  1. I received a payout from Lloyds for mis-sold PPI over 6 months ago. One of the payouts was for a loan taken out back in the late 90's and was paid out on the basis that it was a 'goodwill' payout and the sum was the Lloyds avergae payout for PPI. Since reading online that Lloyds have miscalculated the amount of PPI payouts for a number of claims made in 2012/13 I rang them to ask if my claim was one such. Teh nice lady told me that I recived the full payout and no furher money would be paid ot me in respect of the claim. My question (as I had to rush to work after my call) is this: has anyone made such a reclaim on the basis that the 'avergae payout' figure was too low. I may be 'out of time' but in view of the info on various news sites it would appear to me that the lady just blew smoke over a possible legit claim from me!?
  2. Hello All, I sent in a SAR to MBNA recently, in relation to a credit card and yesterday I received 6 pages detailing charges that I paid on my credit card from 2002 to 2006. When replying back to MBNA to reclaim these charges, do I complete the "compound interest calculator" at 8%, listing all the charges that I paid in that time period? Are there any other calculators I should use? Is the compound interest rate always at 8% or at the rate I was initially charged by MBNA (which is not mentioned on my sheets I was sent) Advice would be appreciated Many thanks Wulfen40
  3. Whilst researching my fight against a GE Money eviction (a successful fight for me) I came across reference to reclaiming unfair arrears charges. On looking thro my mortgage statements I have found that GE Money have been hitting me for 1) Admin fees £40 2) Default Notice Charges £30 3) Debt Counselling Fees £48 & £88 4) Solicitors Fees total £480 5) Additional interest varies every month They say items 1-4 are all interest bearing so I presume the additional interest they are charging is on these items. Goodness knows what interest rate they are charging, The interest bearing fees total £2450 and the additional interest is £1750. Am I right in thinking I can ask for a refund of all these items? Another thing, they add on these fees every month, and every 3 months they write to me to say my monthly payment has been re-calculated and gone up, usually by about £5 are they right and being fair doing this? If these charges are unfair and illegal surely my monthly payment should be re-set back to what it was before they started this 3-monthly increase. Finally, if I am successful in reclaiming the fees they have charged so far, will they stop charging them in the future or do I have to take further action to get that done? Thanks for all the advice i've received in the past on here, and any I get in the future.

  5. I worked for the Halifax then Lloyds Bank for over 6 years. To clarify, I work in IT earning an average wage, I am not a banker crying about a 7 figure bonus or anything out of the ordinary... In 2013 my performance was such that I was awarded an annual bonus, part of it paid in March and the remainder in May 2014. Knowing that they (the bank) lack morals of any sort I specifically called HR and checked that I was still due my bonus, all I was told was that if I handed my notice in before the bonus was paid I would forfeit the award.. .. I also checked the HR bonus T's&C's which said the same thing - hand your notice in before it is paid and you don't qualify, nothing else was listed. I left the bank in June when offered another job. Now in July, on my final payslip they have reclaimed the bonus, when speaking to them they say - even though it wasn't published anywhere - that the policy is you had to be employed at the bank on June 30th to qualify for the bonus, and they say I now owe them this money. What can I do, do they have a case? Any help appreciated, I can't sleep with this hanging over me
  6. Good afternoon, I searched the board, but didn't find anything, I wondered if this has happened to anyone else? I changed my address with BC in 2011, my statements, and all other mail from BC and Mercers etc are at my current address. imagine my surprise when I received Two letters one sent in Jan 2014 and one in March 2014 which have found their way to me (Via a relative, who rents out to new tenants) two letters advising me I may have been missold PPI. Is this an underhand tactic for the bank to justify telling me, in the hope I would never receive ? It give's me option of phoning, writing or filling in BC questionnaire online, but I've been told by someone who recommended I joined here, that it's best to use the FOS questionnaire? Is it worth kicking up a stink about them using a previous address? Or highlight it at some point along the way? I have three accounts with BC would any reason they may have just have one account listed in the above PPI letter, when I seem to have PPI and charges on all three and have been paying reduced rates for several years dealing with Mercers/Calder and Moorgate all in house DCA's (I've been told) all at my current address! My friend has sent me links to PPI section this BC section and stickies to read up on to which I've gleaned lots of pointers. I've been unable to face things for a long time, but with the support of my friend I've been able to start sorting out my paperwork and am determined to become debt free thanks for reading and any direction you may offer Jazz Sorry if this is in BC thread and should be in PPI, I wasn't sure which to use.
