies have been unhelpful, rude and at times intimidating. They refuse to help in any way shape or form. They did say they would consider a reasonable request for settlement if paid in full immediately by debit card over the phone. They said if I pay on line it will just come off the balance. They have now started helping themselves from my account whenever they feel like it taking small payments of £15 and £25 up to 3 times a day when funds are available. They have taken my child tax credits. So far they have had £155 from me. The loan was for £100 and £137.50 was payable under the agreement on 28th Sept or 30th as they claim. The interest to date they say is £58 but there are default fees of £80 and a 'broken agreement fee of £100 !plus failed payment charges of £5 up to 3 times a day. My account shows a debt of £340 and has been passed to debt collection but they are still debiting from my bank and have taken £155 already. I offered to pay them what I owe plus interest several times but told them I will not pay these ridiculous charges and I will not speak to them on the phone or give my debit card details to anyone over the phone. Up to now my bank havent allowed any payments if there have been no funds in my account but yesterday they allowed minicredit to take £25 making me overdrawn. I rang lloyds and explained the situation and they refused to help. I asked for a chargeback but they refused. The guy said that debit card payments are promised payments and they dont get involved with payday companies. I have already downloaded a form for the fos and the guy said to get this sent off as they would sort it out and look at the circumstances fairly but Lloyds wouldnt get involved. In the meantime they said they would continue to make any payments to mini credit and charge me if I go overdrawn because they have no choice as they are promised payments. I said to him if these debit card payments are promised payments why did they not let the original request for the full amount go through on 30th Sept. I would then have been able to move money , job done. I asked to speak to a manager. The manager said that large debit card payments can be refused but not smaller ones so the agreed repayment of £137.50 wouldnt have been allowed. He told me there is nothing they can do to help me and I should phone minicredit . I explained that I had already tried this but he wouldn't budge. I explained that I wanted to close my account and he said if I could go to a branch and pay in enough to cover my agreed overdraft and the unauthorised amount by 3pm they could close my account provided only if mini credit hadn't earmarked any funds !He said it will be in the minicredit terms and conditions that they can take these amounts. I agree this may be the case but I thought that you can remove authorisation for recurring payments. He said payday loans are separate issue. I have since done some reading up on here regarding chargebacks and it appears Lloyds are in the wrong and they should action my request and do a chargeback and not authorise any further payments. Can I get this chargeback and can I stop the payments. I dont have the funds to close the account at the moment and am incurring daily overdraft fees on top of everything else. Mini credit have sent a 'doorstep visit' letter. It gives no postal address for mini credit. I have emailed them telling them I do not consent to a doorstep visit. I have also told them I will not speak on the phone only in writing or email. I have also emailed them telling them I have removed my authorisation for them to take card payments.I have taken people on before and am quite knowledgeable about my rights, alot of it learned from this site. I will not be intimidated by them but this lot are the worst I have ever dealt with and after reading others experiences I am worried that my debt will just keep increasing , I now owe £500 for a £100 loan of which you only actually get £93.50. Mini credits complaints dept said they will accept as settlement the amount borrowed £100, interest to date £58, default charges £80 but they will waive some of the failed debit card fees (which stand at £159) and the £100 broken agreement fee. This means they still want £238 plus a percentage of the £159 ! but that is still increasing. I responded saying as they have already had £155 I will pay them £3 which is the remainder of the interest at that date. I await their reply which I am sure will not be a welcome one. 2 things here , how do I tackle mini credit ? If it goes to OPS which I understand is their in house debt collection, can they enforce all these charges on top of what I have paid them and do my bank have to comply with my request not to pay them any more money and to do a chargeback on yesterdays payment ? I am going to send a complaint off to the FOS but I am worried about them continuing to take money from me in the meantime. Please help ,what should I say to my bank and who should I speak to ?
