  2. I'd like to start this thread with a big, fat 'mea culpa' and declaring my limited company insolvent AND declaring personal bankruptcy are the only routes left to me & I'm at peace with that. I have confirmed this having spoken with my accountant, an insolvency practitioner the accountant recommended, the Citizens Advice Bureau and Business Debt Line. My question, however, is in which order do I execute these? Business first then personal? I've had conflicting advice from the IP and BDL. I only want to do this once (obviously) and do it right so am nervous of starting in case my decision leads to adverse recourse. Please all you smart, helpful people, please advise?

  4. Hey, I haven't posted on here in a long time but I have just received a Claim Form from Lowell Solicitors on behalf of Provident. I used to work in litigation, but that was 7+ years ago (unqualified legal assistant), so whilst I am familiar with small claims and county court processes, I am a little rusty all the same, so I hope to get some information from people in the know... The date of issue is 31/01 I have filed AOS I am calculating the date for the defence to be by 04/03. I have made a CCA request to Lowell Plus I have made a CPR 31.14 request to Lowell Solicitors The part that I need help with if is... I don't really know how to defend my claim. Do I just hope that they cannot find the agreement, unable to provide a legible copy, or there is an issue with the contents etc? If I remember rightly then this loan dates back to 2010/11 - in which case it might be statue barred? I have made a payment to them in almost the same amount of time. I will need a copy of the agreement to see what date is on it. Is there anything else I should do or be aware of? I stopped paying because I was struggling with my mental health; I received a bi-polar diagnosis whilst battling other health issues - so I just lost all touch with reality for a while. Please would any member be able to assist with the following issue that I am having with Clydesdale Finance who have changed a default date with Experian Credit Expert which has greatly affected my Credit file. The issue is: I had had a debt that should have expired 04.01.16 after 6 years, I was eagerly awaiting this to enable myself to move forward with my own financial plans. I recently checked with Experian Credit expert to make sure that my score was still at 999 and that the expected bad debts would disappear from my personal report. I was amazed to see that my credit report score had drastically dropped to 734 barely over the poor mark. I duly contacted Experian to find out what has happened. Experian contacted Clydesdale on my behalf to be informed that I personally would have to contact them to discuss the matter. This proved to be impossibility as I could not find any information as to the contact numbers I would need to contact this company nor could Experian provide me with a contact number saying that they will only accept written contact. On the advise of Experian I duly wrote to them on the 22.02.16 asking them for an explanation as to how and why they have changed my personal financial data with Experian. I provided screen shots of the original default dates that were applicable which was 04/01/2010 which should have expired off my personal credit file from this date. To date I have not even had the courtesy of an contact/acknowledgement of my letter which was signed for and duly received. My questions are: 1) Can a Finance company operate this way legally? 2) What should I now do to move this forward 3) Can I take legal proceeding
  6. As a self-litigant after almost seven years of ongoing PI claim for PSTD which was initially for 40k. My barrister took over my case 2years ago and elevated my claim to 90k. We had two days hearing. I prepared the bundle and delivered personally to his office a week before the date. I asked for his skeleton argument, he replied, that is my own side, I will deal with it. Hearing date the defendant barrister handed his skeleton argument to my barrister my barrister said he didn’t know he had to do one. He borrowed my Ipad and held the court for 1.5 hrs pretext of negotiating. Yes, there was negotiating but only took 5 minutes. The judge rubbish his skeleton argument and he look like idiot when he was asked to comment on the defence case law. I gave her my legal cost for 13k for her to give copy to defendant and the judge. He took it, saying not now, ‘we have not won the case yet.’ Before the hearing defendant offered 12k settlement because they believed that the case was worth 5k. My barrister said it was too low. After the first day hearing which went very bad for the defendant., I asked my barrister to push for more and reluctantly for my barrister the defendant offered 20k, my barrister said no he would get at least 40k for the claim My Barrister won his case and was awarded 5K . I quickly told him to slip my schedule of cost in for the judge to sort it out since he has not prepared one for himself instead he was cherry picking my legal cost. By reading over to the judge. Total pay with cost 7k while I have legal cost of almost 15k for this case. We are still within the week of the decision, can I re-present my cost or go after the barrister. I have waited 7years for this case .

