Where exactly [carpark name and town] Heritage Retail Park, Crewe Received a 'Parking Charge Notice' this morning; cannot say we are surprised as we knew we had overstayed the allowed time and we have no reason to question the rules in place. The issue is twofold, firstly, are parking notices still largely not taking further by private parking companies, or have the laws changed. £40 seems excessive for overstaying by 43 minutes. The second issue is that my partner was using the car and she suffers from MS. Whilst visiting the nearby town, she fell ill, and whilst she didn't need any medical attention, she did have to sit in a cafe for 2 hours whilst the fainting past. The staff in there were incredibly helpful, kept checking on her and giving her food to sustain herself, so they certainly knew she wasn't well. The question would be, would one of these vulturous parking companies see that as a valid reason to cancel the ticket? I'm sure the cafe would confirm, though they are part of a massive chain so who knows.
  2. Hi I signed up to a gym in august this year. I was pressured into signing & have been a few times. I have tried cancelling with letter from GP stating due to anxiety i wouldn't be able to attend anymore. I heard back from ashburn saying they would hold my membership & add unused months onto end but i would have to continue payments of £51 per month. It is now making me ill & my consultant has written a letter stating i will not be able to attend anymore due to lifelong illness (ulcerative collitis). I fear i am going to have issues cancelling so any advice is greatly appreciated.
  3. I don’t know if this will be of interest, hopefully for people in the same circumstances it will be. The history of this is a little personal but I feel it needs to be said. In 2005 I had a breakdown, I had a MBNA credit card with £7000 credit limit when I went on a spending spree and in the interim I applied and got another MBNA card with £6500 limit. During the time of my illness I ran both cards up to the max and I was struggling to make the min payments as I also had several other cards at the time. got these cards by simply applying for balance transfers they were throwing them at me. Needless to say I defaulted on the two MBNA cards. I wrote to them explaining my situation that I was now on medication and to offer a smaller amount of monthly repayments. I made the lesser payments each month and each month they marked it as a late payment default and the balance continued to rise. Eventually I stopped paying, a couple of letters and emails from them stating I was in default. It then went to MBNA debt office, these people were quite aggressive in their emails demanding payment in full and threatening debt collectors. I then wrote to them asking for the charges they kept adding to the account for late payments, I wasn’t late I just didn’t pay the minimum, I also blamed them for putting me in this position, they kept increasing the credit limit so I kept spending and in my condition I had no idea what I was doing. Now on medication, I wrote a strong letter complaining they were the reason I was in debt and they should give me the discount on the advance charges as well as the extra interest cost, I had no reply. Two months later I received a letter from MBNA saying they had written off my debt of over 13k and closed the account. On checking my credit report it shows as closed balance 0 this came as a shock as I had a Tesco card with a large debt on who wouldn’t talk to me regarding my illness and instantly passed it to Frederickson’s. I hope this might help others who suffer mental illness and not to let the credit card co bully them.
  4. I have been ill for 2.5 months, with stress and gastric/gallbladder issues I had my gallbladder removed 4 weeks ago. I am about to return to work. I get severe chest pains from stress still, and I am concerned how I am going to cope back at work my gallbladder operation has been successful. I get the odd twinge of pain on right side, but nothing like before. I feel like I am still on mend from this, but is going in right direction stress levels at work were high when I became ill. I fainted at work, had viral infection, had terrible GERD. thing is I have not had any official communication from HR about returning. Only brief conversation with my line manager about what day I would return. I feel low on energy at minute so forgive me if I have not given more detail, but I would like to hear from others who have been off sick, even if in part due to stress at work. How you were treated when you went back? Did stress levels reduce? Did you end up staying with employer? all advice welcome. I am not sure what I should say to my colleagues when I return this week. My line managers are out of the office this week. It is a large company I work for
  5. Hello and thank your reading, I unfortunately suffer from the following which I take medication for: Spinal Injury - Long term disability affecting movement, loss of feeling in legs and feet Chronic Pain due to spinal injury and herniated discs Depression ADHD I missed my Work Capability Assessment as I had an infection, I called the centre prior to the appointment to tell them and I also visited the GP and obtained medication.I was told that I would receive a letter from the DWP asking why I missed the appointment. I subsequently received the form, I completed the form complete with an appointment card and the medication container which listed the date on which I obtained the medication, at no point was I asked to explain my disability/illness or the reason as to why I had been in receipt of "not fit for work" note from the GP and have been since Sept 2016. A couple of weeks later I received a "Decision maker has decided your capable of work" The questions I am asking are: 1.How can this have been made when there has been no formal assessment completed or any forms filled out by myself to explain the conditions and difficulties I face on a day to day basis? 2.I have note received any explanation as to why this decision was made, so I want to appeal, whats the best way to do this? 3.I have no benefits in the meantime, I am in a lot of debt and am behind in my rent, which means that I may lose my home due to this decision, what can I do? Many thanks in advance for the advice, it is really appreciated
  6. So it turns out PDLs are not just bad for your Bank Account & Wallet - They are also bad for your brain too!! I highlight the below because this is still massively worrying...