  9. Hi! I'm new to all this. I have received a reply from Santander regarding PPI paid on a Debenhams account. They are refusing to refund the PPI payments. They have enclosed a copy of the account application dated Feb 2002 showing my signature at the "Protect Your Account" section. The shop assistant did not discuss PPI with me at the time and it clearly shows that she has marked "X" where she wanted me to complete the form and where she wanted me to sign. It's the usual story that we are all so familiar with now "If you open an account today you will get 20% off your purchases". No mention of anything else. They also state that this is their final response and they have now reached the end of their internal complaint handling procedures. They have advised me that they are members of the Finance & Leasing Association and thay may also be able to consider my complaint. Any suggestions what I should do now???? All advice and suggestions greatly received!!!
  10. What a couple of days! My husband and I have separated. The house insurance was in his name with DL. He spoke to DL explained the situation and they told him that I would have to ring up, start a new policy and they would then cancel the old policy. So I telephoned them yesterday. They told me that as I was taking out a new policy, there would be no cancellation charge for the existing policy. So we went through all of the questions. We had a claim on the policy in June of this year due to a burst pipe, which DL were very good with at the time. Anyway the lady said she had to pass the new policy to the underwriters and she would call me back. About 10 minutes later I got a call back. She told me that as we had had 3 claims in 12 months, they could not offer me insurance. I queried the claims, we had only claimed once! My husband had telephoned them in April and asked about the legal cover. There was something we were considering taking legal action over, but just wanted advice. We didn't pursue this but DL stated it was a claim!! Then there was our carport roof which was damaged in the storms in January this year. DL would not cover it stating it was poor workmanship by the builders that was the primary cause (it's a relatively new house), so no claim was pursued and no payout. This apparently was a claim too. I questioned how could the other 2 times where there was no payout, absolutely nothing done in the legal query 'claim' - how can they be claims? Apparently with the roof, it's a loss - how is it a loss, the NHBC and the builders rectified it, no one has lost anything - but apparently I have claimed with the NHBC so it's a claim??? The legal question, well, I'm at a loss, no forms filled out, just a question asked, but that's a claim. I told my husband what had happened so he telephoned to cancel the existing policy. They were demanding a £118 cancellation fee. He put our case forward, including that I had been told there would be no cancellation fee, the reasons given for refusing to insure etc. Had DL given me the insurance I was willing to take out there and then, there would be no cancellation fee, it was DL who had broken the deal as such. There was confusion at DL as there was only 1 claim showing on the system (the burst pipe). DL then said they were going to listen to the telephone calls between myself and them. They called my husband back and literally declared me a liar! Husband then requested copies of the taped phone calls, written confirmation of the reason for refusal to insure, written confirmation of the details of the 3 claims etc. DL went away, huffed and puffed called my husband back and stated that they had further reviewed the tapes and due to the misinformation I was given and the way I was treated, they would reduce the cancellation fee to £60. No, said husband, I would like the information I've requested please. DL went away again, called husband back. We have reviewed your case, there will be no cancellation fee and your wife should have been offered insurance yesterday. There is only 1 claim on your property......... and here is the gem "would your wife like to take insurance out with us? Ask her to call me and I will organise it with her" I am so wary of insurance now. Is it worth it? The little extras they offer to bump up premiums, are they worth it? I have only ever had to claim twice in over 20 years of home ownership and house insurance. The burst pipe this year and 4 years ago my house was broken into and burgled whilst on holiday. And seriously DL, would I like my home insurance with you? Hell no, I'll never touch your company with a barge pole for anything! Thank you for reading and the opportunity to vent a little. Hopefully even just one person will be helped by this, stick up for yourself, don't let them get away with it. And one last point, fab forum! I've read an awful lot over the last couple of days, it gave me the confidence to fight them over this even though it was via my (soon to be ex) husband.
