Hi there, heres the story, I paid for an early upgrade online with ee. the cost was £251 including the early upgrade fee to buy out the rest of my contract and the upfront cost of the new handset. Now I ordered this the same day my new bill was generated, however my payment date for this bill is the 10th of each month, it was not due for another week so I didnt see a problem. in the after morning after ordering I checked the ee tracker to find news of my delivery only to find it `timed out` it couldnt find any record of the order number in other words. I phoned ee to find out what was going on, the rep told me for some reason the system had taken my upgrade fee but then straight away refunded it and it was on its way back to my account, she apologised and said if I wanted it back quicker I could get an indemnity on the direct debit with my bank asking them to cancel it and I should recieve payment that same day. Since then I found a better deal with another provider on the same handset (vodafones 32gb of data v 8gb ee were offering for the same price as I was paying now monthly!) I decided id use the refund to pay off my contract with EE and go with that one instead of upgrading. I contacted the livesupport on the ee website just to ensure the upgrade hadnt been put through again and to make sure it was indeed cancelled before going with the other network. I was then told that I was not being issued with a refund, the funds instead had been put towards my account balance and it was now in credit (this was presented as something I was apparently meant to be happen with) Now I wanted the refund, my bills not due till the next week and I didnt want to pay it till my next payday which falls before my payment date anyway. I was told I couldnt be refunded as the payment had already been put towards my bill and id just have to get a refund of the credit after paying my bill the next week. My issue is I never authorised this, the payment was sent as part of the early upgrade service it was payment for the early upgrade fee and the handset it was never authorised by me to be used as payment for my bill. EE have just gone ahead and done this without my permission then used that as a reason for not refunding me, I dont see how this is legal to use a payment in a way it wasnt intended without asking esp when the payment is taken as payment for a specific. product and service such as an upgrade. Not happy as not only was my payment used for something not intended by me and without my permission but the woman on the phone in the morning was obviously utterly using me. What I think has happened is ee have sneakily used the fact I made a payment for this upgrade as a way to have me pay my bill off early and just cancelled the upgrade so they can use the payment for this. Obviously very dodgy practise if so! Im just wondering if my misusing my payment in this way ee may have broken any part of their contract, id love to get a bit of revenge by using it as a reason to tear it up. Latest update got in touch with my bank, they say I cant get an indemnity anyway as the payment was by card (so the ee rep was totally using me this morning it appears!) but that the payment is still pending so it shouldnt take any time at all for EE to refund as they can just cancel it.....lets see if they choose to or see if they choose to `keep the money` on my account balance against my will......what they do will decide if I take further action im guessing, EE rep claiming they dont have the ability to cancel a pending payment......utter rubbish! I will be taking this further! luckly ive saved the chat transcripts. anyone else experienced this kind of thing?

  7. Hello All, About a month ago I paid online for a flight with a European Airline. Somehow (no fault of my own) the payment didn't go through although at the time it showed the payment pending. The next day my bank notifies me of possible fraudulent activity and thus locks my online account. Several days later the airline later email me about this non payment. Now I am back in the UK I have contacted my bank, and furthermore contacted the fraud centre. They notified me of the fraudulent activity was actually the airline getting into my personal online bank account with no permission. So regardless of if, why or what their intentions are / were, is this not illegal for an airline, or anyone, to invade a person's privacy like this?!! Can they just get away with it?   8. Hi Guys, Would just like to first say, yes i was stupid and i did a big mistake. But i would like to know a bit more about the law and what i could be facing. I am 22, i have already 2 x SP30 so 6 points altogether. I was driving from dover back to london when someone was up my ass, i let him go infront and did the same back to him which led us to go to around 110mph. When a traffic officer was then behind us with lights on and stopped us both. Other driver wasnt insured or even have a licence so his car got impounded and not sure what officer gave to him. Whereas, with me he said he doesnt have a speed recording of me doing 113mph, so hes writing in his sheet that i was exceeding 70mph. So on the Sheet he gave me on the recorded speed it states "E" and that is all. Its been 12 days since the offence, is it true that they have until 14 days? or is it 6 months to get summons from court? I have spoken to some speeding ticket lawyers/solicitors and they have all said this is something new and never heard of the recorded speed having an E. I hope to hear from you guys.   9. I like to find quirky rules and laws and I have a strange one to share. Story >> 'Having been a practising solicitor for over 16 years, I like to think that I have seen my fair share of quirky cases. But imagine my surprise when I was recently asked to represent a severely disabled man who was being charged with drink driving while on his mobility scooter. I joined the case late in the day. When I met the client he had already been charged with the offense and had attended court and ultimately pleaded guilty to a charge of driving a mechanically propelled vehicle whilst unfit through drink'. Although this story is now a few years old (2014) it still raises several issues in regards to the use and control of mobility scooters.   