  1. Hello guys, I'm about to start the process for getting a PCO licince (private hire - london) I have a DR10 from 2005, it was a morning after thing... gutted at the time, but I'm not condoning it in any way it was a "fair cop" does anyone know if that will mean I will be refused to PCO ? kind of think its worth checking before spending the money..... Any advice would be greatly appreciated....
  2. Hi, I am concerned about what the PCO will think of these things if they come up on my E-CRB check... I have been told by the police that i have no convictions whatsoever on my record but... -------------- In Scotland years ago I got drunk with my friend and fell asleep outside a house - unknown to me he went inside and I dont even know what he did. Then he came outside and fell asleep next to me - the police found us and arrested both of us - They were trying to say we had both broke in - and although i kept protesting my innocence - they said if i dont accept a cation we will be kept there for a long time (this was before i knew about maximum detention times) - I stupidlly accepted (as i was still drunk) - and I dont even know what the cation was for - possiblly breaking and entering - or even burgurlly - im just guessing though. Will this show up in a E-CRB in england? - and if so - is it going to stop me getting the licence? -------------- A couple of years ago I had to confiscate my mothers bank card as she suffers from mental health problems - I did not draw any money out - or even try - and i acted well within the law (under the mental health act) - it ended as no further action - but as all arrests are going to show up it will say arrested for theft. -------------- A few years before that I got a cannabis warning. -------------- I understand I can request what will show up with a police subject access request - but as it will take upto 40 days - that means my application will have to be put on hold for that time (as i dont want to waste £55 for nothing). I am really worried about these things - and the pottential waste of money. If anyone could advise on what I could do - I really don't know - and will wait the 40 days if i have to but really wanted to sort it out sooner. Thank you for your help Timez

Hi guys, I thought I'd come back for some clarification after reading the BBC news on tv licence excuses. http://www.bbc.co.uk/news/uk-22947160 First of all, I have noted that there still are 2 bands - Black and White £49 and Colour £149. Seriously who in 2013 has a black and white TV? I thought that was pre 1990s? Second of all, this is the most trickiest bit I have picked up, if you say you dont have to pay a TV licence, you have to prove this. And if you have "any equipment" that can receieve live TV then you must pay. So, someone who doesn't have a TV, but they have a PC with internet - you still have to pay? Or they got a PC, a console, and a TV to use as a monitor for those things, yet no TV aerial, digi box or sky box, you still have to pay? So from my understanding, if you got the internet and a laptop/pc you have to pay TV licence? Shouldn't it be the other way round they have to prove that we watch live TV on the PC? This law is seriously outdated especially with the black and white band. No one even produces black and white tellys to my knowledge...
  4. Hi there, wonder if anyone out there can help me. I had to report my counterpart driving licence lost and to register a change of address a week ago. I thought that going through the local DVLA office would make the process a little bit quicker. I could not do it online as I do not have a passport. The member of staff at the DVLA office said 3 weeks but said that they say 3 weeks to cover themselves, however, I have had stuff back from them an awful lot sooner In the meantime, out of the blue I have a job interview with more than a good chance of getting the job, in a couple of days with an agency who insist on using my driving licence for an identity and address check, I have been told that if I don't produce the licence, I don't get the job. I phoned DVLA in Swansea today explaining the situation and they were quite unhelpful, I was told that there was nothing on their system and there was nothing they can do about it and to wait the 3 weeks. I'm sure that there must be something on their system especially as a week has gone past as I handed everything into one of their offices and I know of people that have got them back within a few days. Anyone have any idea of what I can do? I don't want to lose the opportunity of this job as I have been unemployed for 8 months and jobs are harder to come by these days. I explained this to the DVLA person and she could not have been more bothered even if she tried. Many thanks in advance.

  6. Hello, i was just going through my passport and drivers licence today and realized that my licence expired one year ago. I had no idea about this as i haven't been driving for a while. Will it still be possible for me to renew my licence? Thanks for your help.
