Hi, i have received an email this morning telling me plusnet are increasing my broadband by £1.50 per month, obviously this is alot and is mid term of my contract with them, my questions are can they do this as i dont have any paper work to see terms and what legal rights do i have to cancel without paying a cancellation fee.   4. My annual gas consumption varied between 402 and 482 cu.ft. between 2007 and 2012. This past year my consumption has increased by 39.4%, which I cannot explain: 1/08/11 to 1/08/12: 437 cu.ft. 1/08/12 to 1/08/13: 609 cu.ft. No changes to my gas installation or my usage of gas have occurred during the past year. I retired in 2004 and live alone. My home had new double glazing fitted to all windows and doors, cavity wall and loft insulation installed in 2005. A new warm air heater was installed in March 2010. My hot water is supplied from an electric immersion heater. My gas meter was manufactured by Parkinson Cowan, modified by George Wilson Industries, type R5. It was installed on 18/05/1999. I tested my gas installation for a leak by comparing full meter readings over a 10 hour period. The reading was unchanged, so I do not think there is a leak present. A graphical analysis of my gas consumption readings for 1/08/12 to 1/08/13 compared with 1/08/11 to 1/08/12 shows a diverging increase throughout the period related to the consumption. I suspected my gas meter was faulty, so I reported this matter to EDF Energy. At its request, I recorded meter readings for two 5-day periods. EDF Energy does not think the meter is faulty. I would appreciate advice on what steps I should take next.
  5. Hi Please help and explain if a landlord can legally increase monthly rent by £150. A bit of background. At the end of August we will have been in this property 4.5 years. When we moved in back in 2009 our rent was £850. almost 2 years later I mentioned to our landlord that we were expecting our second baby due around the 2 year anniversary of living here. We then received a letter stating that the rent will be increased to £900 which is what we paid consistently. Earlier this year my husband who works on a commission basis received salary of £960. His lowest ever. All our other direct debit went off and the biggest amount (the rent) didn't go off as we didn't have enough. Initially she wanted to evict us if we didn't come up with it in a weeks time. And then finally agreed we could split the £900 over 3 months and therefore pay £1200 for 3 months which the last one would have been paid end of June. Luckily for us after paying the first £1200 we managed to get help of £600 to pay her the rest and we were therefore upto date with her rent and been paying £900 since April now. Earlier this month we received a letter stating that the rent would be increased from September to £1050. My immediate thought was that she wants us out now as she is fully aware that we just about covering our monthly bills. Her later stated that we need to increase our standing order if not to take it as our official 2 months notice and vacate. Now the problem is in our area we cannot find anything cheaper. They all similar priced. We were looking into putting money slowly away to move by next year before our 5 year anniversary in the property as we really cannot afford the deposit, rent and credit checks upfront at this time of the year. We also think that increasing it by £150 is really really high and it is her way of getting us out because of having problems before. Can she do that. The first 2 years we signed 1 year contracts but have never signed anything since. She also stated that she has never increased the rent before which is not the case. And rental properties with the value of £1050 in our area are all semi detached with dining room or conservatory or something additional which hers isnt but a small mid-terraced property. Thanks
  6. Can I please scream out loud within the very safe and comforting arms of CAG??? I'll take that as a YES as long as I don't shatter the chandeliers. Simple question! If the council admit to being totally overwhelmed by the increase in the volume of those claiming HB and CT reduction, why don't they just take on more staff to deal with the backlog and process claims in a timely manner instead of inflicting even more stress, anxiety and frustration on claimants when simple reclaims for continued HB and CT reduction take two months and more to process???? My last claim for HB in Dec 12 took three months to process. When you're on JSA and DWP are messing with your benefits as well - it's almost impossible to get anyone to listen. Grrrrrrrrrrrrrrrrrrrrrr!! With all the number crunching and statistics that are being undertaken by every dept in the council for auditing purposes, you would assume that they would be more than capable of forecasting significant increases in volume of those claiming benefits and develop an appropriate strategy to deal with it!!!!   7. This thread is to keep everyone up to date with my little tussle with Scottish Power. A couple of months ago SP wanted to up our DD by nearly half as much again saying that they predicted we would be using more energy soon, at the time we were in credit with them so I emailed them saying i wasn't happy with the increase, inevitably they responded saying the increase would go ahead, I cancelled the DD and have been paying by Debit Card since, and yes, we are still in credit. As a result they cancelled the plan we