  1. Hi, I was made bankrupt in May this year and I co-own two properties with my wife. one of them, (the one we live in) has a small equity and the second has minus equity. The second one is being rented out and is the only income that I have. now the trustee of my bankruptcy has written a letter to the tenants that all monies should be paid directly to them. This will leave me with absolute £ 0 income, and they are taking my wife's part of the rent as well. is this legal and is there anything I can do stop them? thanks in advance for any help. Lolli
  2. Hi, Not sure if this has been asked before but i applied for a Sim Only 1 month rolling sim as my contract phone had ended. Is there usually any credit check for sim only plans as theres no searches on the CRA's to say Tesco carried out a check. Anyone know?
  3. I am a newbie so apologies if I make any glaring omissions. I have spent the best part of this sunny afternoon trawling through other threads and my issue seems to fall into a grey area. I hope to learn from your expertise as to whether I should go to the adjudicator. I took a number of items to the Oxfam charity shop in King Street, Hammersmith, which has a loading bay right outside the shop. I remained in the car while my husband unloaded the boot with heavy and bulky items including about 30+ books. We were there for less than a minute. The bay is marked 'loading only' and there is a small sign which I didn't notice stating 'Goods Vehicles Only'. King Street is largely double yellow lines and zig zags, the Google streetview link is on the UK google site followed by: /maps/@51.492575,-0.228324,3a,75y,231.58h,67.81t/data=!3m4!1e1!3m2!1smcMhzPp6Va_8KYEnFC5xFw!2e0 The reason why I appealed initially is: I was unloading 'goods' as my charitable donations have a commercial resale value in Oxfam I have a Mazda 6 (taxed as diesel rather than PLG) which is a five door hatchback with a huge boot - useful as I sometimes use this for loading goods in my shop I had not ‘parked’ in the loading bay. I stopped and sat in the car with the engine running while the car was being unloaded (debateable, I know!) In the rejection letter, LBHF further decreed that this bay is for the exclusive use of “…goods vehicles carrying out loading/unloading…in an area that …provides guaranteed deliveries to local premises”. Oxfam is a local business, I was unloading goods for commercial resale. I found on the LBHF website their definition of "Goods vehicles are vehicles classified as such by the Driver and Vehicle Licensing Agency (DVLA) and the Vehicle Operator and Services Agency (VOSA). The class of a vehicle is shown on the V5 registration document. Private cars, scooters, mopeds and motorcycles are not considered to be goods vehicles." I am unsure I have much of a chance but I wanted to check before I gave in and paid. In the Notice of Rejection, they have given me 14 days in which to still pay at the reduced rate but if I go to the adjudicator, then only the full penalty will apply if I lose. Hope you can help