  7. Just wondering if any of you could tell me where we stand with this one. My elderly father has terminal cancer and wanted to move 250 miles to be closer to us, we initially tried to get him into a nursing home but found this difficult due to the homes needing to assess him first. The only option we had was to sign a tenancy agreement (in our name due to him being 250 miles away) with my father as the named tenant. As expected he was unable to care for himself and within 4 weeks we were able to move him into a nursing home. The tenancy was an assured shorthold taken out from the 1st June 2016 for 6 months. We paid deposits (which I have never recieved a TDS reference for) and we paid the entire 6 months rent due up front as this was the only way we could secure the property quickly. We kept the estate agents in the loop and they knew the situation from the outset, we had the property cleaned and handed the keys back into them on the 26th June. I last contacted the estate agents on the 3rd August and have been told that the property is now under offer (as in being sold not rented again) but because the sale is not likely to complete within our tenancy period which ends 30th November we will not get any of our pre-paid rental money back. They have also refused to give back our deposit money until the tenancy ends even though we no longer have access to the property and they were happy with it's condition when we gave the keys back. Now on face value, I do know that technically we are liable for the 6 months rental but I'm hoping you may be able to direct me here as to what (if anything) I can do? Many thanks in advance for any advice/help you can offer Dydie
  8. Hi all. I have a number of conditions which have led to excessive debt that I cannot possibly repay in full. I am now receiving the treatment and some of the support I need for my conditions; however the vast debt is preventing me from moving forward with my life, and my credit rating is in ruins. My total debt: £20,000 My total income: Disability benefits (which I'm having to fight for in court) Part of my ADHD is reckless and impulsive behaviour which cannot be controlled. This has led to me accruing ridiculous debt without having anything apart from an eight year old computer to show for it. My conditions were only diagnosed aged 35. Their impact has been so devastating that I am simply incapable of taking on a job at this time. My doctors and therapists have also warned me to avoid jobs, relationships etc while I heal. I *may* be awarded a large backpayment of PIP on Monday. If this happens, I was planning to write to my creditors offering them a one-off lump sum. They are all aware of my conditions and have generally treated me extremely well (although I am now in pre-default status on my loans). Can anyone suggest the wording for this? How can I word it to show that they either accept the reduced offer, or I pay it anyway then declare myself bankrupt? Thanks to anyone who actually read all this!
  9. Hi can anyone help me please with some advice???? I am currently off work on a sick note for supraventricular tachycardia [heart palpatations due to a malfunction in my heart] and endocrine [gland} investigation. Iam claiming sick pay from work and am allowed 3months sick pay. I have claimed 4weeks so far. My job involves working with children that are challenged physically or mentally Due to the fact that at any point my heart can malfunction, I believe that I am not safe to be working with these children. I am waiting for appointments with each of the above clinics [heart & gland]. If I resign from work will I be entitled to any benefits???/if doctor signs me off???? I live at home with my 7yr old and 20yr old the older one has a form of autism. Also is it possible that I can give up work and claim to be a carer for my 20yr old son???