A family member recently passed away suddenly with an outstanding balance on their personal loan a/c of £2,000, £400 in their current a/c and £500 in their savings account DWP have contacted me to inform of an overpayment of pension credit of £200 which of course must be repaid Next of kin has been in touch with RBS bereavement service, whom claim they can take the £900 in the deceased's RBS a/c's against the outstanding balance of the loan 1. Is this true? 2. What happens to the remaining balance of the loan? 3. Should we inform RBS of the DWP overpayment? & 4. Can the DWP overpayment be taken from the £900 in credit? Advice appreciated
  8. Hi, Luckily I've not had to use this site for quite some time, however I can't find any advice on this anywhere so I'm hoping I can count on this site again to shed some light on something. I have a personal lease vehicle, for which I get a car allowance from my work as I need to travel for my job. I'm an account manager so being at customers reliably is a must so I chose a decent reliable vehicle. A Skoda Octavia VRS Estate, which has been great up till this week. I have kept the car serviced as per the manufacturers instructions as I took the full service, maintenance and tyres agreement for less hassle. So if anything goes wrong, as long as I haven't driven like a moron they will fix it with no additional cost, its all in the monthly payment. Whenever it goes in for a service I get a loan car, sometimes I have to wait for a service appointment but again I always stick within the millage. This week though the car started overheating erratically, it would normally do it when the car first starts and runs up to normal temp, it would then continue to climb till it reached the red zone. The first time I didn't even notice it creep up, as soon as the warning light came on I stopped safely and turned off the engine, two seconds later I turned the ignition back on and the temp was almost normal again, waited a few more seconds and it was normal. I started the car and is was as if nothing had happened, this was Saturday, it did the same on Sunday and then on Monday. Again both times I stopped and the temp would do the same thing, I traveled to work and called the Driver-line service that I get as part of the contract. They sent out a full Skoda tech who came to look at the car in just under an hour which was fantastic, I explained the situation and without doing anything he knew exactly the fault. Its the water pump, on new generation diesel engines they have a sleeve which goes over the impeller mechanically which heats up the car quicker, after its done its job its meant to slide back otherwise it overheats the engine. Mine had stopped retracting, turning the car off fired the solenoid which shakes it loose again, the answer is to replace the water pump. This is covered by my maintenance and service agreement so it was taken with me driving and the tech following to my normal dealer, we called ahead but there were no loan cars available. The tech explained that he could take me there and then drop me back at work, once he dropped me off he called into the office and arranged for a 48 hour replacement car to be sent. The call was made at 11:15AM yesterday by the tech, I herd him dial but not the call itself as I had to get back to my office. Anyway he advised that if I didn't hear anything in an hour or so to give them a call. Up till now I was pretty impressed and was happy, this was to change though. Now before I continue, this is a personal lease agreement, whereby I am allowed to use a car that is owned by Skoda and not by me, I have no rights to the vehicle at the end of the agreement. I am aware and happy with this, however I need a car for work, its my lively hood. If I cannot get somewhere when a customer or my company ask I loose money in the form of commission because that job / appointment will go to someone else. This is why I choose a lease vehicle. If something goes wrong - They fix it, Its needs a service - I call a number and it is done, all the while in the maintenance contract it states very clearly that I will have access to a vehicle should anything happen. This is important as I can be anywhere in the UK when something might go horribly wrong. No call was recieved in the time I had been advised, so I chased the Driverline team. They apologies and said someone would be in touch shortly, this was between 13:30 and 14:00 so still plenty of time to get something sorted. Sure enough at 14:40 someone called to get my card details for fuel cover and conference in the DVLA to get access to my licence details. I was told that I would recieve a call shortly to confirm when a car would be with me, they at this time asked when I would finish work, I stated that the office closes at 5pm sharp. I was assured this would not be an issue and if they could not locate a car then I would be offered a taxi at no cost to myself to get me home. An hour passed and I chased them, I was told again that they would phone me back abut they are every busy. I again did not get a call back, I phoned again an hour later, this is