were on and put us onto the standard plan, a further email to them saying I wanted the original plan put back in place, their response was as follows: Your previous service package was Online Fixed Price Energy May 2014 which was changed to Standard following the cancellation of the Direct Debit payment plan. We offer the service package with the monthly Direct Debit payment plan. Now, the advisor that sent this email obviously isn't aware of their own T&C's as in the Terms it states quite clearly payment can be made by DD or Debit Card. So yet another email sent to SP ( and the SP Rep on here) this time stating that I want the original payment plan putting back in place. This is no doubt going to build into yet another disatissfied customer thread, you'd think that with this virtually doubling profit, what is it £700,000,000+ now, they would have better customer service

Hi All, I have received a letter from Santander Cards stating that they are going to increase my Interest Rates as follows: Purchases: 17.9% - 29.9% Balance Transfers: 17.9% - 29.9% Cash Advance: 27.9% - 29.9% Needless to say I was rather appalled at this. They have stated in the letter that I may close the account and repay over a reasonable time period at the current interest rates. What would be the best course of action here? I don't particularly want to use a card with an interest rate at that percentage APR. I have another credit card I can use so I am more than happy to jump ship on this one. (Don't particularly want to Balance Transfer though, would rather come to a sensible repayment arrangement) Cheers, NukeShark.
  9. Hi all, I have not had a Housing Benefit rise from Cornwall Council for 3 years. This is despite my actual rent, (private) increasing in February of each year. At one point, when I requested a rise from the Council, they actually Decreased it. I’m assuming that it was meant to blackmail me into not asking again. This year, they told me they are already paying the maximum allowed for someone like me (a single disabled man, on DLA, P.Credit [till next week – when State Pension kicksin], “as is legislated”). Question: Is there legislation that states that there should be no housing benefit increases for 3 years or longer ? If so,where can I find it please ? If not, which minister is likely to read a letter from me ? George Osborne (or office) doesn’t ! many thanks for reading
  10. Hi All, T-mobile have recently informed me of price increase effective from 9th may 2013. I find this really unfair and have been on the phone with them to cancel the contract due to material detriment as per clause 7.2.3.2 in their contract, However they insist that for the price increase to be of material detriment it has to be above RPI as stated in clause 7.2.3.3. But I think that is not correct. I will be writting a letter to them since they dont seem to reply to emails. If I send them the f ollwing letter will it be OK? Please advise. Thanks for your help. Dear T-Mobile, Re: Contract Termination for mobile number XXXXXXXXX I have received a letter from you informing me that from 9th May 2013 my price-plan will increase by 3.3% (i.e. from £36 per month to £37.18 per month). Thus, with reference to clause 7.2.3.3 in contract terms: 7.2.3.2. You are a Consumer and the change that We gave You Written Notice of in point 2.11.2 or 7.1.4 above is of material detriment to You and You give Us notice to immediately cancel this Agreement before the change takes effect; This change, in the price plan, is to my detriment. Your clause entitles me to cancel this contract without charge by giving you written notice prior to the change taking effect and I now wish to exercise that right. I would like to take this opportunity draw your attention to the fact that clause 7.2.3.3 is instead of, and pre-empts clause 7.2.3.3 and is not additional to it. Material Detriment is including anything implemented under 7.1.4, which therefore, includes price increases. May I also inform you that Clause 9.6 of the General Conditions of OFCOM which states: 9.6 The Communications Provider shall: (a) give its Subscribers adequate notice not shorter than one month of any modifications likely to be of material detriment to that Subscriber; (b) allow its Subscribers to withdraw from their contract without penalty upon such notice; and © at the same time as giving the notice in condition 9.6 (a) above, shall inform the Subscriber of its ability to terminate the contract without penalty if the proposed modification is not acceptable to the Subscriber. On the grounds outlined above, I look forward to a smooth termination of my account without any charges followed by the issuance of the PAC code. Please note if I do not hear from you by 30th April 2013 I will seek to resolve this matter through Small Claims Court.   