  7. Hi all! Long time lurker. Quite a complex issue so apologies about the length of this post. Back when my nephew was born my brother and his partner set up two bank accounts - a joint account and a single person account ( my brothers partner) - meant for paying for stuff for my nephew, etc. They were never married. All well and good until they split. My brothers ex partner is now making life difficult for my brother to get access to the second account - there was a not-unconsiderable amount of money in this, including birthday/christmas money from other relatives, etc. There should be no reason for any money to have left this account since my brother moved out of his ex partners home - we do question whether she has used the money for other purposes and is now attempting to hide the fact. We've tried communicating with her since however it's slow going and it seems very much like she's making it difficult. Some money was paid in by cheque so I imagine it should be able to be traced back to which account it came from. First question: Does this fall under small claims court, criminal law (theft - permanent deprivation?), or neither? Second question: If it's small claims court territory can we start a claim against his ex partner to force disclosure of statements and splitting of funds (So what he has paid in he gets back, what she paid in she gets back)? Hi i have 2 items with brighthouse that cost 18.40 a week (including osc which after reading this forum i understand i didnt have to take out despite them insisting on it) the account should have been paid on saturday just gone but due to unforeseen circumstances i am unable to make a payment until next tuesday which will make it 2 weeks in arrears the following saturday. I have had a shop manager on my doorstep today telling me that if i dont pay by 12pm tomorrow (thursday 17th jan) that they will be taking my goods. in my contract it states in the repossession part if you do not keep your side of the agreement but you have paid at least one third of the total amount payable under this agreement, that is 438.88 we may not take back the goods against your wished unless we get a court order i have paid this amount and more. when i said this to the manager he told me that because it was worded "may not" instead of "can not" then he could take the goods with out a court order. am i right in thinking this is a load of tosh? i have told him the date i can pay it but hes being very arrogant about it and id like to know my rights in this as it all seems a bit wrong. Ive not received any letters or a default notice in writing only him phoning me but i missed his call and him on my doorstep. when he undoubtedly turns up to try and collect the goods do i have to let him into the property? thanks in advance

I am in the early stages of reclaiming fees for arrears,management fees etc so on this front would appreciate a helping hand as this progresses but the other question I ask as I have seen reference to it in other posts is that we took out a self cert mortgage with SPML (now managed through Acenden) in 2006 where the broker who organised got paid a total of £10k for his trouble !!! What can I do about this too with regards to mis selling? From early enquiries they are no longer trading Thanks
  10. Hi all, Im finding it hard to follow the existing threads so i thought it easier to create my own. Ive been with BH for several years now and on every contract i was told i had to have OSC. Have people been successful in reclaiming? What are my first steps? i keep seeing the word SAR floating about ... do i need one of these, i dont have all my original paperwork. Thanks for your help oh also, I finished paying for a tv last november, it had been in for repair whilst being paid for and a few weeks after i had finished paying for it the fault reoccured, so i took out the extended cover for the tv with brighthouse and booked it in for repair. This was in november and they left me with a tv that i have to say i am in love with lol, anyways can i just keep this one now since its been quite a few months

Ive had 3 letters from Cap quest for a debt with Barclays partner finance for a large sum, at first I thought it was a credit card owed but then realised that it wasn't and that Ive never had a loan with this side of the company especially for nearly 10k!! They have apparently purchased this debt They sent a CCJ threat just before last post date this month so shortening any reply time to about 3 days due to the fact royal mail was mostly closed. Then another immediately after Christmas saying they are still going for legal proceedings and seeing as I seem to have no other ccjs if I dont contact them i might may or possibly have trouble getting a mortgage, mobile phone, loan etc. I have had dealings with these people before, they sent me someone elses payment schedule with their address on it and it ended up in dispute and them never contacting me again as it went over the 45 or so day reply they set themselves. I was going to ignore it but being pregnant I dont really want the hassle of defending a CCJ if it goes that far. Anything I can do? thanks