  7. I have decided to make payments from direct debit quarterly payments two a payment card. I told them i am unemployed and will be making weekly payments. I have been paying my licence for the last three years by direct dibit. The cost of a licence is set at £145.50 That will work out at £12.125 a month That is £2.79 a week Why are TV licence (Capita) demanding that the payment be made over 26 weeks instead of 52 I know what they are doing, they want an extra six months in the kitty, so you are always six months ahead in payments Why should i be six months ahead in licence payments before i can have the option of paying over 11 months, that's an extra 6 months of payment Capita will have in their bank account earning interest, and not mine What i am asking is this By what statutory authority can Capita set those repayment terms , as long as i make weekly repayments in advance over 52 weeks by the card, and not go into the red, how can Capita demand i pay more I HAVE JUST CHECKED ONLINE THE STATUS OF MY PAYMENT CARD, TV LICENCE CAPITA ARE SAYING I AM ALREADY £20.85 IN ARREARS, MY NEW LICENCE STARTED ON THE 1/05/2013, THAT'S ONLY 10 DAYS AGO AND THREATENING TO CANCEL MY LICENCE THESE PEOPLE ARE UNREAL
  8. hi all, just a bit of help regarding 3 points put on my licence, after being stopped,on a 125cc i was holding a prov licence, i had been given a £60 on the spot ticket for the offence, which i couldn't afford to pay,so i went to dispute the ticket in court, stating i was not aware i needed L plates for a 125 cc WHICH I WENT TO BUY JUST AFTER GETTING THE TICKET AND PUT THEM ON THE BIKE,i might add that i had all my docs on me to prove i was fully legal minus the L plates,anyway after the court apperance i got a absolute discharge, and that was that, then a day later the court prosecutor sent me a letter stating that there had been a oversight at court and they had not took my licence as i had to have 3 points put on it? which i had to comply with and return the prov licence to DVLA,when i got it back they were on there, anyway a few months later i passed my car test and received my full car licence, as im a disabled person which i will remain being for life ,i applied for a motability car which i was awarded to help in my day to day mobilty,but after the RSA insurance noticed the 3 points for the L plates,they said i could not be put on the cover note for the car,but i could nominate a person to be a driver for me,so i did have a friend to nominate for me which i put forward to be my nominated driver,which was accepted without any question,heres the thing he also had 3 points for speeding on his licence, but they had no trouble insuring him but not me,who now has to arrange a friend to drive me to hospital apps, & other day to day tasks,& thats only if he is free to help if he is not at work,can any one give any advice on who i could contact to see about the possible re opening of the court case,& try have the points removed,& a possible fine or some other way to pay the penalty for no L plates,so i can at least drive my own car without relying on a busy friend which has little spare time to do so,any advice would be very much appreciated.
  9. Hi, my son was banned for drink driving before he even had a licence in 2004 and was jailed (rightly so). He has since been completely clean and requested a provisional in 2007 which he received with the endorsement on it. He has moved address twice since then and informed the DVLA of this without a problem. Last year he took driving lessons and applied for a test, passed his theory and then his full test, at all times providing his documentation (paper) to the test centre. Because he has not received his full licence in the post, he has contacted them to be told that because he has not taken a medical test, his licence is invalid. He is adamant that he has never been informed of this and his original provisional has the original photograph of him which was updated on each subsequent provional, so they know who he is. I hope someone can give me some advice to pass on to him, thanks in advance
  10. I have always paid my TV licence by quarterly direct debit. I have decided to pay now by payment card, telling them i am unemployed. Phoning them up, they tried continually to get my phone number for which i was not accommodating in that request My licence is paid up to the last day in April, they are adamant my first payment card payment has to be made on the 25 April, yet i have paid up to the end of April, so comments on that please I continued to request a full statement of account, that's payments made and dates over the last 12 months, they refused stating the system will not allow it, after continued debate on that subject, they cut me off. Are TV licence subject to the Consumer Credit Act in that you pay in installments IN BRIEF Are TV licence governed by the Consumer Credit Act in that on request they have to send a statement of account for the previous 12 months if paying by an installment plan of payments made
  11. Long story short, someone stole my card uk driving licence. Now the police arrested the person and got me my card back. Unluckily for me the person snapped it in half, but the police taped it together and returned it to me. It's that destroyed in the middle that I look like dracula or frankenstein. i've got some points coming off in august and i got told that i'd have to pay and send in my licence then to get the points removed. is it worth me just waiting until then to send the licence back? Just i'm going to spain on the same day and ideally wanted my licence so that I could hire a quad with my friends there. i just wondered would I have any other options ? or is paying for a new 1 the only way.
