  2. We have known for a long time of the problems with Gym membership and helped a lot of Gym members to successfully cancel the unfair contract. Now, at last, the OFT are 'saying' they are going to do something about it. " Gyms will be forced to drop unfair conditions in their membership contracts. For those yet to act on a new year's resolution to join a gym, the best advice may be to sit tight for a few more weeks. Lengthy contracts with conditions that make it almost impossible to bail out early could be a thing of the past after a crackdown by the Office of Fair Trading." More ...

Just noticed this one so have popped over from the bailiff forum for a mo Link to an article that is telling RBS to cease using Charging Orders like confetti on low value debts: http://www.telegraph.co.uk/finance/personalfinance/consumertips/banking/9795724/OFT-bars-RBS-debt-collecting-that-puts-homes-at-risk.html several comments basically saying the bailiffs should clean the houses of these debtors out and flog their chattels.

I am sure that many CAGgers will have a great deal of information to send to the OFT in Spring.

Dear ********** Our records show you submitted a complaint to the Office of Fair Trading on 5 May 2012 in relation to Toothfairy Finance. There are some serious issues in your complaint we would like further information on in the form of a witness statement. Complaints such as yours are vital in helping us to evidence business practices that might cast doubt upon the trader's fitness to hold a consumer credit license. I have attached an information sheet on providing a witness statement to the OFT. The process usually involves one phone call from us to you of approximately half an hour to 1 hour where you talk us through your experience with the trader. We would then write this statement up and send you a copy to sign. If you provide a witness statement which is relied on by the OFT in any subsequent enforcement action, the details of this statement would be disclosed to the trader and their associates. If the case were to go to the Tribunal, you may be called to stand for cross examination on the contents of your statement.   11. Under the advice of the good members of CAG, I recently made an enquiry of the OFT and received a response which made be of help to others. A bit of background for those who are not aware - in order to carry out Bailiff activities, Bailiffs (or their companies) need to hold a consumer credit licence. To hold such a licence, the holder needs to prove that they are "fit" to hold a licence and this is tested via a "Section 25" test. If their fitness is called into doubt, the OFT can investigate and potentially remove the licence. SO, they sent me a link to a document which will make interesting reading for anyone who has received communication from, or who have dealt with, a bailiff http://www.oft.gov.uk/shared_oft/business_leaflets/consumer_credit/OFT664Rev.pdf misrepresenting your powers, misrepresenting outcomes, not being clear on charges, adding charges not legislated for, failiing to accept a reasonable offer of payment, etc etc ALL REASON FOR COMPLAINT AND REGARDED AS UNFAIR PRACTICE [email protected] is the email address you'll be wanting. They will not give you advice, but they will take your complaint against any licence holder and either investigate, or keep it on record pending an application to renew a licence.
  12. Hello all. I've had many problems previously with minicredit. I can't find the link at the moment but i can find it later after work... Here's a quick story of what happened: I took out a small loan of about £200 i think, Minicredit knocked it up to £1200 in a space a few months I reported them to the OFT I'm now in talks with someone from OFT and they wish to talk to me to take a statement in a form on a Witness Statement. I don't know how many people have been contacted about this. If this is a rare thing for the OFT to do, i would like to know if there is anyone out there with any information that i could possibly pass to the OFT about Minicredit

OFT boosts transparency on heating oil prices 26 July 2012 Following OFT action, GB Oils Limited, the largest supplier of heating oil in the country, has changed its domestic heating oil contracts ensuring quoted prices do not increase from the time an order is made until the customer is billed on delivery. When a consumer orders from a supplier, 'spot' prices are quoted that reflect the current market price of oil. The OFT has secured court orders against Optimum Care Mobility Limited ('Optimum'), a Derbyshire-based business that sold mobility aids such as stairlifts, scooters and specialist chairs, across the country.   19. 27 June 2012 The OFT today accepted legally enforceable undertakings offered by the three largest UK electrical retailers to improve the way the extended warranties market works, following consultation with business and consumers. The OFT's market study of the £1 billion per year extended warranties market, published in February, highlighted a number of competition concerns that could mean customers are not getting the best value for money. To address these concerns, the OFT worked with Dixons, Comet and Argos to agree undertakings, which take into account points raised during the consultation, rather than referring the market to the Competition Commission (CC). Dixons, Comet and Argos have agreed to: Maintain and publicise an independently operated extended warranties price comparison website, to make shopping around easier. Provide more easily available information via in-store leaflets and retailer websites, including on the availability of alternative warranty providers. Conduct regular independent mystery shopping exercises to help ensure shoppers get accurate information from sales staff - and report the results to the OFT. Provide clear on-shelf information about the annual equivalent prices of 'Pay As You Go' (PAYG) warranties, to help shoppers understand the longer term costs when they enter these rolling monthly contracts.   20. he OFT's market study has provisionally found that the following practices appear to inflate the cost of replacement vehicles provided to not-at-fault drivers, making it on average £560 more expensive each time: After road traffic accidents, many insurers of not-at-fault drivers, brokers and repairers, refer those drivers to credit hire organisations that tend to charge higher daily hire rates, in exchange for a referral fee of between £250 and £400 per car hire. Not-at-fault drivers appear to receive replacement vehicles for longer periods than necessary, leading to inflated bills for the at-fault driver's insurer to cover. The report also provisionally found that the following practices appear to be inflating the cost of repairs to not at-fault drivers' vehicles, by £155 on average each time: Certain insurers receive referral fees and rebates from repairers, paint suppliers and parts suppliers. It appears that the cost of paying these referral fees and rebates to insurers increases the repair bills being passed to the at-fault driver's insurer. Certain insurers have agreements with their approved repairers to charge higher labour rates when repairing the vehicle of the not-at-fault driver which they insure, leading to higher bills being passed to the at-fault driver's insurer. http://www.oft.gov.uk/news-and-updates/press/2012/44-12