11. Dear All. I hope someone can advise and help , I've had a credit card with the Co-operative a Platinum credit card fixed for 5 years at 9.9% no problem there. Then at end of term reverted to 12.9% fine now a few months later its going up to 14.9% as I hope some of you will understand I questioned this and phoned them asking why the so recent increase. The chap said Mmm well its because its automated I said well why , he went of to speak to a manager he came back saying its to do with your spending pattern and possibly credit reference. I've been with them 20 years or so have other credit cards and recently Barclaycard have increased my credit limit by £1000 pound , I always pay on time pay more than the minimum, I haven't changed my spending pattern never been late or missed any payments. So I said why the increase he couldn't really answer I had a balance of £300 on card paid £150 today . I feel very badly let down by them they had no real answer and its only Coop that have ever increased there APR of coarse im not happy in sure they can surely use there customer loyalty department and lower my APR but no real answer . I have written to complain but im wondering if im within my rights to have a explanation why because they can't really tell me apart from making more money from me. I've been a loyal customer of there's for over 20 years to be treated as such , when I paid in full on time everytime my APR remained the same I find this very hurtful and totally without justification in my eyes . I said to the guy look at my account never late or missed any payments you couldn't wish for a better customer but he just said im sorry I don't know what to say . I know lower the APR because it can be done because a company many years ago did when I said id close my account , ANY POINTERS ID BE GRATEFUL . Like I've said I've written a letter stating why have they done this and to look at my account over the 20 years never to default and threatened to rightfully leave if nothing is done to address my concerns . Sorry if this sounds petty but this is the only company who have acted in such a unreasonable manner with no real answer or concern about customer relationship.   12. Hi all, I have just received a text message form O2 that reads: "O2: We need to tell you about a change to your tariff. From 28 February 2013, your monthly line rental will be going up by 3.2%. That's the same rate as inflation. To find out more, visit o2.co.uk/prices or call 2202" When I had read it I did the obvious thing and checked O2's Terms & Conditions and it was clause 5.3 that caught my eye. It states: "5.3 You can end this Agreement without having to pay the Monthly Subscription Charges up to the end of any Minimum Period you have left, if: (a) we increase your Monthly Subscription Charges by more than the Retail Price Index (RPI) annual inflation rate at the date we notify you of the applicable price increase; or (b) we increase any of our Charges (apart from for Additional Services) in such a way that would have increased your total bill for the immediately previous month by more than 10% (if the increase(s) had applied for the whole of that month)." My next step was to check the current RPI annual inflation rate and found that the latest one which was released on 18th December is only 3.0% (as per the office of national statistics which I am not allowed to post a link too). This is however for November, but as the RPI for December isn't actually available until 15th January (or even calculable until December has ended) then the RPI for the date I was notified is set at 3.0%. This therefore means that they are actually increasing the price by more than what is allowed for in their T&C's and I should be able to cancel my contract? I would be interested in what others think about this as I am aware that there was discussion a few months ago regarding a similar matter with other providers. I don't see why when you enter into a fixed price contract that they should just be able to increase the price whenever they want, even if it is only a small amount. Regards Mikey

  14. I've just receive a letter to inform me of a price increase by £4.59. I'm on 50mb and was told, along with everyone else, that my speed would be doubling, that was last year, Then came a big price rise and still no speed increase. Now we are almost a year on and another increase in price but no increase in BB speed, I'm still on 50mb despite being told it would be doubling. They now say it will be by the Autumn of 2013 which I suppose will be after another couple of price rises. So much for 'Free' speed increase. Time to make this public on Consumer Action Group.   15. hi sorry if this is in the wrong forum but i've just wondering if anyone has any experience with aqua card putting up interest rates? I've had the card about 2 years had a couple of credit increases always paid on time but today i've had a letter telling me they are putting up my interest rate from 34% to almost 46%, i am at a loss to unsderstand why? anyone got any advice for me ? thanks
  16. Hello ! Travel company Clear Sky Holidays increased their price by £25pp. According to them i was too late to make a booking (deadline was 26/10/2012). I did it online on 25/10. I know that according to their form I was not giving them the exact details, but fine print says: "Booking required via Clear Sky Holidays at "web site mentioned which I can`t post according to this forum rules" or by phone: 0844 493 4655." So that means I completed my first step. After a while I received an email: Hi Tom, Thanks for the interest in the offer that we were advertising. If you can contact me on my direct line number 02085111742, so that we can discuss the holiday and book it for you. Called them back to a number showed above, but company said that they have to increase a price, because I was too late to make a booking, that was my fault and blamed me. Yes I called them few days after I received an e-mail. I was away. But according to fine print there is a choice: online OR by phone. On the online form there is no mentioning of additional phone call which I have to make in order to "complete booking" (so I though that I have done everything before deadline comes), in e-mail there was no period of time as well.   18. Hi all, I checked my PAYE Tax in May and it was around £300. In June it had shot up to over £400. Is this due to the UK budget coming into effect or is something unusual here? I've been advised to investigate with HMRC but knowing how long they take to do anything I thought I'd ask here first Thanks Chris
