  1. HSBC now owns HFC Bank in Brighton. I wrote to HSBC Coventry PPI claims office giving my name, DOB and precise former address, last week, but they replied to say: no records of my account can be found after 32 years, and that they are not legally obliged to retain documents beyond the statutory period if an account was closed. I also opened a Loan Account in Bournemouth and fully repaid around 1983. -- same answer from HSBC: no records. I myself have retained no records whatsoever, but I am absolutely certain I had those accounts, and 70% sure there was PPI as was standard custom in those days. Is this a dead end? Should I invest in £10 requesting a SAR, if so SAR sent to HSBC Coventry or to HFC Bank in Brighton? Later to complain to FOS if we suspect HSBC does have records? Thanks to all for sharing experience.

Hi, this is my first post, please be gentle:smile: I submitted a request to HSBC in relation to PPI that I am certain I had with HFC Bank for two items of computer equipment that were purchased in 1995 and 1997, as I believe PPI was automatically added as a pre-tick? The total amount of both repayments were in excess of £5k HSBC came back negative and asked in their reply whether I had copies of the agreements, number etc. which I don't! I then did a SAR request to Dixons (PC World) which verified that I had both of these agreements with HFC Bank, although they could not give me any agreement numbers? I do have copies of bank statements which cover both of these transactions, which show HFC Bank as the recipient of the direct debit. My questions are as follows; Should I do a SAR request to HFC Bank to see what other paperwork they have, or should it be sent to HSBC, if so to where, and what other paperwork would they want from me? copy of driving licence, utility Bill etc. At the back of my mind I think that I also had some dealings with Beneficial Finance and Hamilton, all now HSBC. Can I do one SAR for all three given that they are all in the same group? Any advice you can give me is appreciated.
  3. My wife has been getting calls and texts from Cabot for weeks telling her to call them about a matter they wish to discuss, but they ask for her grown-up daughter's name. She has happily ignored the calls and texts, nothing to do with her of course. A letter arrived recently advising that Restons were going to make a claim in court for over three and a half thousand pounds, not a trivial amount so they may actually try. BUT, the HFC Bank account was started in 2006 and defaulted soon after when my step-daughter lost her job. The letter states the account was terminated in January 2008. I think she made some movement to pay via CCCS but that fell through long ago. As far as she is aware, nothing has been paid on this account for the last 7-8 years and she's not contacted anyone about it in that time. The letter says the debt was assigned to Cabot in October 2017, no mention of where it was up until then. She does not have any paperwork relating to the account but that's beside the point, she has had no default notice that she is aware of and does not know when the last payment was made either, it's that long ago. Does she just write to them and say 'statute barred' and see where it goes from there or is there some way she can get the info she needs to prove that? I don't think she's ever asked for a credit report but the concern is that will just give the DCA her up to date address, phone number and so on. The letter says she has to pay in full by July 26th 'or else'... They also sent a statement of earnings form.
  4. Hi Ive CCA'd all my creditors. I have had a response from IDEM for some sofas I had from DFS. They have sent me the original credit agreement I signed in DFS on 24/11/07 with a copy of my driving liscence. They have also sent me a list of all payments made, apart from they have missed off the first year of payments made through payplan. So I am guessing that this debt is enforcable so where do I go from here shall I set up a repayment plan for this, do you think I could try and F&F. Should I enquire about the missing payments? The last payment made to them was recently on 04/12/17 which was the last payment I have made into my payment plan. Thanks in advance
  5. Hi Going through some old files and have come across a file of my husbands. He disputed his GM credit card bank in 2008. After a number of letters they failed to provide him with a signed copy of the agreement. There are a number of letters between him and HFC and I have noticed a County Court Summons was issued on 6 Feb 2009 by HSBC bank for the total bank of £11,000. My husband has filed a defence, acknowledgement received from the court dated 21st April 2009 and an allocation questionnaire was returned to the court on the 7th May 2009. He has heard nothing from the court since In March 2011, a couple of letters were received from Wescot Credit services on behalf of HSBC demanding payment or Wescot would take further action. This was not responded to and no further communication has been received. A couple of questions: 1. should we do anything about the County Court summons - I have tried to access the claim on MCOL but it says incorrect claim number of password, which is incorrect as we have triple checked before we entered the details? 2. Can we claim the PPI back from this card? Thanks in advance
  6. Hi, I took one of these out back in the day around 2000 maybe..? I phoned them today to put a claim in. The lady asked me a few questions and said they had a £3600 amount on file. She is going to send me some paperwork. I defaulted on the account and it went to Cabolt finance. I can't remember why i didn't pay it but they will ask me in the paperwork they send I am guessing. I think it maybe because i split with a partner and moved back down south which meant i quit my job. I don't think that is a reason they would pay out on is it as I intentionally made myself unemployed...