  11. I have recently applied for house insurance and had it refused because I gave a wrong date regarding a previous claim. It was originally accepted and the payment taken then they did their CLUE check and found that the date on the claim that I disclosed didn't match the date on the system. I was not given any opportunity to check the information before they sent a letter of refusal. The date they have is correct and the date I gave them was a genuine mistake, I never tried to hide the claim, which was for £509 and my second only claim in 15 years. The problem I now have is that the refusal stays against my name for 5 years and affects all future insurance policies and has already taken effect as the next company I tried would not insure me. What I need help with is how do I appeal against this? It seems somewhat unfair that the insurance industry can do this without some kind of process to give people a chance to check information or even accept an increase in premium. They state that because there was a previous claim within three years they wouldn't have covered me initially but rather than writing and tell me this they just cancelled the insurance resulting in a refusal. I hope this makes sense and would appreciate any help or advice. Thank you
  12. My parents took out a loan in 1996 and were told they HAD to take PPI with it. They were both sold individual single premium policies that were entirely useless to them. We went through the entire process and were told we had to contact the Finance and Leasing Association when all else failed. We were told "Tough luck, there were no laws then to stop them ripping you off and they did, nothing we can do." My father was self employed, my mother only worked part time. We sent them the original copies of the paperwork they asked for and when we asked for them back, we got a bad photocopy of one side of a document which had all the relevant information on the other side i.e insurance no good to self employed, over 60s (Dad was both, mam was 5 weeks or so away from 60) or part timers. Is there any point in trying again?

  14. I am not yet in arrears with Wonga but payment date looming. Have cancelled CPA and informed them of this and I have sent inc and expenditure but received the following reply: We really do appreciate your current difficulties, and the offer you have made, but we were looking for something higher. The size and number of payments you have suggested doesn't really work to help get you out of debt in a reasonable timeframe so we would urge you to reconsider this amount and get back to us with an improved offer. Please call our friendly collections team on 0844 842 9110, who will be happy to discuss a more suitable arrangement. The team are here so please pick up the phone because we really are here to help. Kind regards, Collections Department Obviously I wont be calling them, but now what do I do!? Thanks
  15. Hi all, Apologies if this is in the wrong section. Two years ago myself and my partner separated when I was pregnant, when he moved out he took the tv and the sofa. A few months later when my daughter was only a few days old, a tv licensing enforcement officer called, I was in bed at the time feeding the baby. I spoke to him through the window and asked him to call back, he posted a payment card through the door and left, then I recieved a court summons. On this summons he'd made a statement with a lot of lies eg. I'd said I owned a tv, I had watched tv that day etc. He had my name but no signature, no make or model of any tv, no N.I number and no D.O.B as asked for on the form. I went to court and pleaded not guilty and then it went to trail as it was my word against his. The judge found me guilty because Mr X had worked for the tv licensing for 20 years and maybe I was confused as I'd just had a baby! (exact words). Anyway I was fined £180 plus costs and I have refused to pay, even when the bailiffs came knocking I stood my ground, but now I've recieved a letter from the courts stating I have 7 days to pay in full or I'll be arrested, I dont want to pay this fine, If I was guilty fair enough but I've been fined for something I havent done. Any advice on whats likely to happen when they arrest me please, because I'm not in a position to pay within 7 days anyway. Many thanks in advance
  16. Hi My partner has recently claimed for PPI for a loan she took out in 2002 with Lloyds. The loan was complicated, and her father was asked to take the loan out in his name on my partners behalf (with her paying the loan repayments into his bank account every month). T hey were also sold PPI on the loan in my partners name (her policy). We thought this was a little odd as the loan being in her fathers name, surely the PPI taken out in her name would not cover the loan. However she was told that without taking out this PPI, she would not be allowed the loan. My partner had a meeting with Lloyds where she showed the details of the loan, and discussed making a claim. The woman at the bank was very helpful, and stated that it was completely wrong that the PPI was sold in this manner, and that the person who had initially agreed the loan would be in serious trouble regarding the setting up of this policy. Fast forward approx 3 months, and Lloyds have finally replied to the claim, refusing to pay the money back as it is more than 6 years after the loan started. She finished paying (via her fathers loan) in 2008, and we feel that this date is more relevant than when the loan began. In addition to this refusal, they have also included the original agreement. However this is a mish mash of her agreement, and also the details including bank account of a completely different person with the same surname from Preston (we are from Leeds). They seem to have merged the two to suit their arguement. As a side to these issues, the letter stating the facts of the refusal refers to a member of staff who agreed the original loan/PPI. The name of the member of staff is completely different to the member of staff that actually agreed the loan.
