  1. Hi, Been on Forum for ages and managed to win all but one claim that has been brought against us with advice from here. However, this one is confusing me a little as not had to do it in a while. My wife had a Marshall Ward catalogue taken out in Aug 07 so after the April changes, everything was fine until 2012 when we got into a bit of trouble one thing led to another and she got defaulted, in 2013 Capquest aquired the debt, we CCA'd them, they sent a recon agreement and then all went quiet. Oct 2016 my wife starts to get letters again from Capquest and now passed over to Restons. We have SAR Shop Direct as we know the account has a few hundred in charges, and sent a pre action letter to Restons. Now I know the Default is invalid on at least one point but the recon CCA that capquest sent in 2013 I am not sure it is complete and correct. I understand that post 2007 CCA have very little wriggle room. I am going to be sending off another CCA to Capquest see if they can get anything this time. 1: Dates, it is dated by them nearly 4 months before the account was opened. Is this valid? 2: It has a term under key information that says "Details of up to date charges in relation to each of these matters are available from us" . They never sent anything relating to the charges mentioned within the CCA, do they still have to include everything mentioned? 3: Final agreement, again is dated 2010, the account was terminated in 2012, are these correct 4: Neither agreement has a tick box just a sig box, Is this right? Does any one have a copy of the original T & C's from Marshall Ward Spring 2007 and ISME from Autumn 2012, I am sure I have seen somewhere that the 2011 /12 agreements actually mentioned the £12 default charges whereas the agreements I have don't.

  3. Up until recently, I have been borrowing from multiple payday loans (common mistake, I know) which escalated until I couldn't cover it anymore, ending in a cycle. Since then, I have been with Harrington Brookes to make sure I recover from the scale that I am in. However, despite being assured that my accounts are functional and being processed - Marshall Hoares Bailiffs have continued to contact me by phone and e-mail, until that one threat that they are making that door visit. In which case, made me really worried because I have just told my folks that I have my debts under control (which it is, as I have a repayment plan being set-up). The contact I have at Harrington did say that I must not contact the said bailiffs in any way and only mention that I am already with them and that they are handling it. The big question, after that big phone call threatening you of a visit. How long does it take for them to get here? As I may want to be ready. PS. I am a new member and a desperate one as it is already 8PM and both companies have closed their call centers for the day .

I have just received this email from marshall hoare regarding my outstanding loan with toothfairy i have sent them an offer of repayment the most i can afford submitted a income and expenditure form yet they are still refusing to accept my offer and i have now received this email below, i am happy to pay what i owe but they have added over 400 in charges and are now threatening doorstep agents and court action please help. I dont know where i stand with regards to the charges and everything eles. any help with regards to a reply to them any help whatsoever i would be really grateful of.   8. Hi and thanks in advance for listening, I am having a bit of a problem with MHB. Threatening calls, emails and letters. Unfortunately I am currently unable to give them what they want. I have offered what I can but they are just not willing to listen. Basically it's there way or no way. Is there any way to get through to these guys? I can go into it a bit more if needed. I received this email 2 days ago and have no way of contacting them especially by phone on a charging number. They have no email to contact them on. I did set up a £50 repayment plan from 31.12.12 but was unable to pay due to work problems. I am in contact with Citizens Advice but don't have an appointment until Wednesday 9th Jan 2013 to get any payday loans settled. Is this email legit and will they turn up at my house this week?   10. Hi, This is my first post but I've been reading the posts for a couple of months now. I guess like many of you, I've got myself into a financial mess by living beyond my means and borrowing from payday loan companies. After two years of burying my head in the sand and constantly borrowing month on month and roll over some loans. I eventually got help from payplan and managed to set up a debt management plan. Most of my creditors were reasonable and accepted the plan and all phone call/emails have stopped apart from one... Toothfairy finance. A £400 loan has somehow spiralled to £1846. I've already paid back £236 on it and I reckon I will pay them £600 in total, original loan + 1 months interest plus reasonable amount for default. Also to say I never missed a month paying at least some money to them. Debt now supposedly owned by Marshall Hoare. I'm now aware after reading through the forums that the 3 companies are one and the same. Problem is they refuse to talk to payplan. I'm currently paying £34.20 a month to them (through payplan) and they say they can only accept £40 minimum to freeze charges etc. Technically I could make up the difference but I refuse to as I will then be given them preferential treatment over my other creditors and they have caused me so much stress I won't do it. After weeks after phonecalls from Marshall Hoare where I explained I could only afford £34.20 and they can keep putting charges on because I still won't pay more. I then got a phone call from NDR who said they will accept my £34 a month. I was wary of agreeing to this so I told them to email me the details and I will look over it before I agree to anything. Or contact them and tell them I don't agree to this and will only pay them £600? It is a relief not having to speak to them all the time and have the same conversation, but as I obviously never agreed to THEIR payment plan should I let them know now?

