  1. I can't get legal advice. This is an issue of human rights and a matter of public interest and concern. How can a member of the public not get legal help wherever he goes? I really need help! I am at the end of my tether. Exhausted and at breaking point. I have no energy left. What I have experienced has been horrendous. Every agency which claims to uphold the public interest, has let me down. It shouldn't be happening; not to anyone. I am fighting wars on several fronts, involving the former Bradford & Bingley building society, the legal profession, the Community Legal Service, the Financial Ombudsman Service, the Citizens Advice Bureau and NatWest bank. On top of this I am trying to get an inquest reopened into my father's death in 1970, because the original inquest was a complete sham and new evidence suggests a criminal element attributed to the death. At the same time two evil solicitors conspired against my family and robbed my mother of a house, insurance money and savings, leaving her homeless and broke with three children after my father's death. It is the most ruthless and incalculable act of wickedness I have ever encountered of people held in such a trusted and respected professional position. My life is mired in so many problems now that, without the appropriate help and support, I am just sinking deeper and deeper into the abyss. I have been struggling for four years with one problem after another. I have been passed from pillar to post, up and down, all around and there and back again. Nothing gets resolved. I am met with disappointment at every turn. It has not been a case of not helping myself. Helping myself is all I have done. I have used up all available resources to get matters resolved, but I have been badly let down by the system. I am unable in the first instance to obtain legal help. I have approached a significant many solicitors but none will assist. The reason is unknown to me, other than the fact I am pursuing two solicitors for fraud, and for that reason it appears I have been blackballed by the legal profession. I took the fraud case to the Law Society, the Solicitors Regulation Authority and the former Legal Services Ombudsman, but all they did was obstruct my complaint and attempt to shut it down. Matters were never resolved by the regulators, and my complaint became so mired in needless complexity that it turned into a complaint about a complaint about a complaint about a complaint. The regulators just wanted to grind me down until I gave up. I believe my name is now on a central database 'blacklist', as no solicitor in any part of the UK will assist me in any way shape or form, regardless of the problem. I have contacted up to 300 firms. How can so many apparently unconnected legal firms behave like this? It's all highly suspect. If the blacklist exists, it's an outrage of injustice and needs to be exposed! My trust in the legal profession is now dead. I took my case to the Citizens Advice Bureau. I explained to them that I couldn't get legal advice and therefore needed their intervention. I was astonished when they, too, turned me down. I went through their complaints process arguing that, as matter of human rights and of public interest and concern, the bureau should ascertain why a member of the public cannot get legal help no matter where he goes. The bureau failed in its procedural policy to put me in touch with a solicitor. They closed down my complaint and matters still remain unresolved. I took both my cases against Bradford & Bingley and NatWest to the Financial Ombudsman Service. Both were rejected. The ombudsman let them off the hook, even after I provided overwhelming evidence of wrong-doing, which NatWest have admitted. NatWest have destroyed my business and left me £20,500 in debt, yet I cannot legally hold them to account or have them pay damages, because I can't get legal advice in the first instance. The ombudsman simply ignored the obvious facts before him. The Financial Ombudsman Service has exposed itself as a dysfunctional body that serves the interests of the banks, not the public. I have completely lost trust and confidence in the legal profession, the Citizens Advice Bureau, the Financial Ombudsman Service, the Community Legal Service and practically every conceivable public body you care to mention. There is a systemic and malevolent culture of protectionism operating at every turn and in every organisation it seems - corruption everywhere! Does anyone have a moral conscience anymore?

  3. Hi, I'm after some advice regarding the selling of an HSBC commercial mortgage with the bank insisting that life cover was also taken out with them. I'm wondering if there is any case for a claim of mis-selling of the life cover? The business was a partnership between 4 family members, parents (of retirement age) and two sons of working age. The commercial property had sufficient equity in it to cover the repayment of the mortage upon death/inability to work. Key man insurance was already in place elsewhere for the two sons. HSBC were clear (this was in 2002) that the mortgage would only be provided if life cover was taken out through them for the two sons. Sadly there is no written documentation to illustrate this insistance. Thanks for any help or advice. P

  7. hi i have sent all 5 of my creditors a request asking why i owe the alledged amount i dont dispute owing them some money but not to th eoutlandish claims they have! one i do totally disagree with is sky as i was told when i took it out " i had to have the HD pack it was the only one they did" when i rang sky a few weeks later then confirmed i had been misold and that i could cancel with no charge i nopw havr landed a bill 2 years later with no propr communication for £400! one thing i did want to check is that when i have sent the second letter requesting deatils of debt if i either dont get a response or they cant supply what do i do next?? how do i get these debts removed? also i challenegd my natwest debt orginally 400 now 1700 and they stated "natwest state these charges are fair and accurate" even though they had picked an old address i lived at 5 years before i even opened the account to lend all statements to (conicidentally my ex husbands address) im at the end of my testher i just dont no what happens next.Please help me!
