  1. Hi, hope someone can help. This is in regards of a 'stayed' case from August 2016 Via the County Court Business Centre. Cabot/Restons At the time I requested documents those being: 1. Agreement/Contract 2. Default Notice 3. Assignment These never arrived within the period of 12 days, then a further 30 days. I went on to deliver my defence and ultimately the case was 'Stayed' Present day: I have just received a photocopy of a credit agreement with spreadsheet statements from Cabot who now which to 'discuss the options available for this account.' My initial concern is the photocopy of the agreement, in that it has clearly had something stuck over part of the section 'YOUR SIGNATURE REQUIRED' with what clearly looks like a faxed signature of who ever was signing off on the agreement, although I am unsure if this is normal practice? Also the spreadsheet is very basic with no opening balance/closing balance or written indication to the amount of initial credit and whether this was increased/decreased over time during the period of the agreement? Per my original request during court proceedings they have not supplied 'Default Notice', 'Assignment', although I'm sure this would be a request I would make again should the 'Stay' get lifted and it goes back to court. Any help in this matter would be most appreciated. Thank you.
  2. Hi hoping someone can help/advise, I received a CCJ for the amount of £2802.71 for a credit card. England based. I can't pay this and on the form it does not tell me how I can pay this off in instalments. I have lots of debt which I am dealing with but this one slipped through, my fault totally. Any advice on how I should proceed would be much appreciated. Many thanks.
  3. I have an appointment tomorrow morning at 9am,(universal credit) which I had changed to because my last one was cancelled for some reason. I do casual work here and there I got a text a few mins ago reminding me that I have training (counter terrorism training) at 9:30am - noon at my casual job, I completely forgot but if I phone up UC now they may refuse or sanction me. Should I call up now or in morning?
  4. Please forgive me if I'm going over old ground and the info I seek is already out there but I'm very distressed and up against time. I have an outstanding debt to a private members club which despite my disputing the charges ( i cancelled the membership when i hit hard times) has apparently gone to court I received a NOTICE OF ENFORCEMENT a couple of weeks ago for the sum of #1200 approx from CES.. ..asking me to pay or make an arrangement by 21st July I am used to being sent intimidation letters by DCA's and I took no notice this morning 22nd July two CES enforcement people turned up at my door demanding nearly 2700 pounds that apparently includes further costs as its gone to high court.. ..to be honest they took me by surprise at 6.30 this morning and I was going to pay but haven't got this sum available.. .Ive told them I will look to sort it today to buy time now I dont know what to do to avoid what they say is next which is a warrant for my arrest as well as removing goods (which I know they are not entitled to do if my small knowledge serves me right. HELP! Do I try to make an arrangement with the company? What about these exorbitant extra costs? Any help very gratefully received as Im at my wits end! Thank you

  8. I had driving offence just before Christmas 2014,, was fined by magistrates court amount £500.00 .. I am on benefits ,spoke to clerk of the court on phone requesting £20.00 per week on payment card ,, made 3 payments on card , benefits were taken unlawfully from bank account , had no money to feed daughter or pay bills for 2 weeks ,unable to continue to pay off fine on card. I received an enforcement notice from excel civil enforcement dated 18/02/2015 asking me to contact them before the 28.02/2015, ,,i am on benefits ,I am 30 yrs old benefits each week amount to £110.00 per week , I am a single parent . I rang excel on the 26th of February ,,they told me that the minimum I could pay was £35.00 per week ,despite me informing her I could not afford that much , she said I would have to make 12payments of £35.00 and one single payment of £20.00., ,despite my protests and telling her numerous times I could not afford that amount out of my weekly benefit amount of £110.00 per week shewas insistent that they would not accept anything else , I made an arrangement for the amount of £35.00 per week to be direct debited from my bank account . I made a £20.00 payment , ,but before any of the direct debits could be taken ,my benefit money was unlawfully taken from my account which left me with £4.82 p to live on ..in the meantime ,I contacted the police about money being removed from my account , ,they gave me a crime number ,,I was borrowing money from family land friends for basics ,food ,gas and electric ,dinner money for my 8 year old daughter ,this morning ,27 th March ,,excel bailiffs knocked on my door at 6.30 a.m ,,intending to remove goods ,informed me that he was recording and filming all conversations and what was happening . I asked him If I could call the court office when it opened at 9 oclock to tryand arrange a payment and explain the situation of all monies being taken from my account unlawfully also asked the bailiffif he would be prepared to do the same thing arrange payments ,,he said no ,he was there to take the payment in fll ,which amounted to original £470.00plus the compliance fee £55.00 ,plus enforcement fee of £235.00,,. ..told me that if I didn,t pay him the full amount he would get a warrant