Paul Cowdrey from Rochdale said his home, part of his late father's inheritance, is being sold to pay a £130,000 legal debt owed to a solicitor. He said he complained to the Law Society about the amount of hours he was being billed for by solicitor Michael Sandler. Mr Cowdrey said he was then billed by him for investigating the complaint. Two High Court judges have ruled Mr Sandler was right but the Solicitors Regulatory Authority described his behaviour as "morally reprehensible".
  5. Hi everyone looking for some advice, I have not had a ticket here but nearly did till I saw the residents only parking sign. I then looked much more closely at the road markings for this particular bay, please use street view to let me know what you think, as I believe the line markings are non compliant, but cannot find the "legal" markings for this type of bay.   7. hi - ive heard that if a road is bus only there should be advance warning. What are the rules regarding this? I was driving down corporation street in birmingham approaching an island with three exits. The first and third exits were bus only - and straight ahead was no entry So corporation street is basically a dead end for cars - but there is no warning signs to indicate this in advance of the island. the only bus lane signs are those on the roads off of the island. Is this adeqate signage? Spoke to someone at the council and they said corporation st is a pedestrian only zone anyway.   9. I bought a pair of shoes in July from Clark's for £30. On sale from £60. I tried to take them back today as they have worn excessively in the heel area. I have my receipt. The manager said shoes only have a28 day guarantee and as a gesture of goodwill will only give me a£20 voucher towards a new pair of shoes. I thought everything came with a years guarantee. I also feel these shoes should not have worn so much in the heel area in only six months.
  10. The company I work for has a track record of not really giving a damn about it's employees, until they need something from them. For the past decade or so, every Christmas, the company gives all of the female employees an expensive bottle of wine and gift vouchers for a few hundred pounds. But the male staff get nothing (doing the exact same job by the way). Even a new member of staff (who only started 3 weeks prior to Christmas) got the wine and gift vouchers, and of course she's female. It certainly seems discriminatory to me on the grounds of sex, but is it illegal? I don't mind everyone getting the bonus, but just feel like its a kick in the teeth that only the female employees get it...if we all got a bonus that would be fine. I look forward to your replies.
  11. Hi My paents (mid and late 70's) have an interest only lifetime mortgage which they took out on a 2 year fixed rate. After the fixed rate period it was to revert to Halifax Standard Variable Rate (svr). Shortly before the expiry of the fixed rate period, Halifax wrote confirming the expiry date and telling them they could switch to one of the current fixed rates, as existing customers coming to the end of their deal. I submitted the application for them on line. They were told they would be called. They weren't, so I arranged a branch appointment. At the branch, they were told it couldn't be dealt with there as its a lifetime mortgage and Halifax isn't doing them anymore, but someone from that department would call. They did, but my parents were told that they couldn't switch to a new fixed rate because Halifax no longer does this type of mortgage. They have to either stay on the svr, which is, of course, variable, or re-mortgage - Scottish Widows was suggested. I've checked SW's web site - nothing on there about lifetime mortgages and as I understand it, they withdrew from that market before Halifax. SW do offer the same fixed rate that my parents wanted from Halifax (they're in the same group, namely Lloyds Banking Group), but it carries a £999 fee, whereas Halifax has no fee. However, I can't see why Halifax won't switch the rate. I can't see that the fact that they no longer offer lifetime mortgages is relevant at all. Indeed, their web site specifically has a section for existing mortgage customers and it says that if your deal is coming to an end or you're on the svr, you can switch to one of our fixed rates. No qualifications. The end result is that Halifax is happy to let them stay, but on the svr, even though its a mortgage type that they no longer offer. But it won't let them stay and switch to a fixed rate, because it's a mortgage type that they no longer offer. I can't see the logic and I can't see how this squares with this duty to treat customers fairly which has been bandied round recently. How is it fair to force them to stay on the svr when every other customer on the svr can switch to a fixed rate? It seems that Halifax is trying to force them to re-mortgage elsewhere because they don't want this product on their books anymore, or will punish them for staying by keeping them on the svr. They could save £40 a month on the fixed rate as opposed to the svr, not to mention the peace of mind. The only other lifetime mortgage provider I could fine will charge twice the interest rate. I've queried this with Halifax but have been told that I need to speak to the lifetime mortgage department who don't take calls, they only make calls, so I have to wait 48 hours (only working days count) for a call back. They said its because the department is very busy - funny, since I've been reading in newspapers articles that date from the time they withdrew the product that it only represented a very small part of their business. By the way, my parents were never informed that Halifax was withdrawing from this market and how it would affect them in the future. Again, seems to conflict with one of the six outcomes for the policy of treating customers fairly. Has anyone had any similar experience? I'm thinking of making a formal complaint.

  14. In 2006 I was given a 100% mortgage, interest only. This was even though I had serious debts. The only question they asked was how was I going to pay the mortgage off at the end of term. I replied with a pension (now not possible) I have had letters from the broker asking how I intend to pay it off, but I never replied as I thought it was a ploy to get me on the more expensive capital. I did ask to be switched at one point, but they said I couldn't because of my debts. My mortgage has increased because of arrears and charges, but I am currently not in arrears. I wonder if I have a case for mis-selling, as I believe interest only wasn't the right mortgage for me as it's left me totally trapped. What do you guys think?
  15. Hello, Been renting for a long time. Moving to my own new mortgaged property now. Tenancy from approx Oct 1997. Don't think the deposit scheme applies to the tenancy agreement as it was started before deposit legislation kicked in (if you know otherwise let me know). Now - I only want my deposit refunded in cash. LL says happy to make bank txfr but I will not accept that. Can I legally insist that I will only accept cash? There is no provision on the tenancy agreement as to how it should be refunded. Anyone know the situation? Many hanks. Doc

  17. Hello. I need some help. Today I got paid as usual at the end of the month. I have been working for a big retail firm for nearly 2 years. I transfered to another city 4 weeks ago. The pay I recieved today was 25% short. I phoned my base office and they told me that for 1 week I was recorded as absent, and this isn't the case, my new manager in the new city phoned base office and told them that I was at work and he will send her the information needed as proof and signed by him. The issue is, my old manager where I used to work never sent the time sheet for that week to base office, so they put my down as absent. But now since my new manager has sent confirmation I was working, they told him that I will have to wait until my next pay in 4 weeks to get my money. Is this fair? I mean, I worked and I deserve to get paid. This isn't my fault nor my mistake and they have been told by a manager that I should be paid for that week, so can they make me wait 4 weeks for it? Should I go to my district manager or as someone I work with said to me, to take it out the till lol. But seriously, I got bills to pay how am I meant to pay them with 25% of wages missing? All help appreciated.

