  1. Hi All, I have a mortgage on my property, and a second charge on it. I want to put a third charge on it for a secured loan which has been agreed, and the first mortgage company have agreed to allow the new charge, however the second charge company are refusing point blank to allow any other charge against the property. The new loan isn't large enough to give me the amount I require and to pay off the second charge, and it needs to be secured, so how can I get this new loan done - preferably quickly? What options do I have to persuade them to allow it or to get it registered in any other way please? Thanks for your help
  2. I need to serve a section 8 notice, I'm on the premises & can open the door to allow them to serve the tenants notice. The residence is a private residential address. I'm already staying on the premises, & I can open the door from the inside, & allow the bailiff in to serve notice. Is this legal? The tricky part is, I dont have a tenancy agreement to prove I live on the property, but I can prove I'm the landlord. & the tenants still have a tenancy contract AST on the property. Basically can the tenants claim forced entry, or something, if I allow a bailiff entry to serve notice?

Hi, I need your advice I parked on a street where nobody shows the timer this is on disabled and non-disabled cars, I parked in a disabled slot and placed my blue badge, when I came back 20mins later from a dental appointment I was given a notice, I have only had a blue badge a few months CODE 40 "Parked in a designated disabled persons parking place without clearly displaying a valid disabled persons badge" The images shown on the enforcement site showed 2 images taken at an angle so you could not see the dashboard or badge. I questioned this with photo evidence they came back and said it was for not showing the timer, I questioned again that the notice said nothing about a timer. They sent back more images showing the blue badge they had there was no mention of this in the first reply from them. Where do I stand on this? Does anybody know what the codes are for the parking notices, and is there one for not showing the timer? your help appreciated

Purchased a Panasonic sound bar April just gone The remote does not work changed the batteries and still not working Telephoned argos customer service to make a exchange go smoothly in store To be told I have to contact Panasonic directly I reminded them about SOGA but that means nothing to them I will be going into store shortly I will either be getting a full refund or exchange

Ok my daughter in-law tried to make a payment to her door stop loan agent(provident) she has missed her for a couple of weeks told her to try to give her something even if its only a couple of pound a week till they can get back on track. She only had £3 she could give her today(She had received a letter from provident say she could make a token payment of a pound per week just now) agent refused said it would have to be £5 or nothing this agent has also been holding on to the payment book and has refused to had it over unless she can get a guarantee of £5 min a week. Now as far as I'm aware she can't hold on to the payment book or refuse a payment.
  8. Hi I'm really need some advise on how to proceed with our local Honda dealer. We purchased our 2013 Honda Civic 1.6 EST from a Honda dealer in the north East in 2013. The car was 9 months old. It has been serviced by our local Honda dealer in March 2014 and again in Dec 2014. On the 2nd service the rear brake pads were replaced. The front pads were at 50% worn. End of March 2015 we noticed every time I braked a squealing noise would occur. We took it back to the Honda dealer who serviced the car and were told the front pads were 75% worn but the discs were fine. We have the pads replaced. The squealing didn't go away so we rang the dealer who said give it time they are new pads. Gave it 2 weeks still squealing so booked back into garage who said small stones were causing the problem. Got car back, still squealing, booked back in, brakes all checked, said all OK, got car back, still squealing, booked back in again, brakes stripped and cleaned, got back last Tuesday. Went out Wednesday and squealing worse than ever. Drove it back to the garage. Mechanic came with us in car and every time I touched the brake it would squeal. Mechanic couldn't hear anything. I was gobsmacked. He must have a hearing problem. Car booked back in for today. I have recorded the last week of driving which you can clearly hear the problem on. In the meantime some sensor on the dash keeps going off. Tells me people in back but seatbelt snot fastened. There is no one in the back. Goes off 20-30 times. Sensor replaced last week. Out in it yesterday taking daughter to school and went off over 40 times. I have rang Honda UK who are useless. They say take back to dealer to sort out. Any idea where I go from here. This car is not only embarrassing to drive but distracting. Trying to keep eyes on road but sensor going off and when it comes to braking the notice is horrific.
  9. hi, I have been very stupid and opened a catalogue in my mums name I tried to order something but the order was declined so I stupidly rung the company and they said are you sure this is you because you sound very young, I then replid by saying no this is my mums account I am ringing on her behalf, they asked why she couldn't do it, I then replied saying she isn't very good with computers and ordering ect so that is why I have done it for her. they told me that only my mum can ring and she will have to ring back herself, I am now very worried that I am going to get in trouble ??? the order has been cancelled and I certainly wont be trying to order again !!!
