  1. In August i picked up a friend by entering holiday inn carpark, in the morning to take her out for the day. In the evening I dropped her off in same manner. I didnt park and never left my vehicle. A week later Parking eye sent me a fine for parking for 13 hours! I wrote a simple letter back explining the above, and included a voucher for crossing the Severn bridge TOLL as we were in wales all day, and thought no more about it til court papers arrived a fw weeks ago! I sent the same info to the court explaining above and again as it was done online, I told them I had the voucher copy etc Today ive received another letter from PE saying they are pursuing the court claim as they have no evidence at all of me leaving the carpark and returning in the evening. Ive enquired with the toll company if they have cctv of my vehicle crossing the bridge but sadly they only keep their cctv 90 days so I see no way atall of "proving" I wasnt in their carpark. Any ideas? Desperate!
  2. Hi all, Legal n00b here, and wouldn't want to give too much info for fear of spying eyes!! I currently have a MCOL case where I am the claimant, that has recently been transferred to the local courts to sort out. Mediation was tried, but the courts could either not get in contact with the defendant to sort out dates, or she, (or her solicitor) could not supply the courts with suitable dates. The case has now been transferred to the local courts, which happens to be 200 miles away from where both I and the defendant live. It has been transferred to the court that is local to the defendant's solicitor. The defendant/defendant's solicitor have not been entirely reliable or quick in their responses to both myself and the courts, sending the DQ back only after she received a stroppy reminder from the court. I was never copied in on her Directions Questionnaire, so have only just found out that location is where it is when the Courts told me it had been transferred. I also have no idea if the defendant will even turn up, does she have to or can she get her solicitor to act for her? My main question is if I win the case, can I claim for expenses for overnight stay/fuel or train ticket prices for myself and my 2 witnesses to journey up? I understand that a court will always be assigned to the defendant's local, if she wins, might I have to cover the cost that it takes her to get up there too? Perhaps we could all lift share Thanks for any help, I'm sure other questions will crop up as the case goes on. Cheers
  3. Hi We own a business and have a couple of staff, but have had some post in the name of someone not on our staff and not us. Our apprentice opened the post in error one day and we found debt demands from a catalogue company we contacted them and advised them of this. now the letters are starting again but don't know what to do and are not sure how it can affect our business or us. This is nothing to do with us really could do without the stress of it all as my wife has been ill and this is making things worse. Please can anyone help or suggest how to stop this. Much appreciated.
  4. My Northern Rock/NRAM mortgage has been reviewed. Letter 1 says they have overcharged me, and have knocked £940 off the unsecured part of the Together Loan. Letter 2 says I have underpaid the unsecured part of my Together Loan, and they want £153.15. 1) I have never missed a payment. 2) WTF?
  5. Hi I had an interview for a job today that I only heard about last Sunday, before then I had already accepted a job offer to start next Monday 1 December. After going for the interview today they didn't indicate either way if they wanted me or not but just suggested I delay the other job start date to give them more time to consider things. Should I just tell them no or is there a chance I could also use this to get the other company I was due to start with to up my salary or benefits? FYI these are both entry level jobs paying just over 20k so I'm not a senior exec 2 companies are desperately fighting over or anything.
  6. Hi all. Last Friday we became aware of our kitten having an abscess located above his anus. When we took him to our regular vet he drained the abscess and flushed it before leaving it open / supplying a cone. The vet told us not to let the cat lick the abscess and gave us painkillers to give with food once a day. Last night we observed blood on the floor where our kitten was sitting. On inspection it looked like the abscess had torn down to/ onto the anus. Concerned, we called the emergency vet for advice and were told to bring him in. We did so despite the quoted call-out fee of £170.00. Upon arrival and examination the emergency Vet offered to stitch up the abscess there and then or for us to wait a few hours until the next day then have the same surgery performed. We asked what the emergency vet what she would recommend and was told it would be best to leave him with them overnight so they could go forwards with stitching up Kalli's anus/ abscess plus issuing stronger painkillers. My mother paid a deposit of £250.00 up front as requested then paid a further amount to bring the total to just over £500.00. This morning we contacted our regular vet who expressed dissatisfaction with the treatment given by the emergency vet, stating they shouldn't have stitched up the wound. They said this, explaining, that there is a high chance they will need to undo the work done to Kalli by the emergency vet as this had a good chance of making his injury worse with time and expressing the opinion that over-phone advice was the only thing that should have been provided with the reason being that it would only be a cause for concern had the cat been female. Kalli is a male sphynx. Our kitten is not insured, which means whatever costs are incurred are our own faults for not being prepared - I am aware. I am willing to pay the consultation fee that was required by bringing the cat in and even for the extra painkillers - however, being charged for a surgery/ treatment that was entirely unnecessary feels wrong. We plan to ask our regular vet to put the professional opinion he gave us in writing however I'm really lost about how we can proceed after that. Does anyone have any experience in this? Please help!