  7. Sent a CCA request and this was the response, what do you recommend i do next? They have said they didn't send me the notification letters as they didn't have a confirmed address? the address is the same as the one on the CCA that they have sent these letters to? HFC, CCA request response.pdf
  8. hi, first post so please bear with me. I asked Restons for a CCA a few years ago and sent £1 postal order. They returned it saying that I had to request this from HFC. I did nothing about this, but recently sent another CCA request to Restons. They replied saying " our client is not obliged to provide the requested documentation without the appropriate application and fees made payable to our client" They then go on to say it refers to an HFC loan taken out in or around 2016 and was referred to Restons in 2008. Is the 2016 a typo error? They have enclosed a questionnaire with a threat of legal proceedings if not returned by June 27th. Questions Which is the correct form to send? What is the fee Do I send it to Restons or HFC Do i continue to pay them?
  9. My friend had a loan with HFC, Marble loans in 2004. A few years ago she sent a CCA request to them but never heard anymore from them. They have been selling the debt on to various DCA over the years now they have got heavy and Restons are involved. They have said they are going to apply a Charging Order to her property. She does not have the original paperwork of the original cca request. They sent a letter before Christmas saying she had until the 22nd December to reply to their request and then they will take her to court. Not sure if things have changed now and you can still request cca or if I need proof of original letter? Should she send a SAR to HFC or Marbles Loan with a hope there is a copy of the original cca request or maybe send a new cca request?
  10. Hello My ex husband and I had a loan with the HFC years ago-approx. 18 years It was for 5000. We got behind with payments and def had PPI which actually we could ill afford and both working for NHS didn't need . I think with interest rates , charges and PPI I remember working out once that the 5 year loan had limped into 8 or more years and we had paid back something like a couple of thousand more than the original loan and still owed a couple of thousand ! last payment was over ten years ago and weve heard nothing for most of this time until this year . My husband has moved out as weve amicably separated and I received a letter which was from a DCA saying the debt had been assigned to them in 2013 and what were proposals to pay - as weve definitely left this behind over 10 years ago I didn't think any action would be forth coming . I did however take note that we now have an account number -- the one thing that stopped me reclaiming ppi a few years ago . With my ex`s blessing as its joint loan would it be worth me sending a CCA and starting a ppi claim or may I risk a bad print again on our CRA files ? Thanks
  11. Morning All , hope someone can advise me as im totally bamboozeld. I recevied a letter today from 1ST credit who have been assigned by HFC bank to claim a full outstanding balance from me. How do i find out who are the original creditors?? , i think its was a sainsburys loan that i took out in 2002 that was passed on to HFC bank to chase. I checked my expeiran credit rating this morning and there was nothing on there from HFC ( or indeed no mention of the couple of creditors( aktiv and connaught) i have agreements with by paying back an agreed monthly plan.) My score was 994 out of 997 with no ccj's. all green ticks and no negatives going back 6 years. Showing no records before that. I have mentioned on another thread that i havent paid the sainsbury loan(£9000) since sept 2006, when i went through a divorce and ended up in rehab as i went off the rails. .I ve been given the advice that this debt is now statute barred.There is no mention of the sainsburys loan on my credit file ( i imagine because i havent paid it for 9 years) and the records only go back 6 years on my expiran file. the letter this morning has enclosed a standing order, asking for a £10 admin fee, and to set up payment terms. the thing that worries me is that the balance they are chasing is about a third of the sainsburys loan amount(£3000) . Do you think HFC have written off the debt, And 1st Direct are charging interest on that original amount for the last 3 years since it was statute barred( basically an arbitory figure)??. Im worried now that if this isnt the sainsbury loan that someone has run up a debt with HFC under my name!, although this would show on my credit file i would imagine. sorry if this ll sounds like a david lynch film, im just hopless and explaining myself and obviously with fiscal matters. please advise this poor old sod as my heads in a spin. many many thanks