  12. hi I have got afew accounts which have had charges on , i have not made any payments to these accounts for just over 5 years now so i believe these are status barred if i goto reclaim the charges does that reset the status barred time again , also if a company has not got a signed credit agreement can they put a default on credit file . many thanks for the help
  13. Hi everyone, my OH and me are new here and would really appreciate some help. I have spent hours on the internet trying to decide the best course of action and my head is spinning! The story is long and complicated but I will try to keep it short. My OH took out two loans in 2000 when his marriage broke down. He ended up with a CCJ for one loan (despite using a debt management company - a very long tale of woe worthy of its own thread) the other creditor, Lombard, accepted his offer of low monthly payments which he paid to them via Westcot Credit Services until Arden Credit Management took over management of the account in April 2010. In Dec 2011 the loan account was transferred to idem Servicing, with payments still going to Arden. Last year Arden demanded he increase his payments which he did under protest and recently they have become very heavy handed, demanding another increase, ‘phoning him numerous times a day and sending letters threatening all sorts of action, as he is “refusing to address the outstanding balance”!! (He’s never missed a payment for 12 years!) After trawling through all the paperwork recently, I discovered the original loan includes PPI which my OH doesn’t really understand about and he thought it was compulsory. I decided to fire off a CCA request to Arden to give me time to investigate matters but they have totally ignored it. Unfortunately I think I used the wrong letter template – I used one from a post in this forum but it refers to section 78(1) of the Consumer Credit Act 1974. Have I made a mistake big style, or should Arden have replied to my request anyway? Should I send another letter to Arden about the CCA request putting the agreement in dispute whilst I claim a PPI refund (I am sure I found a follow up letter template on this forum somewhere but can’t find it now)? Do I send a PPI claim to Lombard or idem? Can I also just confirm that we are not trying to wriggle out of paying the debt, we are just feeling very stressed and harassed by Arden and want to fight back a bit! I am hoping if the PPI claim is successful I can offer a Full and Final settlement to Arden. I felt quite strong at the beginning but feel we are now losing our way – please help!

Hi I did a letter to my old mortgage company, I moved away from them 6 years ago, and I put in a letter claiming for the return of the charges they put on my account, just over £1000 in charges in 3 years. they sent a letter back saying basically tough its time barred !! Can I continue my pursue of them and take them to court or the FOS
  15. Hi, Just received 4 boxes from HSBC following SAR letter. So, first and foremost - there is no contract! What does this mean??? and what do we do... Here is our situation: My husband had this account for 15 years. About 7 years ago it became joint after we got married. For years, this was the only bank we used. It went in and out of overdraft. But about 5 years ago, we stopped using it. However there would be an occasional charge and/or direct debit which would keep the overdraft going. This made the account go from 0 to 9K, which is out limit and for the last 3 months it's over the limit, now they are demanding payments and reported this on our credit file. We tried on numerous occasions to resolve, settle, come to an agreement but were always told that nothing can be done and it's all fine as long as we are under 9K. I even tried to close, but no luck... a few questions. PLEASE HELP! - No contract - what do we do? - A number of accounts listed with closed dates unknown - Fees/etc - what are we supposedly to be looking at and how are we adding this up? There is a min of £150 monthly, plus £12.95 ppi - How far can we go back? - Letter template? - Personal issues? What are the types of things we should mention? - Difficulty - We were in financial difficulty for years, this account above contributed to this, in addition to other cc mishandled.. . However now we are doing ok and focused on repaying everything. Does our current financial status matter? - We are not currently living in UK - does that matter. PLEASE HELP! ETERNALLY GRATEFUL FOR EVERYONE'S HELP HERE !
  16. Hi, I am new to this forum but hopefully you can help. I have a small business and have incurred alot of bank charges in the last few years. the charges are now taking me over my overdraft and i am now incurring more charges, its a vicious circle. charges alone since the 1 nov13 £870!!!! i would like to be able to claim the charges back as i now find i have to think about closing my business. any help would be great as there are so many conflicting things on line. thanks jaki
  17. I have just totaled up my old business bank charges. starting from 2001 up until 2005 They amount to about £1,600 Can I claim them back. I still have all the bank statements.