  10. Hi, My partner has had an agreement with IDEM services for a repayment plan of 95 pounds. She was diagnosed with Parkinsons in January. She has been without work for 2 years and now she must accept early retirement as she is no longer capable of working. We wrote to idem and her other creditors asking to reduce the figures to a token 5 pounds of which all but idem agreed. I will fill out and income/expenditure form for her to send, as now I am the only earner in the house and so am responsible for all expenses. is there anything I can do in order to get them to drop their figures or see sense, ultimately she will never realise the conculsion fo these debts as she is no longer in a position to earn money outside of her pension.
  11. I am mightily confused. I have been signing on for 12 months, at the start of my claim I signed a claimant commitment stating I will do X number of steps each week to find work, IE look in papers, ask family and friends, use UJM etc. I completed my job search online and always filled in my activity history on UJM, ensuring I recorded X number of steps as required in my claimant commitment. Part way through the year I was told not to use UJM instead I was given a paper template to fill that stated I must do 35 hours job search per week, this had a section to fill stating the time each task took. Some time later I was issued with a pie chart diagram which showed different activities I could include in my 35 hour job search. Now I have been given another paper template form which states I have to apply for and record 10 vacancies jobs per week. What the heck as happened to my claimant commitment, no where in that did I agree to a 35 hour week job search nor did it state when I signed it that it was a requirement. Secondly, I would never agree to applying for X amount of vacancies per week , what if the only suitable vacancies are ones I have already applied for. And now they have just reissued me a new claimant commitment to sign which is basically same as my old one except they have added “ engage with the work program” Can they enforce this 10 job application rule and what is in place to prevent me from just jotting down bogus applications. Obviously I am fulfilling my claimant commitment still but as there is no actual way to record that activity any more am I even obligated to carry it out. From what I can gather the 35 hour per week is only a suggestion and not enforceable as long as client shows they have took reasonable steps they cannot be sanctioned but I cannot find any info at all regarding the 10 vacancies per week.
  12. Hi all. After having a routine blood test last week that showed a very high platelet count and seeing a consultant (was refered urgently) I now have a condition called essential thrombocythaemia which is a blood disorder - obviously I was very worried as I thought it was leukemia but my red and whte blood cell count is normal. I now need to be on aspirin for life and have regular blood tests and scans to see how I am getting on - as well as losing weight and getting a proper excercise regime. I am sure you are not concerned about that, I will obviously deal with it my own way and after reading it seems life expectancy and prognosis is very good (practically normal) if I make changes to my lifestyle. I am on ESA(assessment) at the moment and not been called to ATOS or whateverf it is now for assessment yet (nearly 6 months) but: (a) Do I need to inform anyone about this diagnosis? (b) Money is not my priority but would I be entitled to anything else (worth asking)? © What happens if I am classed 'fit for work' and have to go back to JSA? The stress of being back under that regime and Ingeus will make me ill My condition although very mild and not life threatening is still classed as a blood cancer even though it is very treatable and prognosis is very good. Many thanks.
  13. Hey lovely Caggers Just after some advice on how to help my daughter, if you don't mind. She was in a private rented flat but cut the tenancy short, we agreed with her landlord (I was the lead tenant although I didn't live there because she's under 18) Housing benefit was paid up until the date her tenancy officially ended, a month after she'd physically moved out. She stayed with her ex's family until ending up in a hostel with her young baby when her ex headbutted her. Nice eh? there was some overlap between the housing benefit on her flat and the housing benefit she got while in the hostel. She accepts she should have told the original council that she'd moved but at the time assumed her landlord would do it. there's been an overpayment & we're happy to pay it for her. My issue is the council have already passed it to debt collectors (the overpayment was only in July) She's now in a house of her own with her little one and is doing a fab job a as a mummy, but... Question is, seeing that she's only 17, living on her own with a baby and being treated for anxiety and depression, do you think the council would take the debt back from Jacobs and allow us to pay it in full for her direct to the council? I don't trust jacobs not to have whacked charges on top but the last thing she needs is the threat of 'bailiffs' knocking on her door, as they've called themselves. There's no court order that we know of. She lives 4 hours away so it's not like I can just go with her to the council to sort it. I wish she lived nearer but it's her choice and she wants to stay where she is TIA!