  12. I had an online credit card with HFC (opened in 2005) which I defaulted on in 2009. It was then 'passed' to Restons. I don't know if Restons are really a solicitors as they claim or a DCA. from 2009 I negotiated payment of £1 to each of my creditors, including Restons. In 2009 I CCA'd Restons and in 2010 Restons issued proceedings against me saying the £1 wasnt sufficient. I defended the proceedings and the proceedings were discontinued before it got to court with no Order as to costs. Am still paying the £1 although I havent heard from Restons since the court case was discontinued. I thought creditors have an obligation to provide periodic statements so wondered if Restons still owned my debt. Therefore a few weeks ago I CCA's them again. They returned my £1 postal order and said they were confused as to why I was making such a request. They did provide me with the agreement though not the terms and conditions or up to date statement. Maybe once you have CCA'd a creditor they count that as sufficient and no point chasing any further even though they havent complied with my current CCA request.... I suppose it's wise now just to keep going with the £1 payments as they were really tough to defeat once they had their claws in and I dont want to antagonise them.
  13. Hello I hope I can get advice. I took out a secured loan in January 2002 for 8000. I obtained the loan through dial4aloan. The loan was arranged and the lender was endeavour. It appears I also was sold ppi of 1200 added to the loan. Well I am trying to reclaim the ppi. However all organisations are blaming each other for selling it. Dial 4 a loan state they only recommended ppi. Yet the ppi policy is on endeavour paper. Aviva say they have no responsibility either. So what happens when no one will accept responsibility? Thank you
  14. Hello all. OK, so I thought I had never taken out a loan with PPI until I was phoned up today by a claim company who told me I'd had a loan with HFC Finance from 2006 to 2009 for £5000. This corresponds with some car finance I had - the dates and the amount are right - and the claim co chappy said the HFC would have added PPI as mandatory at that time. So here's my problem... The car has long gone together with any paperwork to do with the finance - I can't even show that it was with HFC, I'm just working on the basis that the claim chappy has the right info even if I haven't As I've not had that many loans, mostly from my bank and I always turned down the insurance from them, I've only been paying partial attention to the whole PPI thing so far I'm a bit thick when it comes to this kind of thing and normally need a bit of hand-holding One thing I have read on here is that HFC (a) have shredded as much of their own info as they can and (b) are particularly slippery. As it's more than 6 years since I took it out and as I have no info myself, is there any point taking this one (myself, not a claim co)? And if it is, where would I start? Thanks, Higs
  15. Hello everyone, Thanks for all your help in advance! To cut a long story short, my partner is already paying a debt to Bryan Carter to avoid a CCJ as we didn't receive the claim form till the very last day of judgement. But now they're literally chasing him for two other debts (one in dispute, already submitted SARS to Lloyds) but this 'new' one that he has no knowledge of and it's not even on his credit file. He contacted Lowells 2 months ago to state that he has no knowledge of the debt and they also checked his credit file while he was on the phone and the advisor confirmed that there is no record of the HFC bank debt on his file; so advised they will get a copy of the signed agreement. Last month received a letter confirming that they're still awaiting a copy of the agreement and it make take a while, thanks for your patience etc. On Friday received a letter dated 12th May 2015, stating; "As requested, we enclose documentation from your original creditor. We trust that this now answers your query and look forward to receiving your affordable repayment proposals." However, the document they have attached is literally what looks like a photo copy of a bank statement from HSBC; Confirming his address, about your credit agreement etc and about your transactions. I can attach a copy if you need? They're literally stressing me out as clearly this does not answer ANYTHING! Just wondering what my next step should be, as I'm worried they will just issue proceedings and after speaking to National debtline the advisor told me that they don't need to provide a copy of the agreement as a Judge may take favour upon a statement!? And that maybe I should consider sending them a letter called 'complaining to debt companies that you do not owe the debt" So yes, any help would be massively appreciated. Thanks