  19. I am a secure tenant (30+years) and live in fair rented HA accommodation. The rent officer visited my current home 9 years ago (as new build) and wants to visit again soon. What is (in plain language) the formula for setting fair rents? Is the service charge included in the setting of or is this on top of set fair rent? What is the maximum percentage my rent could increase by? Thank You
  20. Hi guys, Just aiming to help other consumers out there... I got a letter in the post today from Sky informing me that my services were going to increase in price, to the tune of £1.50 for tv, and few other increases... I am still in a 12 month contract (until november 2012), as i recently upgraded my services adding HD, multiroom ETC. Now long story short... Simply call up to the "thinking of leaving us department" tell them that your not happy with the price increase so they can cancel all of the services provided by them. They will then (hopefully) give you a £1.50 credit (and credit for the other amounts depending on the services you recieve - ie: sports, movies etc, all have seperate increases) They are applying these increases across to everyone, new, existing ETC... even if your in a fixed term contract... HOWEVER: the UTCCR 1999 regulations state the following: this is a little paragraph from my orange complaint, but is relevant here... also, bear the following in mind: if your out of contract, you have more legroom for discounts "fueled" by the price increase... - dont be happy with the £1.50 credit, tell them you want the best available deal, as you can get services by XYZ service (IE: Virgin Media, BT Vision ETC). My current offers on account are: 9 months free telephone line rental (expiring jan 2013) 12 months free hd package (expiring july 2013) £1.50 credits to counteract price increase (expiring july 2013) my offers are due to a multitude of failures by sky (took them over six months to activate my broadband etc) but I am a little annoyed that the sky adviser i spoke to tried to argue with me that i wouldnt of been able to leave either way... despite their price increase terminating the validity of their "lock in clause" lol. hopefully if anybody else has some info to add and i do hope this helps you guys avoid being ripped off!   22. I would like to know if anyone can help. I purchased 2 flight tickets over a month ago for £150 with Ryanair. When i bought them the prices were rising therefore i grabbed them so they didnt go to high. Since then i have checked and the exact same flights are costing £50. Is there any law which i can use to get the diff refunded of a credit or something as i think that this is ridiculous that prices can be rising at one moment to intice people to buy early, then they drop so low with still 3 weeks to the flight date. thanks Angry ripped off consumer
  23. Hi While studying for a qualification, I was student member of a professional body (this cost me nothing - I assume the training organisation paid). One of the perks of this was being able to upgrade to a full membership for one small fee (under £50), compared to the usual membership of nearly £200. I completed my qualification, waited until I had my certificate, and then upgraded my membership online - it all went smoothly and I paid by debit card Then I received an email saying that, as I'd completed my qualification, I was no longer a student member, and would either have to pay the full fee, or they would refund my reduced fee. However, I'm wondering if they can change their mind like this - they allowed me to upgrade online - is that a contract made? I was still a member of some sort when I upgraded, as my login details etc. still worked. It seems to me that they hadn't got round to updating their database, removing those who were no longer valid student members. I would have happily accepted that I missed out, had they not allowed me to upgrade in the first place, but as they alllowed me to log in, complete registration and took my money, is in not their problem that they hadn't removed me from their database of members? I would still like to be a member, but I'm not sure I can afford the full fee. Does anyone have any ideas where I stand as regards my rights in this matter (before I respond)? I'd be most grateful for any information Thank you
  24. hi Not sure if anyone can answer this here as related to pet insurance. But I am asuming insurance is pretty much the same weather house/pet or car??????? My renewal came through today and they have increased my payments by 75% - can they do that They stated that is because the number of claims for older dogs has increased therfore as my dog falls in to this category my premium has gone up! So from £340 I now have to pay £600 a year which means out of the £1000 insurance my dog is covered for each year I actually only get £400. He is an old dog and prob only got another year left but he cost us around £3000 a year in vet bills so that extra is going to make a huge difference.
