I got my p45 from old employee company on 31st of july and new company took over on 1st august at the same work place but the new company never asked for p45 I did have a sheet that asked about hmrc if I got another job which I ticked but im after finding out as Ive been transferred will I get taxed due to not giving them p45 which I wasn't asked to give and theres other staff that wasn't told either
  2. Hi The company i used to work for has closed down, I do not have a P45 to claim benefits and I am unable to contact them by phone or in person. The company no longer exists, theres another shop there instead which has opened up. I only have payslips from December 2017 which is another company i used to work for (and I was paid cash-in-hand). These small busineses did not give us payslips but only when we needed one and asked for it they would supply it. Will I able to get universal credit if i dont have a P45 or payslips ? What will happen now ?
  3. I left work in March and I have contacted payroll who have failed to issue a P45. They also said I won't get a P60. Their explanation for this was because of the time I left . Can anyone explain this to me ?
  4. So in April 2015 I walked out of my job. My boss posted me my p60, which I thought was all I needed, However now I am trying to apply for ESA due to health conditions and I am told I need a P45 form. I asked my boss for a P45 and she said she sent it with my P60, but I know for a fact I don't have it because I keep all forms like that in a drawer and I have checked for it multiple times. What can I do? She swears blind that she has given me it already, and without this I cannot finish my claim, also from what I gather you cannot get a replacement form.. HELP
  5. Hi, First of all, thanks to anyone who responds as I'm quite confused with this issue. I previously worked for a company for a short stint of time (2 weeks, 3 days), paid a gross salary of £1,200. I received a net pay of £911.28, which included a £60 student loan deduction. Since leaving that company, I have received no P45, however as I was under the tax allowance for the year any tax I paid was deducted. The problem arises when I have received a letter from the student loans company. There is no 'credit' into my student loan, just debits (where I received maintenance loans). Firstly, has my employer not made the deduction as stated on the payslip? Would this be illegal? It came to my attention as I have just received the student loans company letter, and when contacting HR at my new office, they said they are contacted by HMRC to pay my loan. I cannot imagine HMRC doing this within 2 weeks of me starting at the previous post... Stupidly, I've misplaced the payslip when moving house. The previous employer did not provide me with a P45, so I was wondering if I contact them I could get a replacement of the payslip or the P45, and if any of those would show deductions. I received a tax refund from HMRC as I overpaid while I was at the previous company (was on incorrect tax code), so I know that they received my P45 as I spoke to them on the phone about my pay. Will they then also have a copy of my deductions? or just gross & net? Thanks.
  6. Hi all. I was claiming ESA from April last year until a week or so ago and have now got a new job and I start the training on Tuesday. I need a P45 but how and where do I get one from? I don't have one from a previous employer as I was a carer for my Grandmother but dont see how I can have what I need by Tuesday, especially as its bank holiday. What do I do? I didnt know I needed this until I came back from the induction today and everywhere was closed. Thanks in advance!
  7. Hello everyone, I'll try and keep it quick as it is a bit of a headache. July 2014 started working for a small local business. No contract signed. Dec 2014 found out I was pregnant. Jan 2015 told employer I was pregnant. We discussed my Maternity Leave starting on July 3rd. I tried to make all of my maternity appointments on days I was not working, even changing midwives. Due to my health this was not always possible. I had a few sick days in Jan / Feb due to pregnancy illnesses and depression. Feb 2015 prescribed 25mg Amitriptyline which was doubled to 50mg after 7 days. Also prescribed Codeine and referred to a physio for PGP. My boss knew all of my health issues. 16th March signed off for depression from 16th-23rd March. On 23rd March my boss text me to ask why I wasn't in work, I tried explaining that the sick note was inclusive of 23rd and I would be back following shift which was on the following weds. He said I was wrong and phoned his gp who said I should have been back at work that day than phoned my GP who said my next day at work was Wednesday. The text messaging went bck and forth for a little while and actually made me very ill that day. I went back to GP that day who was not happy my boss had phoned his surgery and signed me off again and said it was inclusive of dates and if I didn't feel any better by following Friday than to go in and see him again. 