Hi, I have written to the creditor asking for proof of debt CCA ect and received no response However, today I received a claim form from County Court Business Centre, Northampton in the name of HSBC, who have been looking after this debt for a couple of years It is from Northampton County Court Business Centre but was posted from Newcastle and says all Documents and payments should go to HSBC Birmingham I assume all that is correct but how should I proceed? I am guessing I should acknowledge receipt on line saying I intend to fully defend and then send CPR 31.14 request to HSBC All help gratefully received

Morning guys A little bit of advice please - I successfully reclakmed PPI from HFC Bank for a loan I took out in 1991 - I accepted their offer but noticed that they had withheld £900 for a balance they claimed was still outstanding. I was pretty sure that this wasn't the case - the account was manged ultimately but not transferred to Reston's their in house rottweilers who basically harangued me to repay the debt and I vaguely remembered taking out a bank loan to get them to get them off my back Anyway to cut a long story short I did some more digging and found two letters from Reston's in 1998 confirming that both accounts had been repaid and were now closed - specially that they were accepting the sum of £x in full and final settlement I'm assuming having read some of the other posts on here that they can't withhold any money that they feel is outstanding if I can prove that it isn't. I've written to them pointing out that these account were fully settled and the amount shouldn't have been withheld - this was the advice from the FOS who I'm pretty sceptical about getting involved due to the time it takes them Does anyone have any advice about anything else I should be doing other than this or should it be as simple to sort as I've been told?
  19. In June 2002 I applied for and duly received a marbles c/c, then issued by HFC Bank Limited. Attached is a redacted copy of the agreement which I received following an SAR to HBOS, the now owners of marbles. As far as I'm aware the agreement was a single sheet, as here, although it's possible there might have been a separately enclosed sheet or there might have been some information on the reverse of this sheet. However, I'm pretty certain that I signed only on the face, in the box just above the HFC rep's signature, bottom right, and neither initialed nor signed anything on the reverse, nor appear to have been asked to do so anyway. I do know that at some later point in response to a CCA to BoS I received another copy of this together with a typed note of initial credit limit and interest rate each of which was actually wrong anyway. I don't owe marbles anything so I'm not looking to avoid any debt but I am taking issue with HFC about something they've done - or rather not done - and I wonder if I'm right in thinking that this 'agreement' fails the relevant parts of the CCA and so makes any contract dependent on it unenforceable. Hi everyone can anyone advise me of my next steps with this problem please, here goes, In 2007 I had a marbles credit card (£250) with a hp purchase from currys think it was one of their pushy things when you took out a hp purchase? in 2008 I had a dispute with Marbles (original creditor) over some late payment charges and stopped my payments (last payment made 2nd Jan 2009) This was then passed to several dca's and a few weeks ago I had a letter fro Marlin Financal saying they were acting for Cabot Financial (current creditor) and were going to issue court proceedings if the debt was not paid in full, I sent for statements of accounts and credit agreement and 1 week ago had them returned, the credit agreement has no signature it is just blank?? And since the last payment balance then was £233 so all the rest is made up with charges. Default was made 2nd Jan 2009. Today had a letter from Marlin say that no payment plan has been offer so now they will take steps to issue court action? Any help will be great Thanks mw
  21. Hi, I have recently written to HFC regards a Goldfish credit card account I had going back to around 1997 and I am 95% sure the PPI was automatically ticked on a magazine mailshot. I have written to HFC regards a miss-selling claim and they have written back advising I need to contact the bank that holds the account now (Lloyds TSB) although the credit card was closed and paid off in 2006. I believe that as this claim is for the initial miss-selling rather than on going charges it is still HFC that are ultimately responsible, is this correct, are they just sending me on a wild goose chase ???.