Hi i am hoping someone can help me at present i am sitting here waiting for a return visit from a collection agent sent by Marshall Hoare Bailiffs the agent visited earlier and left a note to say they will be returning shortly. I contacted the company via a contact form on their website they have replied saying they cannot deal with my problem via email and i must contact the call centre which i am not wanting to do as it will cost a fortune. This matter is relating to a payday loan i took with speedy dosh and due to losing my job i could not pay the full amount i tried to offer monthly payments to no avail and now Marshall Hoare want £600 the original loan was £150. I have contacted oft they sent me a form to sign so that they could look into it. I heard nothing for a while but now this company is being threatening and demanding. Please help
  12. I would appreciate any advice on these people formerly MMF chasing a wage day loan about 5 years ago. I stopped paying them because they was continuing to add charges and I repaid this loan 5 times over. MMF have been chasing with threatening letters and now letter from Marshall Hoares threatening to visit. What should I do about these clowns? Please anybody Thanks Mashmallow
  13. Hello, I would like to call on everyone that is currently being harassed and intimidated by Marshall Hoares/Northern Debt Recover/Toothfairy/Paycheck Credit. Also anyone with an account/balance with Toothfairy Finance can also log into their account detail on the Paycheck Credit website. Both are mirrors of each other. http://www.paycheckcredit.co.uk/ https://www.toothfairyfinance.com/ This is as serious breach of the data protection act as Toothfairy and Paycheck Credit both claim to be independent of each other. I suggest anyone with an outstanding balance with either to go and try for themselves. Furthermore all of the letters they send out breach many OFT guidelines: ·Levy charges that are disproportionate to the main debt and which do not reflect the actual, necessary cost of recovering a debt" ·"Pressure debtors who have defaulted on an agreement to pay unreasonably large instalments when they are unable to do so" ·"Make misleading representations as to the action it might take or might be taking to recover a debt" *MARSHALL HOARES IMPLY THEY ARE COURT APPOINTED ect..   15. So here's the story so far. On the 8th May i took out a 100 pound loan with speed credit on the 8th May for 100 pounds. Unfortunately my partner left me at this point and left me in a financially difficul position being required to pay rent, bills and everything else as im sure your aware in a household. At this point NDR took over: (NDR flat out refuse repayment plans when you email them with an automatic email response stating We Do Not Aceept Repayment Plans) To resolve the situation i made the repayment offer on the 7th june for the following installments 26th June: 87 pounds 26th July: 100 pounds They stated that this 187 was the amount owed however there website clearly states that its 12pounds per week. This was 4 weeks after taking the original loan so my maths add up to 48pounds so infact in total 148 pounds. This however was refused. At thias point i got dubious when speed credit refused the repayment schedule so ti think this is a completely fair offer. On another review of my finances i then offered - my original calculations had been slightly off. 26th June: 62pounds 26th July: 62 pounds 26th August: 62 pounds Again my offer was refused under the basis it was unfair. They are also very clever with there contact us you cannot email them only via the website which means you get to keep no proof you sent anything. On the 29th June i made a repayment of 40pounds towards the balance to hold the charges but they wanted a remainder of 211 paid by the end of the month something i wasnt able to do. again charges continued to build and on the 26th July when i was unable o pay 211 i paid a token amount of 10pounds. I got the usual correspondance saying that i hadnt ried or been in contact with he company and and all charges would be applied in the form of a 350 transfer charge (150 admin charge & 200 solicitors fees) They eventually agreed to 2 repayments of 10.5 but at this point i was unhappy hat i had already paid 40 pounds and wanted a further 210 pounds off me for what was a 100pounds loan and realistically at the time i could not afford it. At his point i had made multiple offers of repayment tried everything to n luck so i gave up and was going to ignore them and i didnt think they were contacting me. NDR sent me one final email before all charges were applied completely going against the 350pound charge i would incur and turned up at 386. Onthe 6th of augustthey offered me a final chance to pay 200pounds. unaware to me at this point marshall hoarse started contacting me 48hours later though these went straight to my junk email these were received 080812 - for the amount of 386 130812 - for the amount of 386 180812 - for the amount of 410 in all 3 they give me formal notice speed credit have legally assigned them the debt yet they are based in the same buiilding. Also can they continue to add charges. They advise someone will visit my property (is there anything i can do to stop this) is there anything i can do though now or is it jus going to spiral? wha should i pay back the loan was originally including interest for 148? Have i shot myself in the foot by setting up a payment plan and breaking it i just felt pressured to set it up in place and sent a long winded letter detailing this plan? - the only reason i didnt make the payments was because i believed he charges were unfair. is there anyway i can stop them coming to my property. should i pay anything to the balance at the moment? finally if they take me to court will i automatically get a CCJ against my name or is that only if i break the repayments issued by the cour i really dont want a CCJ. The marshall hoarse states the following in email TAKE NOTICE: You should accept this letter as formal notification that unless payment is received within 4 days then your account will be fast-tracked and considered for the following: Consequences of inaction: 1. Court Judgement legal action will be automatically started in the County Court for recovery of the full amount outstanding. Any such proceedings will include additional claims for legal costs and interest which will increase the amount you will be required to pay. 2. Warrant of execution will be applied for to enable us to seize goods at your addresses and o r an attachment of your earnings. 3. Register of Judgements any judgement will be entered in a public register, the Register of Judgements, Orders and Fines Credit Reference Agencies, who will supply them to credit grantors and others seeking information on you financial reputation. This will make it very difficult for you to get credit. 4. Credit reference Speed Credit have already advised the Credit Reference Agencies of your DEFAULT. This may seriously affect your ability to obtain credit in the future. Once the balance is paid in full, only then will the default be shown as “Default Satisfied”. thanks for all your help and reading through all of this. im hoping someone here can help me if this goes to court, ive deal with loads of companies like this but never been anything like this. i have repayments with a few payday loan companies.