23rd March signed off for depression from 23rd - 30th March. Friday 27th March went back to see my GP as my depression was getting worse and Amitriptyline was doubled again to 100mg. Text my boss to say I had been signed off for another 2 weeks (27th March to 10th April) I text my boss to say I had been signed off and he text back saying he needed sick notes that day and I also needed to phone him. I phoned him that afternoon and he said he was in a bit of a predicament and he either needed to reduce my shifts to one day a week or lay me off. The discussion ended up going in the direction of me being 'laid off'. I specifically asked him if I was being fired or made redundant and he said 'no, you are being laid off. it's different'. The conversation was quite amicable, he knew I wasn't well and I think he was genuinely concerned for my health. I said on the phone I understand his situation and I would be leaving soon to go on maternity leave. There was no discussion about any notice or when my final day was, I assumed it was that day. On 2nd May I received my p45 in post with a couple of old payslips and a payslip dated 4th April with SSP payment and an overpaid holiday deduction. I have not received this final pay. Can I ask him to send me this in a cheque? We used to get paid cash weekly on a Friday for hours worked that week and I was once paid by cheque as he didn't have enough cash on him to pay. The p45 also has my leaving day down as 4th April and is dated 2nd April. I have had no contact with my previous employer since that conversation on 27th March. My boyfriend took my sicknotes down to him on 27th March as I just couldn't face it. I really want to have as little contact with my previous employer as possible, the whole situation made me worse when I was already quite ill and I am starting to get better and don't want to do anything to knock me back down or affect my health or the babies health. Can I text him to ask him to send me a cheque for the final pay amount? I really don't want to talk to him as I have been worrying since I got my p45 on Saturday. I didn't even realise I was owed and SSP and tbh I could really do with it now as I have no income until I get my Statuary Maternity Allowance in a few weeks. Thank you all for reading my post x

  9. Hi, All I have not received my P45 from my employee from over a year ago. I asked again yesterday and they said go through a solicitor and they do not want to talk to me. It states on the HMRC website that your employee must give you your P45 by law. I do not think it is fair to go through a solicitor and pay out money to get it. Is there another option for me to get my P45 because the amount I earned is different from what they submitted to HMRC. They said they paid me a wage that works out almost double my original wage and two payments in month. No money went into my bank account. This situation has made HMRC stop all our tax credits and they have instructed us to get our P45 from our employer, but they will not give it to me. Any help will be appreciated. Thanks in advance
  10. Hello, so I have a little problem and I would like someone to suggest me what to do in a case like this and if there is ANYTHING I could do at all. So I was working for "GI Group" recruitment, M&S warehouse for like 5 months or something. Then I needed to leave the UK so I have left the job. I asked what is going to happen with my holiday days which I haven't used so they guaranteed that I will receive the last weeks salary next Friday (01/08/14) and a payment for all the holiday days plus p45 (on the same or the next Friday from when I will receive the last salary). So last Friday I have received the last money for the last working week. But I didn't get paid for holidays nor p45. So that means I should receive it tomorrow yes? But yesterday I should have received an email with my payslip showing how much money will I get for my holiday days, but I didn't receive it. So I don't think that I will get my money and p45 tomorrow. And its quite a big problem for me, now I'm in other country and I don't know what should I do, I don't want to lose my money. I have called the agency but they told me that they don't have any recordings about me since I have left the job. But the guy told that he will try to sort it out (but I highly doubt, because people who did have problems with payments, could never fix it) and I should try to call them tomorrow. So what should I do if I won't receive the money nor p45 tomorrow? And if they will tell me that there is nothing they can do? Is there any other place to complain about it or reclaim my payment for holiday days without going back to UK? (the same thing is with my partner, we have worked in the same place... ) (Sorry for my English because I'm not British, hope you will understand ) Thank you.
  11. on reduced hours from job and now unable to pay loan back in full arrangement made with them for reduce payment with interest stopped. all done nicely . have today rung them to imform them that my employment has now ended and that payments will need to be £50 per month until back in work. they said will send out i & e form to fill in i said ok i will fill it in with zero's as i will have no income they have agreed to put a hold on the account for 38 days BUT i must provide my P45 :lol::lol:
  12. Hi, I am working out my notice period but in error, my employer has already notified HMRC that I have left and I have received my P45 in the post during the week. I asked them whether I'll get an updated version when I leave but they said as they've already notified HMRC, they won't send another. Is this right and also are there any major implications if I just keep this one in terms of either my final pay or tax codes for new employer, etc...? Also, does this technically mean I shouldn't be in the office!!

