  1. ]Hi guys, This is my first post on here so please be kind. I defaulted on a Mint card way back in June 2007 for £4,500. At that time I was in dispute and refused to pay monthly payments until this was sorted. I then heard NOTHING for five years and for the first 18 months of that the debt appeared on my Credit Expert file as an ongoing 3 ball. last year however, I received a letter from the dreaded Arrow Global who informed me they had 'bought' the debt from Mint. I asked a barrister who informed me that selling a debt is unlawful, but non the less they are still taking people to court and winning! I got onto Mint and asked for proof of being in 'default'. they sent me a letter telling me when I defaulted and the date they CLAIM to have sent the letter out. However, they also told me they could not send me a copy of the default letter as they are printed and sent out automatically. My questions are these: Can a non- regulated debt collection company like Arrow Global really take me to court and WIN? What can I do to verify whether Mint have ACTUALLY registered a default against me and if it is legally binding? Can they do this if there is no legitimate proof of my going onto default? Can Arrow Global still take me to small claims court without a proven default notice? What can I do to fight this and sponging ambulance chasers like Arrow global?

Am I correct in remembering that when RBS Mint card introduced "paperless" statements around 2008 they restricted online access as soon as there was any missed payment but failed to then send paper statements instead still inviting you to look at your online statement in a monthly email ? Presumably a breach of s 78 4b
  3. Hi all, I'm brand new to this forum & wondered if RBS Advanta still exist? I have a credit card contract signed with RBS Advanta - and this seems to be MINT now? Is the RBS Advanta credit card contract a valid contract still? I'm being taken to court by the Royal Bank of Scotland over a credit card loan, which I signed for with RBS Advanta for £3,500 back in 2003, but they kept on increasing this, without my permission or requests, to over £9,000, and now I'm unemployed I cannot afford to repay this, and they are taking me to court when I have no money? Can they do this when only £3,500 signed for? Also, signed with RBS Advanta (not MINT)? Any help here would be greatly received, feeling desperate, thank you. Round table.
  4. Hi My wife has a Mint Card and we also have a Joint RBS account. Now Over the last few months things have been a touch tight financially and we have just made the minimum payment to Mint. As the card was slightly over its Credit Limit they keep slapping £12 charges on. the question I am asking is can Mint Just take the Money from our RBS Account? And if so will/would it be the amount over limit or the whole balance (Currently £790ish)? Any assistance appreciated
  5. Hi there - I wonder if anyone can help. Freds have sent a bunch of 'statements' from a Mint card in response to a prove-it letter. Now, I may have the wrong end of the stick here, but statements don't give proof of a credit agreement, nor do they prove that I specifically hold the debt, is that correct? This is a debt that dos'nt appear on my credit file either, so I'm guessing they still have a way to go to prove anything here. Thanks for anyone who can help, Bird
  6. Hi, I've received a letter from Mint today with the return of my SAR letter and the cheque. They say they cannot trace me despite their efforts so I will need to provide them with an account number and date account closed/opened. They also say they do not hold information longer than six years. It was probably just over 6 years ago because I took out a secured loan to pay all my cards off and that was in June 2006. Is there anything else I can do or is it best to give up. I have no statements or account details now so I can't provide them with anymore info than I already have. Thanks
  7. Hi All, I am back for some help again! The full story to now can be read on the below thread; http://www.consumeractiongroup.co.uk/forum/showthread.php?153836-Brian-Carter-Solicitors-Advice-Please Total amount £3,223.58 With your advice, I managed to put Bryan Carter and his friends in their place and after they were unable to provide me with a CCA for this debt, I have heard nothing from anyone since September 2008. Within the last few days however I have received 3 letters which were sent to my parents house. 1/ From RBS stating that they had assigned this debt to Arrow Global Guernsey Ltd 2/ From Arrow Global stating that they had been assigned this debt by RBS 3/ A debt collection letter from Wescot demanding that I contact them immediately or face further action. I find this strange having not heard anything for 2 and a half years, however I am concerned that as I was contacted directly by RBS that this collection is legitimate. Can somebody please assist me with some advise on the next step? Many Thanks Laura
