  1. our application for discretionary housing was refused, as they say 100 a week on petrol is too much, 195 pcm on hp for car is too much, and that 50 for my disabled childrens things etc equipment, clothes, shoes and nappies and wipes etc. I did provide evidence to show the car is used everyday partner world 35 miles away and used for school run and childs physio sessions, they told to me that we can cut down on petrol and pay less on arrears on utilities (pay 21 on elec and 11 on gas and 25 on water) they also said i should reduce spends on food bill as it is 200 a week for a family of 6. I have applied on 3 different occasions and all been refused and the welfare team helped on last one but still said no due to the above
  2. This will be the fourth, or fifth time its happened, i cant remember now. Just got off the phone to someone in DWP who said I didnt score enough points and wanted to put me through to someone in the Jobseekers Allowance department to make a new claim for JSA. Having a feeling that I would be turned down for ESA (again), i went to the Job Center just after lunch (its usually quiet in the local JC about 1pm) and asked to speak to a claims advisor or someone from the Disability area. Sat down with her, explained my conditions and she simply said "appeal...there is no way you would be able to find a job". I told this to the DWP person on the phone when she called at after 3pm... it stopped her dead in her tracks, she kept pushing me to get off of ESA and get on to JSA... It's been a while since I've had to appeal though, last appeal i went through was summer of last year...is the appeal process still the same? 1: Wait on letter arriving 2: Fill out form GL24 (i think i have the name right) 3: Ask to receive ESA on Assessment level. 4: Keep sending in Doctors notes. 5: Wait for tribunal date. Has anything changed?

Hi, I put a PPI claim in to the FOS on behalf of my husband October 2010,at the time he was still managing to pay his CC and loan, however it all went belly up in April this year and as I have heard nothing for months from the FOS I'm wondering where it will leave this claim when the HSBC take action against him which from the letters received yesterday could be soon Ro

Hi, I have CCA'd AMEX re a very old card (had been paying token payments of £1 for over 4 years but can't really afford to pay all token payments as on IB so I stopped a few months ago) and I thought that I should CCA all of the CC's to buy myself some time. It was a formal request with £1 PO. Today I received a response, AMEX have returned the fee, and provided a copy of the app form, a bad and barely legible one, with a set of terms of when the card was started in 1999 (unsure if they are a true copy). They have referred me to look back at previous statements for balances! I have been paying RMA for 4 years and not once have I recieved any documentation on the balance etc, I have only ever recieved about 4 emails requesting a new I&e form (ignored each time). My question here, is that as they do not reference any compliance with s78 etc, it appears that this is not a response under the formal request for a copy of the agreement etc. I think they have not responded to the formal request as they should have done, and have the returned the fee so that they 'get away' without responding properly? Should I sent the CCA request has not been fulfilled template letter, and should I resend the payment back to them - just to be sure? I thought they had to provide a statement of account, which in my interpretation, is a balance on the account (balance recieved for other CCA requests). Any advice will be much appreciated as I have not recieved such a minimal response to a CCA yet, and I have sent over 15 in the past few years (for myself and others). Thanks me_too
  5. Hi There, I was wondering what further action I can take against what I regard as an unfair parking charge issued by parkingeye, or if I should just pay up. In summary, I was parked at an Aldi car park for 2hours 14 minutes when it was 2 hours free parking. I had returned well before the 2 hour time limit but was unable to get into my car as some idiot had parked that close I couldnt get into the drivers side. So I went into Aldi and told them what was going on, which they basically said there was nothing they could do as it was a car park for local shoppers and would have to wait for them to return. A few days later I got a ANPR parking ticket, so I appealed to ParkingEye rejected the appeal and so it went off to POPLA who also rejected the appeal with the following reason "Considering carefully, all the evidence before me, I find that there is clear signage displayed at the site to inform motorists of the 2 hour maximum stay. Therefore, I find that by parking at the site for longer than the maximum stay the appellant breached the terms and conditions of using the site. I also find that if the appellant was unable to leave the site within the 2 hours prescribed, they should have contacted the operator as their contact number is provided on the signage displayed at the site. I find that the appellant’s case is that of mitigation which does not form a valid ground to allow this appeal." The rejection reason seems to ignore the fact I told the landowners and presume I had a mobile phone with me. Should I just bite the bullet and payup even though I still regard the ticket as unfair? I'm wary of extra costs etc should it end up going to court if I lose. Paul