  19. Hi I received a PCN the other day for parking in a residents only zone in Bury, Greater Manchester BL9 0RS. I had no idea that it's a resident only zone as there were no signs or marking on the road that I parked. There was a sign two streets away as you enter that area that said residents only parking, but I didn't see that sign as it is obscured and angled in such a way that from the direction that I came from you just couldn't see it properly - as shown in the attached photos. I emailed them all this info to NSL but they rejected my appeal and said I can appeal further if I want but if the outcome isn't good and before the 14 days then the £35 is going to become £70.   20. my pc HAS decided it now wants to run in safe mode and will not do a system restore, any help welcome, I have not done anything to it.I came to put it on today and it is running in safe mode so it is making it very hard to do anything.I have shut it down and restarted it but still doing same, was fine last night, I am using Windows Vista home premium. Comp is about 3 years old, have tried system restore but when it has finished it I get a message saying unknown error prevented it doing it.I found what I thought were the back up discs I got with it, tried them but it is still same, IT will not let me do a restore and I have not installed anything new.
  21. Although this doesnt affect me, I am taking an interest - I didnt realise that it only affected those living in 4 council areas until September. I wonder why those 4 areas have been chosen for the Pilot scheme ? Hopefully by then, it will be proved to be another disaster and it will be stopped.   22. Has anyone else has issues with Orange sales reps saying that voicemail is included in Sim only deals and then they bill you 35p per minute for voicemail? I needed a sim for a line I use just to collect messages. I called Orange and they told me that while the 7.50 per month option didn't include voicemail, the £10.50 option did. 3 months later I realise that Orange have billed me 35p per minute for all voicemails. Have spent 45 minutes on phone with them to try to resolve -- they try to put me through to the sales rep invloved but he never answers all calls me back... 6 days has passed since he was supposed to call me back. Complete waste of my time. Very poor customer service + Orange sim only deal is also being mis-sold.

I still have assets of over £16k - does that mean I am not entitled to any further benefits until my savings are exhausted? I believe if I still sign on anyway I will get my weekly NI contributions paid? Does anyone know how much that is worth each week? £5, £10 etc; Ta for any help
  24. Hi! Somehow it seems the fates are out to get me! I applied for an Electronics Repair job in the Industrial Sector which I'm skilled at, with a large American Employer which had a UK Repair facility 35 miles from my home address. I was interviewed for the position, given a theoretical and practical test and later told my application had been successful and I was to start work on the 18th February. The morning I arrived (Monday of last week) I was taken upstairs for an "induction" which consisted solely of a great many forms to fill and sign, all based totally on US Laws, plus being issued with three company-logoed work shirts. Back downstairs I was shown to a bench and left to my own devices for the rest of the day, being told "you're not entered on our Job Booking System yet so we can't give you any work to do!" Tuesday was the same and it was Wednesday before I was able to access the Job booking System and pick up work to do, which consisted of large and complex electronic boards that can only be tested in specialist fixtures made for them. The company had these fixtures but the workshop supervisor sat on his backside all day without making any attempt to show me the operation and use of the test fixtures, instead jerking a thumb in the direction of the Production Manager with "Ask *******!" I asked ******* the Production Manager who said "All our test Software is in the United States and we haven't got it installed here yet!" Although I have the technical knowledge to fault-find and replace components on boards like these, the only thing that can be done is to book them out completed once I'd evaluated them and carried out any work thought necessary, and either return them to the Original Customer for test in the machinery they came from, or test them in the jigs, which as I stated, was not shown or had them demonstrated to me. On Friday at 3.15 pm I was called into an upstairs office and told by the Production Manager and the workshop supervisor that they were sending me home and they didn't want me to attend the premises from then on, they stated "we were looking for an average of £900 invoiced work/day from every technician and you're not suited to our immediate needs - we wanted someone that can replace components on a large processor board and test it and book it out in an hour or less!" As regards their job booking system, all I got was "we expected you to know that!" - how am I supposed to have intimate knowledge of every company's different database system and be expected to use it with no introductory training? The Recruitment Agency that put me forward for this post assured me that "the Production Manager will come over from the States specially to give you the training and support you need to get up to speed on our products", but as you can read above I was offered none whatsoever. The workplace itself was very poorly equipped - a lot of the technical equipment I would customarily expect to find in an Industrial Electronics Repair Centre wasn't even there, I could see NO written documentation for the test fixtures, (unless it was solely on the company's US servers, and I was given no oppurtunity to see it whatsoever - I even had to ask the chap on the bench behind me to show me how to use their job booking system!) I'm sorry for such a long tale of woe again, I applied for this position in good faith on the assurance of the agency that recruited me for it that all product training would be available and a reasonable 90-day probationary period would be allowed - how can you call three days reasonable? Have I spoilt my chances in getting a good reasonably paid electronics job in the future from this episode? I informed the chap at the Recruitment agency what went on there as soon as I left the bulding, but as this was only yesterday naturally he's not got back to me yet! Also was the fault mine in applying for a job that needed more skills than I had experience with, or totally this employer's? I have worked in the Industrial Electronics Repair sector for 11 years with very similar products for a local employer in the past up until 2010 and they said I'd given them every satisfaction and they were sorry to have to make me redundant!
  25. I have been struggling with my mortgage with ge money for years and now they are about to arrange an eviction date. Present monthly payment is around £950 with arrears of around £17000. I cannot lose my home. I have offered in writing to make payments of £1200 per month but fear this may be rejected. They always want to negotiate by phone but I prefer to keep things in writing. Please can someone help