  10. My father passed away on 21st December 2014 and his benefits stopped. Fair enough as the Housing Association flat was paid up until the end of the month. We managed to clear out the flat well before the end of the month and handed back the keys. We were then told that two weeks notice has to be given and that they want £212.52 less £100 as the flat was clean when handed over. We received the invoice this morning almost 2 months after the estate had been settled. I am not sure how my father is supposed to notify the Housing Association that he is going to die and to give them appropriate notice? They have a clause written into the tenancy agreement stating that in the event of death, two weeks notice should be given. I would have though this was an unfair clause in the contract? do they have the right and can they legally pursue us for the money although we did not sign the contract?
  11. Hi Caggers A long story cut short, I went on holiday paid for some duty free on the flight and used my debit card. On checking my bank statement when I got back to the UK, I realised I'd been overcharged by the cabin crew by £45. I emailed the company and they said I was overcharged and they would recredit the debit card with the £45. Unfortunately since paying for the goods and getting an answer back from Thomson I'd lost my debit card and got a new one. They informed me to contact my bank to have the payment refunded and to charge Thomson; my bank said no chance. I went back to Thomson explained what my bank had said and there answer was "well we can only credit the money back to the card that was used to pay for the goods". I asked if they could use an alternative method and they said no; so I'm now £45 down and looking at taking them to the small claims court to get my £45 back out of principle. Before I go down that line, I was wondering if anyone else had had the same type of issue and if they had it resolved without having to go to court. I just cannot believe that a major international company does not have various different means of refunding people who are in my situation. Any input or advice appreciated. Cheers PM
  12. This is the first time I've posted on a forum, thanks in advance for any help I'll really appreciate it. Last January I paid David Lloyd up front for a 12 month membership. I was of course tied in because I'd paid up front. I did use it for first six months and not much for second six months. I always knew I wouldn't renew because it was a one off opportunity because I had money available. I thought 12 months, done the time, won't renew. Late last year I started to get emails to remind me I could renew along these lines: Dear Ms Barker, Membership Number: xxxxx Just to let you know that you can pay your membership fees:- Online with a debit or credit card by going to the website xxxxxxx and following the instructions on screen. Via our Automated Payment System with a debit or credit card, by calling 0207 048 7438 (you will need your membership number). If you wish to take advantage of either of these services your current membership fee of £891.00 is due for your membership at Newcastle. Both the online payments service and the automated payment service will only be available to you for the above payment until midnight on the last day of this month. Of course, if you have recently sent payment please ignore this email. Yours Sincerely Stephen Empson Group Central Membership Manager In January I got texts and phone messages- pretty constant while I was at work- asking me to contact them to renew my membership. As I didn't want to renew I didn't call them just allowed it to lapse and moved on to using a local pool. Nothing once we got to February. Then today an email from ARC Collections asking me to contact them. I emailed them back to say why are you contacting me, I have no interest in renewing. Then I googled it and realised from other people's problems that they will be expecting 3 months notice and now admin fees. Am absolutely desperate, I can't afford this and I don't know what to do. Am also outraged because DL never gave me a moment of indication what they were expecting in calls, emails and texts. Not even a hint. I feel this is set up to ensure people who pay up front fall into this trap. They should contact people in advance and remind about the notice period. I just didn't realise. And now am in trouble. I haven't done anything else yet because I don't know what best to do. Would be so, so grateful for advice. Thanks so much
  13. Hi I'm a sole trader, and at the moment I'm busy paying off a council tax debt. The council were round last week doing a load of work next door, making noise from 8 in the morning and stuff, didn't bother to inform me despite the fact this is their legal responsibility. Anyway, the path I share with my neighbour is now a mess, it's not that bad but the guy didn't hose all the detritus off right which has left it in a worse state than it was before. I have been keeping very clean this summer, and now I have to sweep it and hose it again. As a sole trader, if I was to perhaps go out and clean it up, how much would I be in my right to send the council the bill for it?