  6. Hi I owe JDW £1117 and Simply B £627 I have been paying of an agreed £10.00 every 28 days. Due to a small sum of money that my husband got I wss able to offer them £1000 over both accs £600 to JDW and £400.00 to SB I let then know that this was a one off offer and would they accept as full and final payment. I got a call today and they have rejected this offer even though its over 1/2 the amount they say I owe. I am waiting for them to write to me as they refused to give a sum of money they would accept over the phone I have told them that there is no more money and that if they don't accept this I will continue to pay £10.00 for each account and allocate the money else where. so what do I do next- is it now worth sending them a SAR to see what charges have been made and offer them payment without the charges. If this goes to court will the judge take in to consideration that I made an offer which they rejected? if they sell this Debt to a DCA would the amount they sell it for be less then what I have offered and would it be reasonable to point this out to them if they threaten that. I am unable to pay the full amount as now my husband has got his pension we lose out on other benefits
  7. so, i broke my back in a really bad car accident in November 2013. i was in hospital for over 4 weeks lying flat on my back which was followed by 2 months of wearing a back brace 24/7. during this time my partner, friends and family had to do EVERYTHING for me. i couldn't get to the toilet myself, i couldn't dress myself, sit/lie down or stand myself and i couldn't shower or bathe. i had to learn to walk again, regain strength in every part of my body, attend physio, hospital & doctors appointments and jump through hoops to keep up with all of the forms and stupid repetative questions related to my PIP claim and ESA. nearly 6 months on, i am still off work sick (i'm a waitress) and although my bones have healed and i am walking a lot better, i am still struggling with the majority of things and still have to wear my brace to be able to do simple tasks. despite this, i am not entitled to ESA as i have not 'paid enough tax' in the year they have reviewed and i am not being rewarded PIP as i received 0 points on their ridiculous table of questions (even though i clearly said i couldn't do a lot of them). in addition to that, i am unable to receive any other benefits available as i live with my partner and he earns a decent wage. i think this frustrates me more as i only moved in with him when i came out of hospital because despite him working 50hours a week, no one else could look after me the way i needed to be. i have no income and haven't done for a while, the PIP decision was the last straw and i am so bloody frustrated. can anyone help??

Partner bought a bedding set (duvet cover and pillowcases) in Debenhams yesterday afternoon, got it home, took it out of the packaging (which had been unsealed in store anyway to test the material), realised it was the wrong size, so we took it back to our local store (different to one it was bought in). This was within a space of around four hours, the bedding had been out of the package but not put on. We were refused a refund due to the packing being unsealed due to "health and hygiene reasons", the manager maintained that it was covered in the exceptions to the returns policy, despite the returns policy clearly stating that the exception covers: "Quilts, duvets, pillows and mattresses, no exchange or refund once the original packaging has been opened or damaged unless faulty." Quite obviously a duvet cover/bedding set is none of the above. I have raised it with head office, who predictably have repeated the manager's mantra: "I can confirm that due to health and hygiene reasons, we are unable to exchange or refund bedding sets once the packaging has been opened or damaged unless faulty." There is absolutely no mention of bedding sets in the terms and conditions. "Subject to exceptions, Debenhams is happy to exchange or refund your purchase within 28 days of delivery" They've clearly gone against this. What are my rights and who would I complain to next if I wished to take the matter further? Thanks in advance.