  9. Hi All Last week my wife's PIP claim appears to have been sorted and according to the woman I spoke to on the phone she has been awarded standard rate for both care and mobility. So we are glad it seems to have been sorted but so far we have not had written confirmation of the award so have put the payment they made aside just in case they say they made a mistake. Anyway, While I was browsing the net I came across Carer's Allowance and that it is a benefit that can be paid as long as you get either rate of PIP care (it also apparently applies to DLA and some other benefits). Now I have taken some time to look into this and I seem to have conflicting information with regards as to the receiving Carer's Allowance (CA) and its effect of other benefits like HB and CT. Now I am is self employment but my earnings after costs are in the region of £90-£95 pw after all costs have been taken into account so according to the rule that I cannot earn more than £102 pw I should qualify for it. It the effect it would have on HB and CT that I am unsure of due to conflicting information and this is where I really would like to get some clarity. So if anyone could shed some light onto this possible effect on HB and CT it would be appreciated. FYI: Earning after costs of £92.50 (average), Receive WTC, CT, CB and now PIP standard for both care and mobility. We live in adapted social housing (Tenants Association) underoccupied 2 spare bedrooms Have no savings worth mentioning (£150) If someone could just try to clarify the HB and CT effects as even my landlord if iffy with information.   10. Hello there, First of all, I'm a 27 year old man, I got my self into debt a long time ago which screwed up my credit report completely. Fortunately for me, the debts were removed and my credit report cleaned up a little, but still couldn't get credit from anywhere. I then did something stupid and started taking out loans & contracts with the permission of my family using their name but due to losing my job, I cannot now afford to pay these bills and neither can my family. They are now being hounded by debt collectors agencies and it's causing me sleepless nights and my family won't even talk to me. What can I do to stop this nightmare? I owe around £2000~ in total, but none of that being in my name and I have around £40 spare every month. I know what I did was completely stupid. p.s. I was made redundant and I'm looking for a job, but I have no money income at ALL. Thanks for any help..

  12. I was recently rehoused by my local council as part of the homelessness prevention route, I moved in last week. However, since I have moved in I have had nothing but problems with the upstairs tenants, they make constant noise (not music) but banging around constantly and just making lots of noise all the time and this carries on until up to around 1am-3am or later sometimes. The previous tenant complained about them but I was informed before I had moved in that it had been resolved, it's classed as a private let but the council is involved in the tenancy as well. It's in a very unpleasant area, it's in a block of around 12 flats, some of them are unoccupied but the tenants upstairs seem friendly with quite a few other tenants which concerns me as I reported them to the Landlord. The Landlord got back to me yesterday stating that he had reported it to the police and the anti-social behaviour team at the council but will they actually do anything? also, because they are friendly with some of the other tenants they will easily guess it's me complaining with me being downstairs and with me having only just moved in. We have non-secure tenancies so they can be evicted easily and they have been reported before so really I think they have had a second chance and blown it and they should be evicted but I doubt that will happen. They are also running up and down the stairs very regularly and have lots of visitors banging on their doors so I don't know if any illegal activites are occuring but I feel very uncomfortable in the area and in my own flat. I have taken precautions, I have a panic alarm on my keys, I also have a panic alarm on the wall next to the flat door, there is also 4 big locks on my flat front door which were already there so I'm presuming there has been problems there before. I am just very worried, luckily I am not back there until Boxing Day as I am spending Xmas with friends and family. Any advice you can give me? Thank you.

  14. I'm currently helping a relative defend a case that was brought against her from a plumber who carried out sub-standard and unsafe works at her property. The Claimant is being represented by a Solicitor, The Defendant is litigant in person. The court proceedings are well on their way - hearing is scheduled later this month and both parties have now submitted their court bundles to the county court. To be fair things are fairly straight forward - the Claimant has openly admitted to failing to provide a notice of right to cancel (cooling off period) which should make the contract unenforceable anyway as per The Cancellation of Contracts made in a Consumer's Home or Place of Work etc. Regulations 2008, plus they are in serious breach of The Gas Safety (Installation and Use) Regulations 1998 which has been confirmed in writing from the local Building Control Department (they didn't inform the Gas Safe Register either!) Anyway, what I'm stuck with. In the Directions Questionnaire completed by the Claimant, it states they intend to rely on only one witness (himself) in court. However, upon receiving the Claimant's court bundle there are also an additional TWO unsigned witness statements (aka: a feeble character assassination attempt). Is the Claimant allowed to a) change the number of witnesses at this short notice and b) provide unsigned witness statements (with a view to getting them signed and sent to the court a few days before the hearing)?