Concerning the issue of whether we are a casual worker or a an employee there is many criteria to consider for example the time we work for the employer, our skills, whether he employs us only in case of shortage or during peak time or he uses us in the normal running of our business...etc. However I would like to know if the conclusive evidence is not when the P45 has been issued because if it has been issued one year after the start of employment this means that we are now an employee. It is up to the employer to decide if he need us anymore or nor and as a consequence if he send us our P45 or not. If the employer decides because it is not convenient for him not to issue a P45 at the end of each project we could be consider as an employee There is also the issue of HMRC and in order the employer not to pay tax maybe a worker has to work only for a small period of time and not come back for a long time There is also the issue of the difference between temporary employee and a casual worker

Hey guys, A quick run down of the history of this situation: - Started employment in January 2013 at a relatively new web development company - Began going downhill and it had an impact on my mental health - Fought on, but resigned in October 2013 - giving extra notice up until the last working day of December - Four weeks later I was taken ill, informed my Project Manager and within 2 hours I received an email that said I'd been a brilliant employee but as of immediate notice my employment was terminated. This was allowed as I had worked my 4 weeks notice. --- I immediately contacted ACAS and pointed out my contract stated a minimum notice period of 6 weeks, and was informed this was unlawful dismissal.I calculated holiday leave and ensured this was paid. I informed my previous employers that ACAS were interested in the timing of my dismissal with regards to my health, that they felt there were grounds for action for Unlawful Dismissal, and that I was due holiday leave. After a very quick change of tone in the emails I backtracked, out of sympathy as the company has gone down the drain with everyone leaving, and informed them I really didn't want to cause any harm - I enjoyed working there and liked everyone as colleagues and as friends. As such I was going to overlook the dismissal issue and presume it was done in my best interests, and that by paying me up to the end of the month they were paying my holiday leave off anyway. (I was nice. Possibly wrongly, but within 4 hours of them telling me I had no job - I had an offer for the next week.) I then asked for reference(s), preferably one from each director; and highlighted the fact I had hardly received any payslips throughout the 10 months I was employed there. I also requested my P45 - they promised this would be done ASAP. --- The next week I still felt like I'd been dumped on, and was rather annoyed to see that despite starting a new job - and despite the fact that they had terminated MY employment with NO notice - I had emails and missed calls; asking for assistance on a project! If they gave me the grace of ONE DAY then they would've got all my handover documentation. It wasn't a malicious decision, but I thought it was best to not answer the calls during my new office hours - and I genuinely felt uncomfortable about assisting them voluntarily. (I had signed a Non-Compete Agreement with the new company after all...!) Unfortunately, as I had followed their instructions to the letter and returned the company macbook pro in the state I received it - newly formatted, there was nothing to be gleaned from this device either. It was after receiving the macbook pro that they stopped all communications. I know full well that there was no data on the machine, so there is nothing that would've reflected badly on me. Had I not formatted it then the only things that could've reflected badly would've been job posting bookmarks anyway. (Besides, it had an encrypted home directory and I never shared my passwords.) Over the next few weeks I realised I still had access to client data, so removed my access to any of it - this was a concern of mine when I realised some of the people who still had access to the data hadn't been involved in the company throughout my whole time there. Knowing this was probably an issue as per the DPA.. once again, I felt uncomfortable, but wanted to leave on the best of terms - so turned a blind eye. -- It's now week 7 and I have received nothing from them; they have, to put it bluntly, shirked their responsibilities and broken their promises. I feel like an idiot for being nice and feel as though my (attempted) act of kindness just gave them an excuse to try and take liberties. Any ideas of where to go next? I'm on a business trip to Sweden for two weeks soon, and want this sorted out as soon as possible really. It's worth mentioning that I have recently cleared my finances out and I'm saving for a deposit on a flat with my girlfriend: but of course, I have no proof of income beyond a December payslip. Additionally, I'm being taxed heavily (according to my new employer, although I didn't notice anything) due to submitting a P46 and not a P45. Annnndddd lastly, I needed two references before I even started this job; but it appears my work has been reference enough - however I am aware that this could crop up in the next two months during my probationary period and cause me issues if they then request them. I'm thinking of emailing them both (read; the other directory too; who poured inheritance in to this venture - just to see it wasted away by some curious decisions that he refuses to get involved with) and informing HMRC tomorrow. (Although I was waiting 30 minutes last time I tried to ring HMRC...!) However I'm beginning to consider whether it may be worth scraping the niceties and bringing up the Unlawful Dismissal and the health issues once more; I let them go in order to save a good friendship and so as to help keep some life in that company: but I've achieved nothing. Sorry for a bit of a rant, thought it best to try and explain as much as possible! Cheers guys!
  15. Hi everyone I recently left my job to start a new one. My previous employer claims i owe them money for holidays taken i was not entitled to. They worked holidays out in hours. I was contracted to work 37.5 hours a week, but they took 8.20 per day from us which i dont think is right as they took 41.40 hours for 5 days when surely if i am contracted 37.5 thats all they can take? Anyway they say i owe them over £1000 for 80 hours leave!! This is ridiculous and i am in the process of working everything out. The employee handbook (which i was never given but is online) states: If, on termination of an employee's employment, the employee has taken paidholiday leave in excess of the earned entitlement, they will be required to reimburse the company (by means of deduction from salary) in respect of such holiday I understand that what they are saying is if i owe them money they can deduct it out of my final salary, which was one day plus i was due a tax refund of over £300 which they say they are taking for the alleged overpayment. However they are also withholding my P45. They have said i cannot have it until i have paid back this money, but surely this is a separate issue? I would be grateful of any advice on this.