  8. Hi all, I had an accident in work on August 12th. Today, I had a letter from my employer that I need to attend a disciplinary hearing next week because I initially failed to report my mishap to all and sundry. Is there a time limit for when the incident actually happened and when my employer can call me for a disciplinary? Funnily enough, I asked for a copy of the incident report I submitted to our jobsworth, sorry, very efficient H&S rep, to show my creditors that I'm not pulling a fast one when I tell them I can't pay my bills due to being off work after an accident. One day later this disciplinary letter comes through the door!
  9. I am currently seeking a divorce from my wife. At 67, I am 25 years older than she is and about ten years ago we took out a life assurance policy in her name and against my life. I now wish that policy to be surrendered by her as I do not want her to benefit from my death. She is refusing to do this - what are my options and who do I turn to? Naturally, Skandia, with whom the policy is held, cannot deal with me directly, only my wife. I have very little money and I would like to know what my rights are before seeking legal advice.   10. My name is Mustafa, and I was a customer of Vodafone until November 2011. My credit score has been messed up by Vodafone, and it has ruined my life completely. I failed my loan application and mortgage refused. I made an upgrade in November 2011 with Vodafone and never received the handset, because at that time there was a waiting time log for Iphone 4s handsets. Therefore I cancelled the upgrade. Vodafone staff also cancelled the order BUT never reversed the upgrade. It therefore showed as if I continued the contract for another 24 months even though I never received the device. On the same day I went to another network provider (Three network) and transferred my number. I have received a bill for £790.00 from Vodafone (2 years line rental). I have on the same day spoke to Vodafone and they promised to sort this error and reverse the order, and send me the final bill. It took them 6 months before they cancelled and settled my account. I have received a bill for £35.00 in June and the account is now closed. However; I am keep on getting refused for my credit because on my reports it is showing as if I defaulted to pay Vodafone for 6 months. I have contacted all credit rating companies and explained the situation to them. I have spoken to Vodafone many times and the payment history are still showing as defaulted payments, and as if I missed out the monthly payments of incorrect £790.00. I need to get this fixed as soon as possible as it is severely affecting me financially. I couldn't even re-mortgage my property because of this error. I need them By the looks of it Vodafone is not doing anything at all.
  11. hi, a friend was paying £140.00 per month as her bank Lloyds advised her to take a 'life assurance policy' she has now cancelled the policy because she had assumed that she would be covered for illness (which she is not) she does not speak english and her son who only speaks a little english was with her and translated as much as possible (his english skill is not good) is it possible that this policy was missold as the customer was not sure what she was actually paying for? are there any rules / regulations that state a customer should know what they are buying / paying for? or can they simply sell to someone who has at the most a knowledge of maybe 10 english words?

Just paid my final payment to Payday Express today - just awaiting the confirmation in response to my email requesting that it is marked as paid in full on my credit file and that my account is closed with no further payments required. I am ecstatic Just Muck Hall to go - £150 will be settled by November - and am then payday loan free for the first time in 2 years!!!! Nice Christmas present to myself!. Cant believe I never ever have to deal with them ever again. Sorry just wanted to share my joy on here

I received a letter saying ther was doubt about my claim as I had not applied for ONE job printed off by my local JSP, I wasnt able to get the link to work and by the time I was able to get public internet access the deadline had passed. I had however applied for 14 jobs within the 12 days previous but the Adviser at JCP has advised me that this is a "refusal to work"... hello i applied for 14 other jobs. As a result I am being left with no benefits, no council tax payments, no money for my mortgage ( funnily it comes just as my 13 weeks of claiming benefits is about to pass entitling me to mortgage interest payments) and i have £30 left of my overdraft that needs to last me until I can get work...100's of job applications later and I still cant get work.....Can I sue the individual that has come to this conclusion that I dont want to work? As I'm not sure how I can cope on zero income and possible repossession of my home, not to mention starvation!!!!

Afternoon Everyone It's been a while since I posted, I have been working very hard to secure work after being dismissed late last year, somebody did accept I needed a 2nd chance which was great however I am very keen on getting back into the corporate areana.... Has any body been successful gaining employment in places like banks, or big retail head offices for example? After being dismissed I mean for "gross misconduct"!! I have settled out of court so have been gagged in terms of what I can talk about should they ask also.... I wonder if I should stop trying to get jobs in these places and settle for what I have, I am very greatful for the job I have now.