  17. So I had a call this morning from the job centre telling me that I got zero points on my medical and that I am likely to be refused ESA. I am devastated and don't know what to do. The man asked me if I had anything to say in my favour and I pointed to be honest I was probably so taken a back that I didn't make a good case for myself. I did point out that earlier this year I was placed in the Support Group under special circumstances and that my health was actually worse now. He said that it was now six months on from that time so things would have changed and that didn't apply any more. I again said that things had only changed for the worse. I did give him additional information about my medication, further appointments and tests I am awaiting but I don't know if it is likely to have any effect. He said he will look again at my claim and I will get a letter in the next week letting me know their desicion. From what I could gather it does appear like information I gave the doctor conducting my assesment was missing so it looked like he was typing it all up but in reality he was missing lots out. I will need to get my ESA85 to confirm this. I was so put on the spot to be honest I feel like I messed up my chance to put my position over to him properly. I was only on the phone to him a few minutes he started off by saying that we had plenty of time to talk but then it was like he couldn't get off the phone fast enough. I just don't think I can take it if I have to appeal and I'll end up going back to horrible problems and sanctions with the job centre who were the ones who pushed me to apply for esa in the first instance. I did tell him that if I was refused ESA I would have no option but to appeal. Is there anything else I can do or is it too late now?
  18. Just received a response from Halifax regarding the PPI claim that was made for my mortgage that was taken out. I was told that I had to take out TMPP or that the mortgage would be refused. The letter that we received was that we had taken out the personal TMPP which contains the Life Cover but apparently we didn't take out the PPI element of it. The letter also mentioned that "This is our final decision". Please could you advise me what my next step should be e.g. taking this to the Financial Ombudsman or accepting that the PPI element wasn't taken out. Thank you.
  19. Hi, We booked an Easyjet flight to Istanbul and were due to fly yesterday from Luton, however when we got to the airport and tried to check in our baggage we were sent to the easyjet counter. My wife is not an EU citizen but has a UK spouse visa, we had checked with the Turkish consulate before booking and they had confirmed that she could get a visa on arrival as I as a British passport holder would have to do anyway. Anyway the girl at the Easyjet counter and her colleague refused to let my wife board the plane. I tried explaining that she will get a visa on arrival as she has a UK spouse visa but she said no my wife needs a tourist visa for the UK or a Schengen visa and that a spouse visa is not a visa its just entry clearance (not sure what she was on about). Anyway she wasn't letting us board so we left the airport. (this was at 6am). When the Turkish consulate opened we rang them and they again confirmed that she could get a visa on arrival as a spouse visa is indeed a valid UK visa. I have complained to Easyjet on the phone and they want me to provide evidence that she could get a visa on arrival so I have sent them thelink to the Turkish foriegn office site where it clearly states that if you have a valid UK visa you can get a visa on arrival. Anyway, I just want to knowthe correct way of complaining and getting maximum value from my complaints. I have lost £600 in hotel bookings in Turkey and I also paid for a night at the Ibis in Luton airport in order to catch a 6.30am flight as well as 10 days parking at Airparks. Thanks
  20. hi new to posting on this site so not sure what to write but I am trying to sort out a claim for PPI on a halifax credit card basically I filled out the form and stated the reasons I was claiming was that I was entitled to full pay from my empler for 6 - 12 months if I had an accident or was of sick and that my husband could have helped with the payments I thought I was sold the insurance over the phone but the bank have written back saying that I applied in the bank (it was 1999) they have refused my claim based on the fact that I did not have any appropriate means to pay the card unfortunatley I think I put down the wrong employer on the form but even so my previous employer covered me with sick pay (just could not remember when I took out the insurance) also my husband would have helped. I also said that I was told I would not get the card if I did not have the insurance they dispute this saying that at the time of the sale I was given a fair presentatation of the features of the policy and the cost and that it was clear fair and not misleading. they said they tried to ring me on the 28th June but I did not put a phone number on the letter and that they have completed the review based on their understanding of the innitial contact. their conclusion in short is: the info provided at the sale was fair fully explained and that the advisor acted fairly and reasonably throughout the sale my husband said that maybe i should raise the point that I have a dissability with my hand (missing finger and deformed hand) although I do not class this as a dissabillity he feels it may have affected any claim I made anyway not sure if this would affect my claim though. I am on a debt management plan and one of my creditors is the so I know I will not see any of the money but it will help reduce my debt!!! where should I go now thanks for any help