  14. Bought a Toshiba laptop in April 2014, on my Argos card along with the 3 year protection. Keyboard was acting funny, and my passwords were always missing a letter. Now it has crashed altogether, and the recovery disks were stored, as I thought on my clickfree, but apparently it doesn't backup programme data. Went over to Argos, thinking I would get a replacement, girl told me to go home and ring the breakdown line. rang them, they said that because it was under a year old, it should be Toshiba, she put me through to them. Apparently, it will cost me to get a repair, or even for Toshiba to look at it, £31 for recovery disks, and another fee for them to look at the keyboard. I am totally lost without my laptop, and I thought paying the extra £169 was my security if it broke down. Any ideas
  15. Hi, My mum's phone recently got damaged as the screen cracked. She took it to a mobile phone shop which offered a repair service. She told the staff what the problem was and he told her to come back in a week with her receipt to collect it once it's been repaired. No money was exchanged at this point as she was told she could pay upon repair. Now my mum is not very good at keeping receipts and she lost the receipt the shop had given her. Nevertheless, she went back a week later to find out if her phone had been repaired. The manager in the shop remembered her and told her that her phone had not been repaired as they were unable to find the correct parts for it but refused to give back her phone because she couldn't produce a receipt! They told her the only way she could get her phone back is if she gave them a copy of her passport! What nonsense! My mum was able to tell him exactly what phone it was (it's not a popular phone the brand is Alcatel I believe) and exactly what the fault was and it was obvious to the manager that the phone belonged to my mum but he still refused? Can he do this?? Surely not. My mum really would like the faulty phone back as it is still useable despite the fault with the screen. Thanks in advance for any help on this matter
  16. Hello everyone, I have been working for a big Pizza home delivery company from last 5 years. Last year my manager started giving me less and less hours, despite knowing that this was my main and only job. The situation continued for a few months and I was forced to get another part time job as self employed. In my self employed job I was given generous hours in certain shifts but I decided to keep my first job at the same time have enough hours. Since August I have not been offered any hours at all and at end of September I received a letter saying that I had not attended a meeting with manager and that I was therefore sacked and have right of appeal. (I had never received any notification from my employers asking me to come for the meeting) I appealed and in two weeks the area manager chaired the appeal hearing. He explained that because I had not worked for some months and they have a automated system, that a letter is issued automatically and had been sent to my address. I explained my position and I was promised that I would get at least 30 hours a week in future. I contacted my store manager and informed him of my availability and the hours I can work. I was told that they would answer back soon. I also told my manager that I would be away for three weeks to visit my parents abroad and would return on the 25th. Yesterday I came back and I found a letter saying that they could not guarantee hours because my contract says that I will be given hours according to the business needs. I called the manager and he started asking me question when I received the letter and did not reply to my answer about getting hours. I have a feeling that they will sack me again and will skip all the disciplinary process. I called head office and asked the HR that I want to file grievance against my manager and area manager. They asked me to send details in writing and they will take action. I have been working there for 5 years now and never ever gone through any disciplinary. Have always been punctual and hard working during my shift. They are still hiring people for the same position I had, but they are not giving me any hours (they have window posters for hiring staff) They also have some staff members getting over 60 hours a week. Also in five years I have never been trained for health and safety at work, food hygiene, or fire and safety at work. In the past 5 years I was never paid my full entitlement of holidays. They do not pay us from September till end December (not allowed to take holidays) and the holiday year finishes en December means we cannot claim holiday pay. They will have all this on record. I need some advice from someone on how to proceed. Can I ask them to provide me all the information they hold of me through freedom of information or data protection law? Or I just send them a letter asking for a meeting? I personally think they are picking on me and I have not done anything wrong. I have also worked in same field for more that 25 years in UK and abroad and do not understand why they are treating me this way. I feel frustrated that instead of benefiting from my past experience, they just want to get rid of me for no reason.