  12. I've moved into a student property while I'm at university and live in a shared flat. The house is a 3 floor house with each floor having flats. In my flat our landlord advertised the tenancy with Sky TV & tv licence included in the rent. Last month all of us noticed tv licence letters coming through the post. As it was easter we ignored it. I opened one today as it was just address to the occupier and it says they're sending their 'manchester' enforcement team for a visit due to non response. As a student what can I do? I'm the only one in the house who has the Sky in my room but it was advertised in my bill by the landlord. The other tenants have tvs too but just use it for x box and stuff.
  13. Hi I have 3 points on my licence for speeding. I didn't inform the insurance company because i did not think it was classed as a convicton (drink driving). My wife has a clean licence and was driving my car. Somebody hit my car whilst my wife was driving and the car is now a write off. I have had to put a claim through. Has anyone experienced anything like this and what could the outcome be.
  14. Morning All. A bit of a strange one this and I can not find any direction so turned to you for help. Due to my work in 2009 I took out additional Life Insurance FP Level Life. However, in November 2011, as my job role changed it was no longer required and as my wife was made redundant, the money would be best utilised in the family pot. As time marched on I thought no more, foolish. I have recently been contacted by a firm of solicitors acting for the company I had the agreement with claiming their 'Commission Clawback' I wrote back asking for some additional information to save money e.g whether there was a fee agreement, as one is not mentioned in any paperwork I have, because I have read commission is sometimes offset against this and only the commission to the value of this fee may be requested therefore maybe only liable for the difference. I also believe on reading the FSA Website on Unfair Terms in Consumer Contracts the Terms of Business (TOB) agreement I signed may be unfair and in particular reasons for believing this when you use an IFA you should have a choice how you want to pay for the services - I was not given this, and the terms do not state clearly when and how much me, the customer has to pay the IFA so therefore not aware of the full cost of the financial advice. In addition I believe that my TOB agreement allowed the firm to reclaim an amount from me, the customer, if I stopped paying premiums and the IFA had to refund commission to the product provider as appears in this case. my interpretation of the FSA guidelines also leads my to think that this charge is a disproportionately large sum as I have not fulfilled part of my obligations under the contract. Surely a court would not enforce this over and above my rights to cancel this policy. I have also asked these Sols for my cancellation rights to which after a period of 1 month got nothing except a MCOL from Northampton. I also sent them a S10 DPA request as other members from the IFA had tried to contact me via text and email touting for business. In total the sum claimed is £1261 + Court fee made up of original debt £997.31 plus interest, a tracing agents fee because I moved and not told them £42 plus Sol fees £210 plus future interest. So, apart from acknowledging service can I assume this falls under CCA rules or send a CPR 31.14 request. Any help greatly appreciated.
  15. Alright guys wondering if anyone could give me some advise. I had a knock at the door last year and two guys from TV licensing caught me off guard, I said I watch TV but the house I was staying in apparently didn't have a license. According to my tenancy agreement there should be one license for the property so I showed them this but they gave me a fine anyway. I was planning to dispute the fine but I moved out a month later and forgot about it, this was in September. I get a 'further steps notice' letter a month ago from the magistrates court saying I owe £300 and if I don't pay within 7 days they'll reclaim the money using a bailiff. I phoned them up and explained this was the first I've heard from them, they said I could apply for a statutory declaration due to move of address and the process would start over. I tried to phone and organise this a few times but their phone lines are always busy, they put you on hold for a few minutes then it hangs up. I'm pretty rammed at university right now so I forgot to chase it up, now I have a letter from Marston Baliffs saying I need to pay £390 within 7 days otherwise they will remove my goods. I again phoned the court up today and couldn't get through to organise a statutory declaration, I then went through to the magistrates finance unit and they said tough, you had you chance... its with the bailiff now. Where exactly can I go from here? The fine itself is rubbish, I'm currently bankrupt and a student so there's no way I can pay this fine - and all I own is my computer which I need to work. Any help welcome, thanks.