  21. Hi, I've just received a refusal from HSBC after I complained about mis-sold PPI. I initially complained about a loan which I took out in 2002 and stated how I now realise that I have been paying for insurance that I did not know I had taken out so could not have been explained to me or made clear. Their response was that I was given a Product information Pack and confirmed as the Personal Loan Protection Plan was optional, you had a period of 30 days in which you had the right to cancel the Personal Loan Protection Plan. Therefore, tey consider adequate steps were taken to ensure I was aware that I had had PPI on the loan. I'm not very happy with the response (as you can imagine), as why would I read a load of bumff which was given to me, if it was only going to say what I had taken from the conversation with the sales person (i.e. not expecting it to say anything about PPI as we didn't even discuss it). Has anyone had any experience of this, and if is, what is the best route to go down? Thanks for any help!!!
  22. My daughter is British, was born in the UK and went to school in the UK, and now is trying to go to drama school in the UK. This means getting a LOAN to pay for the fees, (not a grant, a loan), keeping in mind the course fees have just tripled. We've been living the last several years in the EU (Germany), and while here, she tried to apply for a loan in advance for the course she has been accepted on in London. The loan authorities said there was no problem, but she must apply when she has a permanent UK address. She moved to the UK, got a flat, then got a job, and applied again. The loan authorities said there was no problem, but she must apply at a later date, approx. 4 weeks before the course starts. Now, we have received notice to pay the outstanding fees, shortly before the course starts. My daughter has now applied again to the loan authorities in the UK, but this time she has been informed she does NOT qualify for a loan, as she has been living in the EU for the last several years! WTF is wrong with this country?!
  23. I phoned Halifax about 3 weeks ago and complained that I had been miss sold PPI ( to be honest I did not know if I had it because I had thrown paperwork out because it was from 1997 to 2006). I received a letter about 2 weeks ago saying they were looking into it. I have received a letter today ( confirming I dis have it) but they have rejected my claim under 'Optionality' and it says the following: I can confirm that it has never been a requirement to take out a PPI policy in order for a mortgage application to be accepted. In addition, taking out PPI would not have improved the chances of your mortgage application being successful. I am also aware that the mortgage application form clearly demonstrated to you that your PPI was optional and I have concluded that the adviser did not miss-lead you in anyway ( how do they know this if they were not present and I bet the adviser was on commission). They say in the letter that during the original phone call I said I was not given an option as the reason. They have not rang me to ask any questions or sent a questionnaire out, so I do not know how they could have investigated this. They say if I disagree I can ring them or write to the or refer to the FOS. So I did not know I had this, I have checked bank statement and no payments to Halifax other than mortgage payment, so can only assume it was built in the payment or added to mortgage. How could I find this out? At the time this was taken out I was in full time employment and entitled to 6 months full pay and 6 months half pay, as well as 15 years redundancy. furthermore, about a year before I was miss sold this I had been medically retired from my manual job due to back problems. I was fortunate to be given a white collar job and received a pension, which was enough to pay the mortgage payments if I had of lost my job Any help would be appreciated as I am more annoyed that I have been paying for something I did not know I had or needed.
  24. Hello, new to here so hope someone can help me. I received my letter this morning telling me that i failed the interrogation and am fit for work. I have suffered with depression and anxiety for a number of years, and am currently on medication and attending counselling. I was also recently diagnosed with insomnia. I scored a big fat 0 . Does anyone know what the next steps are? I read somewhere a while go that you can 'demand' to be put back on the assessment phase rate whilst your appeal goes through. Does anyone know if that's true? Thanks for your help.
