  1. Can anyone tell me what the law is on planning application time limits are? Do the council have to place a notice on the building that is the subject of the planning application and if so do they have to allow a certain amount of time between posting the notice and actually making a planning decision? Thanks in advance.
  2. this is a good one(not for me) I had my car sorn and parked on my drive, i pre booked an mot for 1030 next day , circa 8 am as the mrs went to take the kids to school she asked me to save her a parking space , i went to try and tax the car on line but could not, i went outside and swapped cars came back in and tried again to tax it could not, i thought well ill just go to mot place as i was going to the car and wait for the mrs she walks in with a smile on her face " you ve been clamped " i replied " yeah sure dont you want to park yours as i go to mot" low and behold i had indeed been clamped . it was now circa 840. i had to pay £260 and then got £160 back, the guy who clamped it was ok and said i should get all the money back as it was a mistake since i had a pre booked mot. However this was only the beginning of my troubles, I tried to contact the dvla - its like asking for an audience with the Pope! Eventually i was told that not only would i not get the other £100 back i would be fined, low and behold a summons came through , it was not clear what exactly it was for i contacted the court and explained the situation, and sent them a copy of the garage diary with my details etc etc, next i get a letter from dvla stating that as i had entered a guilty plea they were offering me the opportunity to pay £285 to settle out of court. I hadnt heard from court yet nor entered any plea. To to it all the letter from dvla had a contact number and fax number that does not exist, and they put down the address of the offence wrong. i tried to contact them no response sent them a letter asking for a copy and all relevant material to be sent to me, never heard back, got a court summons to appear this monday at watford magistrate court to answer for keeping a car on the road under sorn. any one can help with what i should say in court????

  4. Hi everybody, I'm in a bit of a mess and need some advice. I suffer from an auto-immune disease which means that my body attacks itself. It affects many organs in my body and I was in the Support Group due to this. I recently moved in with my partner and we filled in a change of circumstances form. When they received this form, the DWP told me I had been removed from the Support Group and placed back into the main assessment phase of ESA. They sent me a work capability form and said I had to start the whole claiming process again and that I might not get back into the Support Group. I have contacted them a few times about this and whenever I have spoken to them they have said that this is a mistake and to ignore the work capability form that they sent me as it will have crossed with our new claim and that things will just iron themselves out as the claim progressed. Everyone I have spoken to at the DWP has said they won't remove people from the Support Group for simply moving house. Today I received 2 letters. One from the DWP saying that I am not entitled to any money and that my N.I. stamp is no longer being paid and the second from a disability assessment centre saying that my work capability form has to be returned today. I don't know what on earth to do now. I have been told all along by the DWP that I didn't need to fill this form in and now on the day that it is due in I am been told that I do need to fill it in and return it. I feel like they have royally stitched me up. Can anybody offer any advice here? Can they really remove me from the Support Group just for moving house?
  5. Hi looking for some advise here, i purchased a car from Carcraft in 2010, we were missold a warrenty which i am still disputing with all in one finanace. The car fianace was with Marsh Finance, we made full paymenst for teh first year or so and then run in to financial difficulties " new baby" this caused a marriage breakdown, i contacted Marsh and advised of teh sistuation they were helpfull and i asked for the car to be taken back. the car was taken and i had figure of around 2800 oustanding, i argued this with marsh as teh car was worth a lot more than they auctioned it off for. payments were reduced and my marriage dissolveed it has been 2 years and were are still divorcing, in this time i had contacted Marsh and given them a statment of means as i could not afford payments. this led to a charging order on the house etc. as i had my head in the sand for a while i over looked a lot of what was going on.. i am in a position where i may be able to clear off a few debts inorder to clean up my credit file, borrowed money off family, Marsh have refused any negotiation or offer to clear the debts.. id there any way i can push this ? thanks in advance
  6. Hello Everyone, I had a home insurance policy Full Bricks and Mortar plus contents with Axa via One Call Insurance which was cancelled with seven days notice in April 2015. The reason for this was that I had notified them January 2015 that a watch I had placed on cover was more valuable then I thought as I had been in a jewellers and they gave me a free valuation and in April 2015 had asked them to put a ring on cover that was very valuable. I had advised them off the valuations and was sent an email cancelling the policy with seven days notice later that day after they asked for further information. I complained to One Call about this because their email did not actually say it was a cancellation but they were unable to cover our home on the grounds that the valuables were now over the policy limit. I knew that I maybe underinsured but thought they would simply