  18. Hi All, I received a response to my SAR from Aqua/HBOS today. Total charges: £468 I have an old spreadsheet which I believe I found on these forums. It takes the date and amount of each charge and then calculates compound interest (based on my own APR of 35.95%) for these charges. Can I reclaim the charges and this compounded interest? If so I can reclaim £706.22 Any links to template letters would be much appreciated! My account has been sold to a DCA if that makes any difference?
  19. Hello everyone, I hope you can give me some advise. I am embarking on a journey to reclaim excessive fees etc. etc. from my various debts. Before discovering this fantastic website I received a CCJ from RBS Lombard for a personal loan I got into trouble with, this was managed through Arden CM. I have paid in full and the CCJ is now showing on trust as "satisfied". I also had success on this loan with my PPI reclaim for about £6500. I thought I would use this loan account as my test subject because there are very few charges on it, I have full statements. I put a claim using an online template directly to RBS and received two letters from Arden CM in response. The first an acknowledgement of my complaint, the second, I have attached, being their final response. I realise it is a small amount I am claiming but it would be better in my bank account. My questions are:- Are Arden telling me the truth in their response? If not is it worth complaining through the FOS? Many thanks in advance. AS
  20. After years of falling into the trap where I couldn't pay my council tax as the previous year was with the Bailiff and there high fees just put me deeper in to debt.. In the end I took advise from this forum and just ignored them when they came round, and was surprised that they actually couldn't do anything.. I think one year 3 separate Bailiffs came round in one month putting there intimidating letters through the door.. In the end they transferred back to Council, and I did an arrangement with them.. Now finally after years of being in this cycle I am now all uptodate and its a nice relief. Anyway I have realised that some of the charges must of been horrendous, can I SAR the bailiff company, and then ask for the charges they charged me that are over the set price with the council.
  21. I am going to write to the HMRC Pay As You Earn office to claim a tac overpayment for last year. Back in the day the HMRC would pay back with a check. Can I ask the HMRC to pay the amount to a bank account or alternatively directly into my payslip? Thanks.
  22. Hi Im looking for some advice. My husband had an accident in December 2009. The accident was at work so he claimed industrial injuries disablement benefit. He was also in receipt of DLA and ESA. The claim is coming to a settlement at last however the medical expert has said my husband would of became disabled anyway but the accident accelerated this by 12 months. The DWP has asked for benefits back for the first 12 months only apart from the IIDB which they want back in full upto settlement date. The ESA doesnt need to be paid back at all as he started getting that after the 12 months. Now this is where my query is. As its income based ESA the amount we got for IIDB was deducted from the ESA automatically basically making us no better off by claiming. Now my question is would we be able to claim back the ESA under payment once the IIDB has been paid back as it doesnt seem right that we have lost out. many thanks
  23. Hi All, I currently have an ongoing legal claim in the county court against Santander reclaiming credit card charges. All charges in question were applied to the account whilst PPI was on the account, this PPI has subsequently been accepted as having been miss-sold following another claim through the county court. Santander accepted all points in my POC but still managed to drag the case out for another year all the while applying penalty charges to the account. After unsuccessfully attempting to get the bank to repay the charges I filed in court & their new solicitors are playing all kinds of intimadatory hardball in attempts to either have me drop the case by intimidation or have the case set aside. I was just wondering if some of the greater minds on here could have a quick look at some of the paper work & offer some advice. Additionally it it possible to discontinue a case which has had no trial date set so has not been adjudges & the file a new claim at a later date? Thanks in advance.
  24. Hi everyone. Just after some advice about how to reclaim the OSC on a TV I've got from Perfect Home. I took the agreement out in January 2010. I requested an up to date statement of my account which arrived in the post on Saturday, and immediately noticed that I have been paying OSC for the last 3 years, despite the fact that I clearly asked for it to be removed. When I spoke to the staff at PH, they said that because I've paid the OSC for the last 3 years without question, I don't have a leg to stand on. Where do I go from here?