now at 16:30 and was told that I would get a call shortly to arrange either a car or a taxi. 17:00 came and no call, I couldn't get through to anyone and was on hold for over 20 minutes. Luckily a colleague took me home but went out of their way to do so. At 17:55 they called me to confirm that they had received the request, they even confirmed that I finished work at 17:00, no apologies or anything. Anyway the customer service isn't the issue so I'll continue. Was told again that I would get a call shortly to confirm if a car would be with me that evening, no call came, I chased and they organised a taxi to take me to work. Oh just to thrown in that I was meant to pick my wife up who cannot drive due to medical reasons, she luckily was also able to get home by other means. So this morning I received a call stating that I would receive a hire car by 13:00, 13:00 came, no car. I called and chased, was told I would get a call back, none came back to me so chased in an hour again, the format went on as previous. This time the hire company called me and explained they had no vehicles and the one that was confirmed earlier wasn't available till the same evening. This is a large multi branch hire company, something didn't ring true. A colleague phoned and booked a car to be picked up in two hours.......... no issue, no hang ups was all confirmed. We got confirmation e-mails in case they are needed later to prove they were not being honest. I was again told I would be sent a taxi to get me home, this time they arrange for my wife to get one as well. Hers arrived, mine did not... I called again, was on hold for 20 minutes, I called the hire car place who said although it was them that booked the taxi they didn't know when it would get to me. I live 30 miles away from work so not like I can walk it! Luck again prevailed that my boss let me have a company van and managed to just, literally the company insurance company was just about to shut, get me added onto the company insurance so everything was above board. I have not received a call back since, I phoned to cancel the taxi that was going to be arranged for me in the morning to the hire company that tried to feed me a story about how they tried to get me a car all day and it just didn't happen. I at this point lost it a bit and asked why it was possible for a colleague to call and have a car delivered in two hours but over two days and they couldn't get me even a taxi to turn up. So thats where I'm up too, I've totally lost confidence in Skoda to be able to supply this part of their contract with me. Is this enough to go down the lines that they are in breech of their lease agreement with me? I do reseal that whilst I have written this e-mail I sound like a very ungrateful moron, however I pay them a very large sum to have as little hassle having a car as possible. I'm not bothered about owning anything cause all you do is loose money anyway so whats the point. My point is that - 1. I cannot (CANNOT) be without a car, it has very serious repercussions on my personal and my working life 2. The idea is that when there is a problem with mine they are meant to supply something reliable so I can get to work, I would say that two failed taxis isn't reliable and not getting a hire car from a company that has cars available is also unacceptable. 3. Again this is all in my contract, my obligations are to keep the car maintained to their levels and return it in the state I was given it, with the addition of my maintenance and service agreement (which is a very expensive bolt on) this is pretty much covered and therefore there is no expense to myself. (hense me sounding like a right whinging idiot) However thier side of the contact is and should be to keep me as mobile as possible Can someone shed light? Thanks in advance!

I wonder if anyone can advise me of a contact number or help regarding a loan taken out pre regulation via Central Trust CT capital with Endeavour personal finance who are now HSBC HSBC blame Central trust as the broker - Central trust say they were not regulated pre 2005 so told me to look at the underwriter who were Hamilton Insurance. I believe they are now Aviva Insurance. I have telephoned many Aviva numbers today - they all tell me that they have never heard of a PPI claim with them as the underwriters?? Am I going mad? I really have no idea who to contact at Aviva
  10. As a former director of a company that is subject to a winder, I can being sued for sums due to a trade supplier under a PG. I resigned before the winder was made. The debts were incurred during my directorship. Can the trade still sue me?
  11. I took out a Unsecured Personal Loan with Halifax online in December 2011. I was NEVER asked questions like, can you afford the payments, are you employed/unemployed, and I certainly was not asked about my income. This have got so bad I am currently on an IVA - Halifax increased the IVA from 5 years to 6 years forcing me to pay for longer. I am now wondering if bankruptcy is the best option. Do I have a claim that Halifax lent to me irresponsibly without going through my finances first?
