  1. Hi everyone. just a quick question. i defaulted payments in march this year. They claimed to me that they Terminated the Hire Purchase agreement in May 17. since then i have had calls and emails to contact them regarding payment. This morning a letter arrived of NOTICE OF SUMS OF ARREARS. from what i can gather from google this is sent out because the hire purchase agreement is still active. They have not sent any debt recovery letters but just always send letters under the HP agreement. Is it right they are still sending letters out when the HP agreement is terminated?? Many Thanks
  2. There's no point in whining about them. We know they're ripping the public for all they can, any way they can. 58% rates, 28 day account periods when almost everyone gets paid monthly nowadays. My wife has a debt of £2096 with Marisota and I don't know how much with Very. (She says she doesn't know the password! I'm resetting it.) And a credit card, and who knows what else hidden. She doesn't work, I have to pay everything. I want to work out a prediction of where this will all go unless dealt with now. I can use spreadsheets but I'm not sure how they calculate the minimum amount. T's&C's say: The word is INITIALLY. That insinuates there will be something different later. Or is it so simple as 4% of the £2096? That is £83.84 but they are saying amount due is £251. How is it worked out? Thanks.
  3. Hello, I am looking for some advice as Vodafone have treated me very unfairly and I am disgusted with their customer service. In April 2017 I called to give my 30 days cancellation notice as I had a new phone on order from a different carrier. I was told I could cancel my direct debit as I would get a letter with the final bill amount. Towards the end of July I received a letter stating I owed £112, I called them to query why it was such a high amount and to make payment. The advisor said it was a termination fee, I asked if I could make payment next month and he checked with the billing department and came back and told me "as the account is closed I can make payment whenever I can". He said he could set up an automated payment to come out of my bank on the 1st September, I asked him twice would it affect my credit file and he assured me it would have no affect at all so I gave him my card details and thought it was all done. Towards the end of September I received another letter saying I owe £116. I was confused by this as I thought this was dealt with. Upon checking my bank I saw that they didn't take it out as promised. Also noticed 2 late payments from Vodafone on my credit file. I was very annoyed by this as he promised me it wouldn't touch my file and he set up an automated payment which failed! I called them on the 2nd October to complain and the advisor said it was a mistake their end that the payment didn't go through and promised me the late payments would be removed, he put this in my notes. He said I can make payment now or at the end of the month when I get paid. So I called on 27th October to make payment and to get my late payments removed as promised. The advisor told me they could not remove them as its correct. I spoke to her manager and he was understanding and spoke to the credit department and said they cannot remove it as its correct from their point of view. I explained the advisor in July told me it wouldn't affect my file but he said he couldn't find the call recording so no proof he said that. He did say in my notes the advisor from the call in October had put he promised I could get them removed, however he said this was misinformation on their part. I escalated it to someone called Paul from customer relations department who quite frankly didn't care, his attitude was unprofessional and basically implied I was lying. He offered me £50 for the "misinformation" but I said I didn't want £50, I want my credit file rectifying as I will be applying for a mortgage and because of them it would affect my file for the next 6 years and its not even my fault.... He said they cant do anything else and said I can complain to the ombudsman but they probably will favour them and not get it removed. He put my complaint in "deadlock" and I await their letter. I have complained to the ombudsman and will forward them the deadlock reference when it arrives. I cannot believe the way Vodafone treat their customers. I had been a customer of theirs all my life. Absolutely disgusting. I will not give up until I get this fixed and I will be letting the public know how they have treated me. Any help much appreciated.
  4. Can anyone point me to where it says that HB will only get backdated 1 month? It seems as if all Local Authorities apply this rule, but I am finding it hard to locate the exact legislation permitting them to do so. I would be very grateful on behalf of one of my helpees.
  5. Hi all. I am in the process of moving my mum from the awful Talktalk to a company more reliable and trustworthy. However, it has come to my attention that Talktalk have been taking not one but THREE payments a month from her account. What's more, it looks like this may have been going on since 2013! Things are not making much sense to me I need to dig a little what I know so far is this... There are two amounts being taken for Talktalk and one for Talktalk mobile. She does not have a Talktalk mobile and certainly only one phone/internet line. I recall seeing a paper bill earlier this year which was for over £60, yet when I logged into her online account it's showed every bill at the same amount, £40.45. Almost every month she receives messages warning that she has almost used all of her allowance and has even been cut off a few times, yet online it says her allowance is £250 a month and NONE of it has been used. I checked at least five or six bills and they all said the same. On her bank statement the two main direct debits were started at the same time, have the same ID but a different account number. I also know there is no way she makes enough calls to use up even a fraction of that allowance. It seems like they are sending paper bills for one account whilst the other is handled online and something is very wrong. I won't be able to do anything until Monday when I will take her to the bank to see what transaction information they hold. I will also be looking to find as many bills and bank statements as I can to see how far back this goes. I estimate that Talktalk may possibly have robbed my mother of at least a couple of thousand pounds and I want to do all I can to get that back for her. The down side is, of course, I'm amateur at best when it comes to law which is why I'm posting here. If anyone can tell me what to do or where to go once I have this information it would be most helpful. My mum is a widowed, disabled pensioner who has mental health problems that affect her memory and concentration and in my opinion they have completely taken advantage of her, even upgrading her to the more expensive fibre - she has no need for this, she doesn't even know what it is!! I have had experience of their customer "service" myself in the past so if there's a way I can avoid going down that route I'll take it. I'll check back here over the weekend as I am busy tomorrow, for now I just need to gather advice to use after Monday. Thanks guys.
