  1. Good evening fellow members. Before the official claim process started I wrote to CPP claiming misselling and asking for a refund of all the premiums paid. I have recently received a cheque for £ 47.00 in the post. I have been paying the CPP credit cards loss insurance cover since 21st August 1992 and I was expected to receive - in due time - a refund backdated to that year. Instead they claim that compensation is due to me in respect of premiums paid between Jan 2004 and Jan 2005 only as prior to then CPP was not subject to an agreed industry standard . They inform that this is only phase one of the claim settlement and that phase two, pertaining to the period 2005-2013, will follow . Should I not have the right to for money back from the very beginning ? Regards
  2. Hi all, i have a debt with arrow global thats is going to fall off my credit report unpaid at the end of october. The thing is i have an unpaid ccj from 2007 from Bryan Carter for a partial amount of the money owed. I am not being chased for this money but am happy to pay the ccj but not willing to pay arrow global the rest of the money as i think it was mostly missed payment charges etc. So will paying the ccj activate the statute barred debt with arrow global? Thanks for your help
  3. Hi All My situation is very similar to others who have recently received Claim Forms from HL Legal on behalf of Sigma who are claiming "part of monies due....." The POC is exactly the same as the others I've seen in the last few weeks on here and is asking for £299.99 plus court fee and solicitor's costs with a total of £364.99. This relates to an M&S Credit Card which was upgraded from a Storecard and I'm pretty sure they are on dodgy ground with this following the recent case involving a Harrods card. I've completed the Acknowledgement of Service on line and stated that I intend to defend the entire claim. Although I have a copy of the original "application form" on which this claim is based (they refer to it as an agreement) I will be sending them a CPR31.14 request and advise everyone else in this situation to do the same. I will also be advising HL in the same letter that: (a) the account was in dispute and so should not have been assigned (b) that the "agreement" they refer to is unenforceable in that it does not contain the prescribed terms © that Sigma have no legal right to action as the debt was not assigned correctly During the days when M&S were handling it they also sent at least two Default Notices which were faulty in that they did not allow sufficient time for redress. I agree with others on here that this is Sigma just shaking the box to see who will easily cough up £364. They've been sending out loads of these claims. I reckon they will back off once they see a defence will be or has been lodged and when they get my letter. I was tempted to ring them and ask "without prejudice" of course for clarification of their intention behind claiming for only part of the monies due and enquire whether this meant that if their claim was paid that they would officially call it quits and write the rest off. However, I think this may be too risky.
  4. Hi all, I have five debts, all around the 2k mark, I defaulted on them in 2007 and then moved overseas. I have been paying all the DCAs 5 pounds a month since then, but haven't been in contact with them at all, other than to check the current status of the debts recently (they are all basically laying dormant collecting the monthly amounts quite happily). They all have defaults but no CCJs. I am in a position to pay these off now as partial settlements, but I have a question that hopefully someone here can help with: Will the mark of 'partially settled' effectively 'reset' the debts on my credit files and keep them active on my account for another six years ? Or will they still drop off in 2013...which is six years from the date of the ORIGINAL default ? From what I understand, in 2013 the credit file will be completely blank again so it doesn't matter whether I pay them off fully or just partially, is this correct ? I also have a student loan from the year 2000, does anyone know if these are recorded as defaults on credit files ? Thanks