  12. I've got 4 accounts totalling £10K in debt, either credit card or bank loans. All 4 are defaulted on my credit report and are all around 4 years old. I received a 'Pre-Legal Assessment' letter from Lowell regarding one of this accounts this morning advising my account is being escalated for legal assessment, threatening potential Sheriff court action. This particular debt is only for £256, so I presume this is probably just hot air. I'm currently living with my partner and I want to know what are the chances of debt collection agents of bailiffs turning up at my door? Would this only happen after court action? Is it now just a matter of time before I get similar letters regarding the other debts, and should I now make arrangements to repay?

Hello, we have a car loan with a company and in the last 12 months we've received two email both containing a lot of attached letters that contain personal information on a significant number of people. They contain name, address, bank details, car reg details and so on. I'm a bit concerned about this as I worry that our details have gone flying around to others! I also feel sorry for the people whose details I'm seeing! I've alerted the company each time and just received an email back saying "sorry about that, just delete", very offhand about this! Is there anything else I should be doing? I'm concerned that I've received this info but more so that they're doing this and not bothered about it. Thanks for any advice.
  14. Hey folks, need some advice. Hubby had a motorcycle accident last November. Was hospitalised and had surgery. 5 months off work with only SSP. We got through that. We had a witness and the police prosecuted the driver for driving without due care and attention. That went to court in June last year. Hubby had 12m review with surgeon yesterday and has to have further surgery in 3 weeks, meaning more time off work. Our solicitor is telling us that the other parties insures have not responded to their push for admission of liability. Court proceedings were allegedly served in September this year as they hadn't admitted or denied liability and we still have no response. We have asked about an interim payment, but have had nothing . We have been told we cannot get one unless the other side admit liability. We cannot afford for him to have further time off work as he only gets SSP! Is this right? Surely if the driver has been prosecuted it's pretty cut and dried and the driver's insurance company should have at least responded?? Thanks:|
  15. Just been informed that i will not be getting this benefit, i am currently in receipt of DLA. The decision and reasons has been based on a seven minute examination and what has been alleged to have taking place in that period of time is complete and utter made up rubbish. Luckily for me in a sense is that i had a witness my wife who taped the whole seven minute examination which is at complete odds with those giving by the [removed] person who Atos used to examine me. Might send the footage to the media and expose just how and in under ten minutes the government are relying on this practice and in particular claiming parts of the examination which have been used as a means of stopping this benefit without actually carrying out such process which as far as i am concerned is criminal and very misleading. Makes you wonder how many other disabled people are losing any rights that they have based on a fabricated report from Atos :mad2::mad2::mad2:

  17. Hi just wondering can anyone assist or have had similar issue: I purchased a hp car after 6 months and faults i returned the car and wanted to upgrade to a bigger car. However i could not obtain finance was advised that if i got another family member they could try that. my sister went with me and they obtained what we were told was finance and that there was £2000 negative equity from the car i had returned and that this would be added onto the monthly payments. We also purchased gap insurance and were advised that everything was the same only difference was the amount. We were even advised that we could come back half way or in a few years and upgrade again. I have never received a letter, email statement at all in the 30 months i have had the car. To my shock i decided to trade up as i had been told i could so i contacted blackhorse who said yes this could be done as long as i paid 1400. After one week and getting the money i again contacted them only to be told this was a PERSONAL FIXED SUM LOAN!!! This was not what i had agreed to. I brought back a hire purchase car and was told that everything was the same. O and blackhorse said they sent 2 statements of which i have yet to see. I would never have taken a loan for a second hand car and did not know that it was even possible to go into a showroom and get a loan. They were fully aware of my circumstances and wishes given that i was returning a car on hp which was not suitable! They never advises us off the change, yes we signed paperwork but on the basis of the sale team telling us everything was the same. My understanding also was that GAP insurance only covered for the fall in car value not for a personal loan? To add during this time i have since taken another car out and it is hp with the same dealer with the same instructions as before. I truly believed and was advised that they all were the same until now obviously. Any help would be great
  18. Hi, my Aunty as just told me when she took out her mortgage in 2003 with Santander she was advised to take out Personal Protection Insurance separately, which she did. She wants to know is this the same as PPI ?? We have looked on the internet but it's not very clear wether it is or not. Thanks in advance.
  19. Hello, Been a while! I'm trying to arrange a PPI refund on my load with GE Money. I've sent them a form detailing my complaint - and they've come back to me today, saying- They've looked into my unfair PPI claim They've looked into the commission paid to by the insurer to the lender. They're not going to uphold my complaint, because, according to the copy of the agreement shown - the loan was dealt with by a broker 'The Personal Loan Express' it was taken out in September 2003. all the boxes were typed in, and all the boxes ticked for insurance. I recall this was all done over the phone, and they told me to sign the forms and send them back, and because of the type of loan it was, i would have to pay PPI. they're not upholding it because - it's not their problem - The Personal Loan Express. have gone out of business. i can't go to the FOS because it falls out of their remit because the ICOB 'Insurance conduct of business' wasn't started until 2005 They've reviewed my account in connection to the relationship between me and GE Money, in respect of the loan agreement being unfair under s104a of the CCA because of undisclosed commission paid by the insurer to the lender/broker. They're not upholding that either - apparently s104a of the act doesn't apply to the loan agreement, because the loan agreement was entered into before April 2007, and redeemed prior to April 2008. This also falls out of the FOS jurisdiction. They've suggested i approach the FLA, closed my complaint and told me politely not to bother contacting them again. Somehow, even after the length of time - i feel a little short-changed (pardon the pun) It's almost like they're saying 'Yes we knew you had PPI, you can't claim because the firms gone bust, and plus too much time has passed.' I've got a copy of the letter which i'm happy to redact and post, as well as the one page of the agreement. Any advice, would be very grateful Cheers Dman

Hi I have recently been offered a new job and have consented to background checks, i said i was unemployed for five months and they want evidence of this, but i didn't claim and benefits (was living on savings with some help from my partner). The issue i have is they want a bank statement spanning that length of time which makes me feel uncomfortable as i find it very invasive. Also my partner didn't have a bank account at that time so let him use my bank details for his employer to pay his wages into my account, this will obviously show up on my statement. Not only that, when looking through my account history i found a couple of jobs i had forgot about that i had for such a short time but didn't declare (because i didn't remember having them) one was less than 1 week, the other was 1 month. I am upset because i genuinely forgot to incorporate them and even if i had remembered them, wouldn't have declared them as they were crap jobs that i walked out of fairly swiftly and didn't want it to look bad on me. What do i do, do i tell them and hope they will understand or am i doomed?
  21. I am wondering where I stand with this. I have been told that Dukes Bailliffs made a visit to my workplace today. They handed a letter to one of my employees. However this letter had my contact name but another companies address, which is just around the corner, said employee thought it was for them and they had got names mixed up. the company opened the letter which they found was from Dukes Bailliffs but was infact for me. I had my name and personal address inside, saying the same old thing. We have visited your home today and you have 7 days to get in contact. With how much I owed in Council Tax. They immediately returned the letter to me, but wanted to know why their address was on it. They contacted Dukes and asked them, they were told that my council had given them the business address along with my details as a director of that company, as they were unable to get a hold of me at home. They said their company must have something to do with mine. Can they actually visit a place of work and harass one of my employees, and also this has caused quite a bit of embarrassment, on both my part and the company who the letter was addressed to. Isn't this a breach of data protection.
  22. Hello All I am currently being harassed by ROCKWELL DEBT RECOVERY for a guarantee I signed a few years ago. Back in 2011 I closed a business (ltd) which was losing money all was OK and went well with that side of things, I knew that I had signed a personal Guarantee with Lloyds to get access to the LOAN GUARANTEE SCHEME that the government ran. I knew it would be a matter of time before they came knocking but I waited and waited and nothing happened, until I got a letter last November from lloyds asking me to contact the wholesale banking recoveries. I did and I offered them £50 per month with a view to make higher payments around March time. All went quiet until Monday when I had a call from ROCKWELL and stupidly gave them my details. (der) I don't have any copies of paper work of any type from Lloyds. the original guarantee was for 10k and now with charges it has gone up to £15.250 . I have been looking at letters that other members have sent should i do the same. I am on a low wage, I get housing benefit and live hand to mouth at the moment with no saving at all, I am marries with children. rent my house, got a car not worth anything. I am a bit down on my luck and hope to get back on my feet financially but this current climate is bad. Please can you help
  23. Hi I'm a new user seeking some advice with loans2go personal loans. I took out a personal loan with loans2go for £800 with a monthly repayment of £156. Now my partner has previously had a loan with them which he did not pay and has received a CCJ they mentioned this when I took out the loan but gave me it non the less. A couple of days before the first payment was due I was taken ill resulting in 2 hospital admissions and I will require surgery and I have been signed off work for a number of weeks. I cancelled my card as I just cannot afford the repayments any more I am going to struggling with priority outgoings whilst off sick. I have had several voicemails left including one stating that it could be deemed that I have committed fraud. I have emailed them explaining my situation including proof that I have been signed off work and have offered a monthly payment of £30 as this is all I can afford. Any advice or suggestions on how to deal with this are much appreciated. Have I committed fraud and what action can they take?
  24. Dear All, In June 2014, my partner and I arranged an overdraft with our business bank (Nat West) as match funding for a government loan scheme. We were asked to sign a personal directors guarantee and, at the same moment in time, signed the waiver to legal advice form in the bank's office. Sadly, our business has now been declared insolvent and the bank are now calling in the personal guarantee for £20k. Originally, we did not believe we had signed a guranatee but the bank have now come up with the evidence (although that was never originally forwarded to us so we had no copy until now). We have also never received a copy of the overdraft agreement signed in June 14 although we have one signed September 14 with a pp signature from the bank. We were also asked to sign a debenture (again, we have no signed copy) and also a postponement of directors loan account which we definitely didn't sign as they were still chasing us for that in February last year and I know we never signed this. I recently wrote to the bank asking for copies of ALL signed security documents and they only sent me the PG and waiver. I have written to them again today asking for the other security documents. Nether my partner nor I are ones to shirk our responsibilities but I would like to come to an arrangement/agreement with the bank to either pay a lesser amount or a small monthly payment. I have already lost 200k personally from the business failure and hoped that was the end of it. I have phoned several companies who state they deal with these types of issues but not one has come back to me. My question is How is it best to start the process of negotiation with Nat West and what should I say initially? And is it feasible that the guarantee could somehow be unenforceable? I should say that I had another company (Credit4 - beware!) took me to court re another directors personal guarantee for the same failed company and got a ccj and a charging order against a property I owned. i have had to sell that property (my main income) to satisfy their debt and have a small sum left over which I really want to keep to buy somewhere else to live now. Another £20k will add to my losses even more and will dent that small sum. I can't get a mortgage now due to this ccj, even though it is settled, hence why I need to keep as much as I can to buy somewhere to live without a mortgage. My partner now has a new job but has to live away as its not local. We cant afford to buy anything where he is working. Feeling really fed up and just wondered if anyone had some sensible advice on how to get a settlement agreed. Or to know someone who can help at a reasonable cost. A little light at the end of this dark tunnel would be so nice. Thank you in advance to anyone who responds to my request
  25. Hi all, hope everyone had great Christmas and hopefully a nice start to the new year. So the situation is as follows: Parents went shopping to a major supermarket. Mum was paying, dad just arrived to the store, tapped mother on shoulder to let her know he is still in store shopping. Dad turns around to walk back into the store and falls/ trips over a basket. Genuinely fell over. I complained and complained to top of the tree people of the supermarket. Trying to deal with it myself rather than using a 'no win no fee' company. Recently got a letter from the Public Liability insurers of the company, immediately concede liability and offer a paltry sum as compensation. That's by the by, will negotiate a better offer. Part of the letter says that they need to inform DWP of any compensation paid out. My questions are as follows: How does the DWP come into this situation? Why do they need to be informed? Surely they don't count it as income per se? It's not as if its a regular thing or anything like that. Any help to understand the reasons why would be gratefully appreciated :???:. TIA Kind regards