  15. I live in a smallish village and visited my biggest store which is a COOP. An hour later I had to go to a Bargain Booze to get a tin of cat food I forgot. Both these stores were absolutely freezing when entering and the staff were wearing wooly hats, scarves and fingerless gloves. It was warmer outside than instore. Because I live in a village these store are not huge so about a third of their size are fridges and freezers stocking goods, which adds to the cold. However, I've not noticed this in previous years, as in, even in mid-winter, the heating of the store usually compensates for the chill outside and the internal fridges and one doesn't really notice it as it's regulated to be comfortable for staff and the shopper. Today was exceptional in these stores, it was absolutely freezing in both with winter hardly beginning yet. Both stores said their heating system had packed up. Anyone else suspect this is rubbish and they are just saving on fuel bills? The COOP group are in trouble as a whole, are they going bust?
  16. Can anyone offer some advice please. Until a couple of years ago I owned my own house and ran a successful business in Essex. I also bought 4 properties in the north of england which were rented out and managed by an agent. They all have mortgages on them. Due to the recession my business failed and rather than go bankrupt, I sold my house to pay off my debts and now live in a rented flat with my wife. However the houses are all in negative equity and the rental income just about manges to pay the mortgages and agent fees. I am 60 and have been unable to find any employment that is not zero hours and have not earned anything in over 6 months. My wife has a part time job which doesnt even cover our rent of £750 per month. We have now gone through nearly all of the money we had left from the sale of our house, down to under £2000 now . Would we be able to claim Housing Benefit?

  18. Hello everyone, First of all, many thanks to all the people that created CAG and the huge work that I can imagine has been put into it. My name is Carlos and I'm from Spain. I lived in the Republic of Ireland (Dublin) between 2005 and 2006. I borrowed a total of 30.000 euros from Bank of Ireland + Tesco and credit cards. That was for an investment opportunity I was offered at that time, which unfortunately went really bad and I ended up without my investment capital. I stayed in Ireland for another few months while I tried to explain this to my creditors. I tried to extend my initial 5 years repayment plan to a 15 years repayment plan, but they didn't accept it. My last payment to all creditors was done in the beginning of 2006. I found a job in the UK in the same year and after moving over here, I never heard from them since. My personal situation and finances have not improved in a way that I could afford to repay this debt. I would like to know if they could have taken me to court in Ireland while I was absent and if so, if they can get an european cross-border order from an Irish court to enforce this debt over here, if they ever find me. I have checked a few threads, including this one: Republic-of-Ireland-debt-being-chased-in-UK Is my debt statute barred already? Even in the event they have an order from an Irish court? I saw on the internet that debts in Ireland are statute barred after 6 years too, unless they have a court order, which would then allow them to chase the debt for a period of 12 years. "If your creditor gets a judgment, then, in general, they have 12 years in which to enforce that judgment." Anybody could pls shed some light? I'm really worried that find me here and ruin my life.   19. Hi All, Thanks for taking the time to read my problems. Hopefully someone will come along and offer some advice. I had an accident in DEC 2011. It was snowing, i indicated and started to turn right into a side street. The car behind me wasnt paying attention and slid into the right hand side of my car damaging both doors and writing the vehicle off. the defendants car suffered damage to the oassenger front wing and wheel. At the scene we exchanged details and the defendants passenger signed to say that there car was at fault. I have been dealing with the most incompetant insurance company EVER. for the last 18 months I have been hitting a brick wall trying to sort this mess out. The defendant has said that they are not at fault and said that we were traveling the other way and i pulled out infront of her. Her solicitor have disputed the evidence that her passenger signed at the side of the road because it took my solicitor and insurance company 13 months to send it to them. The defendants witness statements have major differences in them. (at a quick read i have counted 8- ranging from the reason of travel, the damage to my car, the damage to her car, the weather conditions etc) I have pointed these differences out to my insurance company who refuse to ask the defendants solicitors why they are different. I originaly complained about the poor service and fact they had not sent the signed admission of liability to the third party in Jan of this year. The complaint was closed because 'it was unjustified' The county court trial date is set for Monday the 17th. I live 300 miles away from the county court where its at and have been told that i cant claim expenses etc for attending. I think the hearing is for 10am. It would take me 5 hours to drive down for the hearing and cost upwards of £300 for the total journey. im so frustrated because I know that this should have been a simple case with the 3rd party signing and accepting liability. but the errors by my insurance company have made it complicated. What Can I do? my legal advisor doesnt want to know, and i think to be honest she couldnt care less what the result is on monday because i have given her a hard time. Any help would be greatly appreciated. I cant sleep on a night from worrying about whats going to come of the hearing and how much my insurance will go up as a result of there incompetance. Thanks