increase the level of cover and I would pay a surcharge. Once Call never offered any alternative. I then received a letter off them demanding a £ 77.00 cancellation fee which given the fact they chose to cancel the policy I felt to be unfair and unjust and if nothing else fell foul of Unfair Contract Terms Act 1971. Following a complaint to the FSA, Axa have written to me to state they offered One Call to place me on a higher level cover and that they in fact did not charge One Call any cancellation fee. The FSA say I have to declare the cancellation but it appears to be a grey area as to wether it increases the cost of my next home insurance or not One Call insist this situation will not affect future premiums as it is not as if I have behaved fraudulently but the FSA say it might. Does anyone know for sure, anyone working in insurance ? Apart from the FSA is there any way I could claim against One Call for the increase in premiums maybe on the grounds they have failed to act correctly on my behalf and thus breached their duty of care to me the consumer ? I would like to teach them some sort of lesson. Thanks in advance for your help Sean
  7. Hello. I just need a bit of advice please. For the last three years I live in a council house . My neighbour is taking drugs, dealing drugs, has complaints from the previous tenant for noise and threats, they robed the house through the loft when the previous tenant was in hospital etc. The police knows about it and admit it but as they put it there is not enough evidence therefore can do nothing. My issue is that the council at the time they moved my family in this house knew about the drugs and the theft (they had reports and complaints from the previous owner) but they didn't let us know about it. They were perfectly happy to move a family with children next to a drug house and a terrible and abusive neighbour . What I want to ask is, was the council somehow responsible to solve the issue before we move in or at least let us know so we can decide if we wanted to move or not to this house? I have done reports for noise, drugs, people arguing and smashing thinks etc but they don't seem to do much, just reports and more reports and visits but still nothing has changed
  8. This is my first post on here. Any help will be greatly appreciated. I seen a house that I liked so I arranged a viewing, when speaking to the estate agent who showed me around she said the property had been on the market for around a year with very little interest and that the property was for sale because the owner went bankrupt whilst he was renting this property out. Taking these few things into consideration I thought I would make a cheeky offer of 100k hoping that they would want a quick sale due to the bankruptcy situation (the property was on the market for 117,950). Two days later I rang the estate agent to see if there was any news she said she hadn't heard back from the trustees yet and in the end it took them a week to decide to reject my offer and make the decision to take the property off the market due to the property being in negative equity. If you've got this far I thank you for your time and basically what I want to no is what do you think they will do now? Will they file for repossesion and therefore the property will be up for sale again shortly? If so how long would it take before its back up for sale? Or will they do something different? Obviously the mortgage company want as much money back as possible therefore the only way I can see this happening is by them selling it. One thing I've thought of is will the trustees possibly take charge of the property and rent it out until the property price increases until they case sell it for what they need to take the property out of negative equity?   9. I was offered a house which was in dilapidated condition from the council. At the time an acquaintance tried to sort me out with a shared private let, rather than move into this house of horrors, but this fell through. The council deemed me intentionally homeless because of this. I was refused access to my housing officer and refused my right to make a complaint about the property, at the time when i had to make a decision. I had a couple of days time frame to make this decision. My appeal failed and i was to be cast onto the streets like a leper, but fortunately luck was on my side. An near impossible feat for an unemployed person in Edinburgh, i found a private let through an x-landlord i was with while i was at university here. So my question is, how long does this unusual punishment last if you are struck of by a council?   10. Hi All, This isn't really a dispute as such as they don't reply to any of my correspondence but I'm hoping to get some guidance as to what actions I could take next. Here's some background: - Made an online order 3 weeks ago for a weights machine @£550. - Payment made using V12 0% Finance (£55 deposit paid upfront and then monthly payments starting in April) - Delivery was agreed and confirmed for 23rd March. I took a day off work and waited in all day but package did not arrive. I tried throughout the day to contact them for an update but could not get through to anybody who knew about my order. Their contact number has 2 options. 