  23. Hi, I have a debt with Lowells bought from HFC Bank, for approx £290 the last payment/acknowledgement was in March 2009. Lowells bought the debt and started sending me letters and calling as they usually do. However after first reading this site I sent them an SAR in March 2014. They have dragged their feet attempting to comply with my request until today (Sunday) I received an email from them the contents below. They sent statements and other fairly useless info to me but failed to send an original CCA signed by me. They have now stated they do not need to and instead sent me a copy of the agreement I may have signed way back in 2005. The copy has my details handwritten but no signature or anything else. Is there anything else I can do about this, as they say I now have 30 days to "arrange a repayment plan".... As you can see from the email this has been going on since March 2014. I also have a Barclaycard debt with them for which I am just starting the same process as on the original SAR they only complied partially with the HFC account and again have done nothing with the Barclaycard SAR or account since then - well over 7 months for them to get the info together which they presumably dont have!!! Contents of todays email copied below ---- Original Creditor: HFC Bank LTD I write further to our email dated 21 August 2014 and apologise for the delay in responding. Summary of your complaint You are unhappy with our contact in relation to the above former HFC Bank LTD account, as you believe we have failed to supply you with all the information you have requested under the Data Protection Act 1998. My Findings Please be aware that under Section 7 of the Data Protection Act 1998, we are only required to provide you with the documents that we hold. We have no obligation to seek and obtain further documents that you request under this legislation. Our records show that we responded to your request for information under Section 7 of the Data Protection Act 1998 and provided you with the data you are entitled to under such a request on 5 March 2014. The Data Subject Access Request pack we provided complies with the requirements made under the request. I note that you have requested a copy of the signed original credit agreement for the above account. The documents required to be supplied in relation to any account governed by the Consumer Credit Act 1974 have been the subject of a lengthy legal test case of Carey v HSBC Bank PLC [2009] where it was held by the High Court that to comply with such a request:- 1. The original signed agreement need not be supplied, as a reconstituted copy of the agreement is sufficient provided it contains the name and address of the person as it was when the credit agreement was signed; and 2. If the terms and conditions of the credit agreement have been varied following the date it entered into, then a copy of the last varied terms should also be supplied. Given the above, please find attached a reconstituted copy of the agreement as supplied by the original creditor, HFC Bank LTD. I have also enclosed statements of the account which demonstrate the balance remains outstanding and due. I have placed your account on hold for 30 days to allow you the opportunity to review this information to contact us with your repayment proposals. If we do not hear from you within this time, collection activity will resume. I hope that this response concludes the matter to your satisfaction. If for any reason you are not satisfied with this response, please do not hesitate to contact me on telephone number 0800 5420 058 or reply to this email. Please refer to our email dated 21 August 2014 which gives you the right to refer this matter to the Financial Ombudsman Service.

I have come across an old loan agreement with HFC Bank in which I do recall the salesperson at my local branch stating that I had to take out insurance for the loan to be successful and because of my age. On the agreement it states a single premium amount of £80.89. The loan was for 36 months @ £32.10 = £1,155.60 APR 31.20% Loan amount £750.00 Total interest payable £374.71 Can someone kindly explain how I calculate monthly PPI & Interest amounts in order to add figures to the single premium calculator spreadsheet ? Thanks
  25. I accepted an offer from HFC on a PPI policy a couple of years ago. At the time I assumed that the process involved the bank calculating what I was owed and paying me that amount. I am now much wiser and believe that they just refunded the premiums and did not add any interest. There was no details of the calculations, not even a breakdown re the 8%. Can I go back and ask them to show me the calculations and question if they were correct?