  14. Hi all, I have sleep apnoea (diagnosed a few weeks ago as a severe case) and am frequently so tired that I cannot work, or cannot work effectively (e.g. fall asleep in meetings, feel like a zombie all day so i can't perform up to the standard that an employer would require of me) I have lost 3 jobs over the last 5 years due to this, although at the time I was unaware of why I felt so awful. My current position is as follows: - I am unemployed. - I would like to be working and lead a normal life. - I have begun treatment for my condition but it is not working yet and it's unlikely to resolve within the next few months. - I don't feel like I can apply for jobs because, in my current state, my performance will be so variable that an employer won't tolerate it, therefore i will be dismissed again. Has anyone any idea what I can do about benefits? As I see it - jobseekers allowance is not possible because I'm not looking for a job - sick pay is not possible because I am unemployed - some sort of disability allowance maybe? I'm unsure if I could qualify for the personal independence payment. I checked using the calculator on the benefits and work website and I score enough points to qualify. The problem there for me is that my day to day activities aren't affected every day, only on the bad days which occur on average about 2-4 days per week so would that disqualify me? If anyone can help me with this, I'd be very grateful. It's causing me massive stress! Thanks, Oliver
  15. Just after some advice on the following and maybe some general fiancial advice rather than full ins and outs of benefits so sorry if I have posted in wrong section and also sorry if it sounds a bit depressing. My mother has been diagnosed with cancer. Hopefully treatable with a 6-9 course of chemo. Anyway. They havent really thought about it yet but sooner or later my mom will go onto half/no pay from work. Mother earns about £1300 a month and father earns a touch less. They have never been much good with money and the majority of their wage goes to paying off debt which totals around the £10.000. Unsurpringly they have no insurances. If she does start to lose any pay then they will struggle to pay the mortgage/debts and with this news my dad is also struggling mentally and also drinking so I also worry about him loosing his job. If it gets to the stage where they have got to worry about money on top of everything else then it may be too much. Knowing nothing about benefits I believe they would be entitled to is carers benefits and free prescriptions. Is this correct? Can they claim for anything else? How much is carers benefit? Posted it in here as I am hoping that I can get involved and help to manage their finances through benefits and entitlements. To keep the cheery theme going they have also talked about wills. They were also talking about signing the house over to another family member just in case they have to go into a home. Can you do this? Dont know how true it is but our neighbour passed their house to their kids to avoid paying care home fees. Seems like to good to be true many thanks
  16. Hi there, I'm wondering what your thoughts are and if I can/should do something. The father of a friend had a serious heart problem and his condition was really bad in January '12. The doctor said he won't survive so he claimed PIP because of terminal illness. Luckily his condition changed and he was much better end of '12, where they bought a fancy new car. At least I thought they bought it. I had some discussions with him about benefits the last few months, where he told me that he's still claiming PIP on the highest rates and he received the car for free. He was able to choose one and he has some free miles with paid petrol. His last medical checks were great and in my opinion he would be able to work. (he should do some exercises for his heart, but he prefers to stay at home and watch tv allday) I asked him if the PIP department or DWP ask about his condition and he laughed and said "they think I'm still dying so they won't ask questions" I feel really sick when I think about it, because they having a great life with full wages from his wife (full-time worker) + free car + full PIP and going on holidays all the time while my partner has a medical condition and is waiting for his PIP (and ESA) since last year October. Nevertheless there thousand other people who need even more help and support and don't receive it. Is it possible to do anything or just wait until DWP contact him again? Thank you very much!