1 for new sales and 1 for existing orders. Nobody picked up option 2 the entire day and not one response to my voicemails. The sales team (option 1) just kept putting me through to option 2 even when I asked them not to. It wasn't until 5.30 that someone actually helped me (I had to be very abrupt). At that point they told me the order could not be fulfilled and that they would contact me on the Friday (4 days later) to update me. - I then checked the website and it said items was out of stock until 4th April - Next day I phoned (again no luck) and used the Online chat to cancel my order due to poor service and the item being out of stock. Again, sales team were not interested. I was promised on three occasions that the manager would call me back within the hour and It never happened. - I sent an email to cancel the order too so that I had it in writing but guess what, no response. I just wanted to ensure that I had formally requested a cancellation within the 14 day cooling period. - I went about 7 days with no response or help. Just wanted confirmation that my order was cancelled and a refund of £55. - I contacted V12 finance too to tell them the situation - No response. - Last week I sent an online chat message saying that If I do not receive cancellation that I will leave a bad reviews online. Manager called and left voicemail a few hours later. Too late, I had already done it. She didn't even acknowledge my cancellation request in her voicemail. She just wanted to re-arrange delivery. I know that £55 isn't a huge amount but it's principle and the customer service has been absolutely shocking. I'm more concerned about the v12 contract as I don't know where I stand on that.   11. Hi there I am posting on behalf of my daughter who is a student in London "I am a student living in London - in wandsworth council - with two other students. Therefore we are exempt from paying council tax. When we first got our council tax bill we sent off our exemption forms. Never heard anything so assumed was all sorted. Months later, we received a reminder, I tried to call the council to say we had sent off forms, could not speak to an actual human being no matter what options i pressed. Gave up as read on a forum that they sometimes send a bill anyway (stupid mistake of mine in hindsight). We then got a final notice letter, I again tried to ring up, couldn't speak to anyone, sent an email. Never heard back. A few days later we got a letter from chandlers debt collectors - all escalated very quickly. If I am honest I think my flatmate, who is foreign and doesn't speak a lot of english therefore we rarely communicate with her, might of being opening the letters and not understanding them and therefore disregarding them, as we have recently discovered she also did it with the electricity bill!!. Chandlers were due to come and collect on the 27/3/15 according to the letter, last wednesday, 18/3/15, i rang the council again, could not get through, scoured their website, they said their calling functions weren't working and to email, emailed and got an automated response saying someone would get back to me in 10 working days. All i want to do is speak to someone to explain that we are students and sent our expemption forms off and what we need to do to make sure they get to the right place next time. Then today i came home to a letter from the bailiffs, they had been around to collect, nobody was in, stated that they would return again and if we ignore the notice they would get a magistrates court order to collect in our absence. I immdiately rang chandlers, they were unhelpful and said there was nothing they could do as it is just an order they get. I then rang citizens advice and they said to pay the debt and they try and claim the money back off the council by proving we are exempt. Which seems ridiculous as we don't owe it in the first place. We are all hard working students and don't even have anything of value apart from my laptop for them to collect, we don't have a TV, car or anything! Fridge etc belongs to the landlords. My plan is to go into the actual council on wednesday (earliest i can do it due to work) and try and explain, but not sure what else to do as chandlers said they would be calling again tomorrow and we are all very worried!!! any help or advice I would be so grateful for!! thank you!
  12. I had a visit from a HCEO today in relation to a high court writ for unpaid water bill totalling £1800. After explaining I was attempting to sort finances in order to apply for bankruptcy and that I had no other money or assets, he said if he could enter the house and see that i did not have enough goods to enable the debt and charges to be paid, he would report that back to the creditor and they would be unlikely to attempt to control the goods for sale. I was cagey about this to say the least. I said i was unwilling to let him in for obvious reasons. He said that if he was not allowed in and I made no payment then the creditor can then make an application to the court to allow them/him entry to seize goods. I asked how that was possible as this was residential. He said they would apply against 'me' and they would be allowed to gain entry forcibly. I said that I would not allow them entry, to which he said i would be arrested for obstruction. I have never allowed anyone in the house and today i spoke to him on my doorstep with the door closed. I am running around at the moment trying to get family to lend me what i need left to apply for bankruptcy, but he was deliberately trying to scare me and made me think he could get a court order and gain entry by force. Please help, I am confused by the changes in the law last year. thanks in advance
  13. Not sure if this is the right forum or not for this one, but here it is. My dad has offered me an interest free loan to buy my council flat, which is all good, and everyone is happy to go ahead with it. The problem i have is, within the next five years, he may well end up in a care home, which means his assets will be taken to pay for it. Does anyone know, as the loan will count as an asset, if i can be forced to pay back, or sell, to pay the bills, or would the terms of the loan still hold, but just be transferred to the local authority paying for the care home? I have asked my solicitor, they told me to ask the council, who then told me they dont know, or know who to ask.