  6. Mine is a complicated tale and desperately need some advice. To make it easier I will break it down as even I have difficulty undestanding it 2006 Applied for Job Seeker's allowance but refused on I hadn't worked for the last 5 years which I had. After much backwards & forwards they told me they had lost my records then found them and wld now credit NI onto my records. Too late to get the JSA etc as now out of time 2015 Applied for a Pension statement & noticed not enough years on Guess what the original missing 5 NI not been credited. Sent letter & copies of original forms I filled in (to show income for each year) and assured they would update their records. Dawned on me that as they had not updated my records when they said they would they would also not have sent any pension contributions to private pension co (I was contracted out to L & Gen). Contacted L & Gen and was sent summary of contributions. No contribution sent from HMRC for the missing years which approx totals £5,000. Wrote to them again and they sent me a letter to confirm that they had put the NI back on BUT for some strange reason instead of NI basd on my wages at the time £48-50K they had said I only earned £5,000-£7,000. Want me to prove I earned it with wageslips/P45 etc from 2001-2005 :mad2: Just contacted Bank to see if I can have statements for that period which hopefully will show a weekly wage (by BACS) otherwise I am stuffed!!! Can any one please advise, I have spoke, written to every department in HMRC and they still are cocking up my records:-x Thanks

    My apologies if I posted in the wrong section,as it relates to a credit card,Santander and Noddle. The story is that my payments do not tally with the balance on my card, this is according to my Noddle report. For example, my last payment on my card was for £500,but Noddle is showing a payment of £100. The balance on my card corresponds to a payment of £500. Looking further back on my report, February of this year, it is showing as 0 payment, but January is £220 and March is £110 .I know for a fact, that I did not make a payment of £220 in January, it was £110. There is no marker to indicate that it was not paid, just a green dot and OK in the status history. There are further discrepancies going further back. I will have to check with my card statements. Who is at fault, Santander or Noddle. Regards, John.
  8. Hi I have late loan monthly payments recorded on my credit report from Nov 2014 up to now . I haven't paid but want to clear the loan now that I can afford to. Myjar charges a late monthly payment fee if you are 3 days overdue on your monthly payment. I have had no record of them asking for late payment charges from me. Can I ask them to accept the loan repayment in full without any charges and is it likely that they will register a default anyway? Look forward to your response
  9. I received a letter from Jacobs today regarding our current arrangement for council tax debt. I'm extremely frustrated, I have never missed a payment with them and even now our current arrangement is a bit of a squeeze, but I pay non the less. Letter dated Aug 2, 2017. I really cannot afford to pay anymore than our current arrangement, I'm obviously going to call them but, I'm not sure what to say/do I can't deal with Bailiffs at my house again, I was a mess last time.
  10. I have today had a letter from my council cancelling my right to pay my Council Tax. In installments. I have been paying this on line for the last 4 months for this year on a regular basis. My last payment was paid on Monday this week. When I received the letter I phoned my Council who informed me all my on line payments have been taken off an old Debt which is also being taken via my ESA. They say I have to pay again as the money I have paid has gone off my old debt. My question is, Is this correct and can they do this.? I spoke to someone back in April who assured me this would not happen again, Obviously, it has.
  11. Received my documentation from the above which seems to state that I did not want PPI in the last century but in 2005 I have entries for £40 called 'out of order' charge. Is this PPI can anyone advise.
  12. Hi I pay by monthly instalments for my car tax and I want to change my bank account direct debit details, so yesterday I cancelled the direct debit and will re-tax the vehicle on 1st August. I have now received an email from the DVLA saying I need to re-tax it. The payment for July has been taken out already. I read the gov.uk website (change accounts part) before cancelling the DD, which clearly gives an example: Example You pay by Direct Debit every month, but want to pay from a different account. You cancel the Direct Debit with your bank on 5 June. You can continue driving your vehicle until 30 June. On 1 July, you have to tax the vehicle again using a Direct Debit from another account. I just wanted to check that I'm doing it the right way right? According to the DVLA website I quoted it's all OK and I won't be untaxed. The email has unsettled me! I went to the link in the email to see about taxing it and it says it's still taxed and would be taxed again from 1st July if I continued, which obviously I don't want to do! Anyone else had this experience and can confirm I'm doing it the right way? Thanks.