  17. Hi guys, new here so will quickly tell you about my situation, last year I took out some PDLs and couldn't afford to pay them all back, including a £200 loan with Toothfairy. Iv had countless letters from TF, MH and NDR demanding over £1000! Iv offered to pay back the original loan amount with a couple of months interest but they are saying they can only reduce the fee a bit, they are still adding interest. I got an email today from NDR I contacted toothfairy today and received an email from MH so they are clearly all the same company... Here is part of the email I received today, any advice welcome! Payday loans can become expensive if you do not keep to the terms and conditions that you agreed to when you took out your loan. I am worried sick. i took out a loan from toothfairy in april. i wanted £100 as i have had them before and payed back in time. on the day, it said i had to choose a higher loan as £100 wasnt available. i got a £200 one and then something happened so i didnt repay. i have since had numerous calls/texts/emails every day form them, and NDR wanting money. the debt has risen to £715 and will rise again if i dont pay within 3 days. today i have had a text from marshall hoares bailiffs sayig they will be at my adress in 3 days and will take things to 9times the value of the loan. i have emailed them, told them on the phone and through the contact us on all 3 websites asking how to repay an affordable amount each month/fortnightly. i am on benefits and get £148 every 2 weeks. i am worried sick for me and my young daughter. i have been sitting with blinds shut and not making noise/not answering door if i am not expecting anyone. i really dunno what to do. they wont give me an answer to repay what i can afford. oh, forgot, i had a text yesterday saying i had agreed to pay today in full but i never did. because i got the text yesterday, i went online banking and switched the money i do have in (my rent) to my savings account so they couldnt take it. anyone have any advie?

Hi guys, I took out a loan with toothfairy finance almost a year ago for £100 and after being unable to pay on the agreed date due to a change in circumstances I have been threatened and mentally tortured by this company. I've tried emailing them countless times to work out some sort of payment plan but I get the generic response. I currently have no job as i have just finished college and i literally have no money so I cant even make token payments. Yesterday a ground collection Muscle Man from marshall hoares came to my door and tried to pressure me into repaying even after telling him I had no money. I have send 3 letters to toothfairy in the past stating that I would not accept a door visit but they just dont seem to listen. I live in Scotland and I was under the impression that the laws are different up here but they wont stop harassing me 7 calls a day, 2 letters a week and constant emails and now this. I appreciate any advice you can give I just want to know what my rights are or what i can do?

Hi I have just recieved a phone call from convers money regarding a debt i have with them and the person i spoke to Hussain was very rude, he originally called and spoke to my OH about this issue even though he didnt know it was my OH telling the OH how they will be starting legal procedings against me blah blah blah. Then he phoned back again on private number and when i challenged him asking why he was speaking to someone else about my finances his response was well they answered your phone so i can tell them what i like. and then continued to say i am not getting into an arguement with you and then said we will see you in court and hung up. I also got an email which said the following ·Solicitors being instructed to commence legal action or personal bankruptcy proceedings ·A debt collection agency being instructed to attend your home to collect the debt or assess your assets prior to legal action Can they get me bankrupt??? I have sent them an email requesting them that they only contact me via letter which i will send by letter too. i tried calling the two numbers i have for them but both are constantly engaged. Are these people regulated by anyone as i could not see any license numbers for fsa etc on there website. Anyone know anything on Convers money or any advice would be really appreciated Thanks