  16. hi i need some advice: ive had parkinsons for 13 years now and have been on a 3 year renewal on my driving licence.Last july i sent off my renewal as usual and heard nothing but 3 letters over the next 8 months saying they were dealing with and i could continue driving.Then last week i got a letter saying they had revoked my licence on medical grounds. I rang the dvla and they say it was revoked because of a report they received from my consultant,i asked for a copy and they said i have t write in (ive done this).I also made an appointment to see my consultant who hasnt seen me for ten years!! its allways a nurse specialist i see. when i turned up for the appointment he wasnt there:-x and i saw one of his minons who couldnt find a copy of his report and tried to fob me off when i demanded a copy. my parkinsons has never affected my driving and i ha ve 9 years no claims how can the consultant recommend i dont drive when he hasnt seen me for 10 yrs. ive had a look at the dvla medical requirements and as a far as im concerned i meet them. i live in a very rural area the nearest shop is 6 miles and theres no public transport.without my dl i would have to move house. i dont know what to do next. sar sent to nhs and dvla
  17. Hi all, newly regsitered so hope you can advise.... i received a letter from the masgistrates court today for non payment of a £961 fine. It's the first notification i've had of this so obviously i'm concerned. i spoke with the court and thet said it relates to identifying in Oct 2012 an invalid licence held for a vehicle i sold nearly 3 years ago. They also said that the DLVA had today sent them notification i don't own the car. I now have to go to court tomorrow to do a statutory declaration which i am apprehensive about, and they informed me that the DVLA may re prosecute depending on the outcome. As i sent my forms to the DVLA when i sold the car i don't really know where i stand. None of this is my fault and i'm angry that the first i've heard of this appears to be incredibly harsh, and now i have to go to court at short notice! Any advice would be much appreciated...
  18. In August of 2011 I bought a holiday chalet that was advertised on Ebay. The chalet was sold to me under pressure because they ‘apparently’ had somebody waiting in the sidelines ready to buy it if I didn’t……I Know! It’s a well known sales tactic and I shouldn’t have fallen for it. However, I did, now I’m tearing my hair out and feel a fool! I was presented with the ‘licence’ to read while I was in his car being driven to the site office to then arrange the handover and change of ownership. When in the site office they offered me no advice to dissuade me from buying the chalet and calmly took my £50 handover fee. If they would have asked me the simple question, have you read the licence conditions? Or do you know that the chalets have a very short life? I would have backed out immediately. I feel very disgruntled about the way I was conned and feel that the site manager, who has now been sacked because of dishonesty, was in on the deal with the chap who sold me the chalet......where was the 'duty of care' on this site? I found out about the huge mistake I made a few days after I bought the chalet. I learned from chalet neighbours that all of the approx. 20 chalets on the site were in fact doomed and were going to be demolished in 2015/16 to enable the park owners to have only static caravans on the site as it was far more lucrative for them. Far too late I know, I read the licence and sure enough, it did say that the licence would expire in 2015. I immediately knew that I’d been conned and of course, felt a fool. I went to see a solicitor about trying to get my money back but was basically told that I had very little chance of getting my money back. So I just accepted that I’d been conned and accepted my fate, and got on with it! However, only a few months ago, a couple of weeks after I had paid the site fees for 2013 season, I became very poorly and lost my well paid job. I decided that I must sell the chalet so I approached the site office to get permission to advertise it and to ask them if they would extend the licence a couple of years to increase my chances of selling it, they said I could sell it but refused to extend the licence, even though there is a chalet next door that has two more years on their licence! This annoyed me as I know that they will only start demolishing the chalets when all the chalet licences have expired. I then called the sites head office to ask them why they wouldn’t extend the licence to improve my chances of selling it I spoke to his secretary and I put this question to her “I know that I won’t be able to pay the £3.600+ fees due in October this year I am now a pensioner and my income is less than 10k so what happens if I can’t sell the chalet?, to which she just replied, “Well, we’ll have to cross that bridge when we come to it won’t we?” Not very helpful at all! Despite only asking a couple of thousand for ownership of the chalet and even offering to give it away to another interested party, nobody wants it! The costs of owning the chalet and paying site fees, council tax, insurance, gas, elec and water, amounting to approximately £4.500 pa just to be on the plot frightens them off! I don’t know what to do now. How do I stand if when the invoice demanding £3600 comes in October this year arrives? Please help!

It started issuing photo-card licences 15 years ago and more than 30 million drivers now have one. These are usually valid for 10 years and there is a legal requirement for drivers to renew the photograph at the same time as they renew their licence.   20. Good Morning According to my calculations today is the last day that these guys had to appeal their licence revoke. Does anyone know if they have appealed and what does it mean for us either way ? Thanks
  21. Theresults of DVLA sight tests should begive to the person undergoing the test. Why you may ask? One part of the testinvolves a periferal vision test to press a button when a light spot appears.If you boob on the test by not pressing the button, they do not tell you. So you wait for the new licenceand low and behold you get a letter saying it is not being renewed!! Now how doyou appeal and how quick can retest to appeal the refusal? The answer is not clear and DVLA appear to have no sense of urgency. A neighbour of minehas not been able to drive since early October 2012. It is now 17th January2013! He sent, after considerable expense, a specialist eye report by special delivery at the begining ofDecember. Update- It is now 22 Feb and after he had written to them he has received a reply and a D1 to complete again! I ask, does this pay to declare honestly what problems you have? Does this make DVLA unfit for purpose, rather like the Home Office was described about 10 years ago?

