  1. I've recently not been able to make the interest payments on my cc - due to personal circumstances (unforseen and largely unavoidable). I'd like to see if MBNA have a copy of the orignal loan agreement (it will be pre-2004). At the moment all I've had (for missing one payment) is a formal letter stating that if I default they will take action. Should I ask for a *copy* of the original loan agreement, or ask for the original? Or should I phrase this some other *legal* way? Hut123
  2. Hi Everyone I finally found the Post button ! Sorry about that. I had previous postings about a Charging Order levied upon my wife by TBI Financial Services. I have posted an update about that today on the original thread but I now have new problems. Since the CO was registered and the CCJ relating to it put on file, other DCAs are now chancing their arm and sending threatening letters about debts which are either not recognised at all and are in no way ever going to be acknowledged, or debts that I know are statute barred. Examples are as follows: 1. Capital One debt. Neither my wife or I have ever had Capital One anything, but we are getting letters from Lowell, Robinson Way and somebody else, think it is Frederickson regarding a Capital One account. They have my wife's name and are adding a new additional christian name into the address, which is very shocking. They also try different combinations of the name on the letters. Putting one name first, trying initials and various other deceptive tactics. Lowell are also asking for a debt for a Creation Finance. again we have no trace of this company, after checking our financial records back as far as 2005, which is as far as we can go with our bankers. My wife does have other debts with Lowell, so I suspect that they could "produce" some form of agreement which is not true copy.I have not written to them yet as I wanted to ensure getting the correct wording.Your assistance would be most welcome on dealing with Lowell, as they made my 87 year old mother in law so ill with her debts she had to spend some time in a convalescent home. We have never ever dealt with Capital One quite honestly. 2. We have a hand written letter from Future Finance in Jersey asking about a very old debt to the Associates which was disputed back in 2004 by CCCS and we never ever heard any more about it, as it was apparently a duplicate of a debt that is on my wife's DMP with Payplan. CCCS phoned Associates at the time and was told to ignore the debt as there had only ever been one account. My wife also phoned Associates at the time and was told that there was some sort of reference number error and that they would write it off and confirm to CCCS. Shortly afterwards CCCS took it off the DMP. That was 8 years ago and lo and behold we now have this letter from a Future Finance which appears to be about this debt. It has little arrows on the page - is this Arrow Finance DCA in disguise ? 3. A letter from Robinson Way asking for a very small amount for a Next account. again neither me or my wife have ever had a Next account ! We are the wrong shape and size guaranteed ! I am going to send that back with a nasty letter but I am more concerned about the first two. Clearly the CO has put us onto the DCA map for intimidation and my wife is ill with disability and I am not going to see her made worse by these timed out vultures. All the above have surfaced since the CO was registered at the land registry and the CCJ went on. I presume that a lot of this is DCAs trying to clear their books but it is causing terrible distress for us. We have all our true debts on DMPs with Payplan and there is no way that these other debts are ours, tracing back to 2004 / 2005. Any advice would be much appreciated by me and my wife. Kind regards
  3. I have just been offered a fantastic new job, which I worked hard to get. The only problem s they will require a 5 year checkable work history. Which wouldnt normally be a problem, but I was suspended from a previous job while investigations were being made. It caused me that much stress that I ended up handing my notice in as I really wasnt up to dealing with it at the time. Looking back now I should've seen it through, but its easy now to say that. That was 12 months ago, and I worked there for 5 years, so really that job takes up 4 years of my 5 year checkable history. What do I do?? What will the future employer ask for, is it just to confirm that I worked there or will it be more in depth. I really need advice!
  4. This video was uploaded in 2007. In the video, it is said to expect to see this innovation taking off. It is now six ears since this video and I wonder why it's taking so long to give us this economical, pollution free free, not to mention the minimal cost fuel? If anyone knows more about this, please tell.
  5. As far as I can work out, the Universal Credit which includes Council Tax Benefit and Housing Benefit will be payed monthly in arreas yet when we are due to pay our own rent (to Whitefriars in Coventry) we must pay it in advance. Currently HB is paid direct to Whitefriars 4 weekly in arrears but the instant your benefit is reduced or stopped they expect us to pay in advance. I am concerned that soon many of us will be caught in the trap where we will be expected to pay our rent (and council tax) upfront even though we wont get it ourselves until the end of the month. Whitefriars start eviction proceedings as soon as an account is £300 in arrears and as our rent is likely to be £109.43 a week come October (gussing this using the average 7.65% increase every year so far) then within the first 3 weeks of the month we will be facing eviction and will have another 2 weeks rent added to that debt before we get paid at the end of the month. I know I am speculating but it is better that I enquire now then ignore the potential problem. For anyone whos response is 'save up so you can pay in advance' - we already have to save up so we can pay our utilty bills, food & hygene & clothing for the month in advance as we will no longer be receiving weekly/fortnightly payments that we have set our budgets to. (that's another point - apparently the monthly paymnent isn't a money saving scheme; it is because 75% of the workforce is paid this way so we should get used to it. I would like to see the percentage of people coming off JSA into monthly paid work vs weekly paid) So, anyway - Am I right to be worried about how I pay my rent when the changes happen?
  6. Experian planning to add payday loans to CRFs but will be recording data differently to other FSPs Banks admit that having or applying for Payday loans isl likely to see rejection for loans even years after. Mortgage applications are likely to be affected. http://www.dailymail.co.uk/money/cardsloans/article-2231040/Payday-borrowers-face-Christmas-credit-shock.html
  7. :!:Hi everyone! My name is Paul, aged 41, I live in Norwich and recently, after 6 years of working for an organisation full-time, I was dismissed with Gross Misconduct. I have since managed to get my self sorted out, in terms of getting all the inevitable benefits sorted out, informing the relevant authorities of my changes of circumstances. The days following the Disciplinary Hearing were very hard for me - I felt shocked, very depressed, worried and very alone. Now I have got over the worse, I am now feeling happier as the overwhelming emotional support I received from friends and family helped keep me optimistic. To cut a long story short, I am now concerned as I recently received a letter from the Jobseekers Allowance department at my local jobcentre, stating that "there is a doubt over why my job ended" - I immediately got back in contact with my former employers, who informed me that they received a standard form to fill in, asking for details such as my job, salary and my hours worked - this form clearly led on to having received this "doubt" letter. I saw my Personal Adviser recently and I showed him this letter - he explained that they will continue paying my JSA whilst further investigations are carried out, and that my employers will have to state why my job ended, and if the response is unfavourable, I could inevitably lose up to 26 weeks worth of benefit and that I would need to claim under the hardship provision. I will also be sent a copy of this, with the employers' comments so I can have an opportunity to put my argument across. I have begun applying for new employment but am now concerned, as my employer has agreed to provide references but they will need to be honest about this. Could this be detrimental towards acquiring any future employment? If I do get an interview, do I declare this, and if so, how would I go about this? This is all very new and daunting for me as I have Adult Learning Disabilities as well - I will be very grateful for any advice/suggestions regarding this.
  8. Why we’re marching Austerity isn’t working Our country faces long-term economic problems. But our political leaders have failed to face up to them. For the next five years or more, unless policies change the economy will not grow, incomes will not rise, and there will be almost no new jobs. If the government keeps on with big spending cuts and austerity we face a lost decade. Even on their own terms government policies are failing. To close the deficit we need a healthy growing economy that generates tax income. But austerity has led to a vicious circle of decline. Instead of just letting the banks go back to business and bonuses as usual, we need policies that promote new and old industries. This new approach would create jobs, especially for young people. It would encourage companies to raise average pay, penalise big bonuses and invest in training and new industries. It would crack down on tax evasion by big companies and the super-rich. It would tackle the growing inequality between the super-rich and everyone else. Rather than deep, rapid spending cuts, we need to reverse our decline and build an economy that works for ordinary families. We need a future that works. 9. Hi, The other night I went out for my birthday and at the end of the night ended up in an argument with a police officer. I pushed him and was put in handcuffs and taken to the station. Once there they took my details and gave me a 'Penalty Notice, Penalty Amount £80' for 'using words and behaviour likely to cause alarm, harm or distress' contrary to section 5 public order act. Then let me go. This is the first time I have had any contact with the law. Will I need to disclose this to any future employers / will it show on a crb check ? I graduate next year and am worried that this will now be a permanent stain on my record. Thanks,
  10. Just spotted this in my experian credit report today: Which is weird, as today is 08/08/2012... Anyone know why this might happen?