  16. Hi, I have been on incapacity for a while, for depression and back problems. I have been doing some voluntary work, and tentatively looking for work to get back "out there". Well, I have now been offered a job! I think I am well enough to do it, its not physically demanding so will not affect my back and I think my depression might be less if i had a reason to get up everyday! But how do I get off incapacity benefit? Do I just ring them and say I have a job? And what happens about getting a P45? I will not be financially better off, but I would rather be working and boost my confidence and self esteem. Help!!
  17. Hi guys, I was wondering if someone can advice me if im wrong but here the situation. I left Giant and received a P45, but there was overdue payment that was processed after my end date and ended up paying extra 2 thousand pounds in Tax. I'm a limited company now, any my accountant is asking me for an up to date P45 to claim it back for me and Giant is asking for a fee. Is this right!??? what do i do...
  18. Posting this on behalf of a couple of friends of mine who ran the UK office of an overseas business. There was a major falling out about 6 months ago and one of my friends was dismissed and the other resigned. Both had their hands forced but in order to bring the whole sorry saga to an end, they went along with it. Anyway, one of them has now received her P45 etc but it was all filled out wrong - including her date of birth! She has asked for the correct documents but the UK solicitor has not been paid by the head office and will therefore not now talk to her. The other friend who was dismissed has not received any information whatsoever and has no P45, P60 or anything. Can anyone help point me in the direction of the legislation that they can quote to try and resolve this? Many thanks
  19. Hi I am really hoping someone can help me understand why, whilst my husband is at the appeal stage (after been declined a transfer from incapacity benefit to esa) has he today received a P45? My husband has been on long term sick due to depression, anxiety and stress (I am really beginning to understand the condition, since all the above kicked in). Can anyone advise us why the above has happened and what we need to do next? Thanks
  20. Hi I was asked to leave my employment in July after one month. To date I have still not received a payslip or P45 from them, despite repeated requests. I have contacted HMRC and as they never submitted the P46 I completed they are unable to assist me any further. ACAS are unable to assist as it isn't a tax matter. Any further advice?
  21. My partner had to leave her job in mid-March this year, due to family illness and childcare issues. I wrote to my local authority benefits section to advise of our change of circumstances, and to ask what documentation was required for reassessing our benefits claim. A good 6 weeks later, after chasing it up, I received a letter stating I had to provide "bank statements, etc", very vague. As we were waiting for my partner's p45, we did not send documentation in. In May I received a letter stating our benefits were being suspended pending receipt of p45, bank statements, etc. In June I received a letter to say our benefits were cancelled. Now I know I should've taken action sooner, but I've been burying my head in the sand, and have actually been off work through stress, and that's the vicious cycle of debt and poverty. Despite contacting her old employer several times, and them trying to blame it on their accountant, my partner still hasn't received her p45. What can we do?

I left my job 3 weeks ago, we didn't part on good terms and when i went to see them for my final pay, i got into an argument with them and they were saying that i owe them money as ive taken too much holiday. I still haven't received any payslips or my P45 which they originally said they would post, this was before the argument. Can they withhold this from me because i "owe" them money?
  23. Hi everybody I need your help, but first of all sorry about my english... I am french and i lived and worked in UK for 3 years in march 2010 i decided to move back to France so i resigned from where i worked, received my last payment but not my p45 In france i kept asking to my ex employer for my p45 because i needed it in france otherwise i couldnt find a job! but i didnt receive it June 2010 my ex employeur sent me a salary of 1200 pounds??? i called them asked them what it was?? error from them!!! I sent it back and asked for my p45 July 2010 still no p45 but another payment of 1200 pounds i called them again...error again and i sent back the money! August 2010 still no p45 yet another 1200 pounds in my account this time i called them but i keept the 1200 pounds! i want and need my p45!!!!! but nothing...today we are end of january 2011 and they ask me for the money and more apparently i havent sent them the one of july!!!! 2400 pounds!!! what should i do?? i dont wana send it because i havent got my p45 and if i wasnt honest with them they wouldn't have known! i want to ask them to pay 50 euros per month + bank fees in france...they'll get the total money in 2015! but is it legal? and is it legal from them? i mean what about the taxes in that salary, how did they justify to keep paying me after i left?? help please!!!! i am in france now and i dont know what to do!!! thanks a lot for your help!