  18. Morning All. A bit of a strange one this and I can not find any direction so turned to you for help. Due to my work in 2009 I took out additional Life Insurance FP Level Life. However, in November 2011, as my job role changed it was no longer required and as my wife was made redundant, the money would be best utilised in the family pot. As time marched on I thought no more, foolish. I have recently been contacted by a firm of solicitors acting for the company I had the agreement with claiming their 'Commission Clawback' I wrote back asking for some additional information to save money e.g whether there was a fee agreement, as one is not mentioned in any paperwork I have, because I have read commission is sometimes offset against this and only the commission to the value of this fee may be requested therefore maybe only liable for the difference. I also believe on reading the FSA Website on Unfair Terms in Consumer Contracts the Terms of Business (TOB) agreement I signed may be unfair and in particular reasons for believing this when you use an IFA you should have a choice how you want to pay for the services - I was not given this, and the terms do not state clearly when and how much me, the customer has to pay the IFA so therefore not aware of the full cost of the financial advice. In addition I believe that my TOB agreement allowed the firm to reclaim an amount from me, the customer, if I stopped paying premiums and the IFA had to refund commission to the product provider as appears in this case. my interpretation of the FSA guidelines also leads my to think that this charge is a disproportionately large sum as I have not fulfilled part of my obligations under the contract. Surely a court would not enforce this over and above my rights to cancel this policy. I have also asked these Sols for my cancellation rights to which after a period of 1 month got nothing except a MCOL from Northampton. I also sent them a S10 DPA request as other members from the IFA had tried to contact me via text and email touting for business. In total the sum claimed is £1261 + Court fee made up of original debt £997.31 plus interest, a tracing agents fee because I moved and not told them £42 plus Sol fees £210 plus future interest. So, apart from acknowledging service can I assume this falls under CCA rules or send a CPR 31.14 request. Any help greatly appreciated.
  19. Almost 2 years ago, we bought a pair of Electric Bikes. They have Lithium Batteries which had on the back of the booklet they have a warranty of 1yr, but 1000 charges. One of the batteries is fine, but the other one barely keeps a charge and drops out quite quickly - they are supposed to go from 4, 3 2 & finally one. Where I bought them from has been on to the importer, who says the battery is out of warranty & therefore they are not liable - a new battery is £300 + so not a cheap item to replace. I have just contacted the importer who again says out of warranty - but take it over & they will test them. My point is that I would have had to have charged the batteries approx 4 times every week since new - certainly have not (bear in mind the other bike one is still ok) - any thoughts on how to proceed with this if they do not want to replace.
  20. hello everyone oh i dont even know where to start here! i seem to have debt letters coming out of my ears! here who and what they are... i have rent arrears of £700 with the council who are threatening to seek possesion i owe £230 to lloyds from a very old account (i got back £1400 banck charges an this is all thats left) and its now with westcott i owe £800 to a catalogue (now with moorcroft) i owe £300 to monument for an old closed credit card (yes i ahve tried an failed to get my ppi back from them twice) and fredricksons and brian carter are chasing me for £2100 from a catalogue, (which when i had to stop paying as i was off work due to illness the balance to this catalouge was £900) i have wrote to them asking for the amount owed to be revised as i feel its unfairthe amount of charges and fees that have been applied, the replied saying the will contact their client and be in touch. argh im not refusing to pay but dont know where to start, im not on the highest wage and due to my medical probs and sickness i could possibly be going in front of a panel to try and keep my job but dont look good, so cant commit fully incase i do lose my job!! any advice before i pull all my hair out!! thank you in advance xxx
  21. I had a WealthMaster plan with Abby Life for 18 years At the maturity date in june they offered me a figure that is even lower than the lowest figure of the predicted illustration figures. I complaint to the Ombudsmen service and the independent ajudicator asses the whole case and decided to go with the decision of the abby life now I am in an argument that when abby life sold me the plan they only mentioned the higher figures not the risks. but obviously in the singed contract it states that the unit linked investment can go up or down at any point. The judicator is only looking into the contract not the emotional sale tactics of the time. So now I want to know for the next step if Ombudsmen service will look into the case with my argument of a verbel sale or they again be looking in to written contracts.