  9. Hi I wonder if anyone could give me some advice? My daughter has an Arriva M ticket app which she uses to buy a monthly ticket on her phone. In December the app was upgraded, when she bought her new ticket at the end of December the app kept crashing, she tried to buy her ticket 4 times without success, however when she checked her bank account the next day the money had been taken each time at £73.80! We've been fighting with Arriva ever since, provided authorisation codes from the bank, bank statements to show the money has been taken out, her last 4 of her bank card and phone number, they refuse to provide a refund even though the evidence is there, stating they can't find the transactions on their system. I've tried to call several times to discuss but their staff are rude arrogant and just argue with you What can I do to get her her refund back it's quite clearly come from her account but the refuse to pay her the money back

Hi, i may be in the wrong not sure, i made a payment agreement with wonga last month to pay my outstanding balance in installments spread over 3 months, i was 5 days late today by the time i called them, they had added a fine and interest from the last agreement, so from £550 it has gone upto £711, i refused to pay £711 and asked them to reverse it back to £550 and carry on with the original payment agreement of the 3 equally spread payments, which they refused... i have had to ask a friend to lend me the money to pay the (£550) 3 payments and he refuses to give me anymore, which i cant blame him.... i am currently on jobs seekers and live on £56 a week and wouldn't even be able to give them a token payment of £1 a month....what can i do????   11. Hi, I was on here some months ago (Jun '13) trying to make a PPI claim from a secured loan/mortgage taken out in 2002, £10k + £1.6k PPI with GE Money. The account went into arrears in it's lifetime but last year it was paid off. So charge has been removed from Property. GE Money refused our complaint, saying that Greenhill Finance introduced the loan. Greenhill Finance response on 28/06/13 was that the mortgage was arranged with I group loans ltd. They then go on to say the loan was pre 2005 so no FOS remit etc. because I felt we had hit a brickwall I attempted to instruct Emcas to deal with it, thinking that left to me we would get nothing so at least we had a chance of getting 60% back. they refused because they said a payment plan was set up in the lifetime of the loan and that therefore if they won any monies, GE money would retain it and we would be left with a fee for Emcas. This doesn't ring right to me. Why would GE money keep any money? So I am thinking about instructing another PPE claim firm but need to clarify we wont end up out of pocket. Many thanks. S
  12. Hi all, My father has been refused Attendance Allowance, so I want to appeal - what's the steps to do this with AA, and any tips to help the appeal/reconsideration go in his favour? (he's completely housebound and the only time he gets out the house is for dr appointments and when I go to visit twice a year - he lives in Dorset, I live in London. He also has lots of health problems.) Thanks for your advice

  14. Hello all, After suffering an accident at work over a year ago (dislocated jaw) I have had severe TMJ disorder since. I am receiving treatment under my Dentist, with regular check ups with my Doctor. I have records at the Hospital for my TMJ disorder and may be referred to the Hospital for possible operations on my Jaw. Long story short, I got 0 points at ATOS, and my tribunal hearing was completely refused. In the letter I received this morning, it stats that they understand I have a "Jaw problem" but that's it. Basically, the advice from my Doctor is null. The doctor at the tribunal was easy to talk to but the judge made me feel incredibly stressed out. I was being looked at, and spoken to like I am dirt. It honestly felt like I was going to be sent down for years or something. How it affects me ~ - Almost daily headaches and facial pain - Jaw tightens up and locks up often - Cannot talk for more than 30-40 minutes - Migraine attacks with aura (so I can become half blind) (Migraines last up to 3 days for me) - Ringing in ears / hearing loss - Severe dizzy spells and drowsiness - Severe fatigue - Depression The doctor there was shocked that, that day was the first time stepping outside for over 3 weeks. Am not enjoying life at all and now I'm basically forced to look for work where pretty much no-one will employ due to my health. The judge was picking faults all the time, it felt like I was being interrogated on my condition. They both even asked "How is it a health / safety risk?" when I said it's a risk to myself and colleagues if I am operating machinery, carry an object or on a ladder. Do I appeal to the higher tribunal or do I risk myself and other people in a work place?