  17. I used to have a credit card with Vanguis, and for two and a half years have had all kinds of problems with them. In 2011 my income dried up as a result of government cuts which removed my workstream. I was unable to pay Vanguis as a result; prior to this I had paid my balance in full or near enough every month. I started to receive telephone calls from them up to 10 times each day, and each time they called they demanded money on the spot. The sums varied and every time they called I had to explain my circumstances afresh. Their staff were in general abusive and unco-operative. This continued for well over a year. Despite my paying PPI to the firm every month, they delayed sending me the forms to claim for several months. When I finally received them I returned them, and discussed the case with them over the telephone at which point I was assured that there was no problem with them. I then heard nothing for approximately three months and the telephone calls continued. One afternoon I received a call from them and I mentioned this policy; they told me that I could not claim under it as I was not eligible to claim, and their representative atempted to intimidate me. During a heated conversation with them I began to suffer severe chest pains which continued after the call ended. I called my GP and was seen shortly afterwards. For two to three weeks afterwards my left arm was numb and I suffered 'pins and needles'.. . the classic symptoms of a stroke. I logged the calls from this firm over a sample period and they were being received at a rate of six to ten per day. I estimate that I have received over two thousand calls or attempts to call me from them. In 2011 I reported them to the Ombudsman Service, who sought 'permission' from Vanguis to pursue the case; needless to say such permission was not forthcoming. After my stroke in 2012 I complained again to the Ombudsman who rejected my complaint on the grounds that Vanguis disallowed it as my response was 'out of time', despite my having received no correspondence from them to respond to. Finally, the Ombudsman agreed to look at it again. By this time the telephone calls had stopped, yet Vanguis continued to charge me increasing sums every month for their Repayment Option Plan despite them plainly having no intention of honouring it. In summer 2013 the telephone calls began again, and somehow they managed to get hold of my father's telephone number and began to call him. His telephone account is in his name, he lives nowhere near me, he is a war veteran of 87 and in poor health. While visiting him, I learned that they had been calling him; he was distressed by the calls and harrassment from Vanguis, and the stress it caused him led to him being admitted to hospital where he remains. Vangius has damaged the health of two people; myself and my father. I have been informed by that I have absolutely no legal right of redress against them for the actions they have taken against me. I have sought additional advice and help and none has been forthcoming. Requests I have made for help have not been answered. In Britain in 2013 outfits like Vanguis act with impunity the authorities appear to have no powers over them. Complaints are ignored or casually dismissed and we, the victims of their greed, suffer. The Ombudsman is no help.
  18. Hi all I am an only child with elderly parents. My mum has depression, i have quite bad anxiety & my dad has just had a heart attack & is in hospital awaiting Angiogram & after either a stent or surgery. A very worrying time that is affecting my mum's depression & my anxiety. We all kind of care for each other at normal times & i help out a lot, but am not an official carer. This morning i've received ESA50, perfect timing hey! So now i've got the added stress of filling that form in. I have filled it, or similar in before & not had to have a medical assessment as i guess by sending in a letter from my gp & proof of medications, they saw that as sufficient. I just have a few questions. 1. Have others sent in Dr's letters & not had to go for assessments, what is the best way. 2. Does Honey Bee's sticky about ESA50 contain a template to follow. Because my illness is classed at Mental, i'm unsure what to write. 3. I am currently staying with my mum until we know more about my dad's situation, but i have a flat & when things are more on a level i spend half my time there & half with family. I'm unsure as to which one i should use as my address. My flat is part of my rehabilitation but all my correspondence goes to my family home. The benefits people know about this as my ESA adviser told them. I have also attended the interviews at mandatory JC+ Anxiety is awkward because there is no given day that i can say that i will be ok, so the part about days i cannot attend i don't know!! Any help appreciated Gaz
  19. I took out a 12 month gym contract which is being dealt with through Harlands. I have called the gym and they just said 'no worries just give your membership card back and cancel your direct debit with your bank and call Harlands to cancel' but I fear it may be a little more complex than that??! My 12 month contract is until August 2014 but I have since been diagnosed with agoraphobia amongst other mental health conditions so, needless to say I cannot go to the gym. Im awaiting therapy but the wait is currently approx 15 months so my health is not likely to improve any time soon. So, I have emailed Harlands explaining my situation and advising them I can forward a copy of my letter from my Consultant Clinical Psychologist detailing the conditions he has diagnosed me with. My query... What are my chances of them cancelling the membership? Will I end up having to pay loads of money out? (Im not working due to my illness at the moment also so cant afford it either) And, If they tell me to go forth... is there anything else I can do or try to get out of the membership? Any help or advice greatly appreciated.