  17. Hi, I am new to the forums. Thanks to anyone for some advice. My current situation is part time work 6.15 hours, in receipt of some JSA and a student studying an evening Level 3 course. back in 2008 I took out a hire purchase loan via welcome finance. After about a year or so I handed the car back due to unforeseen circumstances however was still paying the car off. I cannot remember exact date or times but I stopped paying for a while and remember it got taken over by a DCA which I had set up a payment plan with. I have been out of work for well over a year and have not paid into this debt however have received letters off Cabot Financial to say they have now taken over this account. They were trying to contact me from July. They had sent me a letter to say they would accept a final payment of half the balance. I have recently made contact with Cabot and sent them a call back request form and they contacted me on 28/10/2014. They went through my current situation, income and expenditure and offered me three options. The lowest option being £47.04 a month at £11.75 a week, over 5 years. I asked the guy on the phone if I could take some time to think about this but was told that I could not as it needed to go on the system. I agreed to pay this amount as I felt I had to make an on the spot decision. He advised me to set up a standing order. After the phone call I felt as though I could not afford this amount of money each month, it being more than my water bill. I also checked the figures they presented me and was a bit shocked. This is how I worked it out £11.75 times 52 weeks in a year is £611. Times that by 5 years it equals £3,055??? I called them back and was told by Louise that some months have more weeks? Yes but there are 52 weeks in a year no matter what. Am I being fed lies here? after this call I took to doing some investigating and realised Welcome Finance had gone bust and that Cabot would have brought this debt at a fraction of the cost. No wonder they were offering me the option to pay half. when typing in Welcome Finance I was welcomed with a whole ton of negative information and had noticed that a lot of people were incorrectly charged fees, insurance etc. I am not disputing the fact I have this debt but if I was incorrectly charged by Welcome and are now being done so by Cabot. With this I noticed I can apply to Welcome for a SAR. Which will allow me to see what information they have on me and to get all my account details. Also I noticed I can also claim back any charges on the account? Can you advice me on the best way to go about this as I have never done anything like this before. This is my only debt. I do not have any credit, debit cards etc and even if I did have the money to pay this off I would still be disputing this as it seems this has happened to the majority of their customers. Took me a bit of investigating to find out though. I want to get this sorted out as soon as possible as I want to start improving my credit rating in the future I have options available to me if I so choose. Thank you for any help you can provide me.   19. just like to thank all who post on this site ,dont post much myself but do read and learn and thanks to this have just had £4000 debt wiped out by lowells, had hfc debt sold on to lowells who chased me for two years bombarded me with phone calls and letters never produced any documents or paperwork i ask for today got a letter stating that they had wiped the debt off and would no longer be pursuing it, so to all those still figting dont give in and i found all my answers on this site big thang you to the many good people who post

Hi, 2 months ago i sent my car to a garage to get a gear stick and steering bush done i had just bourght the car cheap as i knew it had the problems.The garage Decided to do a mot on it and came back with faults so they fixed them long story short bill was 900 pound it should of been 300 i didnt ask for any extra work to be done. I had not heard from the garage for weeks and just put it down to parts taking there time coming through. Anyway i got a bill in the post out the blue. well all this was happening i was unlucky to be declaired bankrupt i have put the garage debt in with the bankruptcy so its been wiped . Now the garage refuse to hand my car back to me even though the official reciver has told me i can keep it as its worth under 1500 pound. Not sure what to do next as the debt been taken in to bankruptcy so i dont anyone anything anymore so how can they refuse to give me it back? DO i need to contact the police or trading standards Thanks in advance any help or advice would be great
  21. Hello everybody! I'm here today because my landlady informed me that she wouldn't give me any of my deposit back although I don't feel like she is in her right to do so. Therefore, I would be very greateful to have your advice concerning that issue. General informations (not sure what will be useful sorry...): - I rented a room (with furniture) in her flat, we were the only two people leaving in it. - We didn't use an agency or anything, I found the add for the rent online and dealt exclusively with her. - I stayed there from the 6th of November 2013 until the 6th of June 2014 (as agreed). - When she asked for a security deposit I asked her to draw a Tenancy Agreement, she seemed surprised but agreed immediately and we signed one before I moved in (I have a copy and so does she but it was just with the two of us, no lawyer or anything) - I paid a deposit worth 550 pounds, which was equal to a month's rent. - We didn't do an inventory at the entry or when I left the flat (didn't take pictures either) - We always had a good relationship, up until a couple of months back when I did notice she seemed more cold to me. - the flat was in Barnet (London) - a few weeks before I leave she asked me to pay (and I did) to replace a couple things and repair small damages I was indeed responsible for (for the most part, for some of it honestly I'm not sure but I didn't want to make too much trouble at the time and as long as the money