  14. Dear All, I come to this website by searching for some advice for a serious dispute with my cowboy builder recently. Please bear with me with my long nasty story: We hired the builder in late April 2017 and agreed to make stage payments in contract. The whole project was quoted £35k We paid him 10% deposite and the first stage payment £9k in advance (what a mistake I know). The first stage payment is supposed to cover the material and labour cost till bricks are laid up to roof level (which was not written in contract but agreed verbally). I did get 3 references for the builder and one is from a senior employee of the council, for which he was doing a similar extension. However, I had trouble with him right from day 1. He mis-measured our foundation by 70mm short. We did give him a chance (what a mistake!) and he promised he would be more careful. He was not. He was rough all the way and recently I learnt that he was not qualified builder at all although he claimed he had more than 10 years experience. His work was substandard and his attitude was not professional. He was rude, aggressive and intimidating to my family. He swore in front of my family including my children on a number of occasions, when we pointed out any mistake or simply asked him questions. I found no integrity in him at all, there were constant lies and broken promises. The project was planned to take 10 - 12 weeks. Only 3 layers of bricks have been laid so far. Up to date, we have paid him £16k for the work, which is worth only £6000 - £7000 evaluated by two independent evaluators. Last week when we refused his aggressive demand for more money, he stopped all work, refusing even to relay the bricks that were laid with wrong mortar colour and upside-down airbricks, and took all materials away. There wasn’t any chance to negotiate and discuss. He even dug out a newly laid drainage and took the pipes away! He is now issuing us the final invoice, demanding another £4,500 to be paid in a week. We have declined the payment. In summary some facts: - we already paid £16k to complete the first stage of our extension; - Two builders have evaluated the work done as worth £6,000 - £7,000, meaning we overpaid at least approximately £8k-10k; - My builder has asked us for another £4,500 for ‘work that has been carried out’ as final invoice, which we have declined to pay. We search advice from local council, CAB, trading standard. They all seem to be helpless apart from logging a claim for us. We plan to take legal action to recover our overpayments. But before taking any action, could someone please advise me what I should do or not to do. Any advice is really appreciated! Thank you very much in advance!
  15. Hey, I apologise if this does not belong in this particular sub forum! More than likely I can't do this, but if you've previously accepted a 'gesture of goodwill' payment to settle a complaint... can you actually turn around and say I no longer accept this as a settlement, return the payment to the creditor? Some of these payments made to me are now quite old, but I did accept a recent payment only a week or so ago... This was/is mainly connected to payday loan companies... as i've already raised the issue of unaffordable lending, continued borrowing etc and settled they won't investigate. I made a massive mistake accepting small 'gesture of goodwill' payments, and now the FOS will not investigate updated complaints because of this! It certainly is another lesson learned!
  16. Dear all I would be very grateful for any help with my situation. I had a SPO following mortgage arrears (£3600) in 2008. Since then I have been making my contractual payments but had missed payments on three occasions from unexpected expenses resulting from direct debits being returned unpaid. I was in a particularly bad financial condition in the last 6 months following an elderly family member falling unwell while abroad. The mortgage arrears accrued to £3400 again and the mortgage company ( a subprime lender) has now applied to the court for a warrant for possession. I panicked and raised money from friends and family to clear off the arrears, but the lender is refusing to accept any payments and instead insists that I send them last three months of bank statements before they would decided whether to accept the payments or not. They insist that until I serve them the bank statements, they can't do anything about the eviction and says an eviction date will be issued in due course. They also made me complete an income and expenditure with them over the phone. I am very reluctant to send in bank statements, since with the financial difficulties over the last three months, I have resorted to payday loans (cleared) and I am very worried this will again jeopardize the situation. I am otherwise in a stable job and would be able to afford my contractual payments going forward. I have raised the money and want to clear the arrears but I am left in this dire situation. With family and young children, it looks as if my fate is sealed. May be someone else on this forum would have had a similar situation and I am sincerely hoping for some advice and help. Apologies for the long post.
  17. Would be grateful for any advice. I worked for a driving school whilst going from being a PDI to a fully qualified ADI. I started 1 May 2016 and the franchise fee was £210 per week which I paid regularly. The pupils pay the company and supposedly this should be passed to me. I have received approx. £3,000 but I work out I am owed another £8,000, the company have not paid me since 24 October 2016, I have been in regular contact with them and they keep asking for spreadsheets, etc, of how many pupils I have taught, in March this year they agreed to pay me £100 per day to clear the backlog which lasted 3 days. I stopped paying the franchise fee in March 2017 as I really could not afford it any longer. I now work for another company but when I spoke to the original company they said they owe me £500 but this was 'outset' by £5,000! I don't understand this and they are not providing any evidence. I have worked full time for £3,000 (less petrol and other overheads). Please can anyone tell me how to get help with this. Thank you.

Just a quick one before i jump in and start filling in forms thought i had reclaimed all my PPI years ago, however i recently went through my statement and realized that i had two direct debits to the halifax for a bit i thought it was for the home insurance i moved a while ago - then realized it was morgage protection thinking back i can remember them saying that our morgage application would be looked on more favorably if we took it on... now for the first two years of the morgage this was about £50 a month, until we rang them up as it was really high and they removed things like the illness cover and just left the death policy on it at which point it went to £17.07 - which we're still paying apparently 9 years on is this something that its worth complaining about as i had and still have a death in service benefit of 4x salery (about £100,000), we were told that it was more likely the morgage would be accepted if we took it we're also looking at cancelling it as for the same price we have been offered life insurance at a payout of about £150,000 (vs the £25,000 left on the morgage) is that the best route?
  19. Hi there I am 41 months into a 48 month standard HP agreement. I paid by DD on the nose every month until around the 30 month time, when I became unemployed (no PPI by the way). Since then I have failed to make some payments on time, but NEVER have been more than 30 days late. I'm no angel this I realise but as I type this at least i'm up to date. Every time I fail to make a payment a DN comes out etc etc but I always pay up. As I have 7 months left to pay and my payments are £400 (but the last payment is £550) I should have 6 x 400 plus 1 x 550 or £2950 left to pay. But my credit file which was updated in April says I owe over £5000? The HP company have said this is because of charges incurred for late payments and a home visit which was £75? I checked the date and time on my CCTV and not one person visited my house that day. Are they having a laugh? I advised them that the payments under a HP agreement are fixed and that in October on my final payment they should remove my vehicle from the HPI register - but they said they will not until the full amount on the account is clear. I expect to pay something for my late payments, like I said I'm no angel in this matter, but this is ridiculous; could someone tell me where I stand please?

  23. Hi All... First off apologies if I am asking something that has been answered elsewhere... Truth is I'm in a massive hole and trying to find anyway out (not just with welcome lol) Long story short... Took at a 3rd charge loan with welcome about 12 years ago...it was a struggle from the off... About 3 years in welcome offered us the chance to resign to extend the length of the loan and reduce the payments which we did... Split up with the wife who remained in the home about 6 years ago. For the past 5 years no payment have been made to welcome. Current balance is about £29k. My initial question is that they have never really chased for the monthly payments....the only contact we have from them is a yearly statement and that's it. The debt doesn't appear on my credit file however there is a charge at land registry...does anyone know why this might be the case that they are not chasing us for such a long period of time? House in massive neg eq so am desperate for any ways out Thanks all
  24. Hi Guys I recently took up a job with a local firm whilst out of work. My contract was terminated as the company received a fine from the council for some road signs i had neglected to collect. My argument to this is i wasn't given a A3 map of the roads in question which clearly shows all signs needed to be collected. Any way after the termination of my contract my wages for the week previous and 3 days i worked when i first started as well as 2 days prior to termination hasn't been paid. I wrote to them threatening legal action unless the monies owed were paid but have not received payment. They stated on the letter that they are withholding funds due to the amount of the fine and are trying to negotiate the fine down to a lower value and if they can do that i will be payed a percentage of what i'm owed dependent on the final amount of the fine imposed. I was payed by a separate company owned by the same company and think i was self employed as i had to apply to hmrc for a UTR number. I have since wrote back to them asking for a copy of the fine from the local council and a copy of my signed employment/self employment contract but have not yet received a response. Its around £800 i'm owed and will cost £60 on MCOL. Can anyone advise if it is worth submitting a claim online and what my chances of winning are ? Many Thanks.
  25. Hi All, I was wondering if anyone had any advice. Bit of background, In all my life I have never missed a payment for anything. In May last year I should have paid an electric/gas bill with Npower on a property I was selling. I had a bit of a personal crisis going on (depression) and missed the final bill from npower. I (apparently) contacted them to say i would pay the bill by the 1st June, and then through being in a depression completely forgot. (was for around £180). I then sold the house. The 1st of June came and went. This week I applied for a credit card and was refused. I then looked into my credit file and found that the npower account has -6 months on it since then. (I dont think they actually issued a default notice but im not sure). I contacted them to say there must have been a mistake and they told me i had rang and promised them the payment in June last year (I dont remember this). I Paid this immediately in full, very embarassed. However, we I said i couldnt believe they hadnt contacted me, they said it was because Id agreed a payment date, and all my contact preferences were set to email only..... I never received 1 email, although they said they sent a few. Could someone offer me any advice please as to how to clear my credit file of this? your help would be very much appreciated. regards bruss