10. The government has today said they are to introduce anti-trolling laws. The proposed plans will make it easier for the victims of internet trolls to bring actions against either the ISP or the site owner where the comments were posted, or if the ISP or site owner discloses details of the troll the liability shifts from the site owner to the troll themselves.   11. Hi, Long story but we moved into a flat in approx 2004 and lived there for 2 years. We paid a £400 deposit. My father in law moved in with us (landlord knew about this) and after 2 months we moved out and the tenancy was signed over to my father in law, with is as guarantors. Our deposit was transferred over to cover my father in laws deposit. So from 2006 until now my father in law lived there. Unfortunately just before Christmas my father in law died unexpectedly. He left no will and had no real money, (a small pension, very little in his bank account). He is not married, he had 2 children my husband and my sister in law. The police have put my husband down as next of kin. My husband found out whilst going through his fathers paperwork, letters regarding his father paying an extra £50 every 2 weeks to the landlord to cover a water bill he had got into debt with. The landlord had agreed pay it for him. The latest letter my husband found was from the landlord saying the water bill had finished and there was one more bill of £100 to pay. When my husband questioned the landlord he said my father in law had kept paying it even after the bill was dealt with. My husband has worked out this would have been £600 over payment. So the landlord has £400 security deposit and £600 Of my father in laws money. The landlord has told us he is just working out the money and the cost of cleaning the flat (it was very dirty, no carpets just laminate flooring everywhere). We have now received a letter from him saying In relation to the deposit and fathers overpayments I can confirm I have most of the information in hand. I need to get the figures accurate so am just awaiting the cost of cleaning. Please do not feel I am being awkward with you,(as I also wish to resolve this quickly as possible) but I will require information on who is the executor of your fathers will, or the licensed administrator of his estate (if he died intestate). This may well be yourself, a family member, or a nominated person but we are only permitted to discuss this with that person. As any monies must go to your fathers estate. Please supply this at your convenience so the matter can be resolved. Regards Xxxxx What do we have to do, to sort this. We agree there needs to be cleaning but now he's asking for a licensed administrator. I've tried looking this up and am unsure whether you have to pay for this. Do we need to go to a solicitor or does my husband write back and say there is none as next of kin all monied should come back to him? It's not a huge amount but it is what will help with the funeral costs. We not after the money for ourselves just for the funeral costs. Any advice would be most appreciated. Thanks
  12. Hi My husband is step dad to my eldest boy and his biological dad has parental responsibility. We meaning my eldest son and my 6month old son and husband all live in Southport UK and my eldest sons dad lives in Bootle Liverpool but we as a family are looking at moving to Cumbernauld Scotland. Can my sons dad stop us if he has parental responsibility. Especially if we are saying we will bring him to him during school holidays and pick him up during school holidays this meaning he has no travel cost at all and would see him for 52 days during any of the scottish school holidays which is the equivalant of what he has him now he has him every saturday now. PLEASE PLEASE HELP!!!!!!!!!!

Hi fellow CAGgers, My son is intending to return to England in the near future (about 2 months hence) after several years outside the UK He will obviously need to rent an apartment and get a job (hopefully) What changes should he be aware of in relation to tenancy agreements, e.g. fees payable outwith the rent, TD schemes, etc. There will probably be an issue over credit checks - how best to approch these? Been asked by a friend to see if i can find out the answer, got arrested in Spain 8 yrs ago and fined, didnt pay the fine, now wants to go back to spain but dosnt want to be arrested, would like to pay the fine now if Pos, or what are the chances of them being arrested if they go back (new passport since then so number different) just wants to get it sorted one way or another.
  16. Slightly unusual question here- my daughter had a minor bump that caused no damage as she rolled into the car in front of her in a queue of traffic. Exchanged details with other driver and expected him to bill her for possible scratches that couldnt be seen. However, 4 months later gets a CC summons for £770 for replacement bumper and other parts that were unmarked. Now, knowing about enginering and physics I worked out the speed needed to cause the damage claimed needed to be at least 5 times greater than the speed she was going and given the strength of the materials cars are made of it is beyond the realms of physics to actually cause the damage claimed in isolation . If the impact had caused the damage claimed both cars would be crunched and the drivers in hospital with broken bones. She is obviously insured but what are the chances the insurers will bother to contest this claim? Does anyone know if once admitting liability for the accident it automatically follows that all of a relativley minor claim is paid out without referring it back to either the driver at fault or their insurer. She has passed on the necessary details and a letter saying advantage is being taken in this case to her insurers but will it make any differenec that the claimant is asking for something that is not connected to reality.