  15. So long story short, I had two bad accidents in a day. I first dropped my laptop in the kitchen and the screen ended up breaking. Then while backing up my data my little brother spilled juice over it and the hard drive ended up failing then after that it wouldn't even turn on :/ I sent it in for repair and they gave it back to me today with a letter simply saying they consider the damage to not be covered by our Service Agreement. I'm suppose to write back to the Claims Investigation Department. What say do I have in this? Should I get someone to inspect my laptop so they can also back me up to prove it was an accident? Because I assume they don't believe it was an accident which is why they didn't repair it. I've written about 2 pages so far explaining what happened, I'm sure if I get a technician to check out the laptop it would help but I don't know how much that would cost or where to find one.   16. Hi all first time poster.. My credit card account dates back to 2002 I have been paying a monthly PPI premium any time this credit card was in debt. After reading a lot of success stories of people reclaiming their PPI I phoned Halifax and started a complaint 30 days ago. They told me to fill out the FOS questionnaire which I sent back leading to my claim being declined. In the FOS questionnaire I wrote I felt pressured into taking the policy and they didn't explain the terms and conditions clearly to me. The official letter response said I applied for PPI over the phone the terms and conditions were explained clearly to me and that i wasn't pressured since it was a phone conversation. For one i can't remember the phone conversation as it was 10 years ago now if it even took place. The letter also states that if i don't raise any more concerns they will consider my case as closed in 28days. Is there any way for me to hit them with a SAR request (template?) to get access to the original PPI policy details, the amount I have paid into this policy, access to the phone call log if it exists and any other details I might need? The only documents i have is the credit card application and terms and conditions. I intend to follow this up by using the financial ombudsman service and would like to have all the paperwork regarding my case to send to them.
  17. So, I complained to Halifax a few weeks ago, they 'refused' my complaint. I wrote to the FOS, who contacted Halifax on my behalf. Halifax told them that they were going to make me an offer within eight weeks (eight weeks is tomorrow). I can see in my Credit Card account (being handled by Capquest, but still visible in my Halifax online banking) that they have credited a sum to my account. I don't have a breakdown of what this sum is, but it was ever-so-slightly more than I was expecting. My question is; given that I had to take this to the FOS and their intervention resulted in Halifax paying up, what am I entitled to in terms of interest? As an aside, I see this as deliberate delaying tactics on Halifax's part, and fully intend making a formal complaint about this - again involving the FOS if needs be.
  18. Hi everyone! I'm desperate for some help and advice! I have just been refused car insurance because apparently I had an accident 2 years ago and received a £9000 payout. This never happened and I have not made a single claim in the 10 years I have been driving. The company I'm trying to get insured with can't tell me any details about the claim - they say I'll need to speak to the company that insured me at the time. I have absolutely no idea who this is - I change every year! Can anybody give me some advise on who I can contact regarding this? The odd thing is that I had no issues getting car insurance last year. Cheers.
  19. Hi I wonder if anyone could help me. I had an RBS Classic credit card that I opened in 1999 and closed in 2009. I wanted to find out if I had PPI on the card so I raised a SAR. It was returned in the first instance saying that I had given them insufficient information, I had given them the last four digits of the card, dates the card was opened and closed, my full address that the card was registered to and my name. The letter sent back said that without dates that the account ran for and without an account number they couldn't help. I called the SAR team and asked what exactly was missing to be told that I must have been sent the letter in error as nothing was missing. I sent another letter telling them to look again and that I had been told by their staff that I had given enough information. I put the information again on the next letter, sent the previous letter plus their response and a copy of my council tax bill for proof. They have come back again and said that they can not find an account under my name at the given address and with the date of birth I gave and as the account was closed over 6 years ago they no longer need to hold any details.. ..I never gave them my D.O.B and the account was closed 4 years ago. ..so my question is can anyone tell me that to do now? Do I write back again? I had a loan with them and a current account also which I have successfully claimed ppi on, should I give them the account numbers for these in case they can link them? I am imagining that they will send me everything they have on those two accounts and not the credit card though and I will be right back where I started. Sorry if this post is long, new user and just finding my way. Any advice would be amazing

I requested the security cctv footage on a friend and myself from a major supermarket under the freedom of information act (he had started to go into a diabetic coma and they claimed he was drunk) and they have refused to furnish it. I am aware at one time there was a maximum fee of £10 and it could take up to 40 days. Is there anything I can do?