  20. Hello, Last summer I defaulted on a credit card (Card 1). The debt was passed to a DCA (starts with a C rhymes with Luger) . After 9 months of them ignoring my correspondence and offers to settle, I reported them to FSA who are undertaking an investigation. The DCA has now passed debt back to Card 1. I received a copy of my settlement letter to the DCA from a different credit card (Card 2 ) that I hold that is regularly being paid and the debt reduced. Card 2 sent a cover letter stating they could not link this to their accounts. The copy of my settlement letter is date stamped twice and has hand written references on it that correspond to the DCA references. In other words I believe the copy originates from the DCA files and was sent by them when they handed the debt back to Card 1 or Card 1 have sent it on. I never written to Card 2 so I have not sent the settlement letter in error. If my settlement letter has been sent by DCA or Card 1 to a third party (Card 2 ) without my consent is this not a breach of FSA guidlines, Data protection etc? Would appreciate advice before responding to the various parties. This is my first post, but these forums have been a lifeline in helping me to work towards resolving these issues.   21. Hi. I`m self-employed (wife is not working), looking for new contract but no lack during last two weeks, so decided to claim JSA. I`m in receipt of WTC and CTC. should I let tax credit office know about my recent JSA claim or DWP would let them know and they will stop my WTC? (as now none of us is working). I`m still looking for work but there is nothing I could get. also I`m due a payment for work I done (invoiced 09/04/13 and 18/04/13. knowing guy I was working for I`m expecting payment sometimes in MAY don`t even know when. should I let them know about this? and how would that affect my JSA claim as it would be, if anything income based JSA. right now I`m using my credit card and money coming in for those invoices would covermy debts when I get them. one more thing as I made joint claim (now my wife can look for work as well, more chances to secure it), and my wife used to work as employee will that be possible to use her contributions to pay mine JSA?

  23. Hello, not sure where to post this?? I work in the health service and my friend works for a localauthority. We have pooled our skills and experience and started a businessoffering social care. As we have worked in this field for many years, we haveseen that we can help to fill the gaps and deliver a service. In a nutshell, my friend’s employers have suspended him onthe grounds that he has not declared a conflict of interest and that he wasoperating our business while he was being paid to work for them. This is basedon private emails that I have sent him to his work email. All rubbish aseverything has been done in our own time. Any emails I sent him were forinformation and updating purposes and general chit chat. What makes it worse is that when he tried to approach hismanager about what we are doing they refused to speak with him about it. Thereisn't a conflict of interest because our business will be to support localauthority's to perform their statutory duties and responsibilities. They have used this information that I have sent him andapproached clients (who are over local authorities) of ours as part of theirinvestigation. They have admitted that they are doing this and that they haveused the information from the emails that I have sent to my friend. They alsoinformed him that they will be contacting other third parties!!!! He was interviewed this week and the majority of theinterview was about 'ME'. They are asking questions about my health as theyfound out that I had been signed off work for a few months and during that timeI had sent him emails. They actually accused me of 'working' while on sickleave - not to me but to my friend during his investigation interview. They asked about my interest in the company, my role, myfinancial circumstances plus a lot of other These questions are none of their business and cannot berelevant to their investigation!! I spoke with my employer and declared what I am doing. I didas we have nothing to hide, and are doing nothing illegal and they have beencool about it as there is no conflict of interest and initially all workwill be done in my own time until things take off. Now, I know that they are totally overstepping the mark andI believe that their actions are likely to cause harm to my business and alsomy personal and professional reputation but would appreciate some advice as towhat and how to approach this please.

  25. Hello I'm 19 and currently caring for my father who suffers from mental illness. I quit education to look after him and the job requires me to do a lot of work daily so i decided to start a carers allowance claim ( in the process now ). I'm just wondering though would i also be able to claim income support or any other benefits? Also I travel over 15+ miles a day on train & would like to live closer to him am i eligible rent a DSS property? Thanks in advance for those who take there time to answer these questions