  17. Hi, Does anyone know if it is legal to defer arrears on a loan account without notifying the customer this has / is about to happen? I thought any business operating this type of method would have to let the customer know there was going to be a change to the account? by that I mean putting the amount of arrears to the end of the agreement which by definition changes the end date? Its a bit like implementing a payment holiday without the customer being aware of it? A good friend has just had this happen with a company she deals with and im almost certain its illegal?
  18. Hi there, i'm not sure if this is a little off topic or not, I was wondering if anyone knew of any UK based courses on the laws around money, a degree, A level, what ever is needed. To perhaps shed a little light on my situation, I've been studying psychology for about six years now (23YO) I only learnt so that I could gain the skills to interact with and influence others around me, which seems to be working. I am about to start a PHD in hypnotherapy to help refine the skills I've gained, to go along with it. However i'm absolutely terrible with money, although my debts aren't large, I still have those annoying phone calls and threats of court proceedings. When I am on the phone to said people, I know that they are lying to me about stuff, but because I don't have a specific knowledge in the laws around money I fail to get anywhere, for instance adding on interest to a frozen account etc... I've been racking my brains searching through page after page in google, but there doesn't seem to be any courses, any help is appreciated. Thank you.
  19. Hey I'm currently facing disciplinary action at work and was looking through the previous posts on this site regarding the law with recording and watching members of staff. A few weeks ago I was put under investigation over taking an 'unofficial break' during work hours. I was in my department, had finished the majority of my work, it was a quiet day and the cameras had supposedly seen me sitting on the floor doing no work (sitting on the floor is quite common with many staff due to the bottom shelves being hard to reach while standing). I work for a large retail company who hire an external security company to monitor the cameras and have been told that the managers of the store are not allowed to use the cameras to monitor members of staff in order to discipline them; the cameras are there for security purposes. However, I find myself in a position where the camera has caught me not working for a short period of time and due to me sitting on the floor security have notified a member of management. My problem is that I'm 99% sure and as are most of my colleagues that managers have been using the cameras to catch members of staff not working. Yet in over three years of working for the company I have never heard of this action being taken place before. Not only that but it is common for members of staff to be standing around for up to half an hour at a time doing nothing yet no action has been taken by security to notify management. Is there any sort of way I have had my rights breached? If management are allowed to watch cameras and use them to take action am I being picked on due to nobody else having this action taken upon them considering I have a rocky relationship with some managers?   20. I really need some help and some advice on what to do asap. Thank you in advance to anyone who replies. I am desperate right now. I am in the UK. Been out tonight. Got home and my mum told me she'd had a phonecall from the police. It is regarding a shoplifting offence that I have previously committed and thought I got away with. It was groceries. I am not going to go into details of why because it won't help right now but it's not the first time and I had a caution just a few weeks ago - I know, I know, please a lecture isn't goign to help, I know how wrong I am. at the time I did worry that they had seen me and it was late at night and they obviously took my mums registration number and this is how they have got into contact these weeks later. I didn't speak to the policewoman obviously but she is apparently going to ring me tomorrow to discuss this. What do I do? What do I say? What is going to happen to me? If I have to go to the police station again I don't think I could cope with it all. I know I need to not do this again. I have a very severe eating disorder which is the root of all this but I KNOW it isn't an excuse. They would be able to see by cctv that I am quite ill though appearance wise, but I don't think it will make a jot of difference really as like I said this isn't the first time and I should have learnt my bloody lesson by now. I hate myself. But I need to know what to say on the phone. Whether to admit it or say I can't remember or what/ I just don't know. I am scared. Please help. & please don't judge I can't deal with it. Can't believe this is happening. Apparently they actually thought i'd stolen my mums car or something and she had to explain that no, she bought me shopping but did not know I had stolen, I used the self serve checkouts and just didn't pay for a lot of stuff. Like I said it was late at night and they had no security around. Thank you for reading.