  22. Hi there, for two years I've been working on a software development project at home and living off savings. It's fair to say that the project has turned out to be more complex than originally foreseen but nonetheless is 85% complete and should have the potential to become revenue generating with 3 months further work. Following a recent marriage separation everything has been thrown into turmoil and I quickly came to the conclusion that it would be necessary to get a job to provide me with an income. I got an interview with a company (a leading global brand) who liked my skillset and were happy about the fact that I'd developed these skills in a non-commercial environment because of my extensive past history. Because the division of the company is involved in the finance sector (a lot of my experience has been in financial services) a pre-requisite of acceptance for the position is that I pass a credit check. I figured this would be pretty straightforward as I have no mortgage (house owned outright) and no borrowings. So it came as a hammer blow when I failed the credit check as was told by the HR department that I would be ineligible for the role. It's hard to describe the sense of disappointment I felt when the one great chance I had to lift me out of the terrible situation I'm in was dashed to pieces. It's been the worst 5 months of my life (I'm 47) by a very long way and so to have picked myself up off the floor and taken positive steps to get back on my feet, only for it to turn out to be all for nothing is a bitter pill to swallow. I applied for and received a statutory credit report from Experian which showed a default of £66 for Vodafone and another for £139 for Capquest (formerly FTC), both the default dates being the same 04/10/09. I can remember the situation very clearly. I had been on contract with Vodafone since 30/07/02, and I'd had a very lengthy contract with them prior to this (I first had a mobile in 1994 and had always been with Vodafone). The contract in question was £50/month and due to a change in circumstances I realised that it no longer made economic sense to continue with the agreement so I set about cancelling it. It turned out that whilst you could do just about everything on the Vodafone website one thing it was not possible to do was cancel a contract. This is obviously purely for the cynical reason of making it as easy as possible for people to spend money with the company and as difficult as possible to stop spending money. After much digging around on google I found an address to which I had to send a letter requesting cancellation, and this I did. The contract included a one month notice period and after one month the funds were still being withdrawn from my account. So I wrote another letter which pointed out that I'd already written to them asking for the contract to be cancelled. Another month later a sum of slightly more than £50 is withdrawn from my account again. So I wrote a third time, and you guessed it, they're still taking the money out of my account. At this point I reckon that I'm approx. £110 out of pocket so I had no choice but to cancel the direct debit. Then I recollect Vodafone debt chasers phoning me up and sending me letters. I politely but firmly explained that I felt that they owed me money and not the other way round. It would seem that they sold the debt off to a factoring agency Capquest, and that the single debt is now logged twice on my credit report. The thing is that I moved house in October 2009 and Vodafone were not included in the list of people I notified about my new address, so the existence of a credit default has come as a most unpleasant surprise. Due to my marriage separation I can't easily access the letters I wrote to Vodafone however I believe that they still exist on a partially working laptop that is in my ex-wife's possession. We communicate only via solicitors so it would be a fair amount of hassle to get hold of this evidence, not to mention that the graphics chip on the computer is on the blink and to get it working for even a few minutes requires that I have to heat up the laptop by putting it somewhere hot. So, all in all I feel very badly treated by Vodafone, can anyone suggest what I could do to get these notices removed from my credit file? The one positive at present is that the hiring manager at the company has indicated that if I can get the credit situation resolved in 3 weeks (which seems unlikely) then I'm still in with a chance to get the job, and oh boy do I need it.   23. Hi About 14 years ago we were pressured into buying a life assurance policy incase my husband died while we were paying our mortage, although it was not linked directly to the mortage. As we were pressured into buying it and we didnt want it and couldnt say no are we entitled to claim anything back The life Insurance is with Pearl Assurance

  25. Ok so ive had problems with council tax for years. It all stemmed from a girl i was living with and i breaking up and her leaving me with a huge pile of unpaid bills. since then i've pretty much been stuck in a vicious cycle of being unable to pick up one years council tax because im too busy paying bailiffs for the previous years. Ive recently started a new job, which will solve this situation, however, im a self employed contractor and have to pay for everything up front and claim it back from the company who are paying for my services. This poses a problem, as im on a DMP. The DMP itself isnt too bad, although i have no idea how long it is going to take to clear the balances because ive had to reduce my payments in order to pay... surprise surprise bailiffs authorised by the local council to collect last years council tax. Ross & Roberts are like all Bailiff companies, glorified extortionists. Ive paid so far £700 toward an original balance of £1300 and somehow my outstanding balance remains at £900.. They handled my case so badly at first that i actually emailed the council and tried to open a dialogue. i explained my situation in full and told them that IF they gave me some breathing room, i could clear both this year and last year's balances within the next 6 weeks. The response was basically an explanation of how the council process our tax arrears (something i already knew), a statement of my outstanding balances (again something i already knew) and what can only be described as a "Tough ****" statement regarding my situation. And a "recommendation" that i contact their office to discuss repayment options for this years balance. i have responded re-iterating my situation regarding the DMP and last years balance i.e i have NO spare income, and this financial restriction could potentially cost me my job and that being the case, NOBODY gets paid. I am aware that this situation is really my fault, and i have no intention to try and get out of paying my debts. My objection is that a government department such as the council whose responsibility is to look after the inhabitants should be a damn sight more understanding and flexible. Ive been told year after year by these idiots that if i miss one payment, i lose the right to pay by installments and must pay the full balance immediately or face the bailiffs again. NO other creditor has the power to treat people like this, and those are all optional ones. Without wanting to sound overly dramatic, it is almost fascist, the way that council tax is not only a madatory payment, unless you live on a canal boat or something, but you basically get stomped on with an iron boot if you miss a payment. based on what the council representative said to me, im basically going to be stuck in this cycle forever unless by some miracle i manage to weather the storm and get through the next 6 weeks without any further business expenses.. which is unlikely
