  1. Although I live overseas, I now need to start a couple of different claims for money owed to me in UK from events that arose in UK. The Money Claim OnLine service can be started from here. I fully anticipate at least one case will be disputed by the Defendant contesting my claim against him - so it will have to be transferred to my local County Court (UK not Russia!) for a Hearing. I have a UK address that I return to periodically and would return to for this purpose should it be necessary, but I would prefer this to be when I am already in UK for other purposes. I wish, as far as possible, to plan ahead with a possible timetable for this to fit in with when I might already be in UK, and work back from to when I will file the Claims. Where can I find, or what are, the time periods from/to/between the various steps and stages in the process (and which may require my physical presence) ? Or is this completely unpredictable and variable depending on individual Courts? And can I delay or suggest my availability of dates ? Thanks.
  2. Hi All, I recently put in a claim against EON Homecare for a few hundred quid, and when they didnt respond, requested a judgement by default, which was granted. The nice folks at Northampton CC have even sent me a copy of the judgement sent to EON, ordering them to pay the amount claimed, plus the £35 charge for filing the claim. That was a couple of weeks ago - and not overly surprisingly, EON havent rushed to pay what the court have said they now owe me. My understanding is that my next step is Warrant of Enforcement - which through MCOL would cost £100 (which is added to what EON must pay). However, reading around I've read comments that county court bailiffs are fairly powerless - if EON refuse entry to their premises, the bailiff can do nothing. I've also read about some sort of delay that they can request? Also, some sort of option they have about claiming they never received any of the paperwork the court sent out (only sent 1st class, not recorded or anything as far as I know). I can see me paying the £100 for the Warrant of Enforcement, and still not seeing any money. Can anyone clarify my understanding for me - what my options are, what EON's options are .... and advise of the best way forward etc? Many thanks Steve
  3. Hi, Just looking for any quick advice! Cahoot withdrew an overdraft facility on me about two years ago and agreed I would not incur unauthorised overdraft charges so long as I paid it back at £30 per month. Santander then took over and I was aware that I was being charged £30 monthly regardless of what I paid into the account. I queried this with them and they said they had no record of our agreement. I got them to send me all my statements and as I remembered in the months that I ha paid in the required amount there was no charge whilst in the few months that I failed to pay in the £30 they did charge me which is fair enough. I feel that because of this I can therefore argue that this agreement was in place and Santander who now own Cahoot owe me around £350 in charges I have paid when I shouldn't have (as I had been playing off the overdraft as agreed). I have sent them a LBA letter and called today to see if that had looked at it but the said they are passing it to debt collection as they want the final balance back of me (this balance is ofcourse made up of charges they had placed on the account illegally in my mind). So, Im now about to complete a money claim online to recover my monies. Just looking for advice, do I have a case? with nothing in writing will the courts believe me? Will Santander bother to defend? Who can I contact at Santander to deal with it before it goes that far if possible??? Any help appreciated! Steven

Hey guys, I've been a reader for a while taking in the advice on your forums - it's proved invaluable so far, many thanks to all and keep up the good work However, I'm truly stumped and was wondering if anyone would be kind enough to shed some light on the following.... I've just checked my MCOL site today I noticed that under my claim history it states that a final return for your warrant against Person X has been received on 01/11/10. This is after the warrant of execution was obtained on 13/07/10, following the defendant's refusal to respond to any court correspondence and subsequently entered judgement by default. The sum owed currently stands at 601 pounds. Firstly, I have no idea what 'a final return for your warrant was received on 01/11/10' means?? I've looked on hmcs and google, and cant see a thing about it?? Secondly, as the incident of pretty much fraud took place last november, is there any way i can speed things up at all? Thanks for any help you can provide. G