  21. Could someone help me with this, my daughter had an accident in a major department store. Staff where told, and acknowledged by the physical evdience of that happened. I was in shock and had a very very upset child, when i have spoke with various people re the accident i was told due to Health and Safety law this should have been recorded. I contacted the said store, and got a responce that i refused medical care thus this means it would not go in the book. A- I never refused medical care B- I have been told even though we never had medical care their that its their responsibility and they had to record the accident for their own legalalities to cover themselves from being sued. Can someone please confirm what ACT it is in law that they have to follow on recording this
  22. I have been reading about TV Licensing recently and whether they are lawfully required or not. I have no personal objective here other than enlightenment. I DO have a linence and will contiunue to do so as I can afford it (thankfully I have a job) and I know that I would be harassed if I didn't have one. But that got me thinking....is the main reason that people buy licences because they feel that they would be committing a crime and be threatened/harassed for not having one? When I was at Uni (some time ago now!) I received all sorts of threatening letters (more and more red ink each time) despite not owning a TV or equipment capable of receiving a signal...and this was despite me notifying them of this. Reminds be of DCA threatogram tactics. Churn out 10,000 threatograms, a few will cough up = result for them. I've heard about £1000 fines being threatened, sending enforcement officers round to visit, and even prison! Some arlicles I have read (and youtube vids watched) talk about how, as the TV Licence requirement is based on the Communications Act, it is a 'Statute' and not a 'Law'(Common Law). Not having one does not cause harm or loss to another person so cannot be considered an unlawful act. The case studies suggest that one can 'remove their implied right of access' so that TVL peeps are not allowed to enter one's property and one can refuse to answer any questions to any enforcment agents (normally Capita)....and there is nothing that they can do. The key (apparently) is to avoid engaging with them in any way as they have no right to demand info and enter your property...or even demand your name. People fall foul of this when they fall for the intimidation and sign statements agreeing that they do not have a TVL despite having a TV. As we are talking about an Act/Statute, there has to be an agreement on both sides so unless you agree, they cannot enforce. Correct? or BS?!! So my question is - how does this work out in reality? If someone cancels their licence (or never has had one) will they be 'got' in the end by the TVL people and court system. Can the Police get involved? Will you go to prison? Or is the BBC/TVL hoodwinking us all and with untruths, deliberate misinterpretation of the law, intimidation, threats, harassment and bullying? And should the TVL be abolished? I came here to ask as I very much value the CAG members' opinions and views....
  23. i moved in to a house with a 6mth short hold lease and wasrushed in to it saying it had 3 people after it so payed deposit and waspromised all work and house wouldhing be done up before i moved in when theypurcused it had been emtey for years and and just paint walls did no cleaningect was a mess said i was responable for windows if broke and report anythingelse well when got there could believe it and as time went on never did repairswas at times left with no water and had no heating in the freeze of dec2010 andso on loads of things mold everywhere washing mechine water ran in to yard werekids went all time left down stairs toilet not working for about a year andwhen i moved out as had no choice with him and his staff bulling and if moanedwas told would be kicked out hada break down and when left the was somecealrance and repainting butall the other stuff he added on was like that wheni moved in was caught out lying at court charging for things twice lied aboutwhen i moved out for extra rent chagred for repairs not done as i had pics andcan prove all even the judge knew he was lying and didnt have right recipts ieonly just inside the law still as he took the case and my parents as guartoreven when seen to been lying was still given 3 times what it would of cost torepaint and remove thing so my mum and dad got a 2800 bill which am paying andthat was the judge nearly knock 1000 off i want him to not get away withtreating my mum when ill me and others in this way i can prove most things but things like going with out heating and water is a couple of old letters i wrote complaining to him which is when he started getting really nasty and every time i tried to do anything about it he threatened to kick me out and as i was was have really bad mental health issue at the time just hide away and never did anything and in the end i was forced to move out for fear of being made homeless with 3 children:mad2: please any help or advice would be geatly accepted and used thanks very much in advance

A friend of mine last year had an accident on a well known pier, through no fault of his own he slipped on a puddle on the floor and severly injured himself, anyway cutting a long story short, he was off work for 4 months and during a meeting set up by this pier he was assulted by a security officer. They then proceeded to fabricate a lie that he was rasist toward the security officer who assulted him, all whilst he was still in recovery for the accident. He was taken to court and won with all 12 Jury delivering a not guilty verdict in just 15 minutes. He has now been advised to proceed with the original accident claim, which they have rejected with no investigation and compensation for the assult and Racism case, including costs and loss of income during the period. Now this pier is owned by a well known entertainment and gambling company renownd for not playing by the rules. My friend now plans to create a campaign against this pier and their parent company, he intends on making their 4.4 million visitors aware of what may happen if they had an accident, he intends to set up a website posting factual information and inviting others to add their own stories, as hes sure hes not the only one to be assulted over the years. He intends to make compaints to Trading standards, Enviornmental health, Gambling Regulator etc... He also intends to demonstraite on public land next to the pier from the start of their busy summer period. Firstly can he do this? - hes had a stong letter from the parent companies solicitor stating that: "You must appreciate that we will not tolerate defamatory publications or attempts to unlawfully interfere with our business. We will actively monitor the internet, press and other forums and if any defamatory comments are made, we will tae steps to protect the company, to include court proceedings seeking damages, injenctive relief and costs. Please note that all rights remain reserved." Basically I want to help him with the campaign as I have a sneeky feeling this company have many skeletons in their closet that they dont want to come out, what advise can you give me for setting up this campiagn? Are their any good sites to help with this sort of thing? Any comments and replies and warmly welcomed. Thanks for reading!
