  1. Good afternoon, In a nut shell. Opened a BC CC in Mar 2003. Missed a few payments which meant that i incurred Over Credit limit charges. Over the course of the next 14 years, it escalated. Despite missing payments and over credit limit charges, BC doubled my credit limit on 3 occasions, June 2009, March 2011 and March 2014. Leading to more financial trouble for myself which was impossible to get away from at the time. Finally got back on track in 2018 and managed to clear the balance, but still incurring interest and some charges. Prior to each limit increase, my record with them was nothing short of abysmal, missed payments, over credit limit, when i did pay i was rarely over the miniumum payment. 38 missed payments and 48 over credit limit from 2009. My question is, do i have a claim against BC for irresponsible lending? Regards G

I have mentioned before on the forum of the dangers that debtors face when they visit popular 'social media' sites and apply to join 'closed groups' that claim to offer advice to anyone who has received a letter or a visit from a bailiff. These sites profess to help debtors. Don't be fooled. In the case of this particular thread, the social media site page in question has one aim only and that is to ensure that payment is never made to a bailiff. That is their overriding aim. Debtors joining these 'closed groups' wrongly believe that what they post remains a secret. It does not. Almost all bailiff companies, debt collection agencies, mobile phone providers and banks etc are members of these groups and can recognise the debtor immediately from the documentation frequently exhibited. Yesterday was one of the most serious examples of appalling bad advice from inexperienced members of the public that ultimately led to the debtors vehicle (worth £4,000) being taken by a High Court Enforcement Agent. The poor and inaccurate advice also led to the debt increasing by well over a £1,000.

  6. Hi, first of, just to let you know what I have: Assured Shorthold Tenancy (6 month fixed) which started 16 Nov 2011, it's now a monthly periodic. The letting agents, only having just ventured into private letting (monthly) for the first time ever, issued me with an AST which is a bit of a frankenstein AST. By this I mean: When dates and "months" are mentioned, they used the lunar (not 28 day calendar) as reference. Tenancy, as quoted "The tenancy begging -3 Oct 2011 and is for a fixed term of 6 months and ends on Mid-day on 03 April 2012 subject to terms in this agreement." Rent, quoted as "Total Monthly Charge £450" Rent is to be paid, in advance for the following month i.e. from the 3rd of the month to the 3rd of the next. Then when they mention under "changes in rent", this is how the terms are listed out: We may review the rent due for the premises at any time after six months from the commencement of the tenancy, provided you are given 4 weks notice of such charges We usually increase rents with effect from the First Monday in April each year, but reserve the right to increase on another date. We can reduce the rent at any time. The on the 9th October 2012 (part way through the month 03 Oct - 03 Nov) they wrote to me the following: What happened is that the rent change happened mid-month i.e. 03 Mov - 06 Nov was £450 / mo then 06 Nov onwards was £495. The Shelter helpline have told me that how it works on month periodicals is that: 1) When notice is served, that notice period starts at the first day of the next period and if the notice period continues into another period, the notice changes take effect from the start of the next period from the notice period end date. 2) Rent changes can only take effect from the start of the period after after the notice period has ended. (or something to that effect) I got a little confused as the council told me a whole other story (which I will explain later in the thread).. Am I right in thinking that, the notice period should have started as of the beginning of the next i.e 03 November meaning that the rent increase should have taken effect as of 03 December 2013. Another question, looking back at the history of my account, this has happened each of the 3 times. In one case I received a letter in April stating that the rent wasn't going to increase that April, but it did anyway in November? Can they do that? Finally, the rent increase in question here has been in dispute since it happened. Whilst disputing it, I notified the Council to get the HB raised to cover it so I don't go into debt because of credit reports etc... so they did. The dispute happened for months and months with no budging from the LL. Finally, the person who was handling the dispute left the company entirely and left it all to a bunch of people with no organisational skills. From here on (mid 2013) noe o the repairs are being done, which I'm also disputing, amongst others things and somehow the whole dispute "vanished"... Early this year I received a letter about "arrears" of about 2 weeks (as HB weren't paying the full amount). I contacted them, set up a payment arrangement and make it VERY clear in writing and with each bank transfer that they are nothing but "TOKEN" payments. I've asked time and time again to review the dispute as the increase wasn't even agreed, plus all their dates are wrong, but they seem more interested in collecting arrears. than dealing with this. Can someone have a nose over this and have a look at how I could approach this? Cheers, A

  8. Tens of thousands of elderly customers face a rise in their energy bills, after one of the UK's biggest suppliers withdrew a tariff for the over 60s. E.on has announced that it will scrap its StayWarm scheme, which offered fixed-price bills. The firm blamed new rules which limit the number of tariffs that energy companies can offer. The changes are part of the government's plans to cut bills, and have been backed by the Prime Minister. They are being implemented by the regulator, Ofgem, and will limit the total number of tariffs to four per fuel. "Due to new Ofgem rules, which includes limiting the number of tariffs we can offer, the StayWarm tariff will close as current contracts come to an end from October 7th," an E.on spokesperson said. The customers concerned will be written to, and advised to switch to another tariff.   9. When I signed up with O2, about 18 months ago now, I was told in no uncertain terms by the sales assistants, that the cost will remain the same throughout the term of the contract. This was the strong point in their sales patter - the reliability of this charge being the same constantly to help you budget for the duration of your contract. I was (foolishly) persuaded. May I ask whether this constitutes a breach of contract if they now decide to increasse the charges in spite of having made verbal promises via the sales staff to keep to the same price every month for the duration? If there is a clause that allows them to do this, would this constitute an UNFAIR contract? After all, I am required to pay IN FULL the complete remaining cost of the remaining months should I decide to leave O2 and even then, after payment has been made, I would need to give a month's notice AND not enjoy the service any more from that day onwards. Should I complain to OFCOM? I shall, of course, be complaining to O2. Any advice would be greatly appreciated.

Although Eon have lowered p/kwh ,unit rates,they have scrapped the Annual Threshold of 2680 kwh in which customers saw unit rates once this was achieved fall from 8.436p/kwh to 3.67p/kwh inc vat. Under the revised E.on EnergyPlan with prepayment the old 8.436p/kwh is replaced with a sole unit rate of 4.256p/kwh inc vat. However,there is now a daily standing charge of 27.395p per day !

  12. Hi, I received an email from Three last night telling me that they are increasing my monthly price by 3.6% in accordance with inflation. I wasn't happy with Three at the best of times however, they said in the email that as this price increase goes hand in hand with inflation then no one can cancel their contract as it says in their terms and conditions. When I took the contract out, I was of the understanding that it was £30 a month however, it turns out that that's excluding VAT so I actually pay £35 but that was not ever mentioned to me nor does it make that clear when purchasing the phone. I've also had numerous problems with signal and internet connection. I am desperate to get out of this contract. I have another year left in July. Can anyone advise me as to what I can do? I have thought about just cancelling the direct debit however, I am aware that that would have an adverse affect on my credit rating but I can't think of any other way. Help would be appreciated.