is not too much I'm ok, but the security deposit is different!!) When I sent her the email with my banking informations (naively when I didn't received anything back after a couple of weeks I thought she might not have it) here is the answer she emailed me: "I doubt there will be my deposit to return. Firstly the desk in the room has a number of dents. That's about £250 to replace. Secondly, the room I am not able to rent out until the damp gets sorted, at the moment it is still being dehumidified. I'll need to re paint the room. I can send you the receipt when the builders have sorted it all out. But I don't see the point as you have cost me rent which is the same as the deposit. Sorry." I haven't answered to her yet because it started to scare me a lot and I panicked a little (I'm between jobs at the moment and as my next contract starts in September I was counting on that money!! ) and I wanted to seek advice before I do or say anything. Also, I moved back to France (where I come from) shortly after I left the flat, which doesn't help my situation... My view on the issue is this: I didn't do any dent on the desk, which by the way was already old and damaged when I moved in (the desk is made of a cheap Ikea/Argos type white frame with a big plank of wood put over it) . [ATTACH=CONFIG]51685[/ATTACH] The damp problem I wasn't aware of until a week or two before I left when she did text me that people had come and found a damp problem in the room and said that I had not open the room since I moved in. I answered to her that I had been opening everyday like she asked when I moved in, during at least an hour (which is true, even in winter, and god knows that was painful! And giving the very small size of the room honestly you could not live in there if you didn't anyway!). She texted back that it was getting sorted and put a dehumidifier in my room during the last week I was there. I thought the case was closed.. . But I was obviously wrong. To conclude I must add that I didn't do anything that could have caused the damp problem! My room was the smalest in the flat and the area around one of the window was damaged when I first moved in (paint chipping away and such). Sometime during the couple last months I did notice brown splashes appearing around the window and on the wall nearby after I opened the window to let the air in but the splashes watched away without any effort and I didn't think it was anything more than dirt coming from the outside... They reappeared a second time around the same area shortly before I left (that's when she had people coming over to check) and I just cleared them while cleaning the room on my last day there. So what do you think? Could I be directly and solely responsable for that damp problem even though I did open everyday and didn't do anything out of the ordinary (apart from puting my towel to dry in the room from time to time)? If not who should I talk to? I never had this kind of problems before (this s the third flat I let over the last four years as I had to move a lot when I was finishing my studies) so I'm feeling really lost. ..   22. I originally had debts of nearly 60k, mostly on c/c's. I did have an advantage in that the cards were taken out late 1990's, early 2000's. With the help provided by CAG, I fought of every attempt by these to reclaim including threatened court action by the dreaded Restons in 2 cases. Turned out that 3 creditors could't find the agreements, the other 3 agreements would not stand up in court. As stated without the advice from CAG, I would have be paying these forever. As it was the companies were reduced to endlessly bouncing the accounts from DCA to DCA. Checked and double checked today, they are all now Stat Barred. Only adverse left on my credit file is a default from one of them (the company waited the full six months before defaulting), however that falls off in Sept this year. What I am saying is don't give in to pressure from the OC or the DCA's but fully check out the claims made against you and never believe the outright lies they tell. David
  23. Several weeks ago a recruitement agency offerred me a couple of days' painting and decorating job. We agreed I would be paid 13 pounds per hour. The job was done in two days' time. The forman sent the timesheet to the agency. There were 16 hours in total. The payment arrived into my account later than they promised. But that is not a big deal. The amount was just several pounds less than it should have been after 20% tax. So I asked them to give me full break up of the payment and I asked them to send me a timesheet. Since then they stopped all correspondence with me.. I sent them around 5 messages, but received no reply. Can anyone please give me an advice what to do with them?

I found a room via flatshare and I was given a tenacy agreement which states me deposit of £285 would be put in a Tenancy Deposit Scheme and moved into the property last year back in 11th December It was a 3 month contract and I left on 11th April and the place was full of mould (which I have pictures of) and now the landlord is avoiding my calls. The place is council and he has converted the living room to his bedroom and rented his old bedroom to me so not sure if he is breaking the law there. I also have proof that I paid the deposit on the day of moving as well. The landlord also mentioned that he did not put the money into a tenancy deposit scheme. I am also a bit worried because once or twice he asked if I could pay him cash and I didn’t think to ask for a receipt but the last 2 months I paid into his bank account. Any advice would be much appreciated. He also told me all bills were included via flatshare and on the tenancy agreement it said I would have to pay council tax but he said don’t worry about that as he will pay it then I found via his council tax bill that he is claiming to live alone, further to this he is also avoiding paying his tv license as they have knocked twice. I have since left the property but I desperately need deposit back. I would be grateful for some advise. Thanks. Mark