immediately to remove the goods ,,told him that they were on hp ,he said he would take the only settee I had ,it would be sold for next to nothing and that he would come back for more ,,I tried to make a payment arrangement with him numerous times but he declined each time and stated that only full payment would be accepted he was not prepared to come to any payment arrangement of any kind and that it would be a waste of time ringing the magistrates courts as that they were the ones that had sent him,as he knows what they would say , ,and they woud not be prepared to come to any arrangement as they would only tell me exactly what he had told me i.e. payment in full as he knows how they work .I asked my friend over the phone to pay £301 on his debit card ,I had to pay £100.00 out of my rent money ,then contacted my father over phone who said he would pay the remaining amount £360.00, ,I asked him if he could go to my fathers to fetchthe 360 ,then wait until 9 a.m.for me to contact the court office to speak to them and try to make other payment arrangments and after he picked the money up from my father he could cme back to me to find out what the court had said ,but he said no ,as his vehicle was tracked ..I had to telephone my friend again ,who was in work ,who offered a part payment of £300.00 and then would he come to an arrangement with my self to pay the remaining balance in instalments I could afford ,but the bailiff said a firm no !!..payment mustbe made in full today. .Now I have no money for rent ,for food ,for gas for electric etc;; ..despite me informing the bailiff , I have his name ,of my situation and that my 8 year old daughter was upstairs who would go hungry and cold ..after payments were made by my friend and father ,,he then wroteout on a form a controlled goods agreements ,,Ido not understand why he handed methis controlledgoods form and made me sign it after thedebt had been paid in full ,I am destitute ..please help
  9. Hi everyone, I hope I'm posting this in the correct place as I wasn't sure if it should go here or on the Motoring Group forum. I woke up this morning to find my van had been clamped for non payment of a council parking charge. I'm not too worried about the parking charge as I am in dispute with the council and am currently going through their formal complaints procedure - I realise now I should have just paid the fine and tried to claim everything back afterwards - you live and learn! However, I am concerned with how I was forced to make a payment to the bailiffs in order to get my van back. Whilst my van is personally owned its signed up with the company name, logo and contact details and I use it for deliveries. When I explained to the bailiff I use it for my sole use in my business doing deliveries and am unable to carry out any deliveries without it I believed it was covered under Section 89, 1 of The County Courts Act as the vehicle was essential for my business and I needed it this afternoon for my deliveries. The bailiff said the Act doesn't count and he should know as he's been doing this job long enough - Is this correct ? Also, when I asked why hadn't I need notified he said a letter was sent out 10 days ago giving me 7 days to pay or the would take this action - I didn't receive the letter but have no proof and similarly they cant prove it was sent but said the fact their computer says the letter was issued that's good enough for the courts. In order to get my can back so I could do my deliveries I paid the following: Original fine and fees - £93.20 Bailiffs attendance costs - £61.94 Attendance to remove/removal - £175.00 VAT - £49.63 Total - £379.77 plus £1.00 debit card fee Is there any way I can find out if they are allowed to charge these amounts ? Plus, and this just gets better, I've just realised I've paid too much VAT as 20% of £236.94 (£61.94 + £175) is actually £47.39 - is this fraud or a HMRC matter ? (would love to start a VAT investigation!) Is there anything I can do about the over charge ? When I made the payment I explained I paying under duress as I had no alternative and was looking to mitigate my losses, in that they were phoning to a tow truck to remove the vehicle. I have since faxed a copy of this statement to Marstons as the bailiff refused to sign my statement to confirm I had made him aware. (I also wrote this on the receipt just in case) I've tried speaking to Marstons and requested their complaints procedure only to be told there isn't one, you simply fax or email a complaint and they will deal with it when they get round to it - I though anyone working on behalf of a local council had to have a written complaints procedure ? I've also telephoned my local council's corporate compliance complaints team and they have taken details and said they will look into the matter but it's normally something I would have to take up with the bailiffs firm first. Any advice anyone could give me would be appreciated - I don't mind dragging these guys through the courts or causing as much fuss as possible as I'm happy the original fine will be cancelled by the council once they have dealt with my original appeal.   10. Just thought I'd share that I've had the ODDEST morning ever... Last night I dreamt that I married Jennifer Lawerence.. How odd.. guess watching Hunger Games last week had something to do with it... Weird tho hw dreams can affect your daily lives... I've been in a bubble all day... A good one at that... Very odd tho how I've got this feeling.. lol, I looked her up on google and... I dont even think shes the kinda gal for me... life is weird... very weird!