  11. Hi everyone, Thank you for all the posts and advice on other threads - I have read through them diligently over the last 5 hours, but I am still terrified and feeling downright ridiculous and am more concerned with the 'integrity screening' repercussions from future potential employers. I was in TKMaxx earlier and removed a face bronzer from it's packet and repeated that action with a nail varnish before putting them both in my bag. I was stopped outside the shop by security and escorted to the back office where I admitted to the theft, returned the items which amounted to about £12, offered to pay for them which was declined and was asked for ID. I presented my passport and student ID card and was warned to expect an RLP letter to my home address. I signed the form banning me from entry into all TKMaxx and Homesense stores. I am a 23 year old female student, recently on antidepressants (no excuse, but feel like I am totally losing touch with myself and my principles) and this is the first time this has ever happened. In my panic I volunteered my student ID card as I had no proof of address and they noted down my university name and registration number. After studying for so many years and having student debt up to my eyeballs I am now horrified at the thought that Cireco and associated integrity screening databases could render all my hardwork (and debt) useless because of this frikking awful incident. For all of you who have been very helpful on other posts and are in the know (scarlettpimpernel, 2grumpy, dx, honeybee and the rest), I would so appreaciate having your advice on the following: 1) I understand that Asda, Superdrug, Tesco, Iceland and Boots have access to Cireco's "dishonest database" however can anyone tell me which other non-retail clients RLP have? On their website they mention communications and finance companies as part of their client group. 2) I am in the process of my graduate applications which will include those to law firms (painfully ironic) for grad schemes, government and civil service fast track schemes and grad schemes within the EU, UN and domestic politics. Apparently my name will be on the "dishonesty database" for 6 years so I am almost convinced at the moment that my idiotic actions will have cost me employment in the future due to screening in recruitment processes. I appreciate that this is a dramatic assumption, however I know I will be subject to high-screening for the roles as trainee lawyer, MP staff etc. Does anyone with law/civil service/RLP background know how much of my career I have actually sacrificed? 3) Considering that my priority is my career and therefore not wanting to draw attention to my name on the database, I think I will pay the fine. I understand 99.999% of you will think this completely unnecessary, but I do not want to be remembered or risk anything more that could damage my future any further. Therefore, my question is once I have paid the fine/contribution/office xmas drinks, will RLP come running back for more money? To be completely honest, even though I don't really have the money I can borrow it from my partner and my guilt/shame will be slightly eased by paying for it and not having to worry about my parents opening countless letters from RLP while I am at uni. (I gave them my home address in my panic - so so stupid.) 4) After volunteering my university info and registration number, could RLP notify my university or use that information against me in any way in the future regarding screenings, asking for more money etc? 5) I have a part-time job in a boutique clothes shop and I very much enjoy the work and am a loyal, honest employee. Could TKMaxx/ RLP notify my work place of this incident? Lastly, (and thank you very much for reading this far), I understand this is not a criminal affair but anything that stands against my name could be very damaging, so anyone in a similar situation or with any knowledge about the scope or effect of integrity screening processes for future employment as a lawyer or civil servant, please please please come to my rescue. I am too ashamed to tell my parents - it's not how I was raised. Many Thanks Jerry