  20. research shows that it is likely to be a "harvest mite" that is causing this illness.
  21. I have woken up today feeling awful, no energy at all, sore throat, achy and just feeling terrible, can hardly walk around the house. The thing is i'm due to go to a Work Programme appointment on Tuesday and a job fair Thursday and i'm worried because if i'm not better for those things then I won't be able to attend and I'm worried because I know the Work Programme has a habit of sanctioning people, I have only ever been sanctioned once (unfairly) and I won that appeal so technically never had a sanction. Need some advice on this, thank you.
  22. Morning, I am due to sign on just after lunch. However, I began to feel ill about an hour ago. I am hoping this will pass. I had to near collapses last week, in a matter of 1 hour, if it wasn't for my little son, I would have collapsed on concrete. I am exhibiting the same symptoms as I had last week. My Vegus nerve is irritated and slows my heart down, it's making me feel like rubbish. If I ring in at lunch would they hold on to releasing payment till I am well enough to sign on?
  23. Hi Not sure if this is the correct place to post, if not please redirect me, Thanks. Basically this is my situation. I am seeking advice on behalf of my father, who has now been informed that he has Pancreatic Cancer, inoperable, and highly likely has less than a year - more like 5 - 8 months to live. Naturally this has come as quite a shock to all of us and we almost feel like this is happening to somebody else, kind of surreal, it hasn't really sunk in. At present he is dealing with the 'Charity' Step Change, formally Consumer Credit Counseling Service (CCCS). My own personal thoughts of this 'outfit' for want of a better word are not good, just my own personal feelings after dealing with them over the years. I believe they are 90% for the creditor, maybe 10% for the client - in this case my father. Anyway, he has been paying them for probably 7-8 years on a DMP. Most of his creditors stopped the interest and charges and some are fully paid, others not far off. Then we have a couple of them who have continued to add interest/charges and he still owes them the same now as he did 7 years ago. My father currently pays them £125 a month. I believe though, that his living expenses are about to increase as he will be attending a lot more appointments at the various hospitals that will be treating him, Chemotherapy etc - just maybe giving him a short while longer. Obviously extra fuel, possibly parking, maybe carers and even buying frozen foods to heat in a microwave. Basically I think he isn't going to have enough to cover what's left of his debts. I have spoken to Step Change, and as expected they still seem very keen on him continuing with this DMP. I however, rightly or wrongly have decided that's not going to happen. He has no savings, he needs to use this money - even putting as much as possible away to pay for his funeral as none of us has any money or insurance for that. Sad situation I know. He has no assets whatsoever. I believe he is claiming all the benefits he can, DLA, Pension Credits etc. So I have some questions, and if anybody can help please feel free to do so:- 1) - All his debts are in his name only, so they die with him basically? I hate saying that word die 2) - As these greedy creditors have not helped him in any way (ie, adding interest and charges) would it be wise for me to write and explain his situation, requesting they now clear the debt? 3) - What about if they foolishly decide to take court action, could money be taken direct from his benefits? Although I can't imagine them going to court, it wouldn't surprise me. Basically is it wise to offer something just to keep them off my father's back as I don't want him to worry about this debt. He is worried (like debt is is biggest problem right now!). He is worried we will have to pay his debts after he has passed away. Also, I have briefly read the claim pack for a funeral from the DWP, it seems they will seek to get whatever is in his bank account to help towards the funeral cost. I am not sure how much I could claim towards his funeral, so is it wise to put his bank account in a joint name with myself? So many questions and so sorry for the long first post I look forward to hearing your views. Thank you.