Hello Any guidance would be gratefully received On 6/2/13 I was stopped for speeding on the m6 toll road, this was correct as no excuse I was breaking the limit, however when I got in the police car and we started to do the paperwork the officer said there was a problem with my licence He contacted someone at the DVLA and they said my licence had been revoked in October 2007, I knew nothing of this, I know people say I didn't get the letter etc. but that really is the case here I had fixed penalty points both before and since the date in question but only slightly over the limit on speed cameras I had never been stopped by an officer before So I had a licence in the correct address, I had points added 2 and 4 years after the licence had apparently been revoked, furthermore I found out as I hadn't apparently replied to the fixed penalty offence it had been reffered to court and when I didn't respond to the DVLA my licence was revoked I called the DVLA local office and was basically stonewalled, it didn't matter what I said they told me the letters had been issued, I didn't feel this was fair at all and spoke to the police again, they advised me to raise a grievance with the DVLA asking if they had any proof i.e. registered post that I had ever received the letters I did this by speaking to a manager, the first reaction was to ask me who had told me this and I explained I had been speaking with the police and AA Legal advice, the tone changed a little then and I was told nothing including any points would now be on file as it was too long ago certainly no record of my receiving the letters, so it seems I have to prove I didn't receive something, a near impossible task So to put this in perspective I cannot understand how Letter sent but not received (most believable thing) My case was referred to court, so therefore there would be a fine but I have never been contacted to pay it DVLA say they asked my local police to collect my licence, no such contact ever Points added 2 and 4 years later, which DVLA say's doesn't matter as someone just writes them on and doesnt check the system So all those anamolies versus them saying they sent a letter After the conversation they agreed to priortise the return of my licence and get things done in 3 days not 3 weeks, but I had my car seized which will cost me £200+, had to add a friend to my insurance policy costing me £70, time and associated costs which will be a lot as I work for myself and without a car I cannot but most importantly I have been driving without a licence and therefore without insurance for 5 + years Do I let the above go and get on with my life or do I raise a grevieance?, anyone know what the likely outcome would be and what I would have to do to pursue it?
  23. Hi My story is a bit involved so I thought I would start at the top and gradually move through the different questions I have. My initial question is if somebody applies to the office of fair trading for an amendment to their licence eg: to add another trading style to it at what point are they allowed to actually trade. Is it from when the application is sent or from when it was approved. I have checked the public register of a particular licence holder and they applied for an additonal trading name and style of credit on the 31st May 2011 this is when the OFT has stated application received on the 17/6/11 they have stated closed so this I am assuming to mean when the application was dealt with. I would like to state they are a sole trader offering mortgages and logbook loans Is the licence holder permitted to trade with the new trading style on the 9th June 2011 prior to what I seem to believe is the date the application was approved? Many Thanks for any advice and there is a lot more questions to come I just want to get things in slow order K
  24. hi im writing on behalf of a friend as the caggers have been so good to me, i hope they can help. my friend, sillyly in his youth (10 years plus) made a lot of messes on his license. things he cant remeber such as driving with no insurance, going through red lights, parking fines etc. he didnt pay these and moved around somehwta. i believe he was banned. we are talking about 13 years ago here and he cant really remeber. he is looking for work and needs a license to do most jobs. what will happen with these fines? he is financially penniless to put it nicely. could he face prison? the dvla have asked has he ever lived at his previous address which was not mentioned....as he applied for a first license. what should he do? he doesnt wanna face prison due to all the unpaid fines and by what he says they were around 3k, he deffo dont need baillifs visiting. should he say no? what will happen. awaiting your help. thanks

    DVLA bike licence

    Hi All just rcd my driving licence back fom the dvla after renewing my hgv licence.it has come back without my motorcycle entitlement (licence)i passed my bike tst some years ago cant remember the date safe to say over 25 years.it must have been on there as i was done for speeding on my bike in 2010 and had to produce my licence which came back with 3 points ..not sure how to go about tackling the dvla about it . thanks in advance