Last February my house was sold by Paratus amc with a shortfall of 88k,plus a 2nd mortgage of 22k to welcome finance It took a year for someone to contact me,I told them i couldn't pay as i was on pension credit and housing benefits I am trying to make ends meet by being self employed market trader but i don't make much money Lowel people have accepted £1 a month on a couple of loans and i have offered the same to other companies The ones that worry me are the outstanding mortgage and 2nd mortgage DCM are now handling the case with paratus and are investigating the way in which i gave the house back,I originally told them i couldn't afford the payments in Jan 2013 and said i wanted to sell up and ask for 6 months to do this,they wrote back and said fine they would help all they could,but 2 weeks later they said they were going for repossession as the arrears were to high,so i gave it back and left in June i have a valuation from an estate agent for between 220k and 230k as a selling price,and he said i would probably get between 210-215k,that would have cleared 95% of debts,they sold it for 158k I told DCM i was not happy with the way they sold my house ,so a complaint is going through the system now,and also the mortgage i was sold through a broker 1-2-1 mortgages went bust, was misleading so i have to get in touch with FSA I think,to get compensation I not heard from welcome but a 11k loan has gone up to 23k plus 88k =110k which i don't have what to do,I went for a small loan for my business through SWIG,who give loans to small business who cant get loans the normal way from banks etc,but i feel they will not lend due to this. sorry gone on a bit ,but thats roughly the facts
  15. Hi Couldn't find anywhere else to write this, i guess it could be a housing law issue.. So i'm an only child & the folks are getting on & they live on outskirts of city, i live in city. They are on at me about what's going to happen to the house when they die. It's my inherritance, i don't want to live there but also i couldn't sell it. Can anyone give me advice on my options.   16. I live in a council house and have a secured tenancy. I'm a single parent with one child, the other 2 have left home. When my youngest is 18 can I have her put on my tenancy agreement, in case anything ever happened to me, she wouldn't be homeless? or is that illegal?
  17. hi, My first post and i'm guessing it's going to be pretty unique. My parents split-up when we (3 children) were young & we were brought up by our dad in the family home. Obviously he paid the mortgage, etc. Meanwhile our mother re-married and she has now got plenty of money but dad is broke. The house is still in both their names but mum says she wants to transfer the entire ownership to my dad as long as she "just has to sign something" and it doesn't cost her anything. Dad has agreed to pay all costs but doesn't think he should be actively involved as he doesn't think it's right for it to look as if he was pressuring mum into handling over her share. When i phoned a local solicitor they said dad needed to do it but i agree with him, it might look as if he was forcing her to do it. Is there a document they could both sign that we could then send away to be "legalised"? Or ... ???? Thanks for reading, please help if you can.
  18. Hi, I recently moved house and both me and my girlfriend have many debts between us. Lowells have most of the accounts but there is capquest, dlc and bcw. none of them have our new address, do you think its worth contacting all concerned dca's with the new address or leave them to find us. I have been holding them back with cca but I am concerned that they might just obtain a default ccj at the old address and we wont find out about it untill bailiffs knock at our door.

  21. i really need some advice. Firstly i do not have an account with brighthouse it is my husband who had a p.c from them. He has obviously missed payments as within the last year a representative from brighthouse has been to our house 3 times with the latest visit being yesterday. I dont answer the door so a note is put through so i know it is them. I get frightened when they turn up as my husband is out a lot so never here when they come and we have a 3 year old boy and i dont want him exposed to strange men cominr to our door . I get why they want to chase missed payments but it is nothing too with me . Can i do anything to stop them turning up at my door.

After finishing chemotherapy for ovarian cancer and finally getting back to work fulltime, my husband declared at the end of Aug 2014 that he was "fed up of being Mr dependable" and walked out on me. I have since had everything changed into my name but my question is the house. It is paid for - no mortgage - and is in both of our names. I do not want him to sell it out from under me - is there a way I can get the house put into my name due to his desertion or something or do I have to go the legal route? Any and all advice welcome please.

  24. Hi All I have received a letter stating a charge is being made against my house for a £5600.00 debt that I believe is unenforceable. The debt fell off my credit file 19 months ago and is now being chased by Arr-w Gl--al . Can someone help me with this. there is now a ccj on my file and a court date of 29th Jan 2015 for the judge to decide whether the charge against my house should go ahead. I have not acknowledged this debt to the dca or the original bank.
  25. Several years ago I ran up a debt on a Virgin credit card. I asked if I could pay £60 a month to clear the £15000 debt but they disagreed and took me to court. A charging order was placed on my home and the court agreed I could pay £60 a month. The debt has been sold on to ME 111 a few years ago. My question is: does the charging order transfer with the debt to the new debt owner?