  21. Hi I'm looking for some advice over a somewhat complicated issue. My daughter attended a local gymnastics academy and I bought her a club leotard which was needed for a display, she wore the item approximately 6 times for an hour at a time when I noticed stitching on the shoulder seam was faulty, I returned the item to the academy 7 weeks ago and was told at the time that they had issues with other leotards and it was being dealt with by the manufacturer. Since that time my daughter has decided to leave the academy to concentrate on her other sports I contacted the academy today and asked that the leotard was either replaced or a refund issued as the item was faulty and was told that the manufacturer had looked at the item and had decided that we had purposely damaged it and would repair it at the earliest opportunity but the lady who does this is away, when I questioned if the lady had been away for 7 weeks the academy said that it was the academy's fault as they have missed collection by the manufacturer several times. When I asked about the fact that i was told they had problems with other leotards I was told that those issues were with the cuffs and not the shoulders. I have asked that the leotard is returned without repair so that I can get an independent evaluation as we have not purposely damaged the item why would we? At the time the leotard was only 6 weeks old and my daughter was still part of the academy. The lady who runs the academy has not mentioned anything to me about the item until I contacted her this evening. I feel I have given sufficient time for the problem to be rectified but the academy has told me that I only had 14 days to report a problem . what I really need is advice do I have to accept a repair on the leotard on their say so that I have purposely damaged the item or am I within my rights to ask for a refund. They have point blank refused to give me the item back in the faulty/damaged state that I returned it. I really feel that they have painted me as a liar. Sorry if this is a bit long winded and apologies if I have posted in the wrong section but any help or advice you could give me would be highly appreciated Thank you

  23. Hi My son received a parking ticket, which I presume he didnt pay. He has moved house a lot and the notice must have gone to a previous address - didnt notify the dvla until last week when it was changed. Bailiffs called this morning. Demanded 300 plus there and then. Bailiff returns 30 minutes later and demands 691 pds as truck is on its way. Mu son offered the 300 there and then but the bailiff refused. Is this legal. thanks
  24. hello, I have looked all through the advice from Which, CAB etc. Just wanted to make sure I'm right! Took delivery of a mattress this week (ordered online with a CC). Ten mins after driver left I removed the outer polythene cover to discover a dirty brown rip in fabric. Immediately rang company who were non apologetic, they asked for photos for proof. They subsequently agreed to an exchange only as I forfeited right to a refund by signing for it:roll:. I think this is incorrect as I have reasonable time to examine it surely. It still has the second polythene cover on and has not been moved from the hall where it was left. I don't want an exchange as it seems to me this company boots its mattresses round the warehouse and I'd rather go somewhere else that takes better care of its goods and customers. Waiting to hear from CAB, company have insisted today they are complying with trading standards regs. Shall I just go through my CC company now do you think?
  25. I bought an item from a UK shop online. I changed my mind, around 10 hours after I purchased I sent them an email informing them I'd like to cancel. They dispatched anyway, and I refused delivery when the courier arrived. Only after 3 emails did they refund, but almost £50 less than the item cost (The item was £160, they only refunded £110) I sent a letter advising them that the DSR's apply and that they cannot charge restocking fees and that they must refund the original postage. I was under the impression that as I never took delivery, I should receive a full refund. I've attached a screenshot of some of their terms. I received a reply to my letter stating trading standards had checked their terms and had agreed that they complied with the DSR's. I was just going to start small claims, but the response I received made me doubt I am right, and need a few opinions! Thanks[ATTACH=CONFIG]46755[/